Gender Bias And Legal Careers

Studies show that although women have been entering the law in equal numbers to men for more than a decade, they make up just 23 percent of partners and 19 percent of equity partners. Why do so many women  leave the legal profession at what should be the height of their careers? Last month, more than 160 lawyers gathered at Harvard Law School in November for the ABA National Summit on Achieving Long-Term Careers for Women in Law to identify answers and plot a course to change the trends.

Sharon Rowen, a lawyer from Atlanta,  said her research showed three reasons women leave the practice of law: work/life balance, unconscious bias, and the pay gap. I wish I could have attended the discussion. I hope someone pointed out that seeking work/life balance is the major reason for the pay gap, and that it is not unreasonable to view that as a trade-off that is both fair and reasonable.  Rowan’s list also leaves off conscious bias that pervades society and clients regarding female lawyers, as well as law firm partners.

Iris Bohnet, professor of public policy at Harvard Kennedy School, said some women suffer from “success fatigue,” and leave “because of a work culture that forces them to minimize important parts of their lives.” They ask themselves, “Can I bring my whole self to work?” and “Is this a place where I can thrive?” What she is saying is that a lot of women don’t find the law enjoyable, and that its stresses, patterns and requirements are more accommodating to men than women. In other words, law isn’t fun for a lot of women, while men, because of the nature of males, are more tolerant of it than women tend to be. I wonder if any panelist had the guts to come right out and say that? I doubt it. I bet most of them would deny it, because it’s politically incorrect to admit any gender differences, unless they involve female superiority.

Are women inherently worth as a much as their male counterparts in similar or the same jobs?

Here is reader slickwilly’s Comment of the Day on yesterday’s post, “Thank The U.S. Women’s Soccer Team For Illuminating The Muddled Ethics Of Wage Gap Arguments In Women’s Professional Sports”:

This is rich… equal pay for an equal job… when the job (and skills) are equal.

Years (decades) ago, I was a trainee engineer for a large company. Part of the job was installation of large racks of equipment involving a fully stocked tool box, weighing between 35 and 50 pounds.

Many of the buildings we installed in did not have elevators, so you carried tools and supplies up flights of stairs.

Another trainee was a slip of a girl, likely 125 lbs soaking wet. She was good once on site, but could not carry her own toolbox up a single flight of stairs, or help when major upper body strength was needed to move equipment into position. Yet she got the same pay and incentives the guys did, for less work (she sat around while the guys lugged stuff up the stairs.) There was no offsetting brilliance that compensated for her lack: just plain competent work when she could perform it. Don’t think the guys did not grumble about doing her work in addition to theirs!

To add insult to injury, she was promoted out of the field first because a)she was black; b) she was a she; and c) the work supervisors wanted a stronger person working the jobs (they did not get extra time to do the job when she was on the crew, either) and could not fire her because of the optics of a) and b). This was a corrupt form of the Peter principle, and my first exposure to such.

Another take: in the Army, each person in a platoon must carry his weight and be able to carry a wounded teammate to safety… unless that person was female. Females could not carry their own equipment, depending on their role, and most likely could not carry a man out of battle. And the standards by which they are judges are not the same. You must be able to pass a fitness test of a certain number of push ups, sit ups, and be able to run two miles under a certain time. This scale slides down by age (an 18 year old must do more than a 35 year old to pass, and rightly so) but the scale is significantly reduced for a female soldier. So a female might be able to do 12 push ups, but get a higher test score for those than an 18 year old who could do 40 push ups)

Are Gentlemen Sexist?

On the flip side of the hit post about Emily Heist Moss’s open letter to her harassers, we have the B-side (I know this metaphor marks me as a fogy ): my objections to a New York Times essay by Lynn Messna, who declares that she doesn’t want her son to be gentleman, because gentlemen are sexist.

She writes:

“Start to complain about your preschooler adopting gentlemanly behavior and you quickly discover how out of step you are with the rest of the world. Almost everyone I mention it to thinks it’s lovely and sweet. What’s the harm in teaching little boys to respect little girls?..But I don’t think it’s an overreaction to resent the fact that your son is being given an extra set of rules to follow simply because he’s a boy. His behavior, already constrained by a series of societal norms, now has additional restrictions. Worse than that, he’s actively being taught to treat girls differently,  something I thought we all agreed to stop doing, like, three decades ago. Continue reading

Unfairness in the Name of Fairness: Virginia’s Unethical Golf Rules

Lyberty Anderson, a junior at Manchester High School in Midlothian, Virginia, and undeniably female,  won the Virginia state boys Division AAA golf championship with an eagle on the final hole to capture the 36-hole tournament by one stroke. Lyberty is a terrific golfer, having demonstrated her precocious golf talents by winning women’s tournaments before she was in high school. Nonetheless, the boy’s tournament was outrageously slanted in her favor, and against her male competitors, tainting her victory.

Lyberty won, but she didn’t play the same course as her male opponents. She was allowed to tee her drives up on the shorter women’s tee, meaning that while the boys had to play a 6,653-yard course, hers was more than 1,000 yards shorter, almost 20%.  As Washington Post sportswriter Fred Bowen pointed out, Lyberty can’t be blamed for this: she played by the rules, and played as well as anyone could ask. She now says if she competes in the boys tournament again next year, she’ll tee of from the same spot as her competitors. That shows she understands fairness. Continue reading

Group Bigotry: Is This The Way It’s Going To Be? AGAIN?

I'm a fan of women's curves, but I expected their learning curve to be better than this.

I already covered this topic when Christiane Amanpour held an unrestrained “males are inferior managers because all the blood rushes to their penises” session on ABC’s “This Week” a few Sundays ago, but since it is becoming clear that the outbreak of gender bigotry in the media is more widespread than ABC, a second alarm is warranted.

This week’s Time magazine has a column by Meredith Melnick entitled “Why Women Are Better at Everything.” Among its contents:

•    “Recently in the Wall Street Journal, MarketWatch columnist David Weidner noted that women ‘do almost everything better’ than men — from politics to corporate management to investing.”

•    “What’s the problem with men? ‘There’s been a lot of academic research suggesting that men think they know what they’re doing, even when they really don’t know what they’re doing,’ John Ameriks, the author of the Vanguard study, told the New York Times.”

•    “Women, who have only 10% of the testosterone that men have, seem inured to the phenomenon, according to Coates.”

•    “So, basically, the more women around, the better, as the Journal’s Wiedner said. His column referred to a recent book by Dan Abrams called Man Down: Proof Beyond a Reasonable Doubt That Women Are Better Cops, Drivers, Gamblers, Spies, World Leaders, Beer Tasters, Hedge Fund Managers, and Just About Everything Else.”

•    “…women are better soldiers because they complain about pain less. They’re less likely to be hit by lightning because they’re not stupid enough to stand outside in a storm. They remember words and faces better. They’re better spies because they’re better at getting people to talk candidly.”

•    “Of course, to most women none of this is much of a revelation.” Continue reading

Comment of the Day on “Girl Talk and Bigotry Ethics…”

We had it coming, apparently...

This comment, from new visitor Linda, exemplifies the kind of thinking that too many Americans believe pass for “ethics.”  In response to my post about a Christiane Amanpour-led  panel on her Sunday morning public issues show that celebrated male-bashing and gender bias, Linda’s response is essentially…

1. You “men” have done worse to us.

2. We have the right to get even.

3. You can dish it out but you can’t take it.

4. We have the right to be bigots too.

Indeed women do have the right to be bigots, but journalists like Amanpour abuse their own First Amendment rights when they use the freedom of the press to advance naked bigotry, and women like her panelists disgrace their own principles when they move from seeking fair and equal treatment for themselves to asserting superiority and advocating gender bias. Girl Talk and Bigotry Ethics: Celebrating One-Way Gender Bias on ABC

Christiane Amanpour just led a jaw-dropping roundtable discussion on her ABC Sunday morning talk show, “This Week with Christiane Amanpour,”as three female guest commentators ( Torie Clarke, the former assistant secretary of defense for public affairs in the Bush administration: Cecilia Attias, the former first lady of France and founder of Cecilia Attias Foundation for Women, and ABC’s Claire Shipman)
and Christiane discussed how the convergence of  Former IMF director Dominique Strauss-Kahn’s attempted rape charges and Rep. Anthony Weiner’s travails has created a possible tipping point, in which the nation will finally come to the realization of a fact that these women have known all along: women are just plain better than men when it comes to leadership, management, decision-making, and conflict resolution.

The sweeping generalities, stereotyping, and flat pronouncements of male inferiority were unrestrained. Continue reading
