Ethics Corrupter of the Year

(Awarded to the unethical public figure whose prominence, popularity and success most corrupts the public’s ethical values)

Janay Palmer Rice, beloved punching bag of NFL star Ray Rice, who was caught on camera smooching with her man shortly after being cold-cocked by him in a hotel elevator, married him, and has repeatedly defended her husband, prompting confused female pundits to defend her. She is not only the embodiment of Rationalization #42. The Hillary Inoculation, or “If he/she doesn’t care, why should anyone else?”, she is also a good bet to get some young women killed by giving them a role model who stands for standing by your abusive man with the hard right hook.

Double Standard Of The Year

In a year of double standards, the treatment of soccer star (and accused child abuser) Hope Solo by her sport, feminists, the media and the public takes the prize. The standard, as I understand it, is that big, strong female athletes can beat up smaller, weaker family members with impunity, and it’s no big deal, but when a male athlete does the same, he is scum. Got it.

Uncivil U.S. Official of the Year

Victoria Nuland, Assistant Secretary of State for European and Eurasian Affairs and the top American diplomat in Europe, was caught saying in a viral Youtube video saying “Fuck the EU.”  Now that’s diplomatic. Of course, she wasn’t fired, because she works for the Obama Administration

First Lady Michelle Obama, who helped her husband make the U.S. look weak and ineffectual (he needs no help), by engaging in this ridiculous effort at hashtag diplomacy. Those kidnapped girls were never found, and Boko Haram, the Nigerian terrorist group that took them, I learned today, just killed a reported 2000 more victims. Time for another sad picture, Michelle!

Most Unethical Sports League

The NFL, last year’s winner, was even more unethical this year, with the Ray Rice and Adrian Peterson fiascos, Commissioner Roger Goodell showing no innate instinct for right and wrong and both the league and its teams making up rules and policies according to talk show calls, polls and wet fingers in the air. Meanwhile, it’s still making billions paying young men to lobotomize themselves. What a great sport.

Sports Cheat of the Year

Alex Rodriguez, suspended Yankee star, had denied, denied, denied, threatened to sue Major League Baseball and the union, and insisted that he had not, as an investigation had determined, used performance enhancing drugs supplied by Biogenesis. Then, just as his season-long suspension was lifted, it was revealed that A-Rod had, under oath, admitted using steroids from 2010 to 2012.

Michael Fine, the Ohio lawyer who allegedly hypnotized female clients in order to sexually molest them.  Runner Up:  Alexa Van Brunt. She didn’t do anything unethical; she just advocates ethics rules that would eliminate the core of legal ethics, proving that she doesn’t understand her own profession.

Unethical Judge of the Year

Wade McCree, the handsome devil pictured above (he circulated this selfie), who, presiding over a felony child-support case, conducted a secret sexual relationship with the woman seeking support from the defendant. This was just the latest of his embarrassments.  Runner up: Texas District Judge Jeanine Howard, who handed down a stunningly lenient sentence of probation and 250 hours of community service at a rape crisis center for a man who confessed raping a 14-year old girl at her school.

 

Unethical National Broadcast Journalist Of The Year

CNN’s Carol Costello. She was biased, smug and incompetent all year long, but reached her nadir when she gleefully played a recording of Bristol Palin explaining to police how she had been assaulted, saying to her viewers, “You can thank me later.” She refused to apologize on the air, or to Palin. Observations On The ACLU And “Grand Juror Doe’s” Power Play

In a move that tarnishes the reputation of the ALCU and reveals the deep ideological bias in its ranks, the Missouri chapter of the esteemed organization has encouraged a Ferguson grand juror to sue in order to end the lifetime ban on grand  jurors revealing what occurs during proceedings, allowing the juror to become a media star and, presumably, undermining the credibility of the deliberations that resulted in no indictment against Officer Wilson for his fatal shooting of Michael Brown.

Observations:

1. Grand jury proceedings have to be confidential, or the system will not work (yes, it worked as well as it possibly could have in Ferguson.) Secrecy prevents those who are being investigated from interfering with witnesses and otherwise tampering with and attempting to corrupt the investigation. It protects witnesses who might be reluctant to testify if they believed their comments would be made public. It decreases the likelihood that one who is about to be indicted by a grand jury will flee and thereby avoid being brought to trial on those charges. It also protects innocent individuals whose names may be implicated in a grand jury investigation but who will never be indicted.

2. The prohibition on participants in grand jury proceedings revealing what occurs there is not a restriction on free speech any more than a government employee being prohibited from revealing national security information. This is a necessary restriction based on due process and the functioning of the rule of law, and grand jurors agree to the prohibition as a condition of service.

3. The ACLU is grandstanding for its progressive, civil rights zealot fans and contributors. This is an irresponsible case: if it prevailed, the justice system would be thrown into chaos.

3. If even one grand jury is able to have the ban on secrecy lifted, every grand jury will labor under the fear of those involved that jurors will speak to the media and reveal harmful details. I will be shocked if the ACLU lawsuit succeeds. I think it is a frivolous suit, and a violation of legal ethics Rule 3.1 that prohibits such actions.

4. The grand juror who is seeking the lifting of the ban has arguably already revealed more than he is allowed to do legally under the law, which prohibits disclosing “matters occurring before the grand jury.”

5. The supposed explosive revelations the juror wants to expand upon are nothing at all, just ignorant and biased complaints that have already been thoroughly explored and debated by legal experts. The likes of progressive website Think Progress falsely represents the juror’s views as “significant” because progressives so, so desperately want to prove that Michael Brown was executed by a racist cop who was corruptly exonerated by a biased prosecutor. But as Gertrude Stein said of Oakland, there is no there there.

2014 was the year of the Ethics Train Wreck. They were coming so fast that they were getting tangled up with each other, and old wrecks from past years started rolling again, or the damage that was triggered a year ago or more started kicking in. I don’t know if every year really is more ethics free than the year before, or that it just feels that way because I’m getting better at sniffing it out. By any standards, it was a wretched year, with epic ethical misconduct across the culture. But I can’t stall any more: let’s wade into it. There will be more installments this year, so the misery is coming in smaller bites. You’re welcome.

It’s a tie!

The Ferguson Ethics Train Wreck and The Obama Administration Ethics Train Wreck

The obvious winner is the Ferguson Ethics Train Wreck, which has managed to hook up with the 2012 winner, The Trayvon Martin- George Zimmerman Ethics Train Wreck, as well as a the sub-EthicsTrain Wreck attached to the death of Eric Garner, to further degrade U.S. race relations, undermine the stability of numerous cities, get several people, including the recently assassinated NYC police officers killed, revive race riots, give vile demagogue Al Sharpton unprecedented power and influence, and pick up such distinguished riders as President Obama,  Missouri Governor Jay Nixon, New York Mayor de Blasio. It is also still barreling along at top speed after many months, and is a good bet to continue its carnage well into 2015. 

Yet, it became clear to me this summer with this post that the entire Obama Administration has become an Ethics Train Wreck, and one that is neck-and-neck with the one spawned in Ferguson in threatening short and long-term damage. Incompetence, dishonestly, lack of transparency and arrogance have hardened cynicism in the public, corrupted the ethical values of defenders, let journalists to disgrace themselves, and fertilized festering potential disasters internationally and domestically. This is also, I now see, a wreck of long duration that started in 2009, and had gathered momentum with every year. It also has sparked other wrecks, including the one that now keeps it from being the sole 2014 winner. How much damage will The Obama Administration Ethics Train Wreck do in 2015? Which agency or department will prove itself to be corrupt, incompetent and mismanaged, which official will continue in a post after proving himself unfit to serve, which inept pronouncement or abuse of power will further degrade American trust and freedom?

I’m not looking forward to learning the answers.

Fraud of the Year

The U.S. Justice Department, which allegedly participated in a plot to force  Sierra Pacific Industries and other defendants  to pay $55 million to the United States over a period of five years and transfer 22,500 acres of land as settlement of charges brought against the company by DOJ for causing a 2007 wildfire that destroyed 65,000 acres of land in California. Naturally, the national news media has barely covered this scandal, which is still in litigation. Runner Up: The Victoria Wilcher scam, which made KFC pay for plastic surgery for a little girl when there was no evidence that the company was in any way involved with her injuries. Can’t Win, Can’t Break Even: If You Need To Apologize For Saying “All Lives Matter,” Why Not Apologize For Resolving To Challenge Racism?

We have a reverse Smith in Pittsburgh.

You will recall that Smith College president Kathleen McCartney attempted to  show support for her students  protesting racism and police brutality by sending a campus-wide email titled, “All Lives Matter, ” and came under fire by campus activists because the protest slogan was “black lives matter.” She quickly apologized,  saying that she didn’t intend for “all lives matter” to be interpreted as rebuttal to “black lives matter.”

Now, in Pittsburgh, the Chief of Police is being attacked by his own officers who say that this photograph, posted on Facebook…

…accuses them of being racists.

Touchy, touchy….?

The problem is that the Chief is endorsing a slogan of a group called Fight Back Pittsburgh, which has engaged in anti-police rhetoric in the past and carried signs saying “End White Silence” in protest marches.  It describes itself as a Pittsburgh-based collective (I would call it a Marxist group) with the mission of creating a world that is free of destructive white privilege and oppression. OK, Fight Back Pittsburgh sounds like a group of racists to me. But the message of the sign is hard to take offense at. Who isn’t obligated to challenge racism at work? Continue reading →

The NYPD Turns Its Back On De Blasio: What’s Going On Here?

The rift between New York Mayor de Blasio and his city’s police department  is more than an internal spat. It has the potential to divide and harm the city and citizens, not to mention crashing the Mayor’s already self-jeopardized political career early in his term. Both sides if this dispute committed hostile acts that the other considers grievously disrespectful. Neither combatant appears ready to apologize.

De Blasio crossed what many of his department’s officers consider an uncrossable line when he suggested, in the immediate wake of the grand jury’s decision not to indict in the Eric Garner case, that his own bi-racial son was at risk of harm should he be apprehended by the NYPD. As I have written before, this was not, as the spinners would have it, just a case of a mayor being candid about genuine problem in community relations. This was a tacit endorsement of the “hands up” protests and their contention that Garner, Mike Brown and others were the victims of police racism, that police are killing, likely to kill, want to kill, black kids. It doesn’t matter that de Blasio may not have intended that implication: under the circumstances and in the context of events, this is what police officers interpreted his remarks to mean. He was siding against them. He was suggesting that the grand jury was wrong not to indict. He was suggesting not that some NYPD officers were racially biased, but that black children like his son “may not be [Translation: “are not“] safe from the very people they want to have faith in as their protectors.”

The police have responded with multiple demonstrations of anger and contempt for their boss. Most recently, there were boos and jeers when De Blasio spoke at a police graduation ceremony this week. Over a hundred officers symbolically turned their backs when the mayor spoke at the funeral of Officer Rafael Ramos, who was assassinated by a man who suggested that he was seeking vengeance for the deaths of Garner and Brown. That had followed the theme of an airplane-towed banner over the city that read,“Our backs have turned to you,”which in turn was inspired by the spontaneous gesture by officers present when de Blasio visited the hospital where the bodies of Officer Ramos and his partner lay.

The New York Times, which has been guilty of bolstering the “hands up” lie by carelessly linking the deaths of Brown and Garner as well as Trayvon Martin, none of which can be fairly blamed on racism based on available evidence, has come down squarely against the police, writing in an editorial: Continue reading →

“Doonesbury’s” Unethical Late Hit On The University of Virginia

The Rolling Stone-“Jackie”-University of Virginia ethics train wreck has claimed another victim, and an unlikely one: “Doonesbury’s” characters, who have been led astray by cartoonist Gary Trudeau and the newspapers that carry his popular strip.

In the episode that ran yesterday, the campus bimbo-turned-feminist “Boopsie” ranted about sexual assault cover-ups of by institutions, and singled out the University of Virginia as a culprit, forbidding her college age daughter from attending school there. [ Notice of correction: I am informed by a reader that “Sam” is Boopie’s daughter, not her son as I wrote originally. Thus she is forbidding her daughter from attending a school where she thinks she is likely to be raped, rather than forbidding her son from going to a school where major magazines will unjustly accuse his fraternity of being a cult of rapists. I apologize for the error.] The premise was based on the anonymous allegations of a fraternity campus assault that were turned into a sensational expose by a feminist reporter with an agenda, and guilelessly published in Rolling Stone without confirmation, fact-checking, or a minimal level of ethical journalistic practices. “Jackie’s” rape accusations have been shown to be substantially or completely fabricated, and story has been thoroughly discredited for more than three weeks.

KABOOM! or Unethical Quote of The Month? You Decide…I Can’t, Because My Head Just Exploded All Over The Christmas Tree

“I actually think that it’s probably in its day-to-day interactions less racially divided.”

—President Obama on National Public Radio, giving his assessment of race relations in the U.S. today compared to when he was elected in 2008.

It’s kind of pretty, really.

That explosion (see Kaboom!) was based—I’m guessing now, since I don’t control when my brain blows—-on my shock that the President actually could be President and believe that, as well as not be aware how deluded he appears to assert such something so contrary to evident reality. Is he really that estranged from what is happening in the country he leads? Frightening. Is he really incapable of comprehending the single biggest, most damaging, most unexpected and most dangerous failing of his entire administration? Pathetic. Does he not watch TV? Read blogs? Does he exist in a separate, narcissist parallel reality where everything is as he wills it to be? Wow.

I know that the networks he watches and the newspapers he reads didn’t report them for the most part, but every poll shows that the public overwhelmingly believes that race relations have worsened. You can dispute the value and accuracy of polls with considerable justification, but these are the kinds of polls most likely to be accurate. How plausible is it that race relations, defined as how the races feel about each other and how they are getting along, could improve with the public believing they have worsened? Here’s polls from Pew, Gallup (“The percentage of Americans naming “race relations” or “racism” as the most important problem in the U.S. has climbed dramatically to 13%, the highest figure Gallup has recorded since a finding of 15% in 1992, in the midst of the Rodney King verdict.”), NBC, IDB ( “By an almost 3-1 margin, Americans say race relations have worsened under the man who was supposed to usher in a golden era of “post-racial” relations.”), Bloomberg, and Politico, and there are many others, all with the same message. Moreover, all of them were taken before the ‘killer racist cops ‘ campaign by Sharpton  and his cohorts culminated in the assassination of two police officers by a deranged African American seeking to take “two of theirs for one of ours.” Let’s see a show of hands: how many think race relations have improved in the last two weeks?

The “Non-Violent Protest” Lie

The leaders and participants in the protests related to incidents of excessive police force and violence—real, imagined, manufactured or equivocal—are creating an environment of racial distrust, fear and hate that cannot avoid  resulting in violence. Yet astoundingly, they not only deny the natural consequences of their words and rhetoric but feign indignation (and racism, of course) when the effort, long underway with the assistance of such accomplices as Eric Holder, Barack Obama and Bill De Blasio, is properly condemned as the dangerous and reckless attack on society that it is.

I am not sure which amazes me more: that demagogues like Al Sharpton would have the audacity to proclaim that his organized campaign of hate against police, accusing them of being both racist executioners and the embodiment of a racist justice system, or the caliber of pundits who have rushed to Sharpton’s defense. How can this be? African-Americans are told, for years now, that whites with guns are hunting them; that police are determined to kill them, that the justice system is rigged to let the carnage continue. The carriers of this message includes members of Congress, celebrities, civil rights activists, the Attorney General and the President of the United States. False accounts that support this gross characterization of  disparate incidents, each with unique circumstances, are turned into rallying cries, such as “Hands up! Don’t Shoot!”  The left-biased media openly endorses the narrative, which says that black Americans are being hunted coast-to-coastby an armed force, determined to kill their children.

Just A Reminder: I Warned About This From The Start, Almost Three Years Ago

The Ferguson Ethics Train Wreck, which encompasses the shooting of two police officers in New York City, is just the second section of the Trayvon Martin-George Zimmerman Ethics Train Wreck. The coordinated effort to represent the American justice system as hostile to blacks, and white society as determined to harm them, was launched in Florida in early 2012, nearly three years ago.  It might have failed then, as it deserved to since there was no genuine racial element in the actual Martin-Zimmerman episode, had not the President of the United States used his bully pulpit, credibility with black Americans and the power and influence of his office to declare the local incident as emblematic of societal hostility to African-Americans, and Obama personally. This, as I wrote earlier this week, lit the fuse that exploded into racial violence against police this past week.

I saw it then. I have seldom seen anything more clearly.  So I wrote:

What does {Obama] think he’s doing? Teens, children and adults are murdered every day, many of them right where Obama lives, in Washington, D.C. Aren’t all of the violent deaths “tragedies”? Why is this one, and only this one, worthy of specific presidential attention? Is it because black leaders called for the President to overstep his proper role? Who cares what activists call on the President to do—certainly he shouldn’t. Does this now justify their calls for retribution and violence, or validate high school students who are staging walk-outs to protest law enforcement officials investigating a case before they make any arrest? (Are high school students now empowered to dictate law enforcement policy? Suspend every single one of them.)

What earthly difference does it make what Trayvon looked like, who his death makes the President think about, or whether he looked like the son Obama never had? So what? What if he looked like my son? Not good enough? When a white, Hispanic or Asian kid in a hoodie is shot by some gun-wielding hysteric, can those parents also count on a statement of concern by Obama? What if they are just run down by a drunk driver, or killed by being left in an over-heated car? Not tragic enough? Doesn’t strike the same chord of of “seriousness”? Or will these tragic deaths not be viewed as sufficiently important to the President’s “base” in an election year? Do you think these questions are unfair? Who laid the groundwork for them?

Misusing his office and prestige in such matters simultaneously diminishes the presidency and warps its function. The position has always included the role of Mourner-in-Chief, at times of genuine national tragedies, such as the Twin Tower bombings, the Challenger disaster, and Pearl Harbor. Cheapening this solemn function by intervening in local crimes and contentious race-charged controversies accomplishes nothing positive: it is divisive, intrusive, and dangerous.

Got that? Dangerous. I chose that word deliberately. March 12, 2012.

Reading the comments again now is fascinating: readers conservative and liberal denounced my criticism as unfair, after the usual “Bush did it too” spin from the reflex Obama defenders.

After The Brooklyn Cop Murders, The Sound Of Spinning: WindyPundit Takes On My “Smear”

Mark Draughn, a.k.a Windypundit and the Ethics Alarms 2013 “Blogger of the Year,”  has swallowed the Kool-Aid, apparently, and decided to defend the race-baiters, from the tippety top of our government to the stygian depths of MSNBC, who have finally managed to get police killed in retaliation for the “racist murders” of Michael Brown, Eric Garner, and others. In his most recent post he challenged my analysis, and ended up making me feel pretty good about it. I love Mark’s blog and admire Mark’s mind, and if can’t do any better than this, I am obviously on firm ground.

I want you all to visit Windypundit, for Mark is terrific (usually), so I’m not going to go through the whole post, which you can read here. I will make a few salient observations though. Let’s play “Mark Says”:

“I knew there would be people who would take Brinsley’s reputed motive and use it to smear protesters and activists who had spoken out against police abuse.”

1. Mark wrote this before my straw man post, and sure enough, he followed the script. It’s about “police abuse.” Right. Not race. Not the racism of whites, the hunting down of black men; not about how blacks can’t get justice even when they have been gunned down with their hands in the air. Indeed, it’s not “about” any of the irresponsible, exaggerated, inflammatory accusations that we have been hearing since Trayvon Martin was shot…and not by a cop, either.

2. “Reputed motive.” Mark thinks I am unfair to conclude that a killer who wrote online that he was going to kill some “pigs” in retaliation for police killing Mike Brown and Eric Garner killed the two police officers in retaliation for police killing Mike Brown and Eric Garner.  Got it.

3. I’m smearing protesters! These are, recall, protesters who, by their use of the “hands up, don’t shoot” theme, were smearing a specific police officer with the false claim that he was a racist and a murderer, though the evidence says otherwise, and smearing the integrity of the citizens on the grand jury who refused to indict him.  By extending this smear to police generally, they were also asserting that this—that is, the fictional racist murder of that “harmless, unarmed black teen” who had just tried to take the officer’s gun and was charging all 300 pounds of his body at Officer Wilson—was the potential orientation of all white police.  I was smearing them by pointing out that this was divisive, inflammatory, dishonest and irresponsible.
