Morning Ethics Warm-Up, 12/2/17: Flying Morons, A Fake News Crash, Death By Bias, And Me

1 Moron on board. Passengers can create personal wi-fi networks o and name them what they want while flying on some airlines, like Turkish Airlines.One passenger on a flight from Nairobi to Istanbul named his wi-fi network “bomb on board.”

Brilliant. Passengers could see that the network was in operation on the plane when they used their own devices, and became, ah, upset. In a statement, Turkish Airlines said the flight made an emergency landing at the Khartoum airport in Sudan, but the flight was safely resumed after security inspections on all passengers and the aircraft.

2. Terry McAuliffe for President! A 220-page report from Timothy Heaphy, a former U.S. attorney, was commissioned by the city council to find out what  happened in Charlottesville when a white nationalist group opposing the removal of a Robert. E. Lee statue was opposed by a group including violent antifa thugs. It was released yesterday, and USA Today reports that it concluded…

“This represents a failure of one of government’s core functions — the protection of fundamental rights. Law enforcement also failed to maintain order and protect citizens from harm, injury and death.”

Among the report’s other findings:

• Charlottesville police didn’t ensure separation between counter-protesters and so-called alt-right protesters upset with the city council’s decision to remove the Robert E. Lee statue from Emancipation Park.

• Officers weren’t stationed along routes to the park, but instead remained behind barricades in relatively empty zones.

• City police didn’t adequately coordinate with Virginia State Police, and authorities were unable to communicate via radio.

• State police didn’t share a formal planning document with city police, “a crucial failure.”

• Officers were inadequately equipped to respond to the clashes between the two groups, and tactical gear was not accessible to officers.

The handling of this episode by city and state officials was a warning about how tenuous support is for core American rights and values, though the news media didn’t cover it that way. Ethics Alarms did. Here is what I wrote at the time about the Governor of Virginia, now being prominently mentions as a possible Democratic Presidential nominee…after all, he is long-time Clinton loyalist, so why not?

[We] have Virginia’s governor Terry McAuliffe, who used the power and influence of his office to declare that people holding views he does not approve of are not welcome in the Old Dominion. In the midst of some patriotic grandstanding, he said…

“You are not wanted in this great commonwealth. Shame on you….There is no place for you here. There is no place for you in America.”

This is leftist fascism, by definition. Who is Terry McAuliffe, or Virginia, or anyone, to say who can or should have a “place” in the United States of America? How is this statement applied to white nationalists any different legally or ethically from applying it to Muslims, or lesbians, or abortion advocates, or Catholics, Jews or libertarians?

It isn’t. The entire point of the Bill of Rights is that the government does not get to tell us what to thing, what we can chant, what we can protest, and where we can live.

Charlottesville’s mayor made similar sentiments known, and the result was that the police obeyed the cues, and a riot resulted.

Ethics Observations On The Acquittal Of Kate Steinle’s Illegal Immigrant Killer

Jose Ines Garcia Zarate, a serial illegal Mexican immigrant who had been deported five times and was wanted for a sixth deportation, shot young Kate Steinle in the back in 2016. Since this occurred shortly after Donald Trump, announcing his candidacy for President, had decried Mexico “sending us murderers” across the border, Zarate took on the role of Trump’s  Willie Horton.  Zarate admitted to the shooting, but said that he had just found the gun on the street, and fired accidentally. The jury found him not guilty on murder and manslaughter charges, but he was convicted on a gun charge.

Ethics Observations:

The Kate Steinle killer came back and back over the weakly protected Obama border, always committing crimes and being violent, and yet this info was not used in court. His exoneration is a complete travesty of justice. BUILD THE WALL!…The jury was not told the killer of Kate was a 7 time felon. The Schumer/Pelosi Democrats are so weak on Crime that they will pay a big price in the 2018 and 2020 Elections….A disgraceful verdict in the Kate Steinle case! No wonder the people of our Country are so angry with Illegal Immigration.

Ugh. The question before the jury was whether Zarate murdered Steinle, not whether immigration enforcement is too lax, not whether he was a bad guy, not what previous crimes he had committed. The verdict was no more disgraceful that O.J.’s acquittal, George Zimmerman’s acquittal, Casey Anthony’s acquittal, the acquittals in the Freddie Gray case, or any other acquittal where the prosecution does not prove guilt beyond a reasonable doubt.

Nobody not on the jury or the courtroom has any basis or justification to attack the verdict.

The President’s comments are embarrassingly ignorant or dismissive of the basic principles of our criminal justice system.

  • Attorney General Jeff Sessions‘ statement following the verdict was better, but still wrong:

“While the State of California sought a murder charge for the man who caused Ms. Steinle’s death—a man who would not have been on the streets of San Francisco if the city simply honored an ICE detainer—the people ultimately convicted him of felon in possession of a firearm.When jurisdictions choose to return criminal aliens to the streets rather than turning them over to federal immigration authorities, they put the public’s safety at risk. San Francisco’s decision to protect criminal aliens led to the preventable and heartbreaking death of Kate Steinle. I urge the leaders of the nation’s communities to reflect on the outcome of this case and consider carefully the harm they are doing to their citizens by refusing to cooperate with federal law enforcement officers.”

This “but for” argument is a “Back to the Future”/”Terminator” con. The fact that it was Zarate who picked up an abandoned gun that discharged and killed Steinle—this is what the jury concluded—and not a Cub Scout, a fumble-thumbed bank teller, a stoned gay guy or Pablo Sandoval is 100% moral luck.  Yes, if Zarate was in Mexico—or Iowa—Steinle might be alive today. Or maybe not.  Also if the US gave more aid to Mexico and it wasn’t such a hell hole that its citizens keep coming here illegally, she might be alive. Maybe if Zarate’s mother had been killed by an android from the future before she met Zarate’s father…

The reason to enforce immigration laws is that they are important laws and should be enforced. Steinle’s death and Zarate’s acquittal don’t affect those facts one way or the other. Continue reading →

Morning Ethics Warm-Up, 11/28/2017: The Worst Defense Of Roy Moore Ever!

1 The Dumbest Moore Defense Ever Told! Debating with Chris Cuomo on CNN yesterday morning, Breitbart senior editor Joel Pollak made the following argument in defense of  Alabama GOP Senate candidate Roy Moore:

“You know, in 1973 Ringo Starr hit number one on the Billboard charts with the song, ‘You’re 16, you’re beautiful, and you’re mine,. He was 30-something at the time singing about a 16-year-old — you want to take away Ringo Starr’s achievement?”

He really did.

2. Sally Yates and James Comey are happy, anyway. Leandra English, the deputy director of the Consumer Financial Protection Bureau, argues that the Dodd-Frank Act makes her the lawful the acting director of the agency in a lawsuit she has filed  against President Trump, who also has the law on his side. He appointed Mick Mulvaney, currently Trump’s director of the Office of Management and Budget, as acting director to replace Richard Cordray, who appears to have resigned explicitly to foil the President’s ability to appoint his own choice to head the CFBP. Now there is mess triggered by a rare, genuine example of two statutes with authority over the same situation.

The Justice Department’s Office of Legal Counsel issued a legal opinion that says the Dodd-Frank Act does not displace the President’s authority to appoint under the Vacancies Reform Act. Either statute can be invoked. “We cannot view either statute as more mandatory than the other,” the opinion says. “Rather, they should be construed in parallel.”

Of course, employees of the Executive Branch are ethically obligated to defer to the President of the United States, but this President is handicapped by a thick muck of arrogant holdovers from the Obama Administration, who think it is appropriate to sabotage and undermine a leader whom they do not approve of. This is indefensible.

The lack of the basic deference and respect all elected Presidents should be able to depend upon that so many of the previous administration’s personnel have displayed is an indictment of the Democratic Party’s principles, integrity, fairness, patriotism and respect for process. This is how this story should be reported, too, and would be, by a competent and ethical news media. Continue reading →

1 What a revolting development THIS is!

Liberals traveling to Washington, D.C., may soon have a place to stay that’s catered to them – an anti-Trump hotel scheduled to open in spring 2018. The Eaton Workshop hotel is billed as “the world’s first politically motivated hotel,” according to Bloomberg.  Its founder, Katherine Lo, told the news outlet that the 209-room hotel will open near the National Mall, mere blocks from the Trump International Hotel.

Lo said the hotel isn’t meant “to bring together left and right,” but to attract liberal guests and those who consider themselves “woke.” “Self-selection is definitely one of our strategies,” she said. “We wanted to emphasize that it’s a place for people who are thinking outside the box and want to effect a change in the world.”

The hotel will prioritize community outreach, Bloomberg reported, hosting a series of progressive lectures and fireside chats and partnering with local artists and museums to provide art installations and exhibitions. An anti-Trump video installation in the lobby will also show footage of the 2012 and 2016 elections…Locations are also planned in Hong Kong, Seattle and San Francisco in the coming years that would have spaces for radio stations, multimedia studios and venues for musicians and artists to express their activism.

“We plan to have new ideas in the minibar — an activist toolkit, for example, that includes sheets with information to help you call your congresspeople,” Lo told Bloomberg. “And if we’d been open during this year’s Women’s March, I could have seen us putting poster boards and markers in the rooms.”

I have been reading essays from various quarters concluding that Trump-Hate is fast becoming a clinical condition. This would support that; the question is how many travelers are this far gone into hyper-partisan madness. That aside, we have yet another example of the irresponsible and unAmerican push to shatter American society, make everything political, and to encourage partisan isolation, apartheid, and warfare.

The hotel is cultural poison.

2. Ah, this couple was made for each other! Kayla Moore, wife of Alabama Senate candidate Roy Moore,posted a letter on Facebook over the weekend indicating that more than 50 Alabama pastors still supporter her husband. The letter with their endorsement originated before the GOP primary, however. Mrs. Moore deceptively made these pastors appear to endorse Moore despite the subsequent llegations of his molesting one young teen, assaulting a second, plying another with liquor, and generally being too creepy for normal people to think about without getting ill. Already some of the pastors listed have asked to be removed from the list.

The pastors did endorse Moore in the first place, though, so I wouldn’t want to speculate on how many of them would echo the brain-exploding excuse by Alabama State Auditor Jim Zeigler, who said,

“Take the Bible. Zachariah and Elizabeth for instance. Zachariah was extremely old to marry Elizabeth and they became the parents of John the Baptist. Also take Joseph and Mary. Mary was a teenager and Joseph was an adult carpenter. They became parents of Jesus.”

When I see wives standing up for politicians like Moore, I often wonder, “How can they do that? ” Here’s how: they are sleazy and unethical too.

3. Ugh. Now another woman has accused Bush 41 of groping her during a photo shoot, this one in 2003, and when she was only 16. I believe her, in part because of the ex-President’s spokesperson describing the “joke” he liked to tell female admirers about how his—I still can’t believe I have to write this—favorite magician was “David Cop-A-Feel.”

There is strong evidence that the federal government is Sexual Harassment And Assault East, perhaps not as bad as Hollywood, but just as hypocritical and inexcusable. George H. W. Bush was part of that privileged and abusive old boys culture. The Harvey Weinstein Ethics Train Wreck is just now arriving at the Capitol, which is ironic, since Bill Clinton and his unprincipled defenders started it rolling way back in 1998. Morning Ethics Warm-Up, 11/9/17: Everyone Behaving Abysmally Edition

Let’s scream “Good Morning!” to the sky!

1 The FBI is now complaining that it’s too difficult to break into smartphones, since the Texas maniac, Devin Kelley, had one that has so far resisted cracking. By all means, let’s make sure we have no privacy from government intrusions into our lives and relationships. I’m sure—I really am sure—that the “think of the children!” mob and the “if it saves only one life!” brigade will happily surrender the right to privacy, which is, per the Supreme Court, is also in the Bill of Rights, just like the rights of free speech and the right to bear arms.

The solution is right in front of the FBI anyway.  Just take Kelley ‘s body on a plane trip to Bali, manipulate his dead thumb, and use it to unlock the phone.

2. I see little to choose from ethically between Facebook selling space for deceptive ads to the Russians and CNN selling time on their newscasts for a billionaire to make his personal, dishonest and ignorant demand that President Trump be impeached. I had heard and read about the ad, which is basically Maxine Waters’ warped version of the Constitution and the impeachment clause, with a little Richard Painter thrown in, but I assumed I would have to go online to see it. Nope, there it was this morning during a break on Headline News. Respectable news sources, not that CNN qualifies any more, have traditionally rejected factually misleading political ads from private interests, and a Constitutionally moronic rant from a rich guy with money to burn surely should qualify.

The rich guy is Tom Steyer, who apparently once was an intelligent human being even as you and I. His ad claims that “Donald Trump has brought us to the brink of nuclear war, obstructed justice, and taken money from foreign governments. We need to impeach this dangerous president.” Let’s see: the first is pure hysteria and an attempt to criminalize policy and international poker (I’d argue that the weak response to North Korea by the U.N. and previous administrations has been what has “brought us to the brink,” as well as, of course, the rogue country threatening nuclear attacks and firing missiles over Japan).

The second is a gonzo anti-Trump resistance theory that would be tossed out of any court, except maybe in Hawaii. The third is intentionally dishonest: this is the Emoluments Clause fantasy that holds the discredited theory a hotel owner has to be impeached if he doesn’t sell his hotels. Steyer’s ad also says that that Trump should be impeached for various tweets, half-baked opinions and comments. As one would expect from a  Democratic mega-donor, he apparently believes that speech qualifies as a high crime when it annoys progressives.

Naturally, again as one would expect, Steyer implies in his ad that Bill Clinton, who really did commit a crime as President and really did obstruct justice, was impeached by a Republican Congress for “far less.” This disqualifies him as a serious person.

3. Baseball fans know that Roy Halladay, a near-Hall of Fame pitcher with the Blue Jays and Phillies renowned for his durability until his arm fell off (metaphorically speaking), was killed this week when he crashed his single engine plane into the Gulf of Mexico. Observers say he was flying recklessly, and there is evidence that he wasn’t properly experienced to be operating the plane as he was. Weeping And Screaming At The Sky: Dear Democrats, Progressives, And “The Resistance,” Are You Embarrassed Yet? Why Not?

The emerging strategy of the traumatized and indignant Left since the debacle of last November 8 has been, it seems, to try to cause President Trump to snap, so he would do something that unequivocally justifies removing him from office. Actively trying to drive your elected leader nuts is border-line treasonous, of course, so this strategy is unethical, but never mind: so far, it’s not working. Instead, President Trump’s foes are the ones snapping like dry twigs in the woods. The spectacle is unprecedented in U.S. history, and should be so embarrassing to the un-snapped members of the President’s opposition that it is disturbing that they are not yet  wearing bags over their heads and thinking about witness protection.

The anti-Trump forces could justifiably be ashamed to be associated with all the academics who have thoroughly beclowned themselves, like Harvard’s deluded Larry Lessig, and the long-snapped government ethics specialist Richard Painter, who is back to peddling a false theory of how the 25th Amendment works in order to bootstrap an impossible plan to remove Trump. Then there is the risible  $10,000,000 ad campaign by frustrated billionaire Democratic donor Tom Steyer, calling for Trump’s impeachment without being able to articulate a single basis that would pass logical, legal or Constitutional muster. Maxine Waters is going full demagogue (you never go full demagogue) in her own obstinately ignorant proclamations that an elected President can and should be removed because the Congressional Black Caucus disapproves of his tweets, while the official leadership of her party—which, incredibly, just added disgraced cheat Donna Brazile to its ranks, signalling it vales and priorities— opposes the most uncivil and boorish of Chief Executives by routinely seasoning their own diatribes with words like “shit” and “fuck.” Meanwhile, the defeated Democratic standard bearer in 2016, Hillary Clinton, is on a tone-deaf “blame everybody” tour while multiple scandals surrounding her own campaign revive and emerge, as she establishes herself as the least graceful, whiniest, worst loser in American Presidential annals by approximately ten laps.

Morning Ethics Warm-Up, 10/19/2017: #MeToo, A Fact-Denying Fact-Check, And A “Resistance” Hit Job

1 The contrived anti-Trump controversy over his conversation with a Gold Star widow is so disgusting and cynical that I hesitate to comment on it. This was so obviously a set-up: an anti-Trump woman, angry and grieving over the death of her husband, allowed a virulently anti-Trump Democratic Congresswoman to listen in on the call, then collaborated to make the accusation that Trump’s words that her husband “knew what he was signing up for” were a calculated insult. The New York Times somehow found this worthy of an above the fold article. No other President would ever be subjected to this kind of despicable “gotcha!” attack. No matter how clumsy Trump’s words might have been, and we can only take the word of two women who were predisposed to interpret them in the worst light imaginable, a President must be accorded a presumption of good will in such a situation. This, however, has been withheld from him in all situations by major segments of the Left from the beginning. Representative Fredricka Wilson (D-Fla) boycotted the President’s inauguration, and has made her motives and character explicit by laughing about how this latest controversy has made her a “rock star.” Well, maybe in “the resistance”–I have a somewhat different description for her. Now she’s race-baiting too, calling John Kelly a racist for referring to her, in his defense of the President, as an “empty barrel” who “makes noise.” Yup, I remember hearing stories about Klansmen calling blacks “Empty barrels.”

What did the wife of La David Johnson expect such a partisan, vicious hack like Wilson to do when she chose her to listen to the conversation with the President? It was another episode in the fake “the President is a white supremicist” pageant, and to anyone with a scintilla of objectivity, a blatant one. The Washington Post’s resident race-baiter, affirmative action Pulitzer Prize winner Eugene Robinson, wrote an unforgivable column calling Trump’s comment “mindless cruelty”he never never made a genuine case that there is anything wrong with what Trump said…because, you see, there isn’t. If the wife of a soldier doesn’t understand that when he enlisted in the armed services he was putting his life on the line for his country and knew it, then that’s her misconception. My father, who had his foot blown up in World War II, made this point more than once: if you enlist to fight, you can’t say you didn’t know that the possibility of being killed or wounded wasn’t part of the decision. If it wasn’t, there would be no innate courage in volunteering for service. This, like so much else that the President does and says, is only wrong because it is him saying it. This is the plan. This is how “the resistance,’ Democrats and their core seeks to cripple the government and undermine the President of the United States. They don’t even hesitate to politicize a simple condolence call and the death of a soldier toward that un-American end.

I think my favorite part of the negative spin put on Trump’s conversation with Mrs. Johnson was that “he appeared not to know the name” of the fallen soldier. Any parent who can’t resist excessive creativity and who names a boy “La David” has condemned him to having everyone hesitate to say his name for the rest of his life, as “Wait, this can’t be right…” locks their brains. This is Naming Ethics. Similarly, don’t name your girl “Mister Nancy.”

Accolades are due to another Gold Star widow, Natasha De Alencar, who has released the audio of a call the President made to her in April after her husband, a  member of the 1st Battalion, 7th Special Forces Group (Airborne) became the first American killed in combat in Afghanistan this year. That conversation shows the President as compassionate and willing to spend all the time necessary to express his respect—and she and her were Hispanic, and we all know that Trump just hates Hispanics. That call alone should ensure the President the benefit of any doubt regarding whether he would “insult” a military widow, but it won’t; not for those who want to assume the worst, and want to  make as many people as possible believe that the President of the United States is a monster.

This was an unconscionable hit job. The Democrats and the news media seem incapable of comprehending that the more ruthless, unjust and vicious they behave in their opposition to Trump, the more those who are not already incurable Trump-haters will conclude that their cure is worse than the disease. Morning Ethics Warm-Up, 10/17/2017: Comey, Eminem,”Hustler”… And Cognitive Dissonance

1 Nicely dovetailing with last night’s Ethics Alarms post, Christian Toto put his finger on the tragic and narcissistic delusions of Hollywood celebrities and athletes, without specifying what is really going on: a complete failure to comprehend the Cognitive Dissonance, and the perils of defying the scale. His post is called, “Celebrities make it official: Pick Trump or Us!”

He relates…

Eminem appeared at the BET Awards this week to do more than plug his new album. He unleashed a four-plus minute rap against President Trump…

That’s hardly worth a news item alone. Virtually every player at every level of the entertainment world is against this Commander-in-Chief. Trump…A few have wished him dead in colorful ways. Eminem didn’t go that far. Instead, he turned some of his ire against Trump towards those who support the president:

“And any fan of mine who’s a supporter of his

I’m drawing in the sand a line: you’re either for or against

And if you can’t decide who you like more and you’re split

On who you should stand beside, I’ll do it for you with this:

Fuck you!”

The next night, “Late Night“ host Seth Meyers praised the rapper’s “powerful” rant-rap, and then said:

“And I was inspired by that, so tonight, I say to any fans of this show who are also big fans of Donald Trump, it’s time to make a decision,” said Meyers. “Get off the fence. Do you support him or do you support this show, that constantly mocks and denigrates everything about him? I know it’s a tough call, but the time has come to make a decision. Now, I’m not much of a rapper, but here it goes. My name is Seth and I’m here to say, if you like Trump, then go away.”

Then Meyers ended by flashing his middle finger.

Nice. Also incredibly arrogant,  stupid and ignorant. Whatever Donald Trump’s status on the public’s cognitive dissonance scale …

…was before November 8, it was a lot better after. The Presidency is high on the scale for the vast majority of Americans, because the Presidency, no matter who occupies it presently, carries the respect and prestige of all of the former Presidents, including Washington, Lincoln, the Roosevelts, and yes, Obama. That yanks a new President up the scale, and hard. Part of the assault on Jefferson, Jackson, Lincoln, Washington and Madison by progressives consciously or unconsciously seeks to counter this effect by tearing down the office—yes, “the resistance” would destroy the institution of the Presidency to save it—, but it doesn’t matter. The power of the office can’t fall far enough or fast enough to pass Seth Myers or Eminem on the lower rungs. These ludicrously confused semi-celebrities, just like the NFL stars that most people couldn’t pick out of a line-up, really think choosing between them and the President, the flag and the United States of America—you see, that is the team—and their minuscule and trivial personas is an easy choice. It is, but not the choice they think. When Trump wrongly injected himself into the foolish NFL kneeling protests, the players actually believed that if they showed “solidarity,” NFL would choose them over the President of the United States.

Brilliant.

2.  Yesterday, the FBI confirmed that James Comey indeed drafted his July 5, 2016 statement declaring that Hillary Clinton’s official and classified email machinations did not quite violate the law two months before he made it, and before Clinton had even been interviewed on July 2, 2016.

I initially was inclined to give Comey the benefit of the doubt here, but especially following on the heels of  the FBI  “discovering” last week 30 pages of documents related to the strange 2016 tarmac meeting between former President Bill Clinton and former Attorney General Loretta Lynch while the investigation of Bill’s wife was at a critical stage, I have to revise my opinion. Before the election, Comey’s FBI denied that any such documents existed. Are serious people really going to keep claiming that the President firing Comey was “obstruction of justice”? Increasingly it looks as if Obama’s keeping him in office was a travesty of justice. Or Justice.

 

The release of Comey’s prescient draft confirms information that Senator Chuck Grassley, chairman of the Senate Judiciary Committee, and Senator Lindsey Graham, a member of that committee, disclosed in a letter to new FBI Director Christopher Wray in August.  The Senate Judiciary Committee is reviewing Comey’s conduct as director and President Donald Trump’s firing him in May.

Some analysts are defending Comey, but that seems to be an increasingly forced exercise. “To me, this is so far out of bounds it’s not even in the stadium,” Chris Swecker, who retired from the FBI in 2006 as assistant director for the criminal investigative division and acting executive assistant director for law enforcement services, told reporters. “That is just not how things operate…. Morning Ethics Warm-Up, 9/23/2017: Special “Love Him, Hate Him Or Tolerate Him, Ya Gotta Admit President Trump Isn’t Boring” Edition

I don’t know about you, but I was getting mighty sick of those “morning” shots…

GOOD MORNING!

1 Peggy Noonan, the former Reagan speechwriter who writes powerfully and is not afraid to take unpopular positions, has been as critical of Trump as any rational pundit. She writes in her latest column, that the news media has misrepresented Trump’s U.N. speech, which, she says further,  was what the U.N. “needed to hear clearly and unequivocally.” She adds,

A great line—because it spoke a great truth—was this: “The problem in Venezuela is not that socialism has been poorly implemented, but that socialism has been faithfully implemented.” Mr. Trump then paused and looked at the audience. It struck some as a “please clap” moment. It struck me as a stare-down: I’m saying something a lot of you need to hear. You’re not going to like it, and I’m going to watch you not like it.

… Mr. Trump is on a roll, a sustained one the past few weeks, and this is new. All levels of government performed well in the hurricanes. Mr. Trump showed competence, focus and warmth. His bipartisan outreach, however it ends, went over well with core supporters and others. He had a strong speech at the U.N., in fact a successful U.N. week, beginning to end. His poll numbers are inching toward 40%.

Noonan meets the ethical standard that the mainstream news media, critical pundits and “the resistance” have relentlessly breached: give the President credit when it’s due, and subdue bias to engage in objective analysis for the public;s enlightenment.

2. Ann Althouse, also noting that the President’s poll numbers have been creeping up (a. Not that much b. Who trusts polls? c. So what?), polled her readers regarding why they thought this was happening. Her options were mostly the right ones, though Peggy’s “bi-partisan outreach” was conspicuously missing…

“Hurricanes”—these sorts of natural disasters are usually opportunities for Presidents to play President, and that seldom is anything but enhancing to a POTUS’s image. Ronald Reagan’s speech after the Challenger disaster was a perfect example. Trump gets less credit than he deserves because the news media works hard to represent anything he does in a negative light.

“Kim Jong Un”—Since so many progressives believe that we should keep allowing North Korea to extort the West by endlessly appeasing it, it is hard to see Trump’s hard-line stance moving the needle.

“U.N. Speech”—unless American read it, which few have, I assume the (false) mainstream narrative that it was a disaster prevails.

“Normalization happened”—THAT’s certainly wrong. If it means that General Kelly has made a big and positive difference, then OK. The Wite House is certainly more normal than it was, but far from normal.

“Russia collusion story fading”: “The resistance” is still certain that Trump bartered to win the election and will be impeached for it. Facts, evidence and reality are irrelevant to them.

“Successful policies have been implemented”—In fact this is true, but again, the only ones who know it are pro-Trump partisans,  the small number of citizens who dig through the static and fog of mainstream media Trump Hate, and those who don’t think any retreat from the inexorable progression to open borders, socialism and Big Brother is a tragedy.

“Nothing’s gone horribly wrong (yet)”: The Trump Deranged think that everything has already gone horribly wrong, and that we’re all going to die. Here is a typical Facebook post from a good friend this week:

Trump IS deranged. And we’re all going to pay for it. Am I surpised that a hermetic totalitarian proto-monarchy has created a Kim Jong Un? No, it’s completely predictable and logical. That the US of A has elected someone who is NO better whatsoever than Kim, and in some ways quite worse, is the unforgivable aspect of this whole equation.

“Bad things like The Wall and repealing Obamacare seem to have been merely campaign bluster”—Nah. Lots of other things were bluster; these were just impossible.

But I voted for this one, also supported by my friend’s crazy post: “Trump haters are tiresome.” “Tiresome” is professorial nice-speak for “So vile, un-American and unhinged that if they want one thing, sane and fair and rational citizens will increasingly prefer the opposite.”  The category includes “tiresome” public figures like the Late night “comedy” show hosts, Bill Maher, Samantha Bee, Hollywood, MSNBC, Maxine Waters, the New York Times, CNN, Black Lives Matter, Tom Perez, Elizabeth Warren, and, of course, Hillary Clinton. It’s pure cognitive dissonance.

Naturally that choice is also leading in votes, followed by hurricanes, North Korea, and the UN speech.

3. As always, when the President is feeling cocky, he lets loose with dumb tweets and inflammatory comments just to remind us that he’s not going to change. This morning he reacted to San Francisco Warriors super-star Steph Curry saying that he “didn’t want to go” to the White House when the President hosts the traditional visit from championship sports teams, tweeting,

“Going to the White House is considered a great honor for a championship team.Stephen Curry is hesitating, therefore invitation is withdrawn!”

Stipulated: this is petty, and beneath the President’s office, like 99% of his tweets. It shows thin skin and vindictiveness, and is punching down in the sense that any attack on a citizen from the White House is punching down.

And yet, and yet…I have to say I smiled when I read it. It is damaging for athletes and cultural role models to be disrespectful to the President, the Office, and the country. Curry was gratuitously rude, and deserves a rebuke…just not from the President of the United States.

(I still hope Trump retracts the invitation to the whole team.)

The other outburst, also involving sports, is indefensible.

At a Huntsville, Alabama rally for Republican Senator Luther Strange, who is running in a special GOP primary election to remain in the seat vacated by Attorney General Jeff Sessions, Trump went off script and said,

“Wouldn’t you love to see one of these NFL owners, when somebody disrespects our flag, to say, ‘Get that son of a bitch off the field right now. Out! He’s fired. He’s fired!’” Trump said. “You know, some owner is going to do that. He’s going to say, ‘That guy that disrespects our flag, he’s fired.’ And that owner, they don’t know it [but] they’ll be the most popular person in this country…But do you know what’s hurting the game more than that? When people like yourselves turn on television and you see those people taking the knee when they’re playing our great national anthem. The only thing you could do better is if you see it, even if it’s one player, leave the stadium. I guarantee things will stop. Things will stop. Just pick up and leave. Pick up and leave. Not the same game anymore, anyway.”

Ugh. Owners have a right to discipline players for bringing politics onto the field. When a President tells them to, that  edges too close to government action, chilling speech, and a First Amendment violation.

On the other hand, one does not have to be a conspiracy theorist to detect an uncoordinated but pervasive effort in the news media, academia, the tech sector, show business and Hollywood, and now sports, to flood the culture with so much progressive propaganda and anti-Trump bile that government becomes impossible. The effort has to be countered, but the President is not the proper one to counter it. Still, the integrity and functioning of our democracy is at stake.

4. In Ann’s “Successful policies have been implemented” category, except I would call it “essential polices,” was the expected withdrawal of the Obama Education Department’s infamous “Dear Colleague” letter that prompted universities to dispense with due process and fair standards when finding male students guilty of sexual assault and rape. Blogger Amy Alkon, another rational Trump critic, nonetheless enthusiastically and definitively slapped down an awful, ethics-devoid Times op-ed that, as the Left is wont to do these days, argued that the innocent until proven guilty standards and equal justice should be re-calibrated for the greater good, which is to say, for the benefit of favored groups. Alkon writes of the feminist authors,

[T]hey clearly aren’t looking for justice for all, but just justice for some: typically, the woman. They continue:

The preponderance of evidence standard is also survivor-centered. When judging whether someone has been raped, it’s almost impossible to assert that a sex act constituted violence “beyond a reasonable doubt.”

Our justice system in this country involves erring on the side of freeing a possibly guilty person in hopes of seeing that innocent people are not imprisoned. The fact that it is sometimes hard to judge a “he said”/”she said” case does not change that.

On the other side, and in Althouse’s  “Trump haters are tiresome” ( “tiresome”= frequently biased, ignorant, dishonest, undemocratic, unfair, vicious and hypocritical, as well as dumb as bricks) category, we have this tweet from snarky female comic Chelsea Handler:

“Thank you @betsydevos for making it easier for rapists going to college to get away with raping innocent women. What a role model…”

Anyone who thinks that is clever or true needs to—quickly— read the Constitution, perhaps with a literate translator, maybe a U.S. history book or two, and get at least a rudimentary understanding of the principles underlying the United States and its values.

Morning Ethics Warm-Up, 9/22/2017: Listening To Maxine Waters And Getting Hit In The Face With A Baseball

(Boy, am I glad this week is almost over…)

 

1 There is an Ethics Alarms category for incompetent elected officials like Maxine Waters, but in general I try not to state the obvious, and Rep. Waters has been an embarrassment to her district, her party, the House of Representatives, her party, the Congressional Black Caucus, her gender, her race and democracy generally for decades. Her latest statement that “Impeachment is about whatever Congress says it is. There is no law that dictates impeachment” is an especially striking example of her ignorance, her defiance of her ethical duties, and her sick partisan extremism, but still: Who that has watched this woman can be shocked at this?

During a Congressional Black Caucus town hall yesterday, Waters called on the black community which, to our pity and its shame, trusts this despicable woman to support impeaching President Donald Trump because “there is no law” restricting the practice.

Waters either is unaware of or chooses to defy the Constitution’s Article II Section 4: 

The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.

A. That’s law. In fact, it’s the law of the land.

B. “Treason, Bribery, or other high Crimes and Misdemeanors” is not synonymous with “Anything Congress decides”

One of the worst things about Waters is that she makes citizens who trust her more ignorant about their own country. Her characterization of impeachment is simply false. It is also a prelude to an anti-democratic, ant-Constitutional system in which the Legislative Branch can veto the results of an election as long as one party has a sufficient majority. In this regard, Waters is not alone: this has been a theme of the Democratic “resistance” since the election. That alone is just reason for any rational American to vote against the Democrats, and this would be true if a werewolf were President.

It’s always fun to guess whether Waters is stupid, or lying. I vote stupid. “Bill Clinton got impeached because he lied,” Waters said yesterday. “Here you have a president who I can tell you and guarantee you is in collusion with the Russians, to undermine our democracy. Here you have a president who has obstructed justice, and here you have a president that lies every day.”

Bill Clinton was impeached for lying under oath, which made him unfit to be a lawyer, much less make the laws. He was also impeached for lying to a grand jury, another crime, and obstructing justice for real, not by firing his own subordinate.

An ethical party would censor Waters the way Republicans supported censoring Joe McCarthy. At this point in its history, the Democratic Party is closer to following Waters’ unethical conduct than opposing it. Continue reading →
