Dress Code Ethics: The Jet Blue Affair

JetBlue has a line in its contract of carriage that gives its employees the power to refuse to fly passengers who try to board a plane wearing clothing that is “lewd, obscene, or patently offensive.” Based on that vague standard, Seattle-based burlesque performer Maggie McMuffin was refused seating on a JetBlue flight from Boston’s Logan International Airport last month when the airline’s gate agents refused to let her board  until she changed her shorts. Maggie told a local CBS affiliate that an airline employee said her outfit was “not appropriate” according to the flight crew and pilot. Now Maggie is taking advantage of the situation to get some cheap publicity and maybe an interview or two, while embarrassing JetBlue. You can read more details in Slate’s story here.

Ah, dress codes! They are conduct rules put in place by businesses and institutions because some people have no manners, sense of place, consideration for others or respect, and these codes never, ever, work in the long run, because some people have no manners, sense of place, consideration for others or respect.

Once upon a time, children, adults going out into public dressed with taste and modesty as an expression of respect to others, including strangers, that they might meet. The Sixties destroyed this cultural consensus by questioning manners, decorum, conformity, dignity, and respect for others, especially anybody over thirty. Do your own thing! Let it all hang out! Today, a half century later,  people nonchalantly wear flip-flops to the opera and church, while the obese passenger sitting next to you on an airplane may be wearing a tank-top, and hasn’t  bathed in a week.

Of course Maggie McMuffin—I’m sure that’s her real name—wasn’t dressed appropriately to fly. (That’s her outfit above to the left–I assume she was wearing her head…) She was definitely dressed appropriately to draw attention to herself as burlesque performers (a.k.a “strippers”) are wont to do, and that was her intent. The JetBlue agreement, however, doesn’t say its employees can kick you off the plane for dressing inappropriately—like in a scuba suit, a bunny costume, or as Dracula. It says “lewd, obscene, or patently offensive.”  Whatever you can say about Maggie’s travel garb, it isn’t “lewd, obscene, or patently offensive.” JetBlue was wrong: unfair, incompetent, foolish. Cast Your Vote For The 2015 “Curmies,” Disgraces To The Field Of Education…

Rick Jones, whose blog has been a past award winner at Ethics Alarms and who is also a much-cherished commenter here, has posted the nominees for his annual “Curmie Awards” (his blog is, after all, Curmudgeon Central.) The Curmies are “presented to the person or persons who most embarrass the profession of educator.”

This time, only one of his nominees were the objects of posts on Ethics Alarms. Following is the list of finalists; then go here to read more of Rick’s riffs on the nominees, and to recoil in horror at Rick’s dishonorable mentions, like the  Texas high school that “not only painted Christian zealotry on the corridor walls, they used made-up quotations from the likes of George Washington and Ronald Reagan to do it.” (I’m really sorry I missed that one.)…

1. …Gustine ISD in Texas, where Principal Alan Luker faced a rather unique problem: someone was leaving feces on the gym floor. So, naturally, a couple dozen 4th and 5th graders were carted off to separate rooms for girls and boys and made to drop their pants….

2. … Harrisburg (PA) Sci-Tech High School, where an (of course) unnamed Assistant Principal threatened senior Alexus Miller-Wigfall with suspension for wearing a dress that was “too revealing” to prom…apparently motivated by the fact that Ms. Miller-Wigfall has “more boobs than other girls,” who “have less to show.” (More boobs? Two aren’t enough for this girl?) [Ethics Alarms post here.]

3.…The State Education Department in Florida, which devised a testing apparatus whereby students who got perfect scores on a standardized test actually hurt their school and their teacher by not improving on the previous year’s perfect score. How often does this happen? Actually, tens of thousands of times annually. Yes, there’s a provision that allows districts to correct the record, and indeed the problem might have been fixed by now, but the mere fact that the default position was to punish teachers and schools for not improving on perfection tells us everything we need to know about the corporate-driven lunacy that now infests public education. [ I omitted this initially, finding it so incomprehensible that I, I don’t know, thought Rick was having a stroke or something. He assures me it’s real.]

Proposition: Any educational system that can produce a headline like this…

…needs help desperately.

Or to be torn down and reconceived completely. I am tending toward the latter.

The headline is in fact correct. Winslow Township Elementary School No. 4 sent an eight-year old girl home  for wearing a Kelly green polo shirt, which was deemed to be in violation of the Camden County (New Jersey) school’s dress code, decreeing that shirts and blouses may only be white, navy blue, or dark green.  This is important, for as the  Winslow Township School’s code on dress and grooming points out “school attire can influence a pupil’s behavior and potentially impact the academic environment.”

This kind of mindless autocratic abuse of children causes them to become cynical, angry, submissive, fearful, distrustful of adults, or contemptuous of authority, none of which are good. The President of the United States, since he appears to be in the business of addressing local school wrongs, could perform a service by humiliating these cruel, dim-bulb administrators and their many equivalents by inviting this victimized young lady to the White House. But then she’s not a Muslim, or dark skinned, or a kid who pretended to invent something when he didn’t, so forget it.

I’m sorry I mentioned it.

For a lot of reasons, I have avoided commenting on this story until now. First of all, it is so stupid that if there is someone who wants to defend the conduct of the school in the matter, I don’t want to know them or read them, and I generally don’t post about the obvious. Second, we still don’t have a name of the victim of the anti-Wonder Woman attack, the school involved, or the teacher or administrator involved. Finally, I’m suspicious: a Wonder Woman movie is nearing release, and this seems awfully convenient.

Would You Pay $15 An Hour To This Employee?

I love it when a story  combines recent posts. This one evokes the issue of minimum wage hikes and people who use social media to try to rouse the ire of the web Furies while getting themselves some pop culture fame of the approximate duration—and value— of a mayfly.  If only this teen had shot a lion, it would be perfect.

17-year-old Sylva Stoel was sent home to change when she arrived to work at a J.C. Penney’s store looking like this:

Good for the boss. That’s no way to dress for work in a retail store. But Sylva is imbued with that certitude of perfection that only spoiled and badly raised teens can model, so she quit in protest and announced her defiance to the world, tweeting a photo of her giving the finger to Penney’s…

…. with the legend,“Boss sent me home for wearing ‘too revealing’ shorts that I bought from the store I work at in the career section.”

Yes, but what career, Sylva?

Her argument, brainlessly championed by the Huffington Post, is apparently that employees should be able to wear what they sell, which will be fun for those shopping in the bathing attire section.

I’ve got news for Sylva (I also may have found her missing “i”). You know nothing about the workplace. Your idea of professional attire is pathetic. You have no skills, and setting out to webshame an employer, who generously gave you a chance to get some desperately needed experience, by quitting and flipping your boss off should, if there is any justice, make you unemployable for a good, long time.

Those who run businesses can dictate reasonable dress codes for their employees, and red hotpants are not appropriate attire for male or female workers even in hotpants stores, unless the owner decides otherwise. This twitter assault says nothing of value about dress codes or J.C. Penney, but volumes about a deluded and rude child named Sylva Stoel, whom nobody should hire again until she learns acquires humility and  manners.

Some stories of the malfunctioning of  ethics alarms in school administrators make me want to weep, go postal, or begin a national movement to bring down the public school system for good, so untrustworthy are its stewards.

This one made me want to do all three.

The incompetent and cruel administrators at Harrisburg’s Sci-Tech High School told student Alexus Miller Wigfall that she would be suspended because the prom dress she wore was “too revealing.” The school’s dress code, like most dress codes, is so badly worded that it defies reasonable construction: this one requires “all body parts” to be covered, suggesting that the only acceptable prom dress would be something like this…

A Facebook friend posted the following letter, posted by one of her friends, and supposedly passed along by the target of the letter. The individual subjected to the complaint is reputedly trying to overcome obesity and various health issues. The letter:

I have my doubts regarding the authenticity of this, but it doesn’t matter to this post. I assume we can all agree that the letter itself, if genuine, is cruel, mean-spirited, cowardly (it is anonymous), hurtful, and indefensible. It does raise an valid ethics question, though, which is this: Do we have any ethical obligation any more to exhibit modesty and a degree of public decorum out of doors, when we are likely to come under the gaze of others? At the 2nd District Court in Ogden, Utah, female reporter Morgan Briesmaster was barred by court security from entering the courtroom to cover a story because her sleeveless blouse (left) violated the official dress code.

She eventually gained access by wearing a parka. Up until then, she told other journalists, she waited in the lobby  “where she watched other courtgoers stroll through security with jeans and low-cut shirts.” Her boss ridiculed the situation, comparing it to high school yearbook dress codes, and noted that “any time a reporter is stopped from covering the news, it’s a concern.” There actually is a rule against wearing “tank tops” in that court, but I wouldn’t call what Briesmaster wore a tank top.

The Little Bald Girl, The Ethics Incompleteness Principle And The Ethical Way To Handle Obvious Anomolies

In Grand Junction, Colorado, Caprock Academy student Kamryn Renfro was banned from attending her school after shaving her head in support of a friend undergoing chemotherapy to treat neuroblastoma, a rare type of cancer. Academy administrators told Renfro’s family that they would not permit the little girl to return to class after spring break because her shaved head violated a school dress code requiring that female students’ hair to be “neatly combed or styled. No shaved heads.”

This is obviously the kind of anomalous situation that calls for, indeed screams out for, a compassionate exception. Any school administrator who couldn’t see that is not just unqualified for his or her post, but not sufficiently intelligent or rational to be trusted with the welfare of children, or, I would say, to take tolls in the Lincoln Tunnel. If there really were a competition to see which enforcement of a “no-tolerance policy” would stand as the most outrageous of all time, I would suspect that this would be an entree. (It still wouldn’t win, though.)

As is often the case, this topic interests me more than it appears to engage Ethics Alarms readers, so I was thrilled to see the following comment by Ulrike, who seems to share my belief that “Keep A Breast” Foundation is the ethics villain of this First Amendment skirmish, choosing buzz and cheap publicity over responsible messaging and being willing to throw well-aimed, legally immune monkey wrench into the classroom as well. 

Here is the Comment of the Day by Ulrike (who also has amassed a bumper crop of Ethics Alarms brownie points by being the blogs most determined volunteer proof-reader) on the post  The “I  ♥  Boobies” Saga.

I beg anyone’s pardon if you may find this off topic, but I really need to vent my anger about these bracelets: The message that these bracelets are sending out is not “Save your life by having regular check-ups!” but “Women are perceived as having breasts first, and subsequently as a person”. All this bracelet manages to do is to reduce women to their sexual attractiveness while fighting for their very lives. Well done, “Keep A Breast” Foundation. I wonder what bracelets girls and women who fell victim to aggressive breast cancer and lost one or both breasts are supposed to wear. Maybe “Don’t got boobies you can love anymore”? Continue reading
