Conclusion: If #MeToo Has No Integrity, Then It Is Doomed, And Deserves To Be

When the #MeToo movement emerged, the idea appeared to be that women (and men!) should speak out about sexual assault and sexual harassment, that powerful people should not feel entitled to take physical liberties with others, and that the culture needed to unequivocally and clearly condemn such conduct. Like most abstract concepts, it sounded good in theory, until—

—the question about what constituted sexual assault and harassment remained unanswered, because in so many cases it is a matter of perception and perspective.

—basic due process and the presumption of innocence were ignored, minimized, or jettisoned entirely, turning the accused into victims themselves

—Democrats sought to weaponized the movement politically, raising questions about motive, equal justice, and bias, and turning what should have been a bi-partisan movement into a cynical partisan one.

—The “women must be believed” mantra, discriminatory, unjust and ridiculous on its face, became part of the narrative and burst into open misandry and outrageous double standards.

Then the Harvey Weinstein Ethics Train Wreck collided head-on with the Brett Kavanaugh Ethics Train Wreck, and here we are among ethical and cultural carnage.

Sunday Morning Ethics Warm-Up, 10/14/18…Stretching the Truth: Fake Accusations, Fake Supreme Court News, Fake Fake Doctors

Good Morning!

1.Who Could Have Predicted That Black Men Would Identify With Brett Kavanaugh?,cont. From the New York Times yesterday:

A white woman who called police after claiming that a young black boy touched her behind in a Brooklyn deli drew a storm of ridicule and criticism on social media, and late Friday she made a public apology to the child.

Critics characterized the incident as the latest example of a hypersensitive white person calling the police to report black people for dubious reasons. Many detractors imputed racist motives to the woman, Teresa Klein.

She was quickly labeled “Cornerstore Caroline” by Jason Littlejohn, 37, a lifelong Flatbush resident who recorded the commotion Wednesday outside the Sahara Deli Market on Albemarle Road. Littlejohn’s Facebook recording of the incident had been viewed 4 million times by Friday evening.

“I was just sexually assaulted by a child,” Klein is heard saying on the video as she was on the phone with the police. The boy, who is about 9, and another child burst into tears outside the store as bystanders confronted Klein about the incident. “The son grabbed my ass and she decided to yell at me,” Klein continued in the video, referring to his mother. The video was first reported by The New York Post.

I just don’t think the Left thought through this “believe all women who claim to be victims” bit. And I’m still confused about the rules. You have to believe a white woman who accuses a white high school kid of sexual assault if she remembers it 30 years later, but you don’t have to believe a white woman who accuses an even younger kid immediately, if he’s black? Does it matter if she’s black? If the accused was a white high school kid, then would everyone have to believe her?

2. Newton’s Third Law! From the Huffington Post: 

Minutes after an event at a Manhattan Republican club meant to celebrate violence against leftists, attendees belonging to a proto-fascist, pro-Trump street gang reportedly pummeled three people on the sidewalk in Manhattan’s Upper East Side while shouting homophobic slurs.

Footage posted online by video journalist Sandi Bachom shows a group of men who appear to be Proud Boys — a misogynistic and anti-Muslim fraternity known for committing acts of political violence across the country — kicking and punching three apparent anti-fascist protesters as they lay prone on the sidewalk.

“Do you feel brave now, faggot?” one of the attackers yelled, according to Bachom and another journalist, photographer Shay Horse. Another video shows multiple attackers yelling “faggot.”

HuffPo, being smear-meisters, calls the group “Pro-Trump” in its headline. I don’t recall any news source calling the antifa a “pro-Obama group” when it was running amuck punching people on Inauguration Day. Kanye West may be crazy, but he isn’t wrong.

Writes the former race-baiting ESPN reporter Jamele Hill in The Atlantic:

On Tuesday night, I was in an auditorium with 100 black men in the city of Baltimore, when the subject pivoted to Brett Kavanaugh. I expected to hear frustration that the sexual-assault allegations against him had failed to derail his Supreme Court appointment. Instead, I encountered sympathy. One man stood up and asked, passionately, “What happened to due process?” He was met with a smattering of applause, and an array of head nods.

Why did Hill expect a group that  has historically been the victim of “believe the white woman” more than anyone to regret the failure of the desperation hit on the SCOTUS nominee using the banneer of #meToo waving over an unsupported accuser? Why did the Democrats? It’s pure bias: they assume that any group in their base automatically approves of their “ends justifies the means” tactics, no matter what basic principles of justice or democracy  have to be sacrificed. I heard about Hill’s bias-driven myopia before I read the whole article, and immediately wondered what Brian Banks, the promising high school football player whose life was upended when a jury believed his false accuser, Wanetta Gibson, would think of the argument that Kavanaugh’s appointment should be forfeit because a single accuser “must be believed.” As it turns out, Hill thought about Banks too, and even approached him.

I reached out to Banks and asked whether he had any thoughts about this solidarity some black men seem to feel with Kavanaugh, but he politely declined to comment. I can’t say that I blame him, since there’s probably nothing Banks could say that wouldn’t be interpreted as being unsympathetic toward victims.

Interpreted by who? I’m sympathetic toward victims, but like Banks, I suspect, I’m not sympathetic with those who want to ruin the lives of men, be they a an African American high school athlete or a judge with an impeccable personal and professional record as an adult, by discarding the principles of due process, equal justice, and presumption of innocence. Nobody can say that Blasey-Ford is a victim any more than the women who got Emmet Till killed was a victim. Democrats wanted her to be a victim, and that was the sole basis for her to be believed more than the man she accused. Continue reading →

Ethics Hero: Michelle Obama

Like it or not, Michelle Obama has established herself as a cultural role model, and millions of American respect her statements and opinions and take them to heart. As clearly contrary to reality as  her now-famous “When the go low, we go high” remark was—its is difficult to remember the last time the Democratic leadership “went high”—the statement would have been an ethical one if it were true, and was still arguably aspirational, unless regards it as cynical public deception.

(Which, I confess, I have…)

This week, as important voices in her party increasingly courted hate, anger and violence among members of the public in the wake of Operation Smear Kavanaugh failing so spectacularly, the former First Lady refused to encourage the mob, and told the Today Show,

“Fear is not … a proper motivator. Hope wins out, and if you think about how you want your kids to be raised, how you want them to think about life and their opportunities, do you want them afraid of their neighbors? Do you want them angry? Do you want them vengeful?…Which motto do you want them to live by? And I have to think about that as a mother.”

Wait, WHAT? Democrats Think That They Aren’t Unethical ENOUGH?

There are so many things in today’s post-Kavanugh confirmation Politico piece that might explode an ethics-savvy readers’ head, the CDC should seek leave to ban it as a menace to public health.  The Thing is titled, Democrats Fear They’re the Wet Rag Party: Kavanaugh’s victory leaves many on the left saying it’s time to get mad—and even, and better proof of the reality of Trump Derangement and the ethics collapse of the Left  would  be hard to find.

A digression: Well, not TOO hard. A novelist and passionate progressive blogger named Chuck Wendig published this Twitter rant after the confirmation vote:

There will be renewed calls for civility. Ignore them. They ask for civility as a way for you to grant them complicity in what they do. Civility is for normalcy. When things are normal and working as intended, civility is part of maintaining balance. But when that balance is gone, civility does not help return it but rather, destabilize it further. Because your civility gives them cover for evil. Note: this isn’t the same as calling for violence. But it is suggesting that you should not be shamed for using vigorous, vulgar language. Or for standing up in disobedience. Or for demanding acknowledgement and action in whatever way you must.

Fuck Trump. But he’s just the ugly fake-gold mask they’ve put on this thing. Fuck all the GOP, fuck that blubbering, bristling frat boy judge, fuck McConnell, Ryan, Grassley, Collins, every last one of them. Fuck them for how they’ve shamed victims and helped dismantle democracy. They will tell you to smile, that we need to get back to business, that we gotta heal the rift and blah blah blah — but that’s the desire of a savvy bully, who wants you to stop crying after he hit you, who wants you not to fight back. But you can cry. And you can fight back. They can eat shit. All of them. They can eat a boot covered in shit. Winter is coming, you callous fucknecks, you prolapsed assholes, you grotesque monsters, you racists and rapists and wretched abusers, you vengeful petty horrors.

Sidenote: some will tell you to be civil because our rage and scorn will fuel the other side, but fuck that double standard in both its ears.

Well, if you hadn’t said those SASSY WORDS and demonstrated ANGER at our whittled-down democracy, I for a second might’ve been convinced not to eat this baby. But fie! Fie on you! Your incivility MADE me eat this baby!” Spoiler warning: they were always gonna eat that baby.

I keep hearing the talking point that confirming Kavanaugh somehow undermined democracy. This is essentially a Big Lie, which the Democrats and “the resistance,” being totalitarians in training, are employing with increasing frequency, if not deftness. Democracy is allowing elected Presidents to appoint qualified judges to the Supreme Court, which is what Trump did, and the Democrats tried to prevent. Our democracy demands the presumption of innocence and due process, which Democrats tried to declare null and void. Our democracy demands equal justice under law, which means that accusers and the accused both have rights, and one gender isn’t accorded greater deference than the other.

How did poor Chuck’s brains and values get this scrambled?

Reporter John Harris tells us that Democrats think they were too nice when they employed every cheap trick, unfair avenue of inquiry and a series of late, legally and factually dubious attacks on Kavanaugh’s character to defeat or at least delay his confirmation.

Saturday Morning Ethics Warm-Up, 10/6/18: As “The Bad Guys” Throw A Tantrum Because Their Plot Blew Up In Their Smug Faces

In this post, and later this one, I directly stated that the Left, “the resistance,” progressives, Democrats, had increasingly embraced objectively wrongful conduct and unethical means and objectives as routine, and that the Kavanaugh confirmation fiasco proved it. The commenter here who goes by the handle of “Chrissy Boy” accused me of being openly partisan, which is demonstrably false: I would write exactly the same thing about the Republican Party if it were trying to eliminate due process, the presumption of innocence, fairness, decency, respect for elections, respect for dissent, a competent and objective press, and the integrity of national institutions. But you see, the current strategy of the Left is to make it crushingly clear that you are either with them, or “the other.” They certainly don’t like being “othered” themselves, but when you set out to topple an elected government and a Constitution, that’s what you deserve. In one of its Sunday Reviews—they all run together, since it it is really “The Resistance This Week” under a deceptively neutral name—the New York Times led with an essay in which the writer wrote that the term “resistance” was unfair and untrue, since they were trying to “create a new nation” and the Trump administration was resisting the inevitable. That new nation, the last few weeks proved, would reject the values I just listed.

This is why, though I have a backlog of ethics issues on a variety of topics, as well as some excellent Comments of the Day that require posting, I have to use the limited time I have right now to chronicle the carnage of the Brett Kavanaugh Nomination Ethics Train Wreck, which, it appears though I am afraid to hope, includes dramatically reduced public support for the “resistance,” the news media, and the Democratic Party. President Trump’s approval ratings (whatever they mean) are way up. Approval of the Democratic Party is crashing, and with it the likelihood of a “blue wave” that might allow the Democrats to execute that coup they’ve been attempting. I have been counting on the historical, cultural reality that in the United States of America, we don’t like Bad Guys, and don’t want to support them. I am still hoping that this prompts the Left to have its Michael Douglas epiphany, and start being the Good Guys again. So far, however, the signs are not good.

Ann Althouse flagged this tantrum from Matt Yglesies at Vox  yesterday (several self-exiled Ethics Alarms progressives insisted Vox was an objective commentary site–suuuuure), neatly summing up:

When the Supreme Court gives lefties outcomes lefties like, they want conservatives to stand down and accept that the Court is doing proper, even brilliant, legal work.

Yes, this is a quality of Bad Guys: they have no integrity. Remember that same sex marriage decision that the evil old reloigious right claimed was “illegitimate” because it opposed “God’s law”?

1. It’s Hate Senator Collins Day! I’m not a Susan Collins fan, as I have always found her annoyingly wishy-washy, equivocal, pandering and a poor role model for women in power whose manner and speaking style illustrates why it is that more women aren’t in positions of power. However, she gave a ringing speech yesterday explaining why she would be voting for Kavanaugh’s confirmation, verbally nailing the coffin shut that contained the Democratic schemes to defeat him. My Facebook ffed is filled with people writing that she is a coward, a traitor (to her gender! to #MeToo!), an idiot. Althouse also flagged this comment (with over 1000 “likes”) to the Times piece, “Collins and Manchin Will Vote for Kavanaugh, Ensuring His Confirmation”:

Stipulated, We Can’t Trust Polls, But This One Is A Harvard Poll, So…Well We Can’t Trust Harvard, Either, But Still It’s An Interesting Poll…

We can see one reason why we can’t trust polls from these two headlines:

The Hill: “More Americans oppose Kavanaugh nomination amid partisan rancor.”

AOL: “Nearly two-thirds of voters believe Kavanaugh should be confirmed if the FBI finds no corroboration of the charges.”

We can’t trust polls because they are made to be spun.

The Harvard Center for American Political Studies /Harris Poll online survey of 1,330 registered voters was conducted September 29 to 30. The partisan breakdown is 37 percent Democrat, 32 percent Republican, 29 percent independent and 2 percent other. The full poll isn’t out yet, but here are some results, with my comments.

  • 37 percent of registered voters want their Senators to give Kavanaugh’s nomination the thumbs up, while 44 percent want their Senators to vote against him. But 18 percent of respondents are undecided.

And, apparently, a lot of those surveyed didn’t watch the hearings, don’t know that Dr. Ford’s accusations are unsubstantiated, and almost certainly haven’t read the report of the Committees expert prosecutor, who found them dubious based on her testimony. Thanks, Biased Mainstream Media! But the truth will out…

  • 44%  of men per cent want their senators to vote in favor and another 44% wanting them to vote against Kavanaugh. Among female voters, 44% want Senators to vote against confirming Kavanaugh, while 31% want him confirmed. 24% remain undecided.

Yes, more women are unfair and biased on this nomination. But who wouldn’t want to install a cultural norm where your gender was regarded as automatically unimpeachable, no matter who you accused. with or without evidence?

  • 45%  of independents currently “don’t back their Senators confirming Kavanaugh,” compared to 28% who want him confirmed.

And The ACLU Takes A First Class Seat On The Brett Kavanaugh Ethics Train Wreck. Of Course It Has. (The ABA Stayed In Coach)

The American Civil Liberty Union has decided to make an “exception” to its supposedly unshakable policy of being non-partisan and non-political—Oh,  the pop-up fundraising appeal the group is currently showing on its website says to contribute to “stop Trump’s attack on civil liberties.” Then it vanishes, with the permanent text on the site staying abstract and without any overtly partisan slant.  Nice. And dishonest!—and announced its opposition to Kavanaugh’s confirmation.

This should not have surprised anyone, because the ACLU has become a sham organization, claiming to be non-partisan and apolitical while every day making it increasingly obvious that it, like so many organizations that take that pose (including virtually all of the mainstream news media), it is a fully committed ally of the Democratic Party. Nonetheless, there is always hope that at crucial moments in the nation’s history, organizations will find their soul, their guys and their principles before they seep away.

For this we need look no farther than The American Bar Association, another “non-partisan” group that habitually endorses Democratic Party agenda items that should not concern it at all. Its membership is overwhelmingly Democratic, and being that this entire section of the political spectrum is in the process of being ethically corrupted, many members, including members of its governing body, were prepared to turn on Brett Kanavaugh, a judge the organization had rated as very qualified for the Supreme Court, and recommend his rejection as a consequence of unsubstantiated, last minute allegations of sexual misconduct by an accuser dredging up dim memories from more than three decades ago. As a lesser tactic, many were in favor of bolstering the Democratic Party’s disingenuous call for an open ended FBI investigation, not because it is likely to clarify anything, but because it will accomplishe the Party’s stated objective since before Dr. Ford was persuaded, or pushed, to play the part of Anita Hill in this adaptation of “The Clarence Thomas Hearings.” They want to delay until after the November elections.

Thus it was that Robert Carlson, the latest Democratic Party contributor to lead the organization, wrote this letter on ABA letterhead, falsely stating that he was speaking for the ABA itself:

“The American Bar Association urges the United States Senate Judiciary Committee (and, as appropriate, the full Senate) to conduct a confirmation vote on Judge Kavanaugh’s nomination to the Supreme Court of the United States only after an appropriate background check into the allegations made by Professor Ford and others is completed by the Federal Bureau of Investigation.”

Rather than allow him to hijack its process and integrity, the ABA sent this letter to the Judiciary Committee, clarifying that Carlson was speaking for himself only:

Of course, if it were really a non-partisan, non-ideological organization, the ABA would be in the process of removing Carlson from office. In every organization, falsely using one’s post to imply organizational support of a personal view is a firing offense. Instead, the ABA took the face-saving measure of posting Carlson’s misleading letter (lawyers are prohibited from engaging in misleading conduct) under a link saying, “ABA President Calls For…” THAT’S deceit (lawyers are prohibited from engaging in deceit). Most readers will not notice the material distinction between the President of the ABA’s position and the official ABA position, and that’s just the way the association wants it.

1 My pledge. That’s it. I’ve had it. Every single time I read or hear a reference to how women accusing men of sexual assault or harassment have a “right to be believed,” and anytime I read or hear someone quoting such a reference with approval, I’m going to point out in the strongest possible terms how sinister, unethical, and certifiably stupid this is. If you want to believe Dr. Ford’s dredged up memories of a party—somewhere—where she was jumped and groped by two drunk teens, go ahead. You do have a right to believe anything, including in the Hindu elephant god,  the brilliance of Sean Hannity, and the virtue of Bill Clinton: I don’t care. Be gullible. Asserting that women have some special chromosome-based right to be judged 100% reliable when they make damning and destructive accusations against men violates all standards of logic, ethics, equal protection, fairness , justice and common sense, and threatens tangible harm to innocent citizens and society. It needs to be condemned, and those making it must be condemned until this insidious, ideologically-spawned Big Lie is killed, squashed, burned and vaporized for all time.

For some reason, the tipping point for me was not the nauseating conduct of the Democratic Senators yesterday, which included a dramatic multi-NO! from perhaps the worst of them—well, after Diane Feinstein—Hawaii Senator Mazie Hirono, the one who told Jake Tapper that the very fact of being a conservative is sufficient to disqualify Brett Kananaugh from any presumption of innocence. Stalin reasoned like that. That Hawaii would elect such an un-American, totalitarian-minded fool—she is more ignorant than evil, I think, but I could be wrong—to represent the state is enough to make me resolve to vacation elsewhere when the tropical breezes beckon. What a disgrace she is, and any voters who would allow someone like that to have access to power.  But no, what made me snapo was a small note in today’s paper about how Rep. Leonard Nance’s race to be re-elected to his New Jersey Congressional seat was seen as threatened because he “seemed to cast doubt on Ms Blasey’s allegations” in remarks to a group of college Republicans.

What the hell? Her allegations are over three decades old, she never spoke of them until a SCOTUS nominee she opposed was about to be confirmed, she has no corroboration or evidence whatsoever, and the man she accused uncategorically denies her story under oath. Ethics Morning Sickness, 9/29/2018: The Ford-Kavanaugh Hearing Hangover

According to several sources, Republicans not only have the votes to confirm Brett Kananaugh,  a couple of Democrats may even join their ranks. If true, that’s amazing, and also the most encouraging piece of news I’ve heard since Aaron Judge went on the Disabled List.

I don’t have any special fondness for Brett Kavanaugh, and I have no stake in his confirmation. All I have ever cared about is having outstanding, smart, analytical judges on the Supreme Court. I was thrilled when President Obama nominated Elena Kagan, who fits that description; depressed when he appointed touchy-feely mediocrity Sotamayor, lowering the quality of judicial talent so he could check off a diversity box, but then, that’s Obama. Justices like Blackmun, Souter and Kennedy, all appointed to skirt controversy rather than to ensure a competent Court, do subtle, long-lasting damage to our laws. Aggressive, thoughtful, brilliant jurists like Scalia and Ginsberg keep the third branch of government strong. Kavanaugh is undeniably the kind of qualified, experienced judge who has always been routinely confirmed by the Senate regardless of the President nominating him or his party affiliation. What the Democrats and their allies among activist and the news media have done to Brett Kavanaugh is more than wrong; it is very dangerous, and threatens further the basic comity and respect without which no democracy can function. The treatment of Kavanaugh, which I have discussed in detail elsewhere—the demonizing, the fear-mongering, the character assassination, based purely on an unremarkable judicial philosophy—continues down a slippery slope, already greased by “the resistance,”  that ends in civil war.  The Democrats will only turn away from this disastrous path when they conclude that it won’t work, that the American public rejects “the ends justify the means” as an operating strategy. There are signs that the Democratic Senators televised conduct during the Kavanaugh hearings may be a tipping point. I hope so. I’ll believe it when I see it.

Nothing much has changed in my assessment since I wrote this post ten days ago. I still don’t believe or disbelieve Ford or Kavanaugh. There is no basis on which to believe either of them, but the accuser has the burden of proof, and as was true ten days ago, she can’t meet it and didn’t meet it. Nobody confirms her account. She cannot provide specifics, even as to where the alleged attack occurred, who held the party where it allegedly occurred, or an exact date, making investigation nearly impossible. Her parents, who are alive, have not confirmed her account; apparently she didn’t even tell them about the incident. Her testimony was convincing. So was Kavanaugh’s. Those who say “they believe” either party might as well have a “Bias has made me stupid” sign on top of their head. In yesterday’s New York Times, a full page ad listed thousands of names of men proclaiming “We believe Anita Hill. We also believe Charistine Blasey Ford.” All they are doing is virtue signaling for their pals, proclaiming their partisan affiliation (believing Ford is required to save abortion, and depending on which hysterical activist or pundit you listen to, female suffrage, gay marriage and the continued abolition of slavery), and or proving that they lack the power of critical thought.

I’ll have to sort through all of the logical fallacies used against Kavanaugh later: I’m sure a new rationalization for the list or twelve is in there. For example, I have been told and read that women believe Ford because they know other victims of sexual assault who never reported it. But that doesn’t justify believing Ford! It indicates that the fact that she waited all this time, until evidence was gone and memories faded, to suddenly make her accusation when it was most politically useful to her party doesn’t prove she isn’t telling the truth, but it doesn’t make it any more likely that she is, either. A commenter yesterday suggested that there should be more sympathy and accommodation for victims who are afraid to come forward soon after a sexual assault. “I would like to remind you that women often are not able to speak out against harassment until long after the fact because they are afraid and unable,” she wrote. I replied,

Then they lose their chance. There are a lot of things in life like that. If I’m reluctant to speak up and challenge a mob harassing a US Senator while he’s dining with my family, I can’t wait 20 years and do it then, can I? If you are afraid to report a community criminal when you have evidence against him because you’re afraid to snitch, it’s no mitigation to report the evidence after more people have been hurt because of your delay. How about women who don’t stop their boyfriends from sexually molesting their children because they are afraid? Is it acceptable that they wait until the Statute of Limitations has run, the damage has been done, and the kids are grown and molesting children themselves before they speak up?

You don’t have to remind me of the dilemma. I’m sorry, but I am really sick of this argument…It’s an excuse and a rationalization. It makes fairness and due process impossible, and it allows false accusers to manipulate others. Three decades? Holding a complaint until the exact moment when it can’t be defended against AND will do the most damage?

It’s explainable, perhaps, but it isn’t ethically excusable.
