Friday Ethics Footnotes, 7/31/2020: 1619, Dumber Lawyers, And Trader Joe’s Stands Up For “Trader Ming’s”

1. Psst! This doesn’t send a message that is complimentary to minorities...The California Supreme Court, which oversees the state bar, agreed to lower the passing score for the exam. The objective is to raise the number of black and Hispanic lawyers. 40 % of California’s population is white, and 60% are not. But 68% of California lawyers are white, according to a new report by the State Bar of California.

Well, so what? Maybe more whites want to be lawyers; whatever the reason, lowering the standards for getting a license seems like a poor way to improve the situation, since it promises to add more dim attorneys. Why do all professions have to have identical demographics to the population at large?

“There is absolutely no evidence that shows having a higher score makes for better lawyers,” said UCLA School of Law Dean Jennifer L. Mnookin. “There is significant evidence that it reduces the diversity of the bar.” Yeah, I’m pretty sure letting people get law licenses by playing beanbag would also lead to a more diverse bar. There is no way to determine whether having higher scores on the bar exam correlates with being a “better lawyer,” but I guarantee not being able to pass the bar exam correlates with being significantly slower on the uptake that a lawyer who can.  Mnookin is saying that intelligence and critical thinking skills don’t factor in the practice of law. What an interesting thing for a law dean to say. Do you think she really believes that?

No one has been able to show that the bar exams anywhere have a racial bias, but since other explanations for comparatively low passing rates among African-Americans are not politically palatable, the George Floyd Freakout has led to this. Unethical Quote Of The Week: Tiffany Haddish

“I would hate to give birth to someone that looks like me, and then, knowing that they’re gonna be hunted or killed.”

—-Black comic and actress Tiffany Haddish, explaining  why she hasn’t had children.

Haddish made this astounding statement in an interview with Carmelo Anthony on his YouTube show, “What’s In Your Glass?”,  as she explained why she joined a Black Lives Matter protest.

“I’m a little older now and people are always like, “You gonna have some babies? When are you gonna have some babies? You gonna drop some babies?'” she babbled. “There’s a part of me that would like to do that, and I always make up these excuses like, ‘Oh, I need a million dollars in the bank before I do that, I need this, I need that.”

Then after an explanation that indicates that Haddish thinks she is living in the days of the Underground Railroad and her children would be pursued through the swamps by bloodhounds, like Eliza in “Uncle Tom’s Cabin,” she asked, “Like, why would I put someone through that?”

“And white people don’t have to think about that. It’s time to talk about that, and how we have to come together as a community and work as a unit. Maybe we don’t all agree on the same things, but we need to just find some common ground and move forward as human beings not as like, you know,” she concluded, making no sense whatsoever. Morning Ethics Warm-Up, 7/30/2020: Fact Checks, Fear-Mongering, The Emmys, And Another Cancellation

Yes, it’s time again for Gene, Debbie and Donald to begin the day with the level of enthusiasm that I wish I could muster. A Jack Russell Terrier would also help.

1. “Nah, there’s no news media bias!”The New York Times costs the Marshalls $80 a week. The last two editions were essentially anti-Trump campaign brochures, front to back. Even the sports sections had gratuitous anti-Trump vibes. The Washington Post is worse than the Times, but it’s much cheaper, being a home town paper. Nonetheless, I feel badly enough paying Jeff Bezos for digital access. At least the Times didn’t smear Catholic school boys because an established Native American propagandist told them to.

Yet these are, really and truly, the best newspapers in the country. Think about that. One close relative of the hard-left persuasion subscribes to no papers, and the holes in her basic knowledge of what’s happening would fill the Albert’s Hall. (She relies on MSNBC.)

Newspapers… can’t live without them, can’t have a functioning democracy any more with them. And progressives still tell me to my face that I’m imagining it: the claim that the news media is partisan and biased is a “conservative conspiracy theory.”

2. Fact check! I saw this “fact check” of Barr’s testimony two days ago in my Times today, knew what was coming, decided I didn’t feel well enough to have my temperature raised, and then commenter Dr. Emilio Lizardo was cruel enough to send me a link and a precis.

As with so much of the news media’s fake news and biased analysis, I’d assume that savvy readers can smell the stennch of these things, but maybe not. The good doctor writes,

“This is misleading” – 4 occurrences
“This is exaggerated” – 2 occurrences
“This is false” – 1 occurrence
“This lacks evidence” – 1 occurrence

Nothing like using subjective terminology to demonstrate your objectivity.

Here was my favorite:

What Mr. Barr SAID:  “According to statistics compiled by The Washington Post, the number of unarmed Black men killed by police so far this year is eight. The number of unarmed white men killed by police over the same time period is 11. And the overall numbers of police shootings has been decreasing.”

This is misleading. Mr. Barr accurately cited a database of police shootings compiled by The Washington Post. But the raw numbers obscure the pronounced racial disparity in such shootings. (The statement was also an echo of Mr. Trump’s technically accurate, but misleading claim that “more white” Americans are killed by the police than Black Americans.When factoring in population size, Black Americans are killed by the police at more than twice the rate as white Americans, according to the database. Research has also shown that in the United States, on average, the probability of being shot by a police officer for someone who is Black and unarmed is higher than for someone who is white and armed.Nationwide, the number of police shootings has remained steady since independent researchers began tracking them — declining in major cities, but increasing in suburbs and rural areas.When Representative Cedric L. Richmond, Democrat of Louisiana, took issue with Mr. Barr’s presentation of the data, Mr. Barr responded, “You have to adjust it by, you know, the race of the criminal.” But some research has shown that even when controlling for the demographics of those arrested, there are still racial disparities in the use of police force.

In other words, “misleading” means “contrary to the narrative Democrats and activists want to push.” Got it. Continue reading →

The Ethics Vacuum That Is CNN’s Brian Stelter

Brain Stelter probably finishes no higher than third in CNN’s “Unprofessional and unethical broadcast journalists who any trustworthy news organization would fire but since CNN isn’t trustworthy it won’t” sweepstakes. Nonetheless, he is shockingly and consistently ethics free, which is particularly grotesque for an alleged media ethics critic. You can read the ugly  Ethics Alarms Stelter dossier here.

He’s also, in addition to being a 24-7 ethics dunce, not very bright.

Six Ethics Problems With This Picture….And You Should Be Able To Find More

“Scratch” is a New York Times cartoon feature  in the Sunday Business section. This was the most recent installment. I’ll save my (disgusted) comments for the end…

  • The breathtaking leap of logic in the introduction represents such flawed logic that the Times Business Section destroys its credibility, such as it is, by permitting such an illogical statement on its pages. ‘Since companies have been foolishly pandering to hyper-woke complaints about, for example, the picture on a box of rice and the artwork on a package of butter, and statues of important and influential historical figures who were honored in their times are being vandalized and toppled by people who barely know who they are, it’s a ‘perfect time’ time to consider dishonoring the Founders and others without whom we would have no nation at all.’

Confirmation Bias And A Societal “Big Lie,” Brought To You By Harvard And The New Yorker

She looks so smart and sure of herself! Surely we can trust what SHE writes…

The anti-police propaganda spreading the lie that most police are racist and brutal and therefore a greater threat to society than a benefit has become like the nine-headed Hydra of Greek mythology: nearly impossible to kill. Prime among the villains in this development are the news media, which has enthusiastically spread misinformation while refusing to do its job of clarifying facts rather than distorting them, and researchers and academics, who have become so cowed by the abusive hyper-ideological environment in which they work that they won’t even stand behind their own studies. As discussed here, after a peer-reviewed study showing  that the race of the officer or the civilian could not predict  fatal police shootings was used by defenders of police and critics of Black Lives Matte, the researchers were pressured into retracting their paper because it was being, they said, misused.

I know I’m sounding uncharacteristically frustrated this weekend, but I really don’t know how society fights deliberate disinformation in support of a destructive narrative when both the journalism sector and the academic establishment are in on the fix.

Here is a representative example from The New Yorker. The current edition includes a 5,000 word essay by Jill Lepore, who should be trustworthy: she is  a professor of American history at Harvard as well as frequent writer at The New Yorker and for other presumably legitimate publications.  Her topic is the history of policing in the United States, linking the early role of police in suppressing slave rebellions to police killings of blacks today. At one point she writes,

One study suggests that two-thirds of Americans between the ages of fifteen and thirty-four who were treated in emergency rooms suffered from injuries inflicted by police and security guards, about as many people as the number of pedestrians injured by motor vehicles.

“Now What?” #2, But No Quiz. Just NOW WHAT?

I admit—perhaps you could tell?—I was very irritated at the former commenters here who treated me like I was Alex Jones because early on it became clear to me that the Russian Collusion coup attempt was a partisan plot, carried out by entrenched members of federal law enforcement agencies in the U.S., enabled by the Democratic party, and perhaps even Barack Obama. I remain very troubled by that experience, and am waiting for one—just one would be satisfying—to come back and have the courage and decency to write, “I’m sorry. I didn’t want to believe it. You were right.”

I have a couple of candidates who might show such integrity, and I still have hope. I will not, however, hold my breath,

I have been reluctant to write about the obvious (it seems to me) conclusions recent declassified documents point to regarding Obama’s overt and sinister efforts to undermine the Trump administration and seed the beginnings of the collusion narrative before the President had even been sworn in. The fact is, I have neither the time nor the skill to follow all those breadcrumbs and be a reliable analyst—at least not reliable enough. I have been waiting for a thorough investigation to be launched by a news organization, like the Post did on Watergate, or the Indianapolis Star did to expose the Larry Nasser/ Michigan State/U.S. Women’s Gymnastics scandal. Those things win Pulitzer prizes and enhance reputations, don’t they? Why hasn’t there been a thorough, published indictment of Obama’s perfidy? Wouldn’t there be, if the evidence is what it seems to be? Maybe I’m wrong.

It is suspicious, I have to say, how the major mainstream media outlets have been almost silent on the clear indications that Obama and Biden met with various Justice Department and FBI personnel and discussed how to “get” Michael Flynn. For one thing, the notes taken by Peter Strzok tell us that Joe Biden is lying. Don’t they care? Isn’t  that important? Doesn’t democracy die in darkness? Oh, the Daily Caller and the Federalist and other “conservative” news organizations have written about it, but you know, they’re conservative. It’s all lies The claims are being fabricated by “Trumpers.”

The reactions of my Facebook friends tell me what the wider reaction would be to my connecting the dots publicly. These people are supposed to be my friends, and it is astounding how vicious—and irrational–most of them are any time I, or anyone though few now are so audacious, challenges “resistance” Big Lies and the “likes”-fertilized cant that metastasizes in their cyber-bubble.  I’ve just about reached my limit, in fact. Some of these people really are friends, or I thought they were, and they are acting like, to be crude, assholes. I’m about ready to de-friend about 400 of them, including some relatives. Not only are they being crummy friends, they are bad citizens too.

Which is much worse.

I have a measure of sympathy, I suppose,  because they are being misled by propaganda and the news media’s complete corruption, and are reacting to the natural human impulse to be with the “in-crowd,” like gang members and “mean girls.” But just a measure, and I’m about out. These people are smart; I don’t have many dumb friends—some, more than I thought, definitely, but not a lot.

Unethical Quote Of The Month: Joe Biden

“We’ve had racists, and they’ve existed, they’ve tried to get elected president. He’s the first one that has.”

—-Joe Biden at a virtual town meeting yesterday, giving a novel version of American history.

Where to begin? I suppose it’s obligatory to point out, again, that the now routine assertion that President Trump is a racist is based on distortions, innuendo and outright lies. The Democratic Party/”resistance”/mainstream media axis doesn’t even bother to try to support the claim any more, because, I explained here, this is a  a Big Lie strategy, pure Hitler/Goebbels, from the same source, ironically, of the Big Lie (it’s #3 on the list) that the President is like Hitler. Joe’s Big Lie yesterday is #4. It probably should be #1, since it was formulated from the moment Trump, in announcing his candidacy, said, very clearly, that a lot of illegal immigrants from Mexico were dangerous criminals. That is undeniably true, but it was reported, and has come to be believed, that he said all Mexicans were dangerous criminals.

I’m not going to rehash why Big Lie #4 is  a lie; in you haven’t figured it out, please go to the link. However, it is amazing what happens when you ask anyone, even the most articulate and intelligent Trump basher, how they conclude Trump is a racist. They just can’t do it without resorting to misrepresentations and distortions, then bubble over with rage when you point them out.

Joe Biden, as we all know, isn’t articulate or intelligent, and never has been. Now, sadly, he is existing in the twilight world of some kind of mental deterioration. As an aside, I wonder how the news media and those who would vote against President Trump if whoever was running against him “shot somebody in the middle of Fifth Avenue” are going to rationalize Joe’s increasingly garbled pronouncements. “Be fair. That’s just Joe being Joe. You know, he’s senile!”? “OK, he’s lost it, but at least he’s not a racist”? Incidentally, Joe’s statement describing Barack Obama as “clean” back when Biden had all of his marbles, which were never abundant to begin with, was a more reliable marker of racism than anything Donald Trump has said in public in his long career. Ethics Dunce ( And Irresponsible, Grandstanding Jackass): San Francisco Giants Manager Gabe Kapler

Yecch, yuck, ugh, gag, pittooie!

Yeah, I knew it was probably coming, and I even should have been able to guess the team and the manager, but nonetheless, this is nauseating. I assume the craven response from Major League Baseball in the coming days and weeks will be even more nauseating. Great. Welcome back, baseball!

San Francisco Giants manager Gabe Kapler led several coaches and team members as they did a Kaepernick during the National Anthem before their first exhibition game in the Bay Area Monday. And I had just finished my Smithsonian presentation that night explaining why baseball has been a vital unifying influence in communities and the nation throughout its nearly 200 year history. How ironic.

Rookie manager Kapler, coaches Antoan Richardson and Justin Viele  joined players Mike Yastrzemski (Yes, Yaz’s grandson), Austin Slater, and Jaylin Davis in taking a knee, according to NBC Bay Area. Shortstop Brandon Crawford stood between Richardson and Davis, who are both black, and placed his hands on their shoulders in an apparent sign of support.

Although the Giants did not announce before the game against the Oakland A’s at Oakland Coliseum that some members would kneel,  Kapler said he had informed the team of his plans. Then he blathered out his explanation, which while considerably more coherent than what Colin Kaepenick said after the first time he imposed his political views on his team, the game, and spectators were offensive nonetheless.

None of those cardboard cut-out people in the stands would go on the record later, but reportedly they were not pleased.

Here’s Gabe:

“I wanted to share what my plans were and I did that because I wanted them to know that I wasn’t pleased with the way our country has handled police brutality. I told them that I wanted to amplify their voices and I wanted to amplify the voice of the Black community and marginalized communities as well. I told them that I wanted to use my platform to demonstrate my dissatisfaction with the way we’ve handled racism in our country. I wanted to demonstrate my dissatisfaction with our clear systemic racism in our country. And I wanted them to know that they got to make their own decisions and we would respect and support those decisions. I wanted them to feel safe in speaking up, and so we had these kinds of discussions for the last several days and will continue to have them.”

Asked if he and other Giants would continue kneeling, Kapler said, “We’re going to have 60 chances during the regular season to make the same decision that we made today, to either stand or kneel or do something different.”

Monday Morning Ethics Calisthenics, 7/19/2020: Fig-Heads!

1. Our trustworthy news media, which we can trust to behave like this... From my AOL news feed: “Trump says he may not accept 2020 election results.” From the transcript of the Chris Wallace interview that the headline is referring to:

WALLACE: Are you suggesting that you might not accept the results of the election?

TRUMP: No.

What the President would not do is promise to accept the results if there were a  valid reason not to accept the results. Once Al Gore challenged the Florida vote count after Bush had been declared the winner in 2000, the long standing precedent, followed by election losers like Andrew Jackson, Samuel Tilden and Richard Nixon, all of which had reasons to question the results in their contests, of accepting defeat without a challenge was erased. If any of it remained at all, Hilary Clinton’s pursuit of some way of reversing the Electoral College tally in 2016 completed the job. Trump’s refusal to promise a return to the old tradition is reasonable,  especially with the chicanery enabled by mail-in ballots. What Joe Biden has suggested, despicably, is that Trump will not give up the Presidency even if he is defeated unequivocally and fairly. There is no justification for suggesting this. There is far more reason to believe that any Trump victory, even a resounding one, will send angry and frustrated Democrats into the streets

Trump, as usual, was trolling with his coy response here…

WALLACE: There is a tradition in this country — in fact, one of the prides of this country — is the peaceful transition of power and that no matter how hard-fought a campaign is, that at the end of the campaign that the loser concedes to the winner. Not saying that you’re necessarily going to be the loser or the winner, but that the loser concedes to the winner and that the country comes together in part for the good of the country. Are you saying you’re not prepared now to commit to that principle?

TRUMP: What I’m saying is that I will tell you at the time. I’ll keep you in suspense. OK?

TRUMP: And you know what? She’s the one that never accepted it.

WALLACE: I agree.

TRUMP: She never accepted her loss and she looks like a fool.

This isn’t a topic he should be playing with, because the Democrats and the news media will claim that something sinister is in the works. Trump gives a strong hint of his real meaning: if Hillary looked like a fool by refusing to accept the election results, he wouldn’t want to behave like Hillary. But the President should have simply said, “If I lose, fair and square, of course I will accept the results.”

He also should have answered Wallace’s question as I would have, by saying, “Chris, the tradition you speak of has been rejected twice by losing Democratic candidates since 2000.”

2. There’s no excuse for this in 2020. I could not believe my ears as I watched “Three Billboards Outside Ebbing, Missouri”last night.

I thought that a TV version of “The Hard Way” (1991)  I watched a bit of until I couldn’t stand any more had wrapped up the all-time prize for idiotic Bowdlerization of movie dialogue with such substitutions as “slug in a ditch” for “son of a bitch.”  I mistakenly assumed that the days of red-penciling movie dialogue on the theory that a film’s audiences would be made up of six-year-old Mennonites and 88-year old nuns were long gone. But here was a a 2017 movie with a lot of rough language being made ridiculous by word censorship. “Fuck” was alternately represented by “flock,” “flip,” and “freak.” “Mother-fucker” became “flipper”—in a bar scene, I at first thought a fight started because one character called another a dolphin. “Bitch” for some reason was removed in favor of the word “cuck,” except it was pronounced like “cook.” A character complained about there being “too many cucks in here,” and for a second I thought I was watching “The Great British Baking Show.” All of these strange words ruined the movie, first because the silly replacements turned a smart and moving drama into a absurdist Monty Python skit, and second because the word substitution was so eccentric that I was constantly taken out of the story by wondering, “What word was supposed to be in there?”

In one scene, the protagonist played by Frances McDormand burst  into the police station calling the officer played by Sam Rockwell a “fig-head.” Another officer indignantly shouts at her, “You can’t come in here and call a law enforcement officer a fig-head!” Wait–what the hell is a fig head?

This is incompetent and unfair to the film, the artists who made it, and the audience.

3. OK, I admit it, I have no idea what Kanye West is doing. And I don’t care. After announcing he was running for President, then implying that he wasn’t, the mentally ill rapper held a campaign event yesterday highlighted by his criticism of Harriet Tubman on the grounds that she “never actually freed the slaves, she just had them work for other white people.”

This is gallactically stupid, but it’s still smarter than Candidate Trump’s criticism of John McCain’s war heroism. At least Tubman, her family and friends aren’t alive to exact their revenge on West should he get elected.
