My Favorite Lawyer Discipline Story of the Year

I thought nothing could make me smile in 2010 like the lawyer who told her client she was possessed. This isn’t as spectacular, but it sure is welcome.

The Illinois Administrator has filed a complaint alleging that an attorney falsely certified that he had completed online Continuing Legal Education ( CLE) courses when he actually had his secretary watch the seminars and respond to the periodic prompts required that are supposed to prove that the lawyer is paying attention.

Ethics Call To Arms: Fight the “Fuck You!” Culture

“Every action done in company ought to be with some sign of respect to those that are present.”

This was the very first edict in the list of civility rules memorized by George Washington as a child, rules that shaped his character and significantly influenced not only his life and career but the fate of America. Like most of Washington’s 11o rules, the first has universal and timeless validity, pointing all of us and our culture toward a society based on mutual respect, caring, empathy, and fairness.

Recently, however, there has been a powerful cultural movement away from George’s rules and the culture of civility that they represent. Rudeness has always been with us, of course, and public decorum has been in steady decline since the Beatniks of the Fifties, to the point where it is unremarkable to see church-goers in flip-flops and airplane passengers in tank-tops. Something else is going on, however. Like the colored dots of paint in a George Seurat painting, isolated incidents and clues have begun to converge into a picture, and it is not one of a pleasant day in the park. I believe we are seeing a dangerous shift away from civility as a cultural value, which means that we are seeing a cultural rejection of ethics. Celebrity Ethics: Rihanna’s “Fuck You” Necklace

Pop star Rihanna is getting media flack for being photographed with a group of young children while wearing a necklace with a design that spells out “Fuck You.” “We know she probably wasn’t anticipating being bombarded by a bunch kids and shit, but damn, she could’ve tucked that joint in before agreeing to take photos with the little crumbsnatchers,” opines the classy gossip site Bossip, for example. Joy and Whoopi’s Unethical Bully Tactic

To have seen it live, you have to watch The View, which is not good for your brain or digestion, and be willing to watch Bill O’Reilly, which requires a tolerance for arrogant certitude that is only present in certain genetically gifted individuals. But on the video clip, you can see O’Reilly explaining why about 70% of Americans think that the Muslim center being planned for construction near the site of the September 11 terrorist is “inappropriate,”  saying “Muslims killed us on 9/11.” The View’s co-host Whoopi Goldberg took violent offense at the statement, exclaiming, “No! Not, oh, my god. That is such bullshit!” [Note: It is not “bullshit.” Muslims indeed performed the attack, in the name of Muhammad no less. ] O’Reilly, understandably confused, said, “Muslims didn’t kill us on 9/11? Is “Have a Nice Day, You Piece of Shit!” An Unethical Goodbye?

An ethics complaint has been filed against an Illinois attorney who, as he left a courtroom, bid farewell to his opposing party with the words,  “Have a nice day, you piece of shit!” The alleged legal ethics violations are Illinois Rule 4.4, which prohibits using means that have” no substantial purpose other than to embarrass, humiliate or burden a third person,” and Rule 8.4, which among its provisions forbids “conduct prejudicial to the administration of justice.”

It seems unlikely that the Illinois Bar will find these Rules to have been violated to the extent justifying discipline. Make no mistake: the statement is unethical. Continue reading

Police Brutality: Direct TV Strikes Again!

In a previous post that apparently established the proprietor of Ethics Alarms as a “fuddy-duddy,” I discussed the disturbing series of stereotype-bashing Direct TV commercials that sets out to show how amusing irrational hatred and gratuitously cruel behavior can be. The commercials seem to be escalating, and why not? Ethics Alarms isn’t their only, or most prominent, critic, and ethics be damned—the ads are being watched and talked about! Victory! And besides, they’re aimed at football fans, a demographic that is rather less likely to find the encouragement of random violence upsetting in any way.

The latest “hurt your rival” drama from Direct TV shows two police casually tasering a man who “cheats” in the Fantasy Football league by using his Direct TV NFL  feed to get an upper hand on the competition. (He is seen twitching on the floor. LOL!). As a commenter on the previous post has pointed out, police nationwide are fighting a perception and public relations battle over alleged incidents of excessive force, many involving tasers. This commercial encourages distrust of the police, and reinforces a false and unfair perception that misuse of their power and authority is the norm. Is it worth the laughs, if indeed there are any?

I think the standards for comedians and commercials should be different, with comics having the broadest possible discretion to do or say whatever they feel is necessary to promote mirth from their audiences. TV commercials are more than entertainment: the audiences don’t choose the content of ads or know when they will see them, and their visibility and repetition gives the commercials enough influence over cultural attitudes to warrant a higher level of responsibility on the part of the company and the ad agency.

Mainstream media ads both reflect public attitudes and mold them. The Direct TV ads either show we have a callous society, or are helping to make us one.

Rev. Jones and the “Everybody Draw Muhammad Day” Supporters: Explain the Difference, Please

Now that a mad Florida Pastor, Terry Jones, has taken the twisted logic of that addled demonstration to the next step, planing a Koran-burning to show “we will no longer be controlled and dominated by their fears and threats,” I’d like to hear how those who set out to stick a finger in the eye of Islam by drawing its prophet can justify condemning Jones, when he plans to stick in his whole thumb. Manny, Kanye, and the Farce of Self-Serving Apologies

Two habitual bad actors in the world of entertainment apologized this week, for similar reasons and with equivalent credibility.

First, baseball slugger Manny Ramirez issued an apology to his former team once removed, The Boston Red Sox, for forcing the team to trade him in the middle of the 2008 pennant race because Manny was faking injuries, refusing to hustle during game, assaulting employees, and poisoning team morale and discipline. “I think everything was my fault,” Ramirez said. “You’ve got to be a real man to realize when you do wrong. Hey, it was my fault, right? I’m already past that stage. I’m happy. I’m in a new team,” Manny told reporters. He was with a new team, all right: the Dodgers, his previous team, let him go to the Chicago White Sox for nothing because, well, he was faking injuries, dogging it in the field…same act, different stage. So what was the apology about?

Manny, or more likely his agent, realizes this most recent break with a team as the result of his habitually juvenile and unprofessional attitude might cost him a lot of money at contract time—Ramirez is a free agent after all. So contrition was called for—two full years after he laughed off any suggestions that he was at fault for the Boston debacle, and proved that he had been loafing on the field by playing in L.A. like he was on fire. This isn’t an apology; it’s damage control, and thus is a deceitful and dishonest apology that has nothing whatsoever to do with genuine regret. The big tip-off is that Ramirez felt he had to explain why his apology was so admirable. Yes, Manny, you have to be a real man to admit you’re wrong; a real jerk to fake an apology to fool a future employer into believing that you’ve turned over a new leaf, and real fool to believe anyone will fall for it.

Direct TV’s Commercials For Hateful Jerks: NFL Sunday Ticket

The ad campaign for Direct TV’s NFL Sunday Ticket raises the question: if it is despicable, unethical and wrong to do something hateful to another individual because of his race,religion or national origin, can it be cute, funny or socially acceptable to take the same action against someone because of his pro football loyalties?

The Direct TV campaign, depicts the fans of various NFL teams expressing their anger and dismay over the fact that the satellite television service allows neighbors who have recently moved to their area can continue to root for their home town football teams by subscribing to NFL Sunday Ticket. Headline Deceit, the N-Word, and Dr. Laura

Curse you, Gawker, for making me defend Laura Schlesinger!

Radio talk show host/advisor/scold Laura Schlesinger, a.k.a. “Dr. Laura,” has a target on her back for liberal sharpshooters, thanks to her persistent demonization of gays and her advocacy of female subjugation in marriage. Outside of those two areas (“And aside from that, Mrs. Lincoln, how did you enjoy the play?”), Schlesinger’s ethical instincts are usually sound, and her advice to troubled callers is usually good. But she has a lot of enemies, and proof of that is today’s eye-catching headline on the gossip website Gawker, which can fairly be described as “ethics-free.”
