Jumbo! The Substitute Teacher’s Defense

A jury convicted Sheila Kearns, a former substitute teacher in Columbus, Ohio, of four felony counts of disseminating matter harmful to juveniles. For some inexplicable reason—she reportedly told a colleague that “those kids see worse” at home— had shown the film “The ABCs of Death” during five periods of a Spanish class at East High School  in April 2013.The movie consists of 26 chapters, each representing a graphic death and representing a letter of the alphabet:  “E is for Exterminate,” “L is for Libido,” ”O is for Orgasm,” “T is for Toilet,” and so on. You know, perfect classroom fare.

Kearns earned her Jumbo for swearing in court that she had no idea what the movie—titled “The ABCs of Death,” remember—was about.  Her attorney said she never would have knowingly showed it. One of her students. however, testified that Kearns watched the 129-minute movie, which presumably would have given her a pretty good idea that it was about, uh, death. And ABC’s….

After watching the movie the jury became convinced, its foreman told reporters, that Kearns might not have been aware of the movie’s content the first time she showed it, but she would have figured it out by by the second, third, fourth and fifth showings.

Can’t slip anything by these twelve!

Ethics Observations On Mayor de Blasio’s Refusal To Apologize To His Police Officers

New York City Mayor Bill de Blasio’s relations with his own police force could not be worse, and this is not in the best interest of the citizens both the mayor and the police are duty-bound to serve. Can the rift be repaired?

This week de Blasio ruled out one avenue of peace: he said he would not apologize for his remarks following the Eric Garner grand jury decision not to bring charges against the officer who appeared to precipitate the unarmed black man’s death by using a choke-hold. The mayor said…

“You can’t apologize for your fundamental beliefs. The things that I have said were based on my beliefs, the truth as I know it. Can we do a better job communicating, and listening, and deepening an understanding of what our officers need? Yes.”

Fascinating.

I can’t think of a better example of a dilemma where the most ethical conduct is still irresponsible leadership, and thus, from the perspective of a leader’s obligations, unethical.

From an isolated perspective, de Blasio is asserting his integrity. “I could apologize and help smooth over my toxic relationship with the police, but that would require me to be insincere, and I’m not going to do that,” he is saying. He is saying that his constituents can trust him to be straight and honest, and if that means that he must pay a political price, he will pay it. This is admirable, on a human level. Praiseworthy…in a vacuum.

De Blasio, however, doesn’t have the luxury of being ethical in a vacuum. He is the mayor of a city with a lot of problems, controversies, obstacles to effective governance and people in need. The context of all of his words and actions must be his duties to address those issues, and his integrity, in this case, must be subordinate to getting the job he was elected to do done. What’s missing from the photo above that ran in the ultra-orthodox Jewish newspaper HaMevaser, or The Announcer?

No, the answer isn’t “any Americans,” though that would be correct too.

Why, it’s all the women! German Chancellor Angela Merkel, Danish PM Helle Thorning-Schmidt, Paris Mayor Ann Hidalgo and the High Representative of the European Union for Foreign Affairs and Security Policy Federica Mogherini were all photoshopped out of the Israeli newspaper.

When you have to have to alter the facts to fit your ideology and world view, this is supposed to trigger an ethics alarm that alerts you to the unpleasant truth that the problem is with you and your biases, conclusions and beliefs, not the facts.

Making people disappear from photos is the most grotesque of such self-indicting strategies, but there are many less spectacular but equally unethical examples, and right at home, right now.  Can you name some?

I’ll get you started with my personal “favorite”:

And to answer your question: I’ll stop harping on this one when I stop hearing Ferguson and Mike Brown routinely mentioned as examples of excessive police force and racism.

2014 Conflicts of Interest of the Year

  • Conflicted Elected Official: Philadelphia State Senator LeAnna Washington. This is always an entertaining category. Washington was convicted of using her tax-payer financed staff to organize a yearly campaign fundraiser around her birthday party. When one staffer complained that this was illegal, she reportedly replied, according to his grand jury testimony:

“I am the fucking senator, I do what the fuck I want, and ain’t nobody going to change me. I have been doing it like this for 17 years. So stop trying to change me.”

  • Conflicted Journalist: CNN sent Jay Carney, fresh off his assignment as President Obama’s official spokesman, defender and spinmeister, to cover his ex-boss’s speech.
  • Conflicted  “Non-partisan” Watchdog: CREW. The Center For Responsibility and Ethics in Washington and its chief, Melanie Sloan, finally came clean (after falsely claiming non-profit status as a non-partisan organization for years) by making David Brock, head of the openly partisan, foaming-at-the-mouth anti-Republican media watchdog Media Matters its Chairman of the Board, essentially merging the two groups.
  • Appearance of Impropriety Award: Rep. Steve Scalise (R-La), Republican Whip. It is not certain yet whether Scalise knowingly spoke to a group of white supremacists in 20o2, inadvertently spoke to the group, or just spoke to another group meeting in the same venue before the David Duke-affiliated group of racists started comparing sheets. It isn’t even clear that Scalise knows, but everyone should agree that it looks awful no matter how you categorize it, making the fiasco a classic appearance of impropriety situation. If the Republicans were smart, they would dump him.

Wisconsin Democratic gubernatorial candidate Mary Burke, whose campaign materials were largely plagiarized from the materials other candidates.

Ethically Clueless Voters of the Year

New York’s 11th Congressional District, which contains Staten Island and parts of Brooklyn. These alert and ethical citizens sent back to Washington thuggish and crooked Rep. Michael Grimm (R), then facing a 20-count indictment by federal authorities for fraud, federal tax evasion, and perjury, having earlier distinguished himself by threatening to kill a reporter and being recorded doing so.

Wendy Davis, Democratic candidate for Texas Governor, offered an ad attacking her wheelchair- bound opponent that 1) appealed to bias against the disabled 2) misrepresented the duties of a state attorney general 3) misrepresented the facts of the cases the ad referred to and  4)  deceived the public regarding the ethical duties of lawyers, which Davis, a lawyer, presumably understands. Long, LONG-time commenter Jeff H., himself a cartoonist, weighs in in the controversy discussed in the previous post, regarding efforts to exonerate radical Islam from any responsibility for the terrorist attack against a French satire publication.

In answer to his final question, I would respond: “It’s true, that’s all.” And yes, I think it’s clear that Muslims are more likely to engage in violent terrorism than other faiths, at least at this time.

Here are my thoughts on it: if you think it would avail you any to talk to one of the men who perpetrated this act and say, “It’s OK! You’re not really Muslim!”, then you can go ahead and say they’re not Muslims.

If you ARE a Muslim who notices the hypocrisy in someone claiming to be a Muslim carrying out an act of terror in defiance of parts of the Koran, I wouldn’t have a problem with them saying he’s not a Muslim.

I saw someone call them “pretend Muslims,” and I sort of like that term, but that sort of implies that they don’t believe in the faith itself, and that’s not really for anyone to say. But if we’re calling them pretend Muslims because they don’t adhere to the parts of the Koran that would mitigate violence, they could call everyone else pretend Muslims for not participating in violence. Or, those who have intercourse before they’re married and trim the edges of their beards could be called “pretend Christians.” Let’s see how far that goes.

I really hate to hand it right to the jerks who will use this against the vast majority of peace-loving Muslims, but trying to deny it just kicks the can down the street. Pretending not only that it has nothing to do with it, but that it doesn’t even exist, ends up having the equal and opposite reaction on the other side that insists all Muslims secretly crave violent revolution.

What is especially bothersome is when people are like, “well, they’re Muslims, what do you expect?” I hate to cry ‘racist,’ but… that is totally racist. It is racist to assume that Muslims are not expected to control their anger, or that they cannot help themselves because of their ethnic background. This is why I was furious when I heard people hoping the perpetrators of the Boston bombing would turn out to be white.

Congratulations, you wretched tin-eared pinheads. You got your wish. The Tsarnaevs were white. They were Caucasian MUSLIMS from Chechnya. I hope that makes some kind of difference to you.

But just because jerks will use this to blame all Muslims (which is deeply regrettable), that doesn’t mean the response is to pretend Muslims are incapable of violence. That’s just carrying water for the next person of any belief who wants to do something unspeakable to their next critic.

What I want to see is a statistical analysis of acts of violence like this, the alleged beliefs of the perpetrator, and see if any group of beliefs makes someone more likely to do something like this. The goal is not to attempt to smother any belief except the belief that your opinion gives you the right to hurt someone else.

Yes, those who perpetrated this attack identified themselves as Muslim. Now the question is: “So what?”

Oddly, nobody is refusing to call Lassana Bathily a Muslim, perhaps because he is one, but also because he’s a good Muslim, as most are.

He is the young clerk at a Paris Kosher grocery store who saved several people by hiding them in a walk-in freezer when a gunman began shooting up the store on Yesterday. Actually, I don’t see why his religion is relevant in the least, but that is leading most news reports front and center.

The terrorists who mounted a bloody attack on the satiric publication Charlie Hebdo, however, and who did so while spouting Islamic slogans as planned revenge on cartoonists for engaging in blasphemy against Mohammed, should not be called Muslims. Why? Because they’re not good, you see. Since they’re not good, ignorant and hateful bigots in the United States will attribute their characteristics to all Muslims, and use this as an excuse to harass discriminate and persecute them.

Howard Dean, who is the left’s answer to Sarah Palin: you interview him knowing he will say something that drives conservatives nuts, immediately clarified the rules:

“You know, this is a chronic problem. I stopped calling these people Muslim terrorists. They’re about as Muslim as I am. I mean, they have no respect for anybody else’s life, that’s not what the Koran says. …But I do not think we should accord them any particular religious respect, because I don’t think, whatever they’re claiming their motivation is, is clearly a twisted, cultish mind.”

Janay Palmer Rice, beloved punching bag of NFL star Ray Rice, who was caught on camera smooching with her man shortly after being cold-cocked by him in a hotel elevator, married him, and has repeatedly defended her husband, prompting confused female pundits to defend her. She is not only the embodiment of Rationalization #42. The Hillary Inoculation, or “If he/she doesn’t care, why should anyone else?”, she is also a good bet to get some young women killed by giving them a role model who stands for standing by your abusive man with the hard right hook.

Double Standard Of The Year

In a year of double standards, the treatment of soccer star (and accused child abuser) Hope Solo by her sport, feminists, the media and the public takes the prize. The standard, as I understand it, is that big, strong female athletes can beat up smaller, weaker family members with impunity, and it’s no big deal, but when a male athlete does the same, he is scum. Got it.

Victoria Nuland, Assistant Secretary of State for European and Eurasian Affairs and the top American diplomat in Europe, was caught saying in a viral Youtube video saying “Fuck the EU.”  Now that’s diplomatic. Of course, she wasn’t fired, because she works for the Obama Administration

First Lady Michelle Obama, who helped her husband make the U.S. look weak and ineffectual (he needs no help), by engaging in this ridiculous effort at hashtag diplomacy. Those kidnapped girls were never found, and Boko Haram, the Nigerian terrorist group that took them, I learned today, just killed a reported 2000 more victims. Time for another sad picture, Michelle!

Most Unethical Sports League

The NFL, last year’s winner, was even more unethical this year, with the Ray Rice and Adrian Peterson fiascos, Commissioner Roger Goodell showing no innate instinct for right and wrong and both the league and its teams making up rules and policies according to talk show calls, polls and wet fingers in the air. Meanwhile, it’s still making billions paying young men to lobotomize themselves. What a great sport.

Sports Cheat of the Year

Alex Rodriguez, suspended Yankee star, had denied, denied, denied, threatened to sue Major League Baseball and the union, and insisted that he had not, as an investigation had determined, used performance enhancing drugs supplied by Biogenesis. Then, just as his season-long suspension was lifted, it was revealed that A-Rod had, under oath, admitted using steroids from 2010 to 2012.

She didn’t do anything unethical; she just advocates ethics rules that would eliminate the core of legal ethics, proving that she doesn’t understand her own profession.

Wade McCree, the handsome devil pictured above (he circulated this selfie), who, presiding over a felony child-support case, conducted a secret sexual relationship with the woman seeking support from the defendant. This was just the latest of his embarrassments.  Runner up: Texas District Judge Jeanine Howard, who handed down a stunningly lenient sentence of probation and 250 hours of community service at a rape crisis center for a man who confessed raping a 14-year old girl at her school.

CNN’s Carol Costello. She was biased, smug and incompetent all year long, but reached her nadir when she gleefully played a recording of Bristol Palin explaining to police how she had been assaulted, saying to her viewers, “You can thank me later.” She refused to apologize on the air, or to Palin. The NYPD Turns Its Back On De Blasio: What’s Going On Here?

The rift between New York Mayor de Blasio and his city’s police department  is more than an internal spat. It has the potential to divide and harm the city and citizens, not to mention crashing the Mayor’s already self-jeopardized political career early in his term. Both sides if this dispute committed hostile acts that the other considers grievously disrespectful. Neither combatant appears ready to apologize.

De Blasio crossed what many of his department’s officers consider an uncrossable line when he suggested, in the immediate wake of the grand jury’s decision not to indict in the Eric Garner case, that his own bi-racial son was at risk of harm should he be apprehended by the NYPD. As I have written before, this was not, as the spinners would have it, just a case of a mayor being candid about genuine problem in community relations. This was a tacit endorsement of the “hands up” protests and their contention that Garner, Mike Brown and others were the victims of police racism, that police are killing, likely to kill, want to kill, black kids. It doesn’t matter that de Blasio may not have intended that implication: under the circumstances and in the context of events, this is what police officers interpreted his remarks to mean. He was siding against them. He was suggesting that the grand jury was wrong not to indict. He was suggesting not that some NYPD officers were racially biased, but that black children like his son “may not be [Translation: “are not“] safe from the very people they want to have faith in as their protectors.”

The police have responded with multiple demonstrations of anger and contempt for their boss. Most recently, there were boos and jeers when De Blasio spoke at a police graduation ceremony this week. Over a hundred officers symbolically turned their backs when the mayor spoke at the funeral of Officer Rafael Ramos, who was assassinated by a man who suggested that he was seeking vengeance for the deaths of Garner and Brown. That had followed the theme of an airplane-towed banner over the city that read,“Our backs have turned to you,”which in turn was inspired by the spontaneous gesture by officers present when de Blasio visited the hospital where the bodies of Officer Ramos and his partner lay.

The New York Times, which has been guilty of bolstering the “hands up” lie by carelessly linking the deaths of Brown and Garner as well as Trayvon Martin, none of which can be fairly blamed on racism based on available evidence, has come down squarely against the police, writing in an editorial: Continue reading →

The “Non-Violent Protest” Lie

The leaders and participants in the protests related to incidents of excessive police force and violence—real, imagined, manufactured or equivocal—are creating an environment of racial distrust, fear and hate that cannot avoid  resulting in violence. Yet astoundingly, they not only deny the natural consequences of their words and rhetoric but feign indignation (and racism, of course) when the effort, long underway with the assistance of such accomplices as Eric Holder, Barack Obama and Bill De Blasio, is properly condemned as the dangerous and reckless attack on society that it is.

I am not sure which amazes me more: that demagogues like Al Sharpton would have the audacity to proclaim that his organized campaign of hate against police, accusing them of being both racist executioners and the embodiment of a racist justice system, or the caliber of pundits who have rushed to Sharpton’s defense. How can this be? African-Americans are told, for years now, that whites with guns are hunting them; that police are determined to kill them, that the justice system is rigged to let the carnage continue. The carriers of this message includes members of Congress, celebrities, civil rights activists, the Attorney General and the President of the United States. False accounts that support this gross characterization of  disparate incidents, each with unique circumstances, are turned into rallying cries, such as “Hands up! Don’t Shoot!”  The left-biased media openly endorses the narrative, which says that black Americans are being hunted coast-to-coastby an armed force, determined to kill their children.

Just A Reminder: I Warned About This From The Start, Almost Three Years Ago

The Ferguson Ethics Train Wreck, which encompasses the shooting of two police officers in New York City, is just the second section of the Trayvon Martin-George Zimmerman Ethics Train Wreck. The coordinated effort to represent the American justice system as hostile to blacks, and white society as determined to harm them, was launched in Florida in early 2012, nearly three years ago.  It might have failed then, as it deserved to since there was no genuine racial element in the actual Martin-Zimmerman episode, had not the President of the United States used his bully pulpit, credibility with black Americans and the power and influence of his office to declare the local incident as emblematic of societal hostility to African-Americans, and Obama personally. This, as I wrote earlier this week, lit the fuse that exploded into racial violence against police this past week.

I saw it then. I have seldom seen anything more clearly.  So I wrote:

What does {Obama] think he’s doing? Teens, children and adults are murdered every day, many of them right where Obama lives, in Washington, D.C. Aren’t all of the violent deaths “tragedies”? Why is this one, and only this one, worthy of specific presidential attention? Is it because black leaders called for the President to overstep his proper role? Who cares what activists call on the President to do—certainly he shouldn’t. Does this now justify their calls for retribution and violence, or validate high school students who are staging walk-outs to protest law enforcement officials investigating a case before they make any arrest? (Are high school students now empowered to dictate law enforcement policy? Suspend every single one of them.)

What earthly difference does it make what Trayvon looked like, who his death makes the President think about, or whether he looked like the son Obama never had? So what? What if he looked like my son? Not good enough? When a white, Hispanic or Asian kid in a hoodie is shot by some gun-wielding hysteric, can those parents also count on a statement of concern by Obama? What if they are just run down by a drunk driver, or killed by being left in an over-heated car? Not tragic enough? Doesn’t strike the same chord of of “seriousness”? Or will these tragic deaths not be viewed as sufficiently important to the President’s “base” in an election year? Do you think these questions are unfair? Who laid the groundwork for them?

Misusing his office and prestige in such matters simultaneously diminishes the presidency and warps its function. The position has always included the role of Mourner-in-Chief, at times of genuine national tragedies, such as the Twin Tower bombings, the Challenger disaster, and Pearl Harbor. Cheapening this solemn function by intervening in local crimes and contentious race-charged controversies accomplishes nothing positive: it is divisive, intrusive, and dangerous.

Got that? Dangerous. I chose that word deliberately. March 12, 2012.

Reading the comments again now is fascinating: readers conservative and liberal denounced my criticism as unfair, after the usual “Bush did it too” spin from the reflex Obama defenders.
