Is It Fair For A Business To Discriminate Against the Homely?

The EEOC is investigating a popular Boston area coffee shop chain, alleging that it discriminates in favor of attractive young waitresses to the detriment of older or more homely waitresses. The management of Marylou’s disputes the accusation, arguing that its hiring pool is disproportionately young and attractive.

I don’t want to get into the actual guilt or innocence here, but rather muse about the ethical issue. Should there be laws preventing employers from using attractiveness as a criteria in hiring, if it is relevant to the success of the business, or even if it is not? If a coffee shop owner’s patrons are overwhelmingly male, and the owner believes that having waitresses who look good in a starched uniform makes the customers happy and more likely to spend their money, why should the law prevent that? The Fojol Bros., Innocent of Racism, Political Correctness Victims

In its advanced stages, 21st century political correctness becomes a kind of delusional illness, causing sufferers to interpret  benign, harmless and even socially healthy conduct as offensive and sinister. An outbreak of this variety of political correctness is in full flower in Washington, D.C., where more than the usual number of officious defenders of that which needs no defending are trying to gin up public outrage against a creative, fun, and successful small business enterprise, Fojol Bros.

The company sends food trucks around downtown D.C. and serves strangely named hybrid ethnic dishes inspired by Indian, Ethiopian and Thai cuisines. The Fojol employees who hand out the delicious fare wear turbans, robes and fake mustaches,  claim to hail from  “Merlindia” and “Benethiopia,” and go by names like “Kipoto.” This was once called “theater” and “fantasy,” no more offensive than Disney employees in Frontierland dressing in cowboy and saloon girl garb and calling themselves “Tex” and “Lilly.” Now some are calling it “offensive,” because too many people have forgotten what offensive is. Integrity Check For Obama Supporters: Is This Really How You Want The Campaign To Go?

On the heels of Newark Mayor Corey Booker’s criticism of the Obama campaign’s anti-Bain ad and his subsequent simpering recant, an interesting thing happened: some people actually checked the ad for fairness and accuracy…never mind that it was widely interpreted as an anti-capitalist statement in the world’s most successful capitalist nation. Part of the impetus for the check was loyal Democratic consultant and spin-master Lanny Davis announcing on television that the ad was deceptive in more ways than one.

If you have not seen the spot, here it is:

It tells the story of the demise of  GS Industries through interviews with sad-eyed, salt-of-the-earth workers who accuse Bain of buying their town’s small steel company to destroy it. 30-year steelworker Joe Soptic tells the camera,  “They made as much money off it as they could. And they closed it down, they filed for bankruptcy without any concern for the families or the communities.” Jack Cobb, a another steelworker, calls Bain “a vampire. They came in and sucked the life out of us.” Things were going fine, they all say, until Bain Capital, under the leadership of Mitt Romney, bought the company and soon sold them down the river, laying everyone off and pocketing a huge profit. How that would work…how buying a company and its equipment and then quickly shutting it down would be profitable….is never explained, because actual information is irrelevant to the makers of the ad. The point of the Obama campaign is to contrast the intercut video of Mitt Romney saying he created jobs with the weather-beaten faces of hard-working Americans who say he threw them out of work to funnel money to his rich friends.

Deceit, you’ll recall, is when one uses facts to deceive, usually by omitting other facts that make the revealed facts understandable. Deceit is a form of lying, a very effective and insidious form. President Obama’s anti-Bain ad is, beyond question, deceitful, and deceptive, which means that in this instance at least, so is he. For he, Barack Obama, “approved this message.” Continue reading

Ethics Alarms Lubricant 1: Jennifer Rubin on Intimidating the Supreme Court

Whatever one may think about the Constitutionality of the individual mandate provision of the Affordable Care Act, also known as “Obamacare,” it is a difficult and complex question. Anyone who argues otherwise 1) doesn’t know what they are talking about, 2) is lying, or 3) is basing their opinion on ideological considerations rather than legal ones. The members of the Supreme Court, which must decide the question (and in fact have almost certainly decided it) do know what they are  talking about, and while they all have ideological tilts in the sense that each gravitates to a particular Constitutional philosophy, political considerations, ideas pushed by the media and the popularity of particular legislation are supposed to play no part whatsoever in their deliberations.

The degree to which the Democrats, led by President Obama, have attempted to intimidate, hector and insult the Court into deciding the case in favor of the mandate is unprecedented in my lifetime, and I think it is unprecedented period. The advocates for the law had its legal representative make their case before the Court, and by all accounts he either botched it, or didn’t have points strong enough to withstand the challenges posed by the Justices in oral argument. Fearing that their landmark legislation that was passed by a whisker will topple because of the flawed cornerstone that its architects foolishly, arrogantly and unnecessarily placed at its foundation, Democrats have been pre-emptively impugning the honesty of the Court, essentially arguing that if the law is overturned, it will only be because of political favoritism and bias. It has been a disgraceful display, and is a despicable tactic. Continue reading

Insidious Bias: CNN’s “Question of the Day”

“Today’s CNN Question of the Day: Do zombies make good Presidents?”

It is increasingly obvious that as President Obama’s re-election prospects appear more perilous, the mainstream media will throw objectivity, fairness and journalistic ethics to the winds in order to improve his prospects. Is this unfair, irresponsible and dishonest? Of course.

The trend is only beginning, but it is alarming to speculate how much worse it will get. It is only May, and the Washington Post has already published anti-Romney hit-pieces based on a prep school hazing incident and, this week, an 1897 massacre perpetrated by Mormons on Arkansas settlers. Yes, that’s “news” if you are dedicated to protecting your favorite President, and the fact that his Justice Department appears to be engaged in an illegal cover-up and obstruction of justice isn’t.

CNN’s mornings, meanwhile, are fast becoming the site of blatant and insidious Democratic Party propaganda. I swear, it wasn’t my fault: I have sworn off watching CNN’s twin Obama operatives, Soledad O’Brien and Carol Costello, for their routine pro-Democratic bias and sly Republican bashing, but my wife had switched on CNN just as I came into the living room to drink my first cup of coffee. Just as I reached for the remote, Costello made my head start to explode one more time, announcing, “The Question of the Day for viewers: Do CEO’s make good Presidents?” Continue reading

Newark Mayor Cory Booker Recants

Don’t feel bad, Mayor. Galileo understands.

When, I wonder, will the political parties realize that having spokespersons with proven credibility and integrity, who will speak the truth and not embrace cynical, misleading talking points, can only help the parties’ causes? Based on the sad Corey Booker episode, I’m guessing the answer is “Never.”

The Obama campaign, taking its cue from New Gingrich (which itself is disturbing), put out what can only be called an anti-capitalism ad, condemning Mitt Romney’s leadership of  Bain Capital, a private investment firm that acquires companies, streamlines and repairs them to make them profitable, or liquidates them if they are not. The ad relies on breath-taking ignorance of how investment and business creation works, but fits nicely into the Occupy Wall Street mythology. For a President trying, theoretically, to get the economy humming again, it was a stunning example of campaign deceit.

Cory Booker is Newark’s Democratic mayor, a devoted Obama supporter, and like his state’s Republican Governor Chris Cristie, remarkably willing to tell the truth, for someone in his field. On Sunday’s “Meet the Press,” Booker pronounced the Bain ad “nauseating”:

“If you look at the totality of Bain Capital’s record, they’ve done a lot to support businesses, to grow businesses. And this [the ad], to me, I’m very uncomfortable with….I have to just say, from a very personal level, I’m not about to sit here and indict private equity. I live in a state where pension funds, unions and other people are investing in companies like Bain Capital.” Continue reading

Ethics Dunce: Safeway…Ethics Hero: Ryan Young. Justice? Waiting…

“You’re suspended, Kent.”

I’ve asked many times on Ethics Alarms why so many Americans stand by, inert and passive, when a fellow citizen is in peril.  Maybe the stunning ethics blindness exhibited by Safeway in a recent incident is part of the answer.

Ryan Young, who works in the meat department of a Safeway grocery store in Del Rey Oaks, California, was on the job when he witnessed a man beating a pregnant woman, apparently his girlfriend. Young told the man to stop, but he continued with his assault, shoving and kicking the her.  Young jumped over his counter, pushed him away, and ended the attack.

His reward was to be suspended without pay. Safeway has a policy that directs employees to summon security personnel and not to personally intervene when they see a crime or fight in progress. Even though police confirm that Young may have saved the woman and her unborn child from serious injury, the company is insisting that Young’s conduct warranted discipline, not praise. Editor, Plagiarist and Ethics Dunce Extraordinaire Robert Ripley Meets His Worst Nightmare…

….and that nightmare is Duane Lester, a hard-working, honest, courageous, organized and determined blogger who wasn’t going to let a newspaper rip him off and get away with it. Lester researched and posted an original local news story, a true scoop, and days letter was shocked to find that a local paper, the Oregon Times Observer, had lifted his entire post and put it on the paper’s front page, without credit, permission, or attribution. Shocked and unprepared for such flagrant and shameless appropriation of his labors, he researched the issue, wrote a letter, and then visited the paper to demand payment. Brilliantly, he also brought along a friend with a video camera.

The whole story, as well as the enlightening and satisfying confrontation between the Blogger and the Word Thief, is on the resulting video. There is a lot to see here.

Occupy Eduardo Saverin

Too bad for Severin that they don’t make students read this any more.

You use the culture, markets, resources and freedom of the United States to turn your innovation into a fortune, and when your nation needs you, more than ever, to contribute your fair share to address its serious economic crisis, you decide to flee to foreign shores.

 That’s Facebook co-founder Eduardo Saverin.

Despicable.

Occupy Wall Street and its offspring engage in slander and bigotry by characterizing all wealthy, successful individuals as selfish leeches, but their stereotype fits Saverin like a wetsuit. As his company is poised for a public offering and his shares in it are about to lay golden eggs, he has decided to give up his citizenship, and his tax obligations, to live in luxury in Singapore. This will save him at least 67 million dollars in taxes, and probably more. His lawyer-spokesman says that the timing of Saverin’s exodus is coincidental; he just had an overpowering desire to live in Singapore.

Right.

Well, good riddance. The U.S. needs his money, and had a right to it, but it doesn’t need him. He is an ungrateful, greedy and selfish wretch, and richly deserves to be remembered as this generation’s Philip Nolan, “The Man Without A Country.”

The Yahoo! Mess

Yahoo’s CEO, Scott Thompson, just “resigned” from his post after it was clear that he was going to be sacked. He had been on the job just four months. Why the sudden exit? A simple Google search by a Yahoo! board member revealed that Thompson had lied on his résumé, claiming to have a degree in computer science. This opened a can of worm, Pandora’s box, and an ethics cornucopia, all wrapped in one:

  • Thompson’s initial response was that the mistake was “inadvertent,” and that he regretted not having caught the error. This attempt t0 brass his way out of deception of his own making should probably ensure that he never leads another company. If he had taken 20 seconds to think about it, Thompson would have realized that using a second lie to try to cover the first would only make it clear that his curriculum vitae fabrication was not an aberration. Naturally, it was quickly discovered that he had the same fabrication on his résumé when he had applied for his previous job. Continue reading
