The dilemma posed in the recent post about the radio host fired because of the danger posed by her threatening, stalker ex-husband sparked some unexpected reactions, as many readers expressed frustration that Nancy Lane’s employer left her to her own resources in her peril. One of the more provocative alternatives proposed is Steven’s endorsement of what he calls the chivalristic response.

Rubin-Jackson Revisited: Gibbs’ Rules #6 and The Harmful Apology
Samuel Jackson’s reckless and unjustified attack on KTLA entertainment reporter Sam Rubin (which, incredibly, continues to be misrepresented by most of the news media, internet and social media) is an excellent example of how relatively trivial incidents can teach important ethics lessons. One of those lessons I did not discuss in the previous post about this episode involves the phenomenon of the gratuitous or needless apology.
To briefly recap: Rubin’s celebrity guest, Samuel L. Jackson, falsely and obnoxiously accused Rubin of confusing him with another black actor, Laurence Fishburne, thus asserting that Rubin 1) thought all blacks looked alike 2) was impliedly a bigot or racist as a result, 3) was unprepared for the interview, and 4) was unprofessional and should lose his job. Rubin apologized twice, first during Jackson’s unprovoked rant (for Rubin had not confused him with Fishburne, and it was Jackson who was confused and unprepared for the interview), and later, to everyone else, after headlines that his “racist mistake” had justly provoked Jackson were being repeated everywhere. Rubin said:
“We start right now with the beauty and the occasional pain of live television. First and foremost, I do know who Samuel L. Jackson is. I’ve interviewed him several times over the years, but never quite like the conversation we just had. I indicated to Samuel that I’d seen him during the Super Bowl, and he thought that I had confused him with the commercial Laurence Fishburne had done for a car company. Of course a “Captain America” ad had also run during the Super Bowl, but I immediately felt so dumb, I didn’t bring that up — and he gave me the shellacking that was well deserved. I pride myself on the fact — that unlike a lot of people who do this kind of work — more often than not, I really do know what I’m talking about. But I didn’t 30 minutes ago, and I’m really embarrassed about it, and I very much apologize to Samuel L. Jackson and anyone else who was offended for what was a very amateur mistake.”
This kind of apology, a coerced, false apology for conduct that warrants no apology, regret or forgiveness at all, does not appear on the Ethics Alarms Apology Scale, because while it looks and sounds like an apology, it is something else entirely. Good News On Business Ethics? Maybe: The Ethics Research Center’s 2014 National Business Ethics Survey
The Ethics Resource Center, a distinguished Washington, D.C. based ethics research and consulting firm, performs a survey of business employees every two years to measure trends in workplace ethics. It’s 2013 survey and report was released last week, and appears to bear good tidings. Workplace misconduct is on the decline, the data says. 41 percent of employees observed misconduct in 2013, way down from 55 percent in 2007. Moreover, ERC’s “National Business Ethics Survey,” which polled 6,400 U.S. employees, found that only 9 percent of employees polled felt pressure to compromise their standards in 2013, down from 13 percent in the previous survey in 2011.
ERC Chairman Michael G. Oxley (of Sarbanes-Oxley fame) said in a release,“The results of the survey are encouraging and show that companies are doing a better job of holding workers accountable, imposing discipline for misconduct, and letting it be known publicly that bad behavior will be punished.”
Among the survey’s intriguing findings:
- “Over the last two years, observed misconduct fell in every one of the 26 specific categories we asked about in both NBES 2011 and NBES 2013.
- “Pressure to compromise standards, often a leading indicator of future misconduct, also was down – falling from 13 percent in 2011 to nine percent in the latest survey.”

Zero Sum Ethics Encore: When An Unfair Firing Is Still The Most Ethical Course
Back in June, Ethics Alarms set off quite a donnybrook over a post about a second grade teacher in San Diego who was fired over concerns for the safety of staff and students after the teacher’s ex-husband came to the school to confront her. The teacher protested that the school was abandoning her when she needed support most, which was indeed true. But Ethics Alarms concluded…
“This is the kind of ethical conflict involving competing interests and obligations that only a balancing approach, utilitarianism, can address properly. The husband is Carie’s problem. He is not the school’s problem. It is not the students’ problem. It is not the children’s parents’ problem. I know it’s not an easy problem for her to solve, but she has no right to insist or demand that her inability to solve her problem should be permitted to put others at unnecessary risk…Sometimes ethics is a zero sum game, and someone has to lose. This is one of those times…”
Ethics conflicts (where two or more ethical principles are in direct opposition) necessarily require making tough choices, but many readers didn’t like the analysis, pronouncing it “cold.” “There has to be some other solution,” wrote one commenter. Certainly there are other solutions, but the school was obligated to choose the solution that resulted in the least risk to their primary charges, the kids.
And if children aren’t at risk?
That’s the question raised by the most recent occurrence of the zero sum ethics scenario, in which Nancy Lane, a popular Pennsylvania radio host, has been terminated by her employers because of the threats made against her and the company by her ex-husband. The ex, George Lane, is currently jailed for impersonating police. In the recent past he has repeatedly threatened Nancy, her family and coworkers, and last year hired someone to slash the tires of several company vehicles at Forever Broadcasting, Nancy Lane’s now former employers, who severed its ties with her by writing,
“Regrettably recent events involving your former husband has caused severe disruption to our business and has made this decision necessary.”

Ethics Hero: Michael Sam
Michael Sam, an All-American defensive lineman from Missouri and the Associated Press’ SEC Defensive Player of the Year, told ESPN Sunday that he is gay. “I am an openly, proud gay man.” Sam is projected to be a mid-round draft choice for the NFL draft in May. If he is drafted and makes the team, Sam would be the first openly gay active NFL player.
We shall see. Sam’s plan, he said, was to announce his sexual orientation after the draft, which might have been wiser and more practical, though not as ethical. He said that rumors were circulating, so he decided to come out now.
However he arrived at the decision, Sam’s candor is a courageous act, and I assume he will suffer for it. No NFL team has to draft him, and many teams that might have will not, presumably, simply to avoid the distraction of media scrutiny. If they draft him and cut him, will he claim that it was out of bigotry? Will he sue? I think most teams will decide that there are other similarly talented non-gay players available, and let some other team jump into these roiling social change and political waters. Continue reading
We Are All Dan Snyder Now
…and isn’t that a revolting development?
Few things infuriate me more than when unethical conduct by an individual or organization force me to side with the supporters of a position or a cause that I oppose myself. Last year, to cite the most egregious example, I found myself in the same camp with the National Rifle Association, Ted Nugent and worse when anti-gun zealots, uncritically backed by the news media, used dishonest, misleading, irrational and emotional appeals to try to pass more stringent gun ownership regulations on the wave of national horror over the Sandy Hook shooting. Indeed, the more fake statistics and shameless slippery slope arguments (“If we can save the life of only one child…”) that were aimed at guns and law-abiding gun owners, the more I saw the wisdom of Second Amendment absolutism.
Thanks to the exorbitant and irresponsible rhetoric by the likes of Diane Feinstein, Joe Biden, Andrew Cuomo, Piers Morgan, Jim Carrey and others—Don’t tell ME what I “need” to protect my family and home; there’s a possible serial killer on the loose in my Alexandria, Virginia neighborhood at this very moment who has been randomly knocking on doors and shooting people—I no longer trust the government to make rational decisions that affect my options as a potential gun owner. Good work, guys. Before you started using kids as props, lying about the number of shootings, and sounding for all the world like a nation trying to make sure only the government could own legal weapons, I was a supporter of more stringent firearms regulations. You lost me. I am officially convinced that we may need guns to protect ourselves against power-abusing people like you.
Now members of Congress are trying to strong-arm Washington Redskins owner Dan Snyder into changing the name of his football team, using the power of the government to pressure him, through the National Football League, into bending to their will on a matter that is absolutely none of their business. Great. Now I have to stand shoulder to shoulder with Snyder, whom we in the Washington area know as a spoiled rich kid, a bully, an egomaniac and a meddling fool who has progressively reduced the region’s beloved football team to tragic joke.
And you should stand with him too, if you think our Bill of Rights is worth preserving. Continue reading

I encourage the long form comment here, and Ethics Alarms has many commenters who are masters of the form. I feel badly about the many longer, well thought out essays-as-comments that I do not highlight as Comments of the Day, because they represent—well, most of the time—the kind of serious thought and original expression that most blogs, even many of the best, seldom see. Length is not virtue, of course, but ethics, as this post by texagg04, reminds us, is a vital topic that often does not yield answers that are easy, simple, or permanent. The post is in response to a statement from Fred, another trenchant commenter, on the thread’s discussion of whether a school is ethically obligated to allow single and pregnant teachers, if in its view this undermines its efforts to teach certain values and life choices to the young. Fred wrote:
““Doesn’t have to take the job” is not an ethical or legal excuse if there’s a discriminatory requirement not related to doing the job. Being pregnant while teaching does have some relation to the job. Mopping while Methodist doesn’t….There’s an ethics question in whether the school lived up to their religious principles and a legal issue of arguable sex discrimination.”

NFL Commissioner Roger Goodell’s Super Bowl Deception
Today millions of Americans will gather around televisions, partying and cheering the spectacle of young men maiming and killing themselves for our entertainment pleasure during America’s most popular sporting event, the Super Bowl. An unknown but significant number of those athletes, we now know, are likely to be unable to recognize family members by the time they are 45, and several may take their own lives in despair. Nonetheless, the official position of the National Football league is that all is well, and Commissioner Roger Goodell was touring the Sunday morning news shows to put out the propaganda claim that pro football is good for everyone, even the players who accumulate concussions like the rest of us collect aggravation.
Presumably to appeal to the large proportion of the Super Bowl audience who know little about the sport, as well as the gullible fans who do, Goodell told Fox News Sunday host Chris Wallace (who, if he had the knowledge, wit and integrity, should have stopped him and protested) in response to Wallace’s question about the NFL’s ongoing concussion scandal, that NFL players live longer and are on the whole healthier throughout their lives than the general population.
This is deception, and intentionally misleading.
Goodell is taking advantage of the fact that all the measures of the mortality of pro football players are flawed, which is why last year the NFL Players Union commissioned Harvard to do a 100 million dollar study of the health of ex-players and how to improve it. The union claims that the average age of death of an ex-NFL player is 57 years, which would directly contradict Goodell’s claim. This figure is supported by a 2011 study by the University of North Carolina, as well as insurance company actuarial statistics.
The figure, however, seems statistically unlikely. Measuring the life expectancy of any group of adult men, even those engaged in risky behavior, will yield an average life expectancy that is better than the general population. Why? Because men in the general population die as infants, children, young adults, and before they would be old enough to play football. Thus the NFL and defenders of the brutal game continue to promote the 2012 study that found that NFL players outlive the general population. If accurate—and the players find the study difficult to believe, as do I—it can be argued that this study is also flawed. It compares apples—strong, affluent, college educated upper-middle class men—to oranges–everyone else, including the poor, unemployed, uneducated and poorly nourished. Attempting to get around this problem, one blogger compared the deaths of NFL players to other celebrities whose death notices were prominently published. His conclusion: there was no denying the fact that pro football players appeared to die sooner that non-football players from the same general class, but there was no justification to believethe mid-fifties mortality figure.
So do we know how much playing pro football lowers life expectancy, or even if it does? No….and neither does Roger Goodell. The studies are in conflict. However, we do know that a disproportionate number of the players who may live well into their golden years will do so unable to think clearly, remember their children’s names, or care for themselves, because they accepted big paychecks to allow their brains to be permanently bruised and catastrophically damaged. I don’t call that living or being healthy, and Goodell shouldn’t pretend that it is, or cite as fact what is a disputed contention at best.
Playing pro football isn’t good for you, and if the studies ultimately prove that ex-NFL players are really likely continue breathing as long as the rest of us despite their brain injuries, that just helps us understand why they have been killing themselves.

Ethics Hero: Dylan Farrow (and Observations On Her Open Letter To Woody Allen’s Fans)
Dylan Farrow was 7 years old when, she alleges, her adoptive father Woody Allen began sexually molesting her. Although this became the focus of the legal and public relations battle between her mother, actress Mia Farrow and Allen as their once romantic and domestic relationship—-already destroyed by Allen’s courtship, seduction and marriage of Dylan’s older, also-adopted sister Soon Yi—exploded onto the scandal sheets more than 20 years ago, the now-married Dylan has never spoken out about it herself, though her mother and other siblings have. Allen avoided any criminal charges despite an investigation that found probable cause, and his popularity among film-goers and his stature in Hollywood seemed to be undamaged. Last month, however, a lifetime achievement award at the Golden Globes (accepted by a fawning Diane Keaton) re-opened the unhealed wounds for the Farrows, and Allen’s Oscar nomination last week for his original screenplay for “Blue Jasmine” was apparently too much.
Now Dylan Farrow has decided to tell her own story, and has done so in open letter form, published on the blog of New York Times columnist Nicholas Kristof.

Facebook’s Promote Policy: Annoying And Perhaps Stupid, But Unethical?
I have been wading through the many online complaints about Facebook’s aggressive policy, begun in earnest back in 2012, of reducing the number of “friends” a Facebook user’s posts reach (by about 85%) and then charging the Facebook user a fee to reach more of them. Frankly, as a less-than-intense Facebook user who necessarily spends most of his web-content time running a blog, I didn’t even pay attention to the “promote” button, and wasn’t even aware of the change. The Facebook revenue-generating move is described here and here, but what happened is pretty simple and easy to understand. Having sucked a lot of people, groups and businesses into using their free service to reach family, friends, like-minded souls and potential customers, Facebook then changed the rules and is now charging for them to get the same reach that was free for quite a while. Is this unethical?
Some, indeed many, think so. Here is the New York Observor:
“This is a clear conflict of interest. The worse the platform performs, the more advertisers need to use Sponsored Stories. In a way, it means that Facebook is broken, on purpose, in order to extract more money from users. In the case of Sponsored Stories, it has meant raking in nearly $1M a day.”
This is Dangerous Minds, in a widely circulated attack on Facebook called “I want my friends back”:
“It’s perhaps the most understated stick-up line in history, worthy of a James Bond villain calmly demanding that a $365 million dollar ransom gets collected from all the Mom & Pop businesses who use Facebook. How many focus groups do you reckon it took until Facebook’s highly paid marketing and PR consultants finally arrived at such an innocuous phrase for describing information superhighway robbery?”
Robbery? Conflict of interest? A hold-up? Bait and switch? This is the kind of tantrum that shows how easy it is for unscrupulous politicians to use the profit motive, free enterprise and capitalism as cheap scapegoats for every problem under the sun, all the better to build support for a massive, all-powerful government that will make everything right, and ensure that we all have lollipops and rainbows regardless of talent, effort, hard work or the cruel turns of fate.* Facebook created this service millions use for free—how dare the bastards try to make money out of their ingenuity and enterprise?
