Morning Ethics Warm-Up, 5/4/2018: White Artists, Black Artists, Brain Damage And The Mad Midnight Pooper

Paul starred in my 2000 original one-man show about the iconic lawyer-rogue, and has been performing it for lawyer groups and bar associations ever since.)

1  Déjà vu!  I would write a full post about this, but you can essentially go to all the football head trauma essays, search and replace NFL with NHL, and you’ll pretty much have it. The New York Times reports on a 53 year old ex-pro hockey player whose brain yielded evidence of CTE, and evidence is mounting the the violent sport is doing damage to players similar to what the NFL denied for so long. Right now, the National Hockey League is denying it too:

To the N.H.L. and its commissioner, Gary Bettman, the diagnosis is likely to be the latest piece of evidence to dismiss or combat. Even as links build a chain bridging the sport to C.T.E., the degenerative brain disease associated with repetitive head trauma, and some of the game’s most revered names push the league to take a more open-minded approach, the N.H.L. has denied any connection between long-term brain damage and hits to the head.

The N.F.L. did the same, for many years, until the evidence became too overwhelming, the numbers too much to counter with plausible deniability. Facing a huge class-action lawsuit, the N.F.L. eventually admitted to the connection and agreed to a roughly $1 billion settlement with former players. (That has not kept the sides from continuing to fight over the payouts, amid accusations of fraud and intimidation.) The N.H.L., following the N.F.L.’s strategy of about a decade ago, still contests any role in the burgeoning science of C.T.E., in the courts of law and of public opinion.

What’s going on here? Violent pro sports are popular and profitable, so they will continue maiming players and devastating their families until the public finally refuses to have blood on its hands. It will take a while, and many lives will be destroyed, but in the end, football and hockey are going to have to be responsible, and also held responsible for the carnage their greed has caused.

2. Yeah, I’m being unfair and partisan when I accuse progressives of being hostile to free speech and diversity of views… A hip-hop and R&B radio station in Detroit has announced that it won’t play Kanye West’s music. The alleged justification was the rapper’s dumb remarks about slavery. On “TMZ Live,” West said,

“When you hear about slavery for 400 years. For 400 years? That sounds like a choice. Like, you were there for 400 years and it’s all of you all? You know, it’s like we’re mentally in prison. I like the word prison ’cause slavery goes too — too direct to the idea of blacks.”

That’s pretty stupid for sure, but hardly any more stupid than the kinds of things West has been saying his whole career as his fans cheered him on. He’s welcome to hijack a telethons to say, for example, that President Bush intentionally let blacks die after Katrina, but this goes too far. Regarding Hormone Restrictions In Women’s Sports.

Here we go again.

Since the infamous Soviet Press sisters dominated their events in Sixties Era Olympic games, both looking like Hulk Hogan in a dress, and the female East German swimmers won medal after medal while sporting shoulders that would make an NFL draftee feel proud, the issue of hormone levels in female competitors has been contentious.  The confounding complications of intersex and transitioning competitors has only made the mud muddier. What’s the right thing to do?

Last week, track and field’s world governing body passed new rules limiting  women’s events to athletes with  testosterone levels that are “capable of being produced solely by ovaries.” These rules apply across the board to athletes regardless of what gender they were presumed to be at birth. These new rules could force female athletes with naturally elevated testosterone levels to have to lower their hormones with medication or have to compete against men in certain Olympic events.

Initially the limitations will be enforced in middle distance races of 400 meters to one mile, events requiring the kind of speed, power and endurance that testosterone assists.  I assume that if this compromise, for a compromise it is, gains acceptance, then the substitution of hormone levels for biological sex will travel to other realms of sport, as it should.

Duke law professor Doriane Lambelet Coleman makes a strong argument for the new rules in a column today in the New York Times. She writes in part,

“In competitive sport, winning and room at the top are what ultimately matter, so relative numbers are irrelevant. It doesn’t matter that there are 100 females and three males in a girls’ race if the three males win spots in the final or on the podium because they are males. The unusually high incidence of intersex athletes in the women’s middle distances and their reported 100 percent win share in the women’s 800 meters at the Olympic Games in Rio show their disproportionate power. Indeed, it is because they clustered in the middle distances that these events are the initial focus of the rules. Their supremacy was proof of principle. Testosterone readings outside of the female range were also found in the throws, but these were attributed to doping, not intersex conditions.

The I.A.A.F. is requiring that affected athletes lower their testosterone levels to within the female range if they want to continue competing in the middle distances in the women’s category. By definition, the required hormone therapy causes medically unnecessary physiological change, and no one should be forced to take drugs they don’t want or need.”

From The Ethics Alarms “Outrageous Double Standards” File: The Washington Post Gives A Vocal Anti-Semitic Politician A Pass

Ward 8 in the District of Columbia, where corrupt former mayor Marion Barry set up shot after getting out of prison, now has a Representative on the D.C. City Counsel who makes Barry look like Barack Obama as a statesman and Stephen Hawking as an intellect. This is Trayon White, who recently made the news after opining that “the Rothschilds” as in, “the Jews “control the weather to own the cities.”  After an apology, he took a tour of the Holocaust Museum, and embarrassed himself further, asking some bizarre questions before leaving the tour early.

So what was the Washington Post editorial page’s reaction to this? Amazing…some high (low?)lights…

Many people were inclined to believe that D.C. Council member Trayon White Sr. (D-Ward 8) spoke from ignorance, not malice, when he talked about Jewish financiers controlling the weather. That was, and continues to be, our view….

So an elected city official is more ignorant than a stick of gum. The “Jews control the weather” line was scientifically ignorant, societally ignorant and historically ignorant, plus being so cretinous it hurts to read. At that point, does the distinction between malice and ignorance matter?

Mr. White, who joined the council last year, has attracted national attention because of his controversial remarks earlier this year suggesting Jewish control of climate and government. The furor had died down when The Post detailed an awkward visit to the Holocaust Museum by Mr. White and his staff. That Mr. White initiated the visit is to his credit, and a pass should be given to questions asked in earnest good faith but out of ignorance. Sadly, as shown by a recent survey, a lack of knowledge about the Holocaust is not uncommon in young Americans.

What? The man is an elected  government leader! Government leaders have to know something. White’s questions (for example..shown a photo taken in 1935,  that depicts a woman in a dark dress shuffling down a street in Norden, Germany wearing a large sign around her neck reading, “I am a German girl and allowed myself to be defiled by a Jew” as she is surrounded by Nazi stormtroopers, White asked his guide, “Are they protecting her?”) reveal a deep lack of knowledge or minimal historical education. He’s unqualified for office. What kind of defense is it that “young Americans” are ignorant of the Holocaust? This isn’t even an effective “Everybody does it” rationalization. He’s not a “young American,” he’s a City Council member. He’s supposes to lead “young Americans.”

And how many young Americans think that the Jews are controlling the weather?

For contrast and good laugh, read this defense of White, which is essentially identical to White’s own “I try to help the downtrodden, so it shouldn’t matter if I’m dumb as a brick” excuse. Back to the Post…

Morning Ethics Warm-Up, 3/19/18: Unethical Wedding Gifts, The Fairness Conundrum, What Really Makes Students Unsafe, And More

1 A Not Exactly Hypothetical… A family member is getting married, and the social justice warrior spouse has decreed that no gifts should be sent, just contributions in the happy couples’ name to designated charities and causes, all political, partisan, and ideological. Does this obligate guests to give money to causes and organizations they object to or disagree with? One might be tempted to teach a life-lesson in abuse of power, and pointedly give a contribution to, say, The Family Research Counsel, the NRA, or Paul Ryan’s re-election campaign, but that would be wrong. Wouldn’t it?

2. “Progressive fines” poll update. The percentage of readers who regard so-called “progressive fines” as fairer than fining all law violators the same amount regardless of resources is about 6%, in contracts to 40% who think this is less fair. As I suspected, the schism is driven by the long-standing (and resolvable) arguments over what constitutes “fair” government policies, and whether it is the government’s job to try to make life less unfair. Is it “fair” to treat everyone the same, when we know that life doesn’t treat everyone the same? Are those who argue that life’s unfairness should be addressed by individuals, not society, taking that position because they are winners in life’s chaotic lottery? Can society and governments be trusted to address “unfairness” and inequality without being influenced by the conflicts and biases of the human beings making and carrying out laws and policies. I don’t generally care to spend a lot of Ethics Alarms time or space on abstract ethics questions, but some of them can’t be avoided. You can take the poll, if you haven’t already, here.

Morning Ethics Warm-Up, 3/9/18: Update On A Jerk, Deceptive Recycling, A Movement Becomes A Club, And The Future Is Abused

1 Good! Billy Williams, that Derry, N.H. Used Apple Store owner who announced that Republicans weren’t welcome in his store, was evicted from his space. For weeks, a sign in the window has said that the store would re-open after renovations, which Williams’ former landlord says is not true. Williams rented the commercial space for $2,000 per month and owed $15,110 after neglecting to pay rent for seven months.

Williams, you will recall, said that he infallibly could recognize Republicans. His Facebook post announcing the GOP ban described members of the political party as “almost evil, and to be honest, usually evil.” [Pointer: Arthur in Maine]

2. Recycling Deceit: In Atlanta’s Hartsfield-Jackson International Airport, I was intrigued yesterday by the cylindrical re-cycling receptacles that had two deposit holes, a circular one on one side, into which we were told to put cans and bottles, and a long rectangular slot on the other side, for newspapers and other paper refuse.  I lifted off the top: sure enough, everything went into the same place, newspaper and cans alike. I don’t know what the term is for gratuitously demanding that the public do something pointless and trivial just to exert power, but this was it.

3. The problem with #MeToo. Commenting on yesterdays Comment of the Day, in which Carcarwhite wrote, while criticizing the #MeToo movement,

“I was kissed by Eddie Van Halen back stage in the 80’s, on the lips, a few times. He was tipsy and happy and took a selfie of us before seflies were selfies, and I’ve actually had friends on the Left tell me I should my story publicly. And they say I am ENABLING THIS BEHAVIOR by not going forward”

Commenting, Still Spartan said in part, “What you described is NOT “Me Too.” Just because some people take it too far, does not mean that it is not legitimate. If you affiliate with the Republican Party you are not welcome into our store. We will not offer you service. If you come in anyway, I suppose you could sneak in but we will probably know. In fact, we can point out a Republican just from the way you look in person or in a photo. Once I tried doing this and realized I could. We put to a test and told 30 random people that we were guessing Republican or not and all 30 I was correct. You have an uptight, closed energy, negative aura to you… almost evil, and to be honest, usually evil. You also lack a psychic gateway to technology.”

Signature significance: Billy is unethical, a bigot, a bad neighbor, a bad citizen, a bad American, and a toxic asshole. He is the kind of hateful hyper-partisan fool who is poisoning our culture, our communities, national politics and our public dialogue.

So is anyone who cheers him on.

Billy takes pains to point out that his bigotry isn’t illegal, so it must be OK. (See: Rationalizations List, #4. Marion Barry’s Misdirection, or “If it isn’t illegal, it’s ethical.”)  He also doesn’t worry about backlash from any potential customers who might choose to direct their business to someone who isn’t working to divide the United States into divided camps, each discriminating against the other based on hate and contempt for their opinions. “If you’re in it for the right reasons, it doesn’t matter that someone isn’t gonna come to you with their money,” Williams said, courageously. .He then compared himself to Oskar Schindler.

Ethics Hero: Chandra McKinnon

There is moment in my favorite Saturday matinee movie, “The Vikings”—okay, it’s tied with the original “Journey to the Center of the Earth”–where Ernest Borgnine as Ragnar, the Viking King, is about to be thrown, hands bound, into a pit of ravenous wolves by his Britsih captors, A Viking, we have learned, can only go to Viking Heaven, Valhalla, if he dies with a sword in his hand. Just as Ragnar about to be tossed, Tony Curtis cuts his restraints and hands  him a sword, and the Viking King, beaming, leaps into the pit with a victorious shout of “VALHALLA!” They didn’t have CGI back then, so we only got to hear the sounds of him killing snarling wolves left and right until he was finally mauled, but I always could picture Ragnar’s battle in my mind.

That’s also how I picture Chandra McKinnon, a Canadian law clerk, as she fights off the hoards of mindless anti-pit bull breed hysterics over at The Post That Never Dies, Unethical Website of the Month: Dogsbite.Org . which has over 5,000 Facebook shares and which has been attracting dog breed bigots regularly since 2015.

Chandra leaped into the pit shortly after I gave up trying to reason with these idiots. I finally added this to the post:

In the future,  comments to this post that consist of nothing but repeating the same disproven myths and ignorant beliefs about the various pit bull breeds will not get through moderation. Any serious, well-researched, civil comments presenting counter arguments and genuine statistics to the facts and expert opinion discussed in these posts are welcome. Citing dogsbite.org as authority will guarantee rejection. Lumping multiple breeds together as “pit bulls” proves laziness, bias and ignorance, and will also result in the comment being spammed. Dumb arguments like “You can’t prove they aren’t pit bulls!” will have the same results.

It is depressing how many people will hold on to a factually unsupportable bias despite every effort to enlighten them, but then prejudice against humans works the same way.

It was getting ridiculous. The commenters, sent my way in intermittent waves by the website’s defenders, are usually semi-literate and always immune to reality.  I have banned more commenters on that post than any three elsewhere on the blog. Here is part of a typical rant from one of them, since banned under the Ethics Alarms Stupidity Rule:

Mr Marshal, why is there a FB page titled Our Pets were Attacked by Pitbulls?… If pitbulls are no more aggressive than other breeds, then why are there no similar pages for other breeds?? Why no “Our Pets were Attacked by Poodles” FB page??…Because these breeds have never killed a human EVER, so most likely will not maul another dog!! …As an ethics person, do you think it’s ethical to prioritize the lives of one breed, the fighting pitbull, over the lives of numerous other breeds, and say well I don’t care about the lives of all those other breeds as long as we can own our pitbulls?? Doesn’t matter that pitbulls kill and injure multiple other breeds each and every day, as long as I fullfill my selfish want for a breed that has no purpose in today’s society since it was bred for a sick bloodsport, then I’m fine with that!! IS THAT ETHICAL???

Morning Ethics Warm-Up, 1/14/18: Comfort Women, Presidential Health Lies, Pit Bulls And No “Goodbye Columbus”…Yet

1 Attack of the Dog Bigots. The 2015 Ethics Alarms post designating an anti-pit bull breed website “Unethical Website of the Month” was once again targeted by dog breed bigots and has been getting the same, mindless comments from hysterics that it has been recieving since the post went up.  I don’t allow comment threads to be polluted by propaganda, so I have posted an update requiring any comments to be substantive and to make a genuine effort to address the inconvenient facts I have laid out here over time, facts that the dog bigots routinely deny or ignore, and facts that virtually all experts in the dog field have confirmed.

I recommend  scanning the comment thread, however, for a reason unrelated to dogs. The commenters in the mold of the one who recently wrote this—“But tomorrow, and every day after, when ANOTHER pit bull mauls ANOTHER person, the nutters will take a break from their busy schedule of rampant drug use and domestic violence to jump onto the comments section of the news article to defend these useless pieces of canine garbage.”—are perfect examples of 1) the reasoning of racists and 2) individuals who no longer process information that challenges their belief system, so they simply ignore it all, deny it all, and just keep mouthing their ignorant manifestos.

They are indistinguishable in this regard from the indignant women who have now for three months running come up to me during a break in a legal ethics seminar, recited their feminist cant  talking points objecting to my accurate explanation of legal ethics priorities when the clash with political correctness, and then turned their back on me and walked away when I attempted to address their points.

2. A Japanese Ethics Train Wreck. The Japanese army forced captured Korean women, many thousands of them, to be their sex slaves, or “comfort women.” This is documented fact, and it also launched an ethics train wreck of unusually long duration.  The long-held official position of the post war Japanese government that South Korea’s complaints about these war crimes were either exaggerated or imaginary—the equivalent would be if the German government denied the Holocaust, which it has not—has undermined relations between those countries to this day. There is no end in sight, as this report explains.

What a mess. Japan’s current Prime Minister,  Shinzo Abe, was once a Comfort Women Denier. In  2015, the South Korean president, Park Geun-hye, signed an agreement with Abe  as a “final and irreversible” settlement of the controversy, including an official Japanese government apology and an $8.8 million fund to help provide care for the now elderly ex-“comfort women.” The damages were judged inadequate by critics, and Park was later impeached. Now the current South Korean president wants the deal to be renegotiated. Abe, however, rejected  the “additional measures” sought by Seoul, saying that, in essence, a deal’s a deal. He’s on strong ethical ground there, except that the 8 million was ridiculously low,  and Japan’s acceptance of its responsibility for the sex slave outrage has always been grudging at best.  Continue reading →

Here’s another one.

Regular readers here know I’m a sucker for Presidential history, even when I’m not the one expounding on it. I’m also a sucker for posts that I would otherwise have to write myself., and I was outlining a very similar post to this when Steve-O-in-NJ kindly produced this Comment of the Day. For of there is one thing my life-time love affair with the Presidency and the men who have had the audacity to try, always with mixed success, to fulfill its crushing challenges, has taught me, it is that these were all weird men, each in their own unique ways. You have to be weird to seek this job, or survive it.  The argument that Donald Trump’s undeniable weirdness is somehow deserving of less tolerance than any of the other Presidents is  bigotry mixed with ignorance. Leadership is itself abnormal, and has infinite guises.

Washington was an inch away from leading an army personally to put down the Whiskey Rebellion. Andrew Jackson had a notorious temper (all his life), fought duels (though not while in office), and said he was going to hang the first South Carolinian who defied Federal law to the first tree he could find if bloodshed resulted from that defiance. LBJ gave interviews while on the toilet, more than once. Jimmy Carter talked about having consulted with his young daughter regarding policy matters and claimed to have seen a UFO. Calvin Coolidge brushed off a reporter who had made a bet that she could get more than two words out o him by saying “you lose.” Grover Cleveland had half his jaw cut out due to cancer and told the press he had two bad teeth extracted. He also married a woman who was young enough to be his daughter. Lincoln of course battled what we’d probably now recognize as clinical depression.

The two biggest offenders for presidential disability were Woodrow Wilson, who was actually completely disabled by a stroke and hid it, in effect making the nation an oligarchy ruled by his wife and closest advisors, and JFK, who hid the fact that he had Addison’s disease (why that didn’t keep him out of the Navy I don’t know), probably PTSD, and crippling back pain that sometimes left him unable to stand without drugs. I also wonder if it would be out of line to diagnose Clinton with satyriasis, given his behavior.

My main point is that some of the arguably best presidents like Washington and Jackson, others who were at least popular like Cleveland and Clinton, and some that official history is reluctant to examine too closely like JFK (although that is starting to change) all had issues of risky or extreme actions, bizarre behavior, or concealing disability from the public, and no one now calls any of them unfit for office, nor was that charge ever leveled to my knowledge at any of them with any level of seriousness. As far as I know no Republican leader has ever leveled the charge of mental or other unfitness at any Democratic president with any seriousness, although Clinton’s sexcapades, Carter’s incompetence and errors, LBJ’s open crudeness and weirdness, and JFK’s litany of problems presented the opportunity several times. Lies, Dunces, Fools, Villains, Hypocrites And Big Liars In The Resistance’s Plan E, “The President Is Disabled!” [Part 3]

This topic started out as a morning warm-up and has stretched into three posts. I’m sorry: the more I look at it, the more infuriating Plan E appears.

Let’s briefly recap, shall we?

…The news media, using the dubious claims of Michael Wolff as its catalysts, and following the dictates of the anti-Trump resistance, is trying panic the public into believing that the President is mentally incompetent, and that the provisions of the 25th Amendment might have to be activated, removing him from office.

…That this claim is legitimate, justified, or based on anything but the same view of the President the news media, progressives and Democrats had and loudly publicized through the 2016 campaign is a lie.

…Because it is an audacious, unconscionable lie devoid of evidence or justification being repeated for the purpose of making its targets deny it and discuss it, thus giving it more publicity and legitimacy (“Did the Holocaust really happen?” “Did Trump make a deal to have Russia take down Hillary?”), it fits the description of Hitler’s Big Lie propaganda technique.

…The foundation of this disgusting plot is Bandy Lee, Yale professor of psychiatry who has been condemned by her profession, who is hawking a book, who relies on rationalizations, and whose statements betray a political rather than a professional agenda.

7.  Ethics Dunces: Everyone who accepts, supports or furthers Plan E, the “Trump is disabled” lie. Ethics Dunce is too mild a name here. We have the mainstream news media proclaiming to the world that the President of the United States is mentally deficient based on tweets, gossip, leaks, unethical diagnoses by discredited professionals, an author who has admitted making things up and lying to the White House to get access, and Steve Bannon. Those who enable Plan E are deliberately risking Constitutional disaster and permanent weakening of our institutions. Jonathan Turley properly called this out as the nonsense that  it was in October, only then the supposed crippling malady being claimed was narcissism. That wasn’t flying—Turley: “If we started removing public servants because they were narcissists, the nation’s Capital might become a virtual ghost town. In D.C., the question isn’t who fits that definition? but, who doesn’t?”—so Lee et al. switched to “dementia.”

That’s equally weak and dishonest, and obviously so to anyone who is objective. In the Washington Examiner, Eddy Scarry asks,  “Why hasn’t Michael Wolff’s dementia-Trump ever been seen in public?” We have seen public figures and elected officials show signs of mental problems, like Nancy Pelosi, who has frequently mixed up names, forgotten where she was, sounded disoriented and confused, and talked gibberish in public appearances, or John McCain, who had a disturbing episode in a Senate hearing before his brain tumor was discovered.
