1. The photo was beyond irresponsible and stupid, and looks more so in the wake of the recent school shooting. It’s creepy, Bonny and Clyde-ish, and the caption, “Homecoming 2014,” could be reasonably seen as a threat.

2. The fact that the guns were Airsoft replicas is irrelevant. My son left one of his Airsoft rifles in a car outside our house, and a virtual police S.W.A.T. team showed up. These toys are close enough to the real thing to be threatening.

3. Generally, punishing students for what they say on Facebook exceeds a school’s authority, but not in a case like this.

4. The punishment is wildly excessive. No threat was intended, no weapons were brought on school grounds. The kids broke no laws. They just used terrible judgment.

5. They needed to get a lecture, an assignment, and maybe a suspension of a single day. Hitting them with ten days and possible expulsion is just typical anti-gun bias and hysteria.

Privacy, Facebook, And School Abuse of Power

Riley StrattonIt can a bit late to the party, in my view, but the ACLU just delivered a crucial blow to Big Brotherism in the schools. Addressing an issue that Ethics Alarms flagged in 2011, Minnewaska Area Schools (in Minnesota) agreed to pay $70,000 in damages to Riley Stratton, a 15-year-old high school student,

for violating her rights. It also agreed, as part of the federal court settlement, to rewrite its policies to limit how far a school can intrude on the privacy of students by examining e-mails and social media accounts created off school grounds.

In 2012, the ACLU Minnesota Chapter filed a lawsuit against the Minnewaska School District after it suspended Stratton for a Facebook post, written and published outside of school, in her home, in which she expressed hatred for a school hall monitor who she said was “mean.”  After the suspension, Stratton used Facebook to inquire which of her “friends” had blown a whistle on her. School officials brought the young teen into a room with a local sheriff and forced her to surrender her Facebook password. Officials used it to searched her page on the spot; her parents were not consulted.

“A lot of schools, like the folks at Minnewaska, think that just because it’s easier to know what kids are saying off campus through social media somehow means the rules have changed, and you can punish them for what they say off campus,” Minnesota ACLU attorney Wallace Hilke said. “They punished her for doing exactly what kids have done for 100 years — complaining to her friends about teachers and administrators. She wasn’t spreading lies or inciting them to engage in bad behavior, she was just expressing her personal feelings.”

Not that it was any of the school’s business if she was spreading lies or inciting others to bad behavior. This phenomenon, where schools decide that they have a right to punish students for non-school activity, words and thoughts  was discussed on Ethics Alarms, and condemned as unethical, here, here, here, and here, and more recently here.

Minnewaska Superintendent Greg Schmidt protested (the school settled without admitting any wrongdoing) that the school only wants to make sure kids understand that actions outside of school can be “detrimental.” “The school’s intent wasn’t to be mean or bully this student, but to really remedy someone getting off track a little,” Schmidt said. Not your job, you officious, censorious, child abuser. This is the sole realm of parental authority. I have seen enough wretched judgement from your breed, Mr. Schmidt—like (I’m picking examples randomly) here, here, here, here and here—to convince me and anyone with a cerebral cortex that school administrators lack the training, wisdom and judgment to know what “going of track a little” is for a 13-year old.

Stay out of my kids’ life and my family’s life. You have enough trouble running schools properly…work on that.

Second KABOOM! of the Day: The Worst Example of “No-Tolerance” Ever

Sometimes it seems as if there is a team of fiction writers concocting absurd school no-tolerance scenarios just to see what idiocy the news media will believe. Unfortunately, the topic defies parody, and now, just as I cleaned my office up after the cranial detonation earlier today, there is this:

At Bayside Middle School, in Virginia Beach,* Virginia, sixth grader Adrionna Harris saw a classmate cutting his arm with a razor blade. She took the blade from the student, threw it away and persuaded him that what he was doing dangerous and wrong. Then she told the school’s administration about the incident. Because saving the boy from serious harm required her handling a dangerous weapon on school grounds, Adrionna received  a 10 day suspension with recommendation for expulsion.

KABOOM!

In an example of the news media’s  remarkable facility for misunderstanding just about anything, a local TV station reporting on this story asked, “Was the school’s zero tolerance policy taken too far?” Yes, for all you idiots and teachers out there, was this the right thing to do?  What a stupid, stupid, question. Of course it wasn’t. Of course the school’s zero tolerance policy was taken too far. Any no-tolerance policy is by definition “taken too far” because it eliminates common sense and discretion (assuming that school personnel are capable of either) and leads to fiascos like this. That is not the question raised by the episode. Note to our sad and incompetent journalists: if you can’t do better than that, just report the news and shut up. You aren’t helping.

Vote For The 2013 Curmie, Designating The Worst Of Misconduct In The Name Of Education

Over at Rick Jones’ Curmudgeon Central, the final nominees for his not-so-coveted 2013 Curmie Award are up, and the winner will be determined by the vote of Rick’s readers. The Curmies memorialize the worst in U.S. conduct by education professionals, and a revoltingly diverse group of miscreants he has assembled. I urge you all to drop by, read Rick’s commentary (and about some of the awful incidents that didn’t make the cut), and vote.

Only three of Rick’s final eight were covered on Ethics Alarms, and while I am confident that the ultimate winner is among them, I am now second guessing my editorial judgment. Rick’s blog is more education-centric than Ethics Alarms ( his work has filled the gap created when the excellent “No Tolerance” blog went down), but I’m trying to recall why I passed on the other six, particularly Alex Evans and his imaginary grenade, and the student suspended for disarming another student. I think I was getting so sick of post-Sandy Hook hysteria when the invisible grenade story came out that I just couldn’t write about another one just then. The other one…well, as Rick notes, there were some complicating factors, but I should have covered it. Luckily Rick Jones was on the case, and did his usual excellent job.

Here, with Rick’s descriptions and links to his commentary, are the nominees:

Principal Greer Phillips of PS 79 (the Horan School) in East Harlem for conducting a completely unannounced (to teachers, to the police…) lockdown drill less than a week after the horrors at Sandy Hook Elementary. In aggravation: outrageous timing and an incompetently run drill complete with contradictory instructions, but also the makeup of the student body (a high percentage of students with emotional or cognitive problems). In mitigation: I can’t think of a thing. [Ethics Alarms commentary here.]

Principal Valerie Lara-Black of Mary Blair Elementary School in Loveland, Colorado for suspending 2nd-grader Alex Evans for throwing an imaginary grenade into an equally imaginary box containing “something evil.” In aggravation: this is stupid behavior even if there’s something tangible. In mitigation: there’s probably some idiotic zero tolerance policy that purports to justify if not demand these flights of inanity.

Principal Tracey Perkins of Cypress Lake (FL) High School for suspending a 16-year-old student because he disarmed another student, a football player who was threatening a teammate with a loaded gun. You see, he was “involved in an incident in which a weapon was present.” In aggravation: apart from the sheer idiocy the charges, they were changed after the school started being (quite rightly) embarrassed by the publicity. In mitigation: it is possible that the boy was indeed uncooperative with the ensuing investigation.

Principal Carla Scuzzarella of North Andover (MA) High School for stripping Erin Cox from her volleyball team captaincy and suspending her for five games because she went by a party where there was alcohol long enough to drive a drunken friend home. In aggravation: the police statement makes it clear that Ms. Cox had not been drinking, and the policy manual makes a specific point about the folly of guilt by association. In mitigation: there are reports that she was at the party longer than it would have taken just to collect her friend.

Officials at Dietrich (ID) High School for reporting science teacher Tim McDaniel to the school board and the state professional standards commission, allegedly for using the word “vagina.” Yes, in a biology class. In aggravation: Mr. McDaniel seems to be being penalized for the precise reason that he was doing his job. In mitigation: it is unclear to what extent the school per se was responsible for the brouhaha, although they clearly did little to prevent it.

Batavia (IL) High School and their equally incompetent school board for punishing social studies teacher John Dryden. His crime? Reminding his students of their 5th amendment rights while distributing a survey that could indeed have led to self-incrimination. In aggravation: the survey, with students’ name on it, was a clear invasion of student privacy, motivated by the usual nannyish hogwash. In mitigation: Dryden did react without checking with school officials about the intents of the survey. [Ethics Alarms commentary here.]

The unnamed teacher at Boles Junior High in Arlington, Texas for pouring pencil shavings into the mouth of 8th-grader Marquis Jay, and to the authorities who cravenly gave her a slap on the wrist. In aggravation: you need aggravation??? In mitigation: the boy deserved some punishment—he was at best inattentive—and it seems to have been an unpremeditated and isolated incident. Principal John Hynes of Grace Brethren High School in Simi Valley, California for the completely unauthorized action of changing the grades of at least one student (possibly several, including his own daughter), and the spineless board who allowed him get by with little punishment. In aggravation: it’s a short step from what has been admitted to and what has been alleged, which would be an outrageous abuse of power. In mitigation: with the exception of the one case, the allegations come almost exclusively from a now-former teacher. This may not be the most objective of sources.

My parents once gave me a tie clip with a tiny derringer on it, which I wore to school frequently. Occasionally, I loaded it…you see, the gun took a miniscule cap, and when you pulled the trigger, the report was shockingly loud. Had this been the kind of itsy-bitsy gun that 12-year-old Joseph Lyssikatos had on his key chain (his gun was slightly larger than a quarter; mine was slightly smaller than a nickel), then his school might have had a valid reason to object. But it wasn’t. His gun was a decoration only, but it didn’t stop the school from suspending him for three days.

I’ve been pretty dense about these cases, I must admit. I used to think it was just no-tolerance idiocy, merged with post-Sandy Hook paranoia, that was behind all of the silly news stories. It finally dawned on me that it is far more sinister than that: this is a deliberate and relentless process of state indoctrination. The schools, teachers and administrators are determined to make  future generations of Americans just as fearful and negatively disposed toward guns, and thus toward self-sufficiency and the Second Amendment, while pushing them to embrace complete dependence on a government that cannot be depended upon, and trust in a government that has proven progressively more untrustworthy. Shocking Report: “Zero Tolerance” Policies Are Stupid and Destructive. Who Knew?

If you wanted proof of the utter stupidity and recklessness of no-tolerance policies in the schools, your search is over.

A study of the effects of  ‘Zero Tolerance’ programs in Texas public schools by the Council of State Government’s Justice Center reveals that:

  • Six out of ten Texas high school students have been suspended for expelled or suspended from class at least once over the past six years.
  •  15 % of students were removed from the classroom eleven or more times for disciplinary reasons.
  •  83% of African-American students in Texas have been expelled at least once by the time they graduate
  •  African American students and those with educational disabilities experience a disproportionately higher rate of removal from the classroom for disciplinary reasons. Continue reading

Comment of the day: “It Has Come To This”

JC comments in response to “It Has Come to This,” the recent  post about a school suspending a student for the non-bullying, non-threatening, non-defamatory content she wrote to friends on her personal Facebook page in the privacy of her own home. JC apologetically calls it a rant; I don’t think it is. He is providing useful context for the school’s abuse of its power, and illuminates how we got to this unfortunate place, where parents abdicate to the schools, and the schools open the door for government intrusion into our homes and families.

“…Do schools have a legitimate concern? After Columbine, Red Lake, etc. I can understand why schools would be concerned about online postings discussing murder. Often the shooting is mentioned before hand in an online post. How to prevent this school shootings? School officials think that paying attention to students online activities (whether at school or at home) is the answer. There is a world of difference between the student saying I wish teacher X was dead and saying I am going to bring three guns to school and here is the plan on how I am going to carry out my attack. School officials seem to view that difference as a fine line that they would rather be on the safe side of.

It Has Come to This

…Well, your kids, anyway. But you’re next.

Rundlett Middle School has suspended  a 13-year-old Concord, New Hampshire girl for posting on her Facebook page that she wished Osama bin Laden had killed her math teacher.  Many of the stories published about the incident close with the statement,  “School officials say they can’t comment on the case because of privacy concerns.” While I suppose I should be relieved that they are still concerned about some privacy issues,  their respect for privacy generally leaves a lot to be desired.  So does their respect for basic constitutional rights…but they aren’t the only ones.

The post was stupid, and so what? The teacher was not placed in any jeopardy (Osama is dead, no matter what the school might have heard); no student was bullied (not that this would justify the long arm of the government reaching into the child’s bedroom either); nobody was defamed.    Kimberly Dellisola, the girl’s mother, has told the press the punishment was “too harsh.” Would somebody please tell Kimberly that the school has no business punishing her child at all? That’s Kimberly’s job, or at least was, until schools decided to take over policing what children do, write and say in their own homes. Continue reading

The YouTube video of the tormented 16-year-old Australian student who provides a surprise ending to a 12-year-old bully’s fun at his expense by suddenly slamming the younger boy to the ground—breaking the bully’s ankle in the process— has set off an international debate that could help clarify some important ethical dilemmas regarding bullying, or muddle them further.

 

The video shows a heavy teen, one who classmates say has been bullied by other children for years, enduring repeated punches by a smaller student as his humiliation is being videoed for posterity.
