Beware that slippery slope!

Ethics Alarms is blessed with an unusually wise, articulate, philosophically diverse and often cantankerous readership. One of the luxuries this affords me as that I do not have to raise every single relevant issue in an ethics commentary, because I can be reasonable certain that a commenter will raise it, often with a perspective that I had not considered. Among benefits, this keeps my posts from being even longer than they already are. An example of this phenomenon  is this comment from Mike Martin, on yesterday’s post regarding the family that bullied US Air into refunding non-refundable tickets because the mother was diagnosed with Stage 4 breast cancer. My first draft of the post had discussed the important  issue Mike raises, but I decided to stick to the main topic, the conduct of the Compassion Bullies.

Scent Branding, Mind-Control, and Ethics

A recent article on the web that purported to explore the ethics of “scent branding” was fascinating for two reasons.

First, “scent branding” is a term I had never encountered before, for a practice that I had not focused on. About five seconds of thought, however, made me realize that indeed I was aware of the phenomenon, and had been for quite a while. “Scent branding”—using fragrances in a commercial environment to create a desired atmosphere and to prompt positive feelings, recollections and emotions from patrons—has been around a long, long time, though not under that label. When funeral parlors made sure that their premises smelled of flowers rather than formaldehyde, that was a form of scent branding. Progress in the science of scent allowed other businesses to get into the act: I was first conscious of the intentional use of smell when I spent a vacation at the Walt Disney World Polynesian Villages Resort. The lobby and the rooms had a powerful “tropical paradise” scent, a mixture of beach smells, torches and exotic fauna. It was obviously fake, like much in Disney World; also like much in Disney World, I found it effective, pleasant, and fun. I certainly didn’t think of it as unethical. I was normal in those days, however.

Well, more normal.

The second aspect of the article, entitled “Is it Ethical to Scent Brand Public Places?”, that caught my attention was that it had an obvious agenda. The piece was opposed to scent branding, and set out to find the practice unethical in order to justify condemning it. Continue reading

Comment of the day: “It Has Come To This”

JC comments in response to “It Has Come to This,” the recent  post about a school suspending a student for the non-bullying, non-threatening, non-defamatory content she wrote to friends on her personal Facebook page in the privacy of her own home. JC apologetically calls it a rant; I don’t think it is. He is providing useful context for the school’s abuse of its power, and illuminates how we got to this unfortunate place, where parents abdicate to the schools, and the schools open the door for government intrusion into our homes and families.

“…Do schools have a legitimate concern? After Columbine, Red Lake, etc. I can understand why schools would be concerned about online postings discussing murder. Often the shooting is mentioned before hand in an online post. How to prevent this school shootings? School officials think that paying attention to students online activities (whether at school or at home) is the answer. There is a world of difference between the student saying I wish teacher X was dead and saying I am going to bring three guns to school and here is the plan on how I am going to carry out my attack. School officials seem to view that difference as a fine line that they would rather be on the safe side of.

It Has Come to This

…Well, your kids, anyway. But you’re next.

Rundlett Middle School has suspended  a 13-year-old Concord, New Hampshire girl for posting on her Facebook page that she wished Osama bin Laden had killed her math teacher.  Many of the stories published about the incident close with the statement,  “School officials say they can’t comment on the case because of privacy concerns.” While I suppose I should be relieved that they are still concerned about some privacy issues,  their respect for privacy generally leaves a lot to be desired.  So does their respect for basic constitutional rights…but they aren’t the only ones.

The post was stupid, and so what? The teacher was not placed in any jeopardy (Osama is dead, no matter what the school might have heard); no student was bullied (not that this would justify the long arm of the government reaching into the child’s bedroom either); nobody was defamed.    Kimberly Dellisola, the girl’s mother, has told the press the punishment was “too harsh.” Would somebody please tell Kimberly that the school has no business punishing her child at all? That’s Kimberly’s job, or at least was, until schools decided to take over policing what children do, write and say in their own homes. Continue reading

Ethics Quote of the Week: Washington Post Columnist Michael Gerson

“In determining who is a “major” candidate for president, let’s begin here. Those who support the legalization of heroin while mocking addicts are marginal. It is difficult to be a first-tier candidate while holding second-rate values.”

—-Washington Post columnist and former Bush advisor Michael Gerson, pronouncing presidential candidate Rep. Ron Paul’s Libertarian endorsement of drug legalization ethically unacceptable.

Gerson’s deconstruction of the all-too-common and increasingly ominous calls for legalizing addictive drugs nicely captures the trio of ethical flaws of the advocacy: it denies the crucial and legitimate government role defining responsible conduct for society, it embraces the myth that recreational drug use “does no harm,” and it is arrogant and selfish, condemning the poor and reckless to problems that their fragile resources cope with, in order to bestow a dubious “freedom” that the drug advocates do not need. Why NPR’s Wrongs Don’t Make James O’Keefe Right

And the NPR Ethics Train Wreck continues

Between union hysteria in Wisconsin, carnage in Libya, and tsunamis, the fact that James O’Keefe’s fake Muslim billionaire act exposed more NPR integrity issues was drowned out by shouting, gun shots and water. In fact, the second victim of O’Keefe’s sting may have taught us more about NPR than the first.

In the surreptitious audiotape of  NPR’s continued encounters with the fake potential big bucks donor, NPR’s director of institutional giving, Betsy Liley, is heard advising the supposedly wealthy Muslim donor how the network could help “shield” his group from a government audit if it accepted the $5 million he was offering. It seems pretty clear from the tape that this was not what the sting was set up to prove: what the “Muslim donor” really wants is to get a promise from NPR that it will slant the news content the his way if the gift is big enough. Liley stood her ground on this core journalistic principle admirably—so much for the claim that George Soros bought NPR’s advocacy with his recent gift—but fell into another trap of her own making.

NPR spokeswoman Dana Davis Rehm said in a statement that Liley’s comments on the tape “regarding the possibility of making an anonymous gift that would remain invisible to tax authorities is factually inaccurate and not reflective of NPR’s gift practices. All donations—anonymous and named—are fully reported to the IRS. NPR complies with all financial, tax, and disclosure regulations.” That’s undoubtedly correct; Liley was not merely ethically wrong but also literally wrong, for what she was suggesting almost certainly couldn’t happen. However, the fact that she would say such a thing believing it could happen, or think it was acceptable if it did happen, or try to acquire a large donation by persuading a donor to believe it could happen, all point to the one conclusion: NPR’s culture is ethically compromised, and the organization’s leadership has failed to meet its obligations to create an ethical culture  there. The sting is more disturbing than the earlier one that caught an outgoing NPR executive taking extreme partisan positions that belied NPR’s position that it is objective and unbiased. The comments of Ron Schiller just confirmed what many, including me, thought was already apparent in the tone of NPR’s work. I had also always assumed, however, that the place was professionally and ethically run (excepting the tendency to fire employees for expressing politically incorrect opinions on Fox News).

So this settles it, right? O’Keefe is a hero?

No, he’s not. James O’Keefe, in fact, is an ethics corrupter, an individual who weakens the public’s ethics by encouraging it to accept his dubious values. Continue reading

Ethics and the CALM Critics

The Commercial Advertisement Loudness Mitigation, or CALM Act, is now on the way to President Obama’s desk. The law addresses a long-time irritation to TV viewers, who have been complaining about television commercials booming out at ear-splitting volume as soon as a moderately-loud program takes a break. The advertising trick, which has been around for a while, has become even more blatant in recent years with availability of new sound technology. Some televisions have been equipped with devices that supposedly even out sound variations, but they do not completely solve the problem. The new legislation directs the Federal Communications Commission to require advertisers, within a year, to adopt industry technology aimed at lowering the volume on televised sales pitches.

This is a classic example of law doing what law is supposed to do: step in when individuals or organizations refuse to respect ethical values and cultural norms in the pursuit of their own self-interest, and set penalties to inspire them to engage in fair conduct, since “doing the right thing” isn’t motivation enough. Unavoidable Bias in the Embryonic Stem Cell Research Controversy

In the embryonic stem cell research ethics debate, I come out on the “pro” side. Nonetheless, a New York Times article this morning shows clearly how thoroughly and unavoidably biased scientists and researchers in the field are, leading to the conclusion that the decision whether stem cell research is ethical or not, and whether, or to what extent, it should be permitted, cannot be left to them.

The article, by Amy Harmon, begins,

“Rushing to work at Cincinnati Children’s Hospital Medical Center one recent morning, Jason Spence, 33, grabbed a moment during breakfast to type “stem cells” into Google and click for the last 24 hours of news. It is a routine he has performed daily in the six weeks since a Federal District Court ruling put the future of his research in jeopardy. “It’s always at the front of my brain when I wake up,” said Dr. Spence, who has spent four years training to turn stem cells derived from human embryos into pancreatic tissue in the hope of helping diabetes patients. “You have this career plan to do all of this research, and the thought that they could just shut it off is pretty nerve-racking.” Continue reading

More Spam Ethics

Increasingly, specialty blogs are sporting posts asking whether particular practices are ethical. That is a good thing. The unfortunate part is that too many of the posters lack the tools to answer the question.

You would think the proprietor of a website called “Pro Blog Service,” for example, would be capable of at least spotting the ethical issues in his query about blogging, but no. In a post entitled “Is It Unethical To Edit Spam Comments?“, he describes the common spamming practice of sending in a comment to a blog post that expresses bland and non-specific praise for the original post in order to get a URL publicized.
