Ethics Observations On Beyonce’s Super Bowl 50 Halftime Performance

On the eve of her Super Bowl 50 half time show performance, Beyoncé released  “Formation,” a video full of references to Black Lives Matter tropes and propaganda, including “Hand Up! Don’t Shoot!”  (You can view it here. The earlier version of this post had an unofficial version: I apologize for the error.) Then in her portion of the Super Bowl 50 halftime show, the pop star gave the sold-out stadium and world-wide audience a live version of the video, including  backup dancers wearing Black Panther berets who formed  an X, apparently alluding to black Muslim activist Malcolm X, and raised their fists in the “black power” salute. African-Americans activists wrote that they saw the performance as a tribute to the 50th Anniversary, not of the Super Bowl, but to the Black Panthers.

The halftime show was part of a marketing plan messaging across multiple platforms, from social media to mainstream media. Once the show was seen in the context of the more explicit video, a controversy emerged, just as Beyoncé ‘s marketing geniuses hoped it would. Former New York mayor Rudy Giuliani was among the vocal critics, calling the show “outrageous” said telling Fox News,”This is football, it’s not Hollywood, and I thought it was really outrageous that she used it as a platform to attack police officers who are the people who protect her and protect us, and keep us alive.”  Protests are planned at NFL headquarters.

What’s going on here?

1. Stipulated: Beyoncé’s sole intentions are to sell, make money, and get buzz. If she has a genuine political motive, and I doubt it, it is secondary to the good ol’ profit-making motive that has made her a mega-millionaire. She and her husband Jay-Z have been linking their brand to Black Lives Matter because they see profit in it, that’s all. Is it crass and ethically inert? Sure it is…just like the music business and the rest of show business. Is it particular disgusting, at a time of dangerous racial division in this country heightened by liars, crooks, complicit activists and cynical politicians, to try to make money by glamorizing it? Yes indeed, but the Julie Principle needs to be applied here. Fish gotta swim and birds gotta fly, and if you are paying any attention to people like Beyoncé, you can’t be shocked or overly angry at them when they show that their motives are purely non-ethical at all times. Yes, Beyoncé’s conduct was culturally irresponsible and unethical. “This is my shocked face:”

2. That said, hijacking the Super Bowl halftime show to make a race-baiting, divisive, anti-police demonstration out of what is supposed to be a unifying, fun, family-friendly cultural event, by extolling the racist Black Lives Matter, the criminal and racist Black Panthers, and destructive lies like “Hands Up, Don’t Shoot!” is indeed outrageous. Double Standard Of The Year

The deference accorded to anti-white protesters on dozens of college campuses, not just by spineless administrators but much of the news media. Similar protests, conduct and rhetoric by white students would be immediately condemned for what it would be: blatant racism.

 Lie of the Year

Hands Up! Don’t shoot! The lie was uttered in 2014, but acquired new status after the Justice Department unexpectedly and definitively determined that the evidence did not support the inflammatory myth that Mike Brown was shot dead in Ferguson while trying to surrender to Officer Wilson. Never mind: the lie is part of the manifesto of Black Lives Matter and similar groups; it is still alluded to by activists and shameless politicians; it still divides the nation and focuses hate on police departments; and it has contributed to getting police officers killed while making communities more vulnerable to crime. It may be the Lie of the Decade.

Uncivil U.S. Official of the Year

Justice Antonin Scalia, who crossed all lines of judicial restraint, collegiality and civility when he excoriated his colleague, Justice Kennedy, who was the fifth vote in the majority of SCOTUS’s ruling  that same-sex marriage was a Constitutional right no state could deny, with this comment in a footnote:

“If, even as the price to be paid for a fifth vote, I ever joined an opinion for the Court that began: ‘The Constitution promises liberty to all within its reach, a liberty that includes certain specific rights that allow persons, within a lawful realm, to define and express their identity,’ I would hide my head in a bag. The Supreme Court of the United States has descended from the disciplined legal reasoning of John Marshall and Joseph Story to the mystical aphorisms of the fortune cookie.”

The Jesse Jackson Award 

(For the Year’s Worst Amateur Diplomat)

Barack Obama.  I know, this is snarkier than I like to be in these awards, but the signature diplomatic measure of the past year, the astounding, one-sided, dangerous and Munich-like deal with Iran, could only be the product of an ideological tyro placing wishes and hopes over diplomatic responsibility, and not for the first time. For most Presidents, trading dangerous terrorists for a deserter would be nadir. History has seen many tragedies seeded by world leaders with no diplomatic skills: the disastrous Treaty of Versailles,  Potsdam, and the treaty that this one most resembles, negotiated by the hapless Neville Chamberlain. We can only hope that the worst case scenario doesn’t materialize, but if it does not, it will be moral luck.

The NFL, for the third year in a row. “Concussion,” Tom Brady, Deflategate, more evidence that NFL players are slowly killing themselves with brain damage, Johnny Manziel.  What a great sport pro football is.

Sports Cheat of the Year

Tom Brady, New England Patriots ball-deflating quarterback.  Brady eventually avoided punishment because the NFL botched both its investigation and its imposition of penalties, but his smirking, cynical comments about the incident made it clear that he thinks cheating is no big deal, and most of his fans agree.

Not surprisingly, Brady supports Donald Trump.

Unethical Lawyers of the Year

Law Firm Division:  Lawyers Stephen Diaco, Robert Adams and Adam Filthaut of the Florida firm Adams & Diaco were found to have “maliciously” set up the drunken-driving arrest of their opposing counsel in a  high-profile defamation trial. The plot involved a comely paralegal and a cooperative DUI cop. Last I checked, it looked like all three lawyers would be disbarred for life.

Scary Lawyer Division: California lawyer Douglas Crawford  held a can of pepper spray a yard from the face of the opposing lawyer saying, “I will pepper-spray you if you get out of hand.” Then the lawyer pointed a stun gun at Traver’s head and said, “If that doesn’t quell you, this is a flashlight that turns into a stun gun.” To show he wasn’t kidding, Crawford discharged the stun gun the startled lawyer’s face.

Hard-working Lawyer Division: Massachusetts lawyer,  Karen Andrade, was  charged with prostitution after a police investigated a report by a suspicious neighbor and  found online reviews of both the lawyer’s legal services and her escort services

Celebrity Lawyer Division: Michael Cohen,  one of Donald Trump’s lawyers, told the Daily Beast that it was legally impossible for a man to rape his wife. He was only a couple of decades and many court cases behind on his research. That piece of legal scholarship came after he had threatened the website’s staff in language usually associated with loan sharks and pimps.

Ethics Hero Most Likely To Really Tick Off Black Lives Matter: Washington Post Fact Checker Glenn Kessler, Who Names “Hands Up! Don’t Shoot!” As One Of The Biggest Lies Of The Year

Now somebody tell Black Lives Matter, all of the copycat activist groups, and all the progressive, pandering politicians, like Bernie Sanders, currently giving deference and respect to such groups that still tacitly use Dorian Johnson’s Big Lie in their literature and demonstrations. Somebody tell the Democratic National Committee, which endorses Black Lives Matters, shameless race-baiters that they are. Is the antecedent ambiguous? Never mind: race-baiters applies to both.

Most of all, somebody tell America’s African Americans, most of whom have been conditioned to believe the lie, and thus to believe that young Mike Brown was executed on the streets of Ferguson because he was black. They have been thus taught so they distrust whites, law enforcement and their nation,  and so they will vote Democratic.

Here was the original debunking of the lie, in March. I’ve been tracking the lie since before then: it was evoked in Farrakhan’s march on Washington and in August’s Ferguson demonstration. In both cases, the news media soft-peddled the implicit endorsement of a vile falsehood for its value in spreading distrust, fear and hate. Continue reading →

You think that having Donald Trump running (temporarily and momentarily) as a front-runner in the race for the 2016  Republican Presidential nomination is embarrassing for Republicans? That’s nothin’! The official endorsement of the racist, violence-promoting, anti-police and anti-rule of law movement Black Lives Matter ought to disqualify the Democratic Party as a trustworthy political organization until it stops pandering and apologizes for this statement.

Black Lives Matter is a racist, anti-white, hate-fueled organization that considers any law enforcement involving black criminals presumptively racist. The movement continues to rely on false and discredited media and activist narratives (“Hands up! Don’t shoot!”), citing “victims” like Michael Brown as the justification for its existence, presuming guilt in cases where the facts are uncertain or in legitimate dispute (Eric Garner was not “choked to death,” nor was he intentionally killed; Sonny Gray’s death is still unexplained; there is no evidence that Tamir Rice’s death was related to race). The primary result of the group’s efforts so far have been to increase racial tensions, to spark deadly attacks on police officers, and to cause a catastrophic rise in urban murders as police avoid proactive methods and stops involving black suspects to avoid becoming the next Darren Wilson. When it was reported that Vester Lee Flanagan II had accused one of his victims, Alison Parker, of making racist statements,  Baltimore BlackLivesMatter activist Kwame Rose tweeted that he hoped the accusation would be investigated, because it is white racism that causes blacks like Flanagan to turn against society. Now we have Rose’s answer (not that he’ll accept it, being a professional race-baiter): the shooter had been offended when the white reporter had talked about “going out into the field,” taking it as a reference to cotton fields. When a watermelon was bought by a TV station exec for the staff to share on a summer day, Flanagan thought it was a racist gesture aimed at him.The race hate that many in the black and progressive community have been working overtime to embed in the nation—brings out the base to vote, you know—bore deadly fruit in Vester Lee Flanagan. And he will not be the last.

A man with a successful and famous father who could never find success, Flanagan had absorbed the false assertion being aggressively pushed by political leaders and activists in the black community that the United States is so hostile to African Americans that none of his failures were due o his own choices, problems or conduct. His expanding racial paranoia made it impossible for him to keep a job, and ultimately led to murder and suicide.

Protest Ethics: Of Ferguson, “Facts Don’t Matter” And The Unethical Anniversary

On August 8, political leaders, national activists and hundreds of people including Cornel West and the relatives of Eric Garner and Oscar Grant came to Ferguson, Missouri. They chanted, sang and marched in a vigil to commemorate the death of a young black man who was shot in the act of attacking a police officer, because a false account by one of the young man’s pals created racial division, began an unraveling of trust in police nation wide, ruined the police officer’s career, prompted attacks on the grand jury system, and launched a lie, “Hands Up! Don’t Shoot!,” that dominated protests in many cities for months. There are many destroyed businesses and lost lives because of the events in Ferguson last year.

Why is anyone commemorating them?

Because, in this issue, facts don’t matter. Or “Facts Don’t Matter.” This will be a regular mantra on Ethics Alarms, until they do.

Activists urged the crowd not to let Brown’s death “be in vain.”  What does that mean? Mike Brown threw his life away. He was no martyr, no hero. Can an ethical and positive movement be constructed on a false narrative and a phony hero?

“Black Lives Matter” Is Unethical, And So Are Politicians Who Pander To It

black-lives-matterThat’s the tipping point for Ethics Alarms. “Black Lives Matter” is unethical, and those who use it are unethical. And politicians who grovel to those who criticize them for not embracing it are contemptible.

The Martin O’Malley embarrassment over the weekend clinched it for me. Demonstrators interrupted the former Maryland governor, mounting a pathetic campaign against Hillary Clinton for the Democratic presidential nomination, as he was speaking at the Netroots Nation conference. When they shouted, “Black lives matter!” a rallying cry of protests that has superseded “Hands Up! Don’t Shoot!” because that one was eventually exposed as a lie,  O’Malley—the naive, racist fool!!!!— responded: “Black lives matter. White lives matter. All lives matter.”

The activists  responded by jeering him and refusing to let him speak. .Later in the day, O’Malley, “showing the firm commitment to leadership in the face of adversity that we expect in a presidential candidate,” as one wag put it on Jonathan Turley’s blog—apologized, saying…

“I meant no disrespect. That was a mistake on my part and I meant no disrespect. I did not mean to be insensitive in any way or communicate that I did not understand the tremendous passion, commitment and feeling and depth of feeling that all of us should be attaching to this issue.”

I bent over backwards to defend Smith College President Kathleen McCartney when she apologized for using the phrase “all lives matter” in December of 2014. I wrote:

If an activist says to me, “too many children go to bed hungry!” and my retort is, “Too many people go to bed hungry!”, the unspoken argument is “So stop acting like children are a special problem!” If I say, “We need peace in Syria,” and a friend’s response is “We need to end war, period!”, I view that as an effort to minimize my concerns by launching it from the realm of a specific issue into vague, generic territory.  “Black Lives Matter!” in the context of recent police episodes where African Americans died under circumstances that many believe show police callousness and excessive force against blacks is a distinct assertion that suggests that the law enforcement and justice systems do not currently function as if black lives matter as much as white lives. It is true that “All Lives Matter” includes the larger subset “black lives matter”; it is also true that it blurs the issue at hand, and dilutes the protesters’ point. It is not inappropriate for  President McCartney to apologize in this context…unless, of course, she intended a rebuttal, in which case she is indeed spineless.

I still believe that made sense in December, but “Black Lives Matter” means something very different now, after six police officers were charged with murder to quell a Baltimore mob after Freddie Gray’s death, and after President Obama decided that the merciless shooting of a  young white woman in San Francisco by an illegal immigrant wasn’t worthy of the same attention he has given other deaths when it was a black life that had been lost. The Oxon Hill High School “Art Display” Controversy

Oxon Hill (Maryland) High School allowed a display of student art to remain in the school’s rotunda for most of May. Some students and teachers said the display was “cathartic;” the Washington Post called it “an embodiment of the angst and anger” students felt “when police violence made national headlines.” “Young black males: the new endangered species,” read a placard; next to it was a cutout painted to look like a police officer with white skin reading a newspaper with obituaries of black men killed by law enforcement officers. Next to that was another silhouette painted black, depicting a black man with hands raised wearing a T-shirt with holes in it. “Blood” dripped  from the eight bullet holes, forming the stripes of an upside-down American flag.

Last week,  after a photo of the thing was posted  on Facebook and recieved criticsm there and on some conservative websites, school officials decided to remove the display. A spokeswoman for Prince George’s County Public Schools said the decision was made to protect the school and students. But those pesky students installed a new display consisting of two wooden coffins amidst flower petals, with headstones reading, “HERE LIES OUR FREEDOM OF SPEECH” and “HERE LIES OUR FREEDOM OF EXPRESSION.” They then tweeted messages with the hashtag #donttakeitdown and collected nearly 1,500 signatures on a petition demanding a statement of solidarity from the school board.

Isn’t self-righteous ignorance grand? Not only should the display have been removed, it should have never gone up in the first place, since it continues to spread a virulent and divisive lie (nobody was shot eight times with his hands up), while encouraging racial distrust and hatred. Ethics Observations On A Nashville Police Arrest Video

I encountered this video on CNN this morning:

Observations:

1. No police officers should have to work under these conditions. This requires courage and tolerance above what any professional should have to muster on a regular basis.

2. Every urban mayor, district attorney, police chief, civil rights advocate and journalist should be asked to comment on the video regarding the principles of respect, civic responsibility, and citizenship.

3. If the question is asked why crime rates are rising in several cities due to a cessation of proactive law-enforcement, this video is a nearly complete answer.

4. What prominent U.S. African American officials, leaders and celebrities are condemning this conduct by the friends of the individual being arrested, and conduct like it all over the nation? I haven’t seen or heard a single one.

5. Allowing this phenomenon to continue without addressing it directly is community malpractice, irresponsible, destructive, and almost certain to be deadly.

6. When such a situation escalates to violence, as this one easily could, who will be responsible, and who should be held responsible?

Star Wars Bar Script

Peter Mayhew, a.k.a. Chewbacca the Wookie, has released to the internet the page from his original Star Wars script that answers the crucial ethics dilemma discussed on Ethics Alarms in 2012.

As it seemed when we all first saw the film, Han Solo shot the porcupine fish-headed space-thug Greedo with a blaster before being fired upon, and I have no problem with that at all. It was self defense.

Nonetheless, a large group of activists, led by Greedo’s family’s lawyer and whipped into a frenzy by cable TV, demonstrated and protested based on a bar patron’s false report that Greedo had his hands up at the time. Luckily, the film proved this was false, though “Hands up! Don’t blast!” survived as a provocative refrain.
