Comment Of The Day: “Late Nominations For 2016 Jerk Of The Year: Lena Dunham And Daniel Goldstein, Ivanka’s Jet Blue Harasser”

Bill Maher, role model...

Bill Maher, role model…

Steve-O-in-NJ‘s reaction to the JetBlue flight harassment of Ivanka Trump by a lawyer could just as easily been written as a comment on this Ethics Alarms post, from shortly after the election, which began..

I have to adapt, with acknowledgement, a long-running gag wielded by Prof. Glenn Reynolds on his iconic conservative website Instapundit thus:

“I wrote if Donald Trump was elected President, we’d have a nation of assholes, and I was RIGHT!”

The problem is that the joke isn’t funny in this case. It’s tragic. What I am seeing in the news, watching on social media and reading on the web and in editorial pages shows me that the last eight years have done even more damage to American unity and ethics than I had realized.

Here is Steve-O-in-NJ‘s Comment of the Day on the post, “Late Nominations For 2016 Jerk Of The Year: Lena Dunham And Daniel Goldstein, Ivanka’s Jet Blue Harasser,” and I’ll have a few comments at the end:

The left seems to be perfectly ok with raising jerkiness to a profession – I decline to call it an art form. I’ll be the first to admit sometimes I don’t use my brain and turn to vicious attacks. Jack was absolutely right that I am not helping myself in my lucid moments when I do that, and, in all fairness, he isn’t the first. Actually a judge here in NJ has seen both sides of me, and said to me once, in a rare ex parte discussion (as part of a “breakout” settlement conference) that “there are two of you, apparently, the thinking Steve and the angry Steve. I would request that only the thinking Steve appear here.” I’d also say that some other people here aren’t helping themselves with the same approach, BUT, that’s for Jack to say more about.

There are plenty of scholars and pundits on both sides politically, and they are of varying quality, from the very erudite to the not much more than trash talkers. Most of us, when we are in our thinking mode, can tell the one from the other, and would place more value on Victor Davis Hanson’s perhaps overly sonorous pronouncements than on Michelle Malkin’s near-rants, and more value on Alan Dershowitz’s legal analysis than on Jonathan Alterman’s self-important poking.

Obama, Trump, And The Avoidable “Two Presidents” Ethical Dilemma

trump-and-obama

Yesterday, Donald Trump sent out not just one but three tweets that directly interfered with current U.S. policy efforts, involving the costs of a new jet fighter plane, nuclear weapons, and a U.N. resolution criticizing Israel. This understandably is causing consternation in the Obama administration, because Trump is exercising influence without authority. Until January 20, 2017, Donald Trump has no official position or authority in the government at all. He does have power and influence, however, because everyone knows that he will have authority very soon.

What constitutes abuse of the power and influence? Should a President Elect be a mute and invisible presence until he is officially sworn in, so as not to interfere with the current President’s discharge of his duties?

For the lame duck Chief Executive, with slightly more than two months left in office and vastly diminished influence, the ethical problem is different. How much should he defer to the incoming President, and not take actions that will seriously interfere with the policy directions the new President  may choose to take? Once the will of the people has been made clear at the ballot box, is it fair and responsible for current President to actively work against the likely agenda of the incoming President?

Finally, if a lame duck President is attempting to undermine the objectives of the incoming President before that President Elect takes office, is it unethical for the President Elect to use his influence and power to stop him, or at least mitigate the damage? Continue reading →

From The “When Ethics Alarms Are Devoured By Hysteria And Partisan Hate” Files: Jezebel Readers React To The JetBlue Harassment Of Ivanka Trump

love-hateHere are some comments reacting to the JetBlue incident from Jezebel, the feminist website. These are not the outliers. These are typical. I’ve checked some of the other progressive sites.  At Talking Points Memo, the consensus seems to be that it’s “fake news.” So far, the vast majority of the coverage is from conservative sites. Most of the left partisan sites don’t report embarrassing conduct by their compatriots if they can avoid it….or perhaps they just don’t want to inspire comments like these.

Jezebel’s blogger set the tone by invoking the “Tit for Tat” and “They had it coming” rationalizations with this coda to the post:

Given Donald Trump’s unabashed love of heckling people in front of a crowd—he singled out NBC reporter Katy Tur so many times she had to get Secret Service protection—I’m just surprised the administration didn’t give Lasner’s husband a cabinet seat right then and there.

From the comments…

I know i’m supposed to feel bad for Ivanka, but I can’t. Fuck her. Fuck her husband. They are going to make billions off the american taxpayer and have no shame or remorse or anything resembling human emotions. I might feel the slightest bit of pity for the kids, except then I remember they’re all fucking rich and will get whatever their bratty asses demand for their entire lives. So i guess i’ll save my concern for the millions of men and women of various races, creeds and sexual orientations whose lives will begin to become progressively worse on January 20th.

***

She knew exactly what she was doing and what the potential outcomes were from flying commercial. Part of me thinks Bannon set this up so this exact incident would occur and everyone would feel sorry for lil Vanky.

***

FUCK THAT NOISE.

If I saw a Trumpsatzgruppen member on a flight, I would be in jail right now, b/c I would not shut the fuck up about it the entire flight.

***

Seriously. Let’s not forget:

— At last count, 838 products in Ivanka Trump’s line, and not a single one made in the US.

— She’s already used her father’s position to further her business by selling dresses and jewelry, and she’s sat in on meetings with leaders of countries in which her business stands to benefit.

— It took more than a year for employees at her company to convince her to establish a maternity policy; she told one employee that when she had her baby, she was only out of the office for a week (she neglected to mention her in-home nanny when explaining this).

— For several months now she’s posted a job on her site for a Freelance Graphic Designer, a full-time job, Monday through Friday, 9-6. But as freelance, this person will not receive any benefits, including healthcare and maternity leave; and the contract is month to month, allowing Ivanka Trump’s company to cut that person loose at any time with zero notice. That’s some fine job creation right there.

In short, fuck Ivanka Trump. She’s a hypocrite just like her father, and while I would try to find a way of doing it without getting kicked off a plane, I’d have no problem telling her so.

***

Yeah the French should have just said “This cake is really good, don’t upset the Queen.” Or the people of Boston should have just drank the tea and asked politely to not be taxed. Fuck the trumps, they should be called out at every opportunity.

***

Going high hasn’t worked for us since what – 2000? i am sick of it. i am sick of us having to be the reasonable, rational ones. fuck all of that. they go low and they win. they go low and they obstruct a president for an entire 8 years. it is time to go low.

***

Fuck her and her three small children.

Ethics Quiz: The Truth About Snopes

"So what? What matters is the quality of work we do, not how we do it!"

“So what? What matters is the quality of work we do, not how we do it!”

Ethics Alarms had already declared the fact-checking website Snopes.com untrustworthy,  based on a series of partisan posts that intentionally muddied the factual waters rather than purifying them, when Facebook named it as one of its select gate-keepers to protect its readers from “fake news.” This was not wise,  since a fact-checker who slants the facts is as useful as an accounting firm that will cook the books for a price. I laid out a series of conditions before I would ever use the service again, and so should Facebook. My non-negotiable demands before I would visit the site, reference it positively, or use it as authority were:

  • Getting out of the political fact-checking business.
  • Firing researchers who have been conclusively shown to engage in biased and shoddy research
  • Confessing its betrayal of trust and capitulation to partisan bias, apologizing, and taking remedial measures.

However, there is more to consider. In an exclusive report so lurid that I assume it is credible only because publishing it without iron-clad verification would be asking for a lawsuit and worse, the Daily Mail has just revealed that…

  • When Snopes  was founded by spouses Barbara and David Mikkelson, they used a letterhead claiming they were a non-existent society to give credibility to their research.
  • The couple is divorced, and Barbara claimed in legal documents that David embezzled $98,000 of company money to spend on “himself and prostitutes.”
  • Now operating Snopes himself, David Mikkelson’s new wife Elyssa Young is employed by the website as “an administrator.” Before that, she  worked as an escort and porn actress.
  • She also ran  for Congress in 2004 as a Libertarian on a ‘Re-Defeat Bush’ platform
  • Kim LaCapria, one of the site’s  main researchers and the author of the baised and misleading “fact-check” on Hillary Clinton’s representation of a child rapist, previously had a blog called “ViceVixen.”

The article also includes this:

David Mikkelson told the Dailymail.com that Snopes does not have a “standardized procedure” for fact-checking “since the nature of this material can vary widely.’” He said the process “involves multiple stages of editorial oversight, so no output is the result of a single person’s discretion.” He also said the company has no set requirements for fact-checkers because the variety of the work “would be difficult to encompass in any single blanket set of standards. Accordingly, our editorial staff is drawn from diverse backgrounds; some of them have degrees and/or professional experience in journalism, and some of them don’t.”

Your Ethics Alarms Ethics Quiz of the Day:

Should any or all of the items in the Daily Mail story, it it is accurately reported, disqualify Snopes from being trusted by Facebook, its readers, or anyone else?

Ah! So THAT’S What’s Going On In North Carolina!

Somehow the story isn't clear without Elsa in the picture, it it?

Somehow the story isn’t clear without Elsa in the picture, it it?

While national Democrats were desperately and embarrassingly search for some way, any way, to overturn the election of Donald Trump, the mania reaching apotheosis in the unhinged rantings of Michael Moore—“Trump is not president until 12 noon on Jan 20th. So we’ll continue to fight & hope to find a legal, nonviolent way to stop this madness,” the “madness” known as “losing an election”—Democrats, news media, and op-ed writers in the New York Times (but I repeat myself) have been loudly condemning the North Carolina Assembly as part of a condemnation of Republicans generally. After narrowly losing the State House, the overwhelmingly Republican legislature has been passing measures to limit the power of the incoming Democratic governor  in a lame-duck legislative session. The changes drastically reduce the number of officials the governor can appoint within state government, require legislative confirmation of Cabinet-level appointments, eliminate partisan majorities in the state board of elections and strip the governor of the power to make appointments to the University of North Carolina Board of Trustees.

This is, according to Slate’s Mark Joseph Stern, for example, a “last-minute power grab” that “marks an alarming departure from basic democratic norms—a blatant attempt to overturn the results of an election by curtailing judicial independence and restructuring the government to seize authority lawfully delegated to the incoming Democratic governor.” By the end, he is foaming at the mouth with indignation:

“What’s happening in North Carolina is not politics as usual. It is an extraordinarily disturbing legislative coup, a flagrant effort to maintain one-party rule by rejecting democratic norms and revoking the will of the voters. It is the kind of thing we might expect to see in Venezuela, not a U.S. state. It should terrify every American citizen who believes in the rule of law. This is so much more than a partisan power grab. This is an attack on democracy itself.”

I was preparing to write something similar, but unlike Stern, I did some research first. What I discovered, however, thanks to the work of Volokh Conspiracy contributor Jonathan Adler, a Case Western law professor, was that as unethical as the General Assembly’s power grab is, the tactic is business as usual in the Tarheel State. Adler points his readers to the research of John Hood, who informs us…

Precisely four times in modern North Carolina history, voters have elected a new governor or lieutenant governor of one party and legislative majorities of the other party. In all four instances, the legislature stripped the newly elected executives of some power.

In the first three instances — Republican Gov. Jim Holshouser’s election in 1972, Republican Gov. Jim Martin’s election in 1984, and Republican Lt. Gov. Jim Gardner’s election in 1988 — a Democratic legislature did the stripping. As Martin’s biographer, I’m most familiar with his experience. Lawmakers limited his ability to staff agencies (including the State Board of Elections), subjected other appointments to constraints or confirmation, and withdrew gubernatorial control over state construction and administrative hearings, among other actions.

In each case, Republicans cried foul. Democrats insisted they were simply carrying out North Carolina’s longstanding preference for legislative supremacy….

Democrats upset with the special session might have been more persuasive had they chosen a different rhetorical strategy. Every time they accused GOP lawmakers of “unprecedented” acts, of “contempt for democracy,” of being “sore losers” and the like, all Republicans heard was hypocrisy. What happened in 2016 was different in detail, but not much in degree, from what happened in the past. A better argument would have been, “Yes, we Democrats went too far when we were in power. It often came back to bite us. Don’t make the same mistake.”

I am all for breaking the cycle. That will inspire greater trust and long-term thinking, from both sides.

That pretty well sums up my position too. Continue reading →

Ethics Observations On The Trump Sons’ Influence Peddling Story

161220181600-opening-day-fundraiser-780x439

To catch you up: Celebrity gossip website TMZ  hyped the launch of new Texas nonprofit led by Donald Trump’s adult sons Donald Jr. and Eric based on what it called a “draft” of a soon to be released event brochure. The non-profit was offering, we were told, access to the new President during inauguration weekend  in exchange for million-dollar donations to unnamed “conservation” charities.  Prospective million-dollar donors to the “Opening Day 2017” event on  January 21, the day after inauguration, were to receive a “private reception and photo opportunity for 16 guests with President Donald J. Trump,” a “multi-day hunting and/or fishing excursion for 4 guests with Donald Trump, Jr. and/or Eric Trump, and team, ”as well as tickets to other events” and “autographed guitars by an Opening Day 2017 performer.”

The Center for Public Integrity was on this like a shot…and so was the news media. I received a link in an e-mail from someone who archly noted that “You seem to be interested in influence peddling,” a reference to my many posts about the real purpose behind the Clinton Foundation, “so perhaps you will find this of interest [Unsaid but understood: “…you Donald Trump enabling, racist, fascist bastard!”] In the link, TIME took the hand-off from the Center, and got a series of quotes from critics, like Larry Noble, the general counsel of the Campaign Legal Center, a nonpartisan campaign reform organization.“This is problematic on so many levels,” Larry said.  “This is Donald Trump and the Trump family using a brand new organization to raise $1 million contributions for a vague goal of giving money to conservation charities, which seems a way of basically just selling influence and selling the ability to meet with the president.”

Noble cautioned that the details of the event and its association with the new nonprofit listing the Trump brothers as directors were still unclear. “It’s really hard to identify all the problems when they’re so vague,” he said.

True. As of today, Donald Trump Jr. and Eric Trump are no longer listed as directors of a that non-profit. Papers removing their names from the Opening Day were processed by the state of Texas,  a spokeswoman for the Texas secretary of state told CNN Money.

Never mind!

Ethics Hero: President Barack Obama

President Obama granted clemency to 231 deserving individuals, yesterday, the most individual acts of clemency granted in a single day by any President inU.S. history. He also issued 153 commutations, and has now commuted the sentences of 1,176 individuals, including 395 life sentences. The President also granted pardons to 78 individuals, bringing his total number of pardons to 148.

Good.

The pardon and clemency powers of the President are underused, and until the last two years, Obama underused them more than any modern President. Now, presumably in a last minute flurry to enhance his legacy, Obama has embraced these acts of mercy as one thing he can do that Donald Trump will not be able to reverse. Obama’s motives are irrelevant, however. The “quality of mercy is not strain’d…” and it also shouldn’t be criticized. We must assume that the beneficiaries of Obama’s mercy are deserving, and that there aren’t any Marc Rich-types in the group.

There is so much that is right with Obama’s commutations and pardons. They match the spirit and ideals of the season; they provide second chances to Americans who need them; it returns citizens to their families. Let’s hope that he has begun a permanent competition, and that every President will now strive to exceed the number of official acts of mercy of his or her immediate predecessor.

Thank-you, Mister President.

You just made the United States  a little more ethical.

A lot, in fact.

The Electoral College’s Day Of Reckoning, Part II: Dunces, Heroes, Villains, And Fools

The failure of the ugly Electoral College revolt scheme that ended yesterday—let’s ignore the coming storm of frivolous lawsuits for now, all right?—with the official, irreversible, like it or lump it victory of Donald Trump over Hillary Clinton also settled some distinctions, some desirable, some not.

  • Ethics Heroes: All of the Republican electors who resisted the harassment, propaganda, intimidation and bad arguments and did their duty, avoiding a crisis and foiling the attempts of Democrats to cheat, which is exactly what the effort to flip the electoral vote was. The faithful electors get bonus points for making so many Democrats and progressives look silly in the process, a fate they richly deserved.

Come to think of it, it was predictable that Democratic appeals to electors would persuade more Democratic electors than Republicans. Which leads us to…

  • Ethics Dunces: A bevy of Hollywood B-listers joined forces in an offensive video that, like Brezenoff’s petition, misrepresented history and the Constitution to gull star-struck electors into defying the public’s will and its trust that their votes would be respected by electors. Led by Martin Sheen, who has no credentials in government or political science but played a wily President on TV, Debra Messing, James Cromwell, B.D. Wong, Noah Wyle, Freda Payne (Quick: who is Freda Payne?), “Better Call Saul’s” Bob Odenkirk, J. Smith Cameron (?), Michael Urie, Moby, superannuated M*A*S*H stars Mike Farrell and Loretta Swit, Richard Schiff, Christine Lahti, Steven Pasquale, Emily Tyra and Talia Balsam tell the electors that they will be following the Founders’ intent by rejecting Donald Trump. This is flatly dishonest, as they are attributing the contrarian position of Alexander Hamilton, who detested popular democracy, to all the Founders, who rejected Hamilton’s proposals on how the government should be elected and structured.

“What is evident is that Donald Trump lacks more than the qualifications to be president. He lacks the necessary stability and clearly the respect for the Constitution of our great nation,” say the celebrities. Obviously it is NOT evident, since Trump’s voters won the day.  The Federalist accurately describes what was behind the video:

“The message is clear: the candidate for whom these celebrities spent months shilling lost the Electoral College, the metric granted ultimate primacy by Article Two of the Constitution. Now, as individuals with no substantial political background, these celebrities have organized en masse to produce content designed to “educate” our electors, chosen for their political pedigree, on their electoral duty. The whole situation reeks of condescension, dirisiveness, and social hubris. What these self-ordained celebrities are demanding is nothing short of the very opposite of what they claim to be purporting. They assert that they “stand with…all citizens of the United States,” yet admittedly only if those citizens agree with their political viewpoint. If said citizens disagree, then, unfortunately, these celebrities decidedly do not stand with them. In fact, they would prefer electors to actively oppose the wishes of these very citizens, so that the candidate they personally believe to be the best suited has a second shot at the presidency.”

That’s about the size of it, yes indeed. Continue reading →

The Electoral College’s Day Of Reckoning, Part I: Revelations

crying-clinton-supporters

After all the protests, the petitioning, the grandstanding, the misinformation and bad law and false history, after all the harassment and intimidation aimed at getting state electors to violate their pledges, duty and the trust of theirs state voters, all designed to keep Donald Trump from attaining 270 electoral votes and thus forcing the Presidential election into the House of Representatives for the first time since 1876, the results were just another humiliation for the Democrats and Hillary Clinton. Donald Trump was officially elected President of the United States, and it wasn’t close.

Four Democratic electors in Washington, a state Clinton won, voted for someone else, giving her just eight of the state’s 12 electoral votes. They will be prosecuted, apparently, for breaking a Washington statute. Colin Powell, a Republican, received three of the faithless elector votes and Native American tribal leader Faith Spotted Eagle received one, apparently because one elector decided that rather than vote for Senator Elizabeth Warren, a real Native American was preferable. Single  electors in both Maine and Minnesota attempted to cast ballots for Bernie Sanders, but state laws requiring electors to follow the statewide vote invalidated both rebellious ballots. One Hawaii elector did vote for Sanders, an especially outrageous betrayal of the vote since Hawaii went to Clinton even more decisively than California.  Never mind: this unknown, unvetted, undistinguished citizen decided that no, he or she knew better. That’s the model Democrats were promoting.

The one Republican elector, Texas’s Christopher Suprun, of Texas, who had trumpeted his  intention  not to vote for Trump despite his state heavily favoring the President Elect voted for Ohio Governor John Kasich as promised, and another Texas elector defected to vote for Ron Paul. Thus the almost six week Democratic push to use the Electoral College to pull victory from the jaws of defeat had the net effect of increasing Trump’s Electoral vote advantage over Clinton by three, with Hillary Clinton becoming the candidate with most defecting electors in over 200 years.

George Will’s favorite phrase “condign justice” leaps to mind. First the Wisconsin recount increases Trump’s vote total, and now this.

When The Electoral College Makes It Official Today, Remember What Really Made It Possible For Donald Trump To Be President—And It Wasn’t Racism, Misogyny, Xenophobia, Fake News Or Putin

Today, when the electors meet and officially cast the votes that make Donald Trump the next President of the United States, Ethics Alarms will retire the “This will help make Donald Trump President” tag. I was going to wade through the many posts bearing that tag, but the task was too arduous and  depressing, and besides, new examples pop up every day. Trump does not have the skills, experience, reliability, judgment or temperament to be trusted to serve the role that those who voted for him designated him to serve, but the reasons much of the nation desperately, fervently, urgently wanted someone to fulfill that role and now, should be evident to anyone who is not part of the problem.

Two examples suffice.

1. Illegal immigration. Thanks to Trump’s slovenly rhetoric, Democrats, illegal immigration advocates and the news media managed to turn what should have been a substantive debate over the U.S.’s enabling of illegal border-crossing into the false narrative that Trump was racist, xenophobic, and had called all Mexicans “rapists and murders.” (He never did that.) Then Trump himself allowed the debate to focus on his absurd impossible measures to address the crisis: a Berlin-style wall that he would “make Mexico pay for” and mass deportations of 11 million U.S. residents or more. These deflections didn’t change the facts, however: Eight years of the wink-wink-nudge-nudge Democratic and Republican policies of allowing a constant stream of law-breaking foreign citizens over our borders, bolstered by the Orwellian deception by journalists, elected officials and activists of calling them “immigrants” to make dissent from these policies vulnerable to attack as “racist,” had justly infuriated many Americans. After watching so many politicians pretend to oppose the flood across our borders and back down or descend into double-talking gibberish, it was refreshing and—yes, Mrs. Obama–hope-inspiring to hear someone, anyone, call the crisis what it was and pledge to address it, even in crude  terms.

Illegal immigration, and the flaccid, dishonest handling of it by both parties is the issue that made Donald Trump’s rise possible, and all of the conditions that created public indignation and anger over the issue still exist.

1,574  illegal aliens were apprehended at the U.S. Mexico border per-day during the month of November, marking the fifth straight month of escalating illegal immigration into the southwest United States. Nobody knows how many weren’t apprehended, but it is probably more. In addition to the tens of thousands of illegals streaming in from Central America, officials are reporting increased numbers of Cubans and Haitians crossing into the United States from Mexico. No, they aren’t all rapists and murderers or even criminals, and they aren’t all Mexicans, but they all came here or tried to come here illegally. That makes them wrong and undesirable, and all the linguistic tricks being employed to make that simple statement difficult to express won’t alter that central fact.

This month, the Center for Immigration Studies  reported that illegal immigrants with criminal records in this country probably total at least 820,000, with most having felony and serious misdemeanor convictions. Other estimates, naturally the ones cited by Trump,  have suggested up to two million criminal illegal immigrants, but 820,000 is still a number larger than the populations of four Alaska, North Dakota, Vermont or Wyoming.
