Awww! YECCHHH!

Director Glenn Weiss made a surprise proposal to his longtime girlfriend Jan Svendsen during his Emmy Awards acceptance speech.

The Ethics Alarms rule, hinted at in other posts, is that anyone who issues a marriage proposal in public, putting unethical pressure on his or her loved one to accept, should be rejected on the spot. The act is unfair, disrespectful, and signature significance for a jerk and a bully who is unlikely to be a pleasant life partner. This goes for sports stadium TV screen proposals, but Weiss’s version is especially bad: the coast-to-coast live TV proposal.

It was unethical in other respects as well. The Emmys aren’t license for any winner to hijack the show  and divert it for his or her own  personal objectives.  Making an acceptance speech into political rant is wrong, but the recent culture of award shows has ratified the obnoxious practice: that’s why the ratings for awards shows are falling like ripe apples in October. In Weiss’s case, there was also the hypocrisy factor. He has produced and directed 18 Tonys telecasts for CBS, and is known “as an unforgiving stickler when it comes to keeping acceptance speeches to the allotted 45 seconds.” One theater exec told Page Six that “every year, Glenn gives this pompous speech to all the nominees, lecturing everyone about how the clock starts the second your name is called and that going long is unfair to your fellow nominees because it eats time for everyone whose categories come later in the evening. Leave it to him to completely flout his own rule in order to grab as much attention as humanly possible for him and his girlfriend.”

Sunday Morning Ethics Warm-Up, 9/16/2018: “Ozark,” Slandering Irving, And Language Showdown At Taco Bell [UPDATED!]

Good Morning!

1. Call me an old ethics fogey, but I don’t think these kinds of TV series are culturally healthy. I’ve been watching the Netflix series “Ozark,” and hating myself for it. The show is well acted and even has its ethics dilemmas, but like “Breaking Bad,” which was obviously its inspiration, there are no admirable characters, and the “heroes” are criminals. In the Golden Age of TV, there were unwritten (and sometimes written) rules that shows could not rationalize, trivialize or romanticize illegal, immoral or unethical behavior, and needed to reaffirm positive values. In “Ozark,” “Breaking Bad” and “Better Call Saul,” the latter’s spin-off, as well as “House of Cards,” and “Shameless,” among others, there are virtually no admirable characters at all. I have been watching “Ozark” in part because I like the actors, in part because there’s nothing I want to watch anywhere else except baseball, and, yes, in part because of voyeurism. Still, it makes me want to take a shower, and I fell that the increasing tendency of Hollywood to portray everything and everyone as corrupt makes a “the ends justify the means” rationalization seem like a matter of survival.

2. Post-mortem slander, again. This is a recurring theme here: a famous person is deliberately misrepresented in a dramatic depiction, and legally there is nothing that can be done about it. The First Amendment protects the practice, but it is still wrong, it still leads to public misconceptions, and it still sullies the reputations and legacies of important figures in history who deserve better.

In a recent one-man show Off- Broadway about American song-wrting legend Irving Berlin, writer-performer Hershey Felder portrays Berlin in his dotage as ” a miserable fossil so twisted with rage and zonked on Nembutal that he shooed away carolers who came to his Beekman Place window to serenade him with ‘White Christmas’,”  shrieking “They don’t deserve it,”  meaning the gift of his iconic song. That’s not what happened, however; not even close, according to the Times review of the show:

When he was 95, Berlin not only let those carolers into the house on Beekman Place but also kissed and hugged them and (according to some reports) poured them hot cocoa. “This is the nicest Christmas gift I ever got,” he said.

UPDATE: I relied on the New York Times review for this comment, and not for the first time, trusting the Times to play straight may have been a mistake. Reader Eric Herrault has a very different view, and I am appending his comment here:

In a website however that discusses ethics I think it is important to call attention to the real serious problem here. The quoted “review” in the New York Times of The BERLIN piece, was some kind of personal grudge hatchet job against the performing artist. This brainless reviewer does not describe the show I saw, or in fact the show at all. This is easily provable by seeing the show itself, or having a look at every other New York outlet, major and minor. Nowhere does anyone suggest this twisted and bizarre take on Irving Berlin. The one place it is suggested however, is by the reviewer himself, as he links to and then lauds a review of the book As Thousands Cheer about Berlin, that calls Berlin terrible things and worse. And yet, somehow this neanderthal supports that utter nonsense. The show is full of joy and laughter from beginning to end, with a sad feeling lived too long and the world having passed him by. The ethics violation here is that this disturbed reviewer (for whatever reason) is allowed to write in the first place.

The Facts Are In: Surprise! Serena Williams And Her Defenders Were Dead Wrong In Every Respect

It is rare that a public controversy that breaks down ideological lines actually has a resolution. The uproar over the sexist “double standards” a tennis umpire supposedly used against Serena Williams as she lost the U.S. Open championship (fair and square) to Naomi Osaka is just such a rarity. Although it should have been obvious on its face (Yes, it’s legal jargon, but I love it) that Serena was grandstanding to distract from her loss and posing as a gender rights crusader when she was really being an entitled celebrity jackass, social justice warriors fell all over themselves rationalizing her outburst, with columns titled, “Right message, wrong timing” at best,  and demands that the umpire and the U.S. Open owe Williams an apology for enforcing the rules at worst.

There’s no longer any valid  justification for debate. Williams was wrong; her defenders were biased, and it is they, not match umpire Carlos Ramos, who are obligated to apologize.

The New York Times isn’t always spinning for the Left. In a thorough article yesterday, it revealed that when the rampaging tennis diva protested to Brian Earley, the tournament referee, “There are men out here who do a lot worse than me, but because I’m a woman you are going to take this away from me? That is not right,” she was perpetrating a falsehood.

The Times actually looked at the data, something that should have been available to the public immediately after the Williams tantrum, but let’s be grateful for responsible journalism even when it’s suspiciously late. The conclusion: Serena’s accusation notwithstanding, “men appear to be fined proportionally more often than women for a variety of offenses.”

Ethics Quiz: The “Racist, Sexist” Cartoon

Australian sports cartoonist Mark Knight drew the cartoon above criticizing Serena Williams’ tantrum and otherwise unacceptable behavior as she lost the women’s title at the U.S. Open to young Naomi Osaka.

The cartoon was immediately attacked as sexist and racist. Is any criticism of Williams’ conduct racist, since she couched it as justified as a protest against alleged gender discrimination by umpire Carlos Ramos? Is any caricature of an African American celebrity subject to accusations of racism? Here is another tennis cartoon by Knight mocking a white, male player:

The Washington Post claimed that the Williams cartoon employed “facial features reflecting the dehumanizing Jim Crow caricatures so common in the 19th and 20th centuries.”

Tennis Ethics: Spectacular Ethics Train Wreck At The U.S. Open

 

Wow.

And tennis is supposedly one of the most ethical sports.

This weekend’s U.S. Open women’s final opened up so many cans of ethics worms that they should be squiggling for weeks.

Here is the New York Times report in part:

Anger, boos, tears and an accusation of sexism overshadowed a remarkable victory by Naomi Osaka, a rising star who became the first tennis player born in Japan to win a Grand Slam championship.

Osaka soundly defeated her childhood idol, Serena Williams, 6-2, 6-4, in the women’s final of the United States Open on Saturday, blocking Williams from winning a record-tying 24th major singles title. But the match will long be remembered for a series of confrontations between Williams and Carlos Ramos, the match’s chair umpire, who issued three penalties against Williams in the second set, after Osaka had established her dominance.

The first was a warning after Ramos felt Williams was receiving instructions from her coach, Patrick Mouratoglou, from the stands, which is against the rules. Williams was offended by the implication that she was cheating, and she demanded an apology. Later, after losing a game, she smashed her racket on the court, incurring a second penalty and the loss of a point. Finally, after she called Ramos a “thief” for taking the point from her, Ramos cited Williams a third time, resulting in the loss of a game. Williams’s anger intensified, and she pleaded for help from the tournament referee, Brian Earley, and the Grand Slam supervisor, Donna Kelso….

But what should have been a moment of uninhibited joy for Osaka turned into tears of sadness. The postmatch celebration was tarnished by the angry booing from fans upset over what they perceived as Ramos’s unfair treatment of Williams, and amid the cacophony, amplified by the closed roof because of rain, Osaka pulled her visor down over her face and cried….

In the second game, Ramos spotted Mouratoglou urging Williams to move up, and Mouratoglou conceded that he was, in fact, coaching. But he argued that it is done by every coach in every match and that the warning was the cause of what followed. He said Ramos should have quietly told Williams to inform him to cut it out. “That’s what umpires do all year,” the coach said, “and it would have ended there, and we would have avoided a drama that was totally avoidable.”

Williams approached the chair to tell Ramos that it was a “thumbs-up” gesture and that she would never accept coaching on court, which is against the rules of Grand Slam events. “I don’t cheat to win,” she said in a stern tone. “I’d rather lose.”

During the next changeover, tensions seemed to simmer down during a civil exchange when Williams explained to Ramos that she understood he might have interpreted some coaching, but that none actually existed.

Williams went back on court, held her serve in that game, and then broke Osaka’s serve to take a 3-1 lead in the second set. If she could have consolidated that break, it might have turned the flow of the match. But Osaka broke right back, and after the game ended, Williams destroyed her racket by throwing it to the court in anger. That resulted in a racket abuse penalty, a second code violation, for which the penalty is a point. Osaka would start the next game ahead by 15-0. When Williams realized that, she argued more and demanded that Ramos apologize to her and make an announcement to the crowd that she was not receiving any coaching. Ramos, known for his no-nonsense approach, did not relent.

“You owe me an apology,” Williams said. “I have never cheated in my life. I have a daughter and I stand for what’s right for her and I have never cheated.”

When the next changeover came, with Osaka leading, 4-3, Williams, still visibly distraught over what she perceived as unfair treatment, told Ramos that he had stolen a point from her and called him “a thief.” For that, Ramos gave Williams a third code violation, which meant she lost a game. Without swinging her racket, Osaka was now ahead, 5-3, and one game from the championship. Williams did not appear to realize that Osaka had been given the game until she reached the baseline again. Now fuming, she returned to the chair and demanded to speak to Earley and Kelso. Fighting back tears as the crowd yelled, hooted and booed, Williams pleaded her case. She said the treatment was unfair and argued that male players routinely behave in the same manner without facing penalties.

“There are men out here that do a lot worse, but because I’m a woman, because I’m a woman, you’re going to take this away from me? That is not right,” Williams told one official. Later, at a post match news conference, she accused Ramos of sexism for issuing a code violation for her “thief” accusation….

As the players stood next to each other, fans booed and Williams, seeing how upset Osaka was, moved over and put her arm around the new champion and then pleaded with the fans not to boo.

Osaka, in her speech, apologized to the fans, acknowledging that most of the fans were rooting for Williams in her quest to set a career record.

Now this, from the Sporting News:

Patrick Mouratoglou admitted to coaching Serena Williams during the U.S. Open final, but believes she never received his message….Mouratoglou said he had attempted to help Williams, but added coaching was common in almost every match.”I’m honest, I was coaching. I don’t think she looked at me so that’s why she didn’t even think I was,” he told ESPN.

“But I was, like 100 percent of the coaches in 100 percent of the matches so we have to stop this hypocritical thing. Sascha (Bajin, Osaka’s coach) was coaching every point, too. “It’s strange that this chair umpire (Carlos Ramos) was the chair umpire of most of the finals of Rafa (Nadal) and (his uncle) Toni’s coaching every single point and he never gave a warning so I don’t really get it.”

The Hitler Joke, Our Rights, And Our Nation

Prologue

When I was a junior in high school, I played Ko-Ko in  the Gilbert and Sullivan Club’s production of “The Mikado.” The head of the music department directed, a Jewish teacher named Mr. Einsig. He had the staging notes for all of the Gilbert and Sullivan works from the director who had gained great acclaim from his work with the Boston Light Opera Company, and I must admit, I cribbed many of that director’s ideas myself, through Mr. Einsig.One effective  staging concept was for the encores to “The Flowers That Bloom in the Spring.” Each one was performed as a different ethnic parody, with Ko-Ko singing translated lyrics. It began with Japanese, of course, then French, a Brooklyn dialect, and the biggest hoot of them all, German. I performed it, in my kimono, with an over-the-top Hitler imitation, complete with mustache, ending with an emphatic “Heil” gesture.

It brought down the house. Ten years later, at Georgetown University Law Center, I played Ko-Ko again, did the same Hitler parody again, and brought down the house again. Nobody complained. My late father, crippled for life in the fight against Hitler, detected nothing wrong with the routine. He also loved “Hogan’s Heroes,” with the show’s reluctant, inept, heiling Nazis, and the other Heil-filled spoofs of Hitler by Chaplin, Mel Brooks, and even the Three Stooges.

Now here is what happened to a private school teacher: read the whole, awful thing here. The short version: he was gesturing while explaining something in class, and noticed that his arm was raised Nazi-style, and said, “Heil Hitler,” jokingly. There was no question whether he was serious or not: everyone knew he was joking, and why he was joking. He even stopped and explained to the class that Once Upon A Time, in less enlightened eras, it was considered amusing to mock Hitler and the Nazis.

Ben Frisch, the teacher, a practicing Quaker  whose father was Jewish and who had two great-grandmothers  killed at Auschwitz, was fired by the private school anyway. The school principal who fired him explained his reason to the New York Times magazine  by saying, “One of our pledges is to make all of our students feel safe. And that is something that I take very, very seriously.”

Apology Of The Year (So Far): Patterico

I’m not a fan of the blog Patterico’s Pontifications for a lot of reasons, beginning with the fact that he doesn’t supply his real name. He appears to be a generally conservative blogger whose assessment of mainstream media bias comports with my own. He also has been a vocal Never Trumper, and since November of 2016, that way madness lies, as we can see from some of the hysterical commentary from the likes of Bill Kristol, George Will, Jennifer Rubin and others. Patterico’s brain jumped the shark with his ratification of the absurd Angry Left and “resistance” conspiracy theory that a former aide to Judge Kavanaugh, Zina Bush, was flashing a white supremacy signal behind him during the first day of the Senate hearings on Kavanaugh’s nomination to the Supreme Court. I wrote about it here; the controversy was beyond stupid, and in my opinion, so stupid that I did not feel it was worthy of a stand-alone post. I considered checking my Facebook friends’ posts to see how many of them were swallowing this idiocy, but chickened out.

The furious anti-Trump warriors become even more infuriated when you call them deranged, but the Zina Bush uproar is an excellent example of why it is not only fair to do so, but essential. They need to know. There is no reasonable justification for assuming or concluding that Zina Bush. or Brett Kavanaugh, or Donald Trump are white supremacists any more than there is justification for assuming or concluding that they are cocker spaniels or invaders from the Planet Zontar. If you think any of these people are really white supremacists with a white supremacy agenda, then you have slipped a cog somewhere, and need help.

I think what has happened to such sufferers is that they heard too many repetitions of certain dishonest and divisive parts of the Democratic party’s disinformation campaign to seed their coup, and at some point began to believe them, The white supremacy delusion seems to arise from the repeated smear, a standard one since Trump entered the Presidential race in 2015 by a frontal assault on the nation’s policy of encouraging and romanticizing illegal immigration, that opposing illegal immigration was the same as opposing immigration itself—hence xenophobia, hence “nativism,” hence racism, hence “white supremacy.” In fact, nothing in Donald Trump’s vast history of dubious conduct and ill-considered statements suggest a white supremicist agenda or beliefs in any way. Travel Notes…[UPDATED]

Every trip I take seems to require some ethical clarification…

  • Lose-lose. At our hotel in Ft. Lauderdale, a convention of either transvestites, transgender individuals, or some combination of the two dominated the hotel. The organization was “Himmaher”…I think I’m spelling it right. [Correction: I wasn’t. And that wasn’t the organization; it was the name that was listed for the gathering, and the name was HIMMERSHE. Thanks to Zanshin in the Comments below for the correction.]

I had several illuminating encounters. I don’t know that this is true of all such people, but the members of this association or club all seemed to want to make any non-club member they saw as uncomfortable as possible. Yes, that’s unethical. How you choose to dress, what you choose to have lopped off, and who you want to sleep with could not interest me less, and that is the  attitude a society like ours should strive to encourage. (None of those things should engender and advantages, either.) But what these people seemed to be seeking was imposed ethics zugswang. If you looked directly at them, the response was a chip-on-the-shoulder, “Go ahead and stare, honey: neverf seen a freak before?” If you appeared to be avoiding staring—I regard a six-foot ex-male standing in the middle of a hotel lobby in a  wig, skimpy bathing suit, 6 inch heels and speaking loudly in a base voice as parading a psychological problem or ten, and deserving the same social courtesy I would offer to a Tourette’s victim or a hebephrenic—then the individual decided to make it a project to get you to stare, as if your failure to provide the attention they craved was an insult.

Now THIS Was Hypocrisy: John McCain’s National Cathedral Service

Ethics Alarms has spent a lot of time and space trying to clarifying the term hypocrisy, which like another term abused here by commenters, ad hominem attacks, is more often  misused than used properly. Hypocrisy is conduct that proves insincerity and  dishonesty (or, Hanlon Razor fans, stupidity), in which one’s conduct does not match one’s contemporaneously stated belief regarding what one’s conduct should be, under circumstances that suggest that the objective of the words was to deceive, by falsely claiming dedication to principles the speaker in fact does not possess or aspire to. Thanks to the orgy of hypocrisy that the Washington, D.C. funeral service for the late Senator John McCain this weekend deteriorated into and the equally hypocritical reporting on it, we now have a perfect example of hypocrisy for the ages.

Let’s start with the fact that a theme of the service was McCain’s alleged dedication to civility. The fact that the Senator openly planned his own funeral to settle scores and act on old grudges is the ultimate rebuttal of that claim. It was undeniably uncivil to dis-invite the President of the United States from what would otherwise be a display of unified and bi-partisan Washington community respect for a departed public servant. That was an insult, and intended as one. Insults are not civil. The retort to this is that the President was not civil to McCain, which is true. However, if the professional duty of civility is waived by another’s breach of it, then there is no such duty.

McCain’s own daughter launched the proceedings with her own uncivil rant, saying in part, “We gather here to mourn the passing of American greatness—the real thing, not cheap rhetoric from men who will never come near the sacrifice he gave so willingly, nor the opportunistic appropriation of those who lived lives of comfort and privilege while he suffered and served.” Later, she added, “The America of John McCain has no need to be made great again, because America was always great.”

In addition to being uncivil—I have never been to a funeral that consisted even in small part of veiled insults and attacks on someone else, and Marc Anthony aside, have always understood that using a funeral service for this purpose is boorish and unethical—the attacks on the President, like Meagan McCain’s, were cowardly. The man (and the office) being savaged wasn’t present, and the crowd was united in its hostility to the target. George Washington’s 110 Rules of Civility cover that kind of conduct neatly:

89. Speak not evil of the absent, for it is unjust.

Leading up to the ceremony, the news media were equally dishonest in describing McCain. Dana Milbank of the Washington Post declared that McCain  “never forgot that political opponents are not his enemies, and that there are things more important than winning elections.” Funny, it seems pretty clear that McCain regarded Donald Trump as his enemy, treated him as such, and made certain that his admirers would carry out his vendetta. The description also was historical revisionism, at least through the news media’s own assessments. After fawning over the “maverick” when he was challenging George W. Bush, journalists turned on McCain and discovered his dark side when he ran against a man the entire journalism establishment had decided to elect President. The Pew Research Center found that between the Republican National Convention’s close on September 4, 2008 and the final presidential debate on October 15, McCain’s media coverage was more negative than positive by a 4-to-1 ratio, and pundits like Milbank were writing statements like this one, from New York Times columnist Maureen Dowd, who said ,“Even some of McCain’s former aides are disturbed by the 73-year-old’s hostile, vindictive, sarcastic persona.”

When it was George W. Bush’s turn to speak—his family had enhanced its stock with McCain by barring the President from Barbara Bush’s funeral—one of his accolades was that McCain “detested the abuse of power”, though not, apparently, sufficiently to do the right and responsible thing and give up power when he was no longer well enough to discharge his duties. Is an octogenarian Senator with aggressive brain cancer still fit to serve in the U.S. Senate for almost a year as his condition deteriorates? To ask the question is to answer it, yet McCain insisted on keeping his power to the end, in part so he could continue undermining the President of the United States. Let’s say McCain “detested the abuse of power” by others.

The Henry Higgins Syndrome And Me

Today’s latest “Let’s hate the President!” item from the news media was the leaked news that Trump can’t stand how AG Jeff Sessions speaks. Politico reported yesterday that Trump has griped “to aides and lawmakers”  “that Sessions isn’t a capable defender of the President on television — in part because he ‘talks like he has marbles in his mouth.’”

As usual, the fact that some un-named source says something doesn’t make it true, or, for that matter, legitimate to reports as news, by hey, it’s Donald Trump, so fairness, ethical journalism and professionalism are suspended, right? If you hate the man, here’s more non-substantive, unproven stuff to believe and complain about on line, and if your business is to try to define and encourage standards of societal and workplace ethics, here’s one more chance to be vilified on Facebook as a “Trump supporter” by pointing out that it is wrong for anyone to be subjected to hearsay snipe attacks like that.

In this case, however, there is another factor. There are a lot of speech habits and styles that I have a visceral dislike of too. Some I can defend, some are just a matter of taste, regional influences and upbringing, and some are genuine impediments to my treating people fairly.

Here’s one that my Facebook friends will love, for example: the way Donald Trump talks drives me crazy. His repetitive vocabulary–every thing is “great,” “strong,” “weak,” “stupid,” “smart,” “sad” or “tough; everyone is a “loser,” a “moron” “out of control,” or “dangerous”–signals “uneducated simpleton” to me. I’ve read all of the scholarly examinations of Trumps communications style and why it is effective, and I understand the theories. They are probably right. Where I come from, however, size, precision and variety of vocabulary is deemed a reliable way of gauging intellectual capacity. Continue reading
