The consensus among objective legal observers is that President Obama’s unilateral amendments to a bill passed by Congress and signed by him into law exceed his constitutional authority, are illegal, and violate his oath to “preserve, protect and defend the Constitution of the United States.” Worse, they create a precedent that endangers the nation’s freedom,  as protected by the rule of law and the system of checks and balances, by laying the foundation for more obtrusive and dictatorial acts by future Presidents, who are sure to notice that the negative consequences of this blatantly unconstitutional act were nil. The President and the executive branch shares responsibility for this dangerous and irresponsible display of autocratic lawmaking with both houses of Congress and both political parties, none of which have demonstrated either the integrity or the courage to oppose him, for varying reasons.

It is depressing and indeed disgusting that our successful democratic system of government  created out of the vision and sacrifices of so many men and women of character, ability and high ideals is being progressively undone by fecklessness, incompetence and political expediency. In a long report published in the Washington Post a week ago, New Jersey Governor Chris Christie’s conduct as a federal prosecutor was examined, under the headline, “Chris Christie’s long record of pushing boundaries, sparking controversy.” This is euphemistic, to say the least. What the report describes is clear-cut, undeniably unethical practices by Christie. They were arguably legal and technically permitted at the time (though no longer), but never mind: they were unethical, and would quickly set off the ethics alarms of any ethical lawyer or politician. For Christie, they did not.

I’ll focus only on the main practice in question. The Post’s Carol Morello and Carol D. Leonnig write,

“As the top federal prosecutor in New Jersey, Chris Christie struck an unusual deal with Bristol- Myers Squibb. In exchange for not charging the drugmaking giant with securities fraud, Christie’s office would require it to fund a professorship at Seton Hall University’s law school — Christie’s alma mater.The $5 million gift, one component of a larger agreement between the company and prosecutors, was hailed by the school, in South Orange, N.J., as a cornerstone of its new center on business ethics.”

  • The dishonest conduct of media “fact-checkers” in using their columns not to dispute facts but to take issue with opinions, usually on partisan grounds, with which they disagree.
  • The misuse of “lies” and “lying” to describe either mistakes or opinions, neither of which are lies.
  • People who lie themselves while accusing others of lies.
  • Fact-checkers who misstate facts while accusing others of misstating facts.

Governor Cuomo’s Selective Anti-Gun Fervor: And This Is Why So Many Americans Have No Respect for Laws Or Lawmakers

[UPDATE: Jerome Hauer disputes some of the reported facts in this post. I have yet to find any sources that have different facts, but I will revisit both the story and my conclusions, and make appropriate revisions, retractions, or clarifications if and when warranted. You will find Mr. Hauer’s comment, and my reply to him, below.]

New York Governor Andrew Cuomo has been the source of some of the most excessive anti-gun rants making up the sorry legacy of the Post Sandy Hook Ethics Train Wreck. It was a year ago that a unveiled a package of strict gun restrictions, saying that with “the senseless massacre in Newtown, Connecticut… New York must say enough is enough to gun violence.” Oh, Gov. Cuomo hates guns, believe you me.

So what do you think happened when it was revealed that Jerome Hauer, Cuomo’s Division of Homeland Security and Emergency Services Commissioner appointed in 2011, had not only been carrying a handgun to work ever since, but also, incredibly, took out the gun and used the laser sighting device attached to the barrel as a pointer in a presentation to a Swedish delegation on Oct. 24? Hauer was not only breaking the Cuomo-backed law barring state employees from packing a weapon at their workplace, but also was modeling the kind of ignorant and dangerous firearm misuse that undermines any claim that he was a safe, responsible, well-trained gun owner.

What happened appears to be this: as soon as the Governor got word that Hauer’s illegal and reckless conduct was about to be revealed in the press, the Homeland Security chief received a quick waiver from New York’s Office of General Services Commissioner RoAnn Destito. The waiver, of course, could not make his prior conduct legal. Continue reading →

Unethical Tweet of the Month: Actress Eva Longoria

Emilio Vicente, a gay illegal immigrant from Guatemala who is a candidate for  student body president at the University of North Carolina at Chapel Hill, is now facing a run-off after receiving 41.08 percent of the vote.

He may or may not have been helped in his quest for the position by the above unsolicited tweet by actress Eva Longoria of “Desperate Housewives” fame. As far as anyone knows, she has absolutely no connection to Vicente or Chapel Hill. However, she knows he will be a “great leader” and is inherently a better candidate and more qualified than opponent Andrew Powell, who has the damning and disqualifying characteristics of being white, straight, law abiding and an American citizen. Vicente, however, is supremely qualified to lead because he is Latino, gay and illegal.

This is pure, undeniable bigotry, but politically correct, left-endorsed bigotry, so Longoria, who was the Democratic Party’s embarrassing 2008 co-campaign chair-–“war on women,” don’t you know—will never be criticized for it by the morally superior progressive establishment,  though her tweet is as indefensible and un-American as it is legalistically stupid.

I am officially declaring war on racist, bigoted, stupid women….like Eva Longoria.

Obama’s error came when he misnamed Alexis de Tocqueville, a clear-eyed Frenchman who explained the subtle miracle of American culture and democracy in the 1830s. His book is a classic, partly because his insights about Americans’ social equality and civic society have become commonplace among centrists and conservatives. But Obama called him “Alex” in front of the French and U.S. press, and while facing banks of TV cameras. The White House’s official transcript, however, hides the presidential error by using the correct name. It now says that Obama declared: “Alexis de Tocqueville — that great son of France who chronicled our American democracy.

That’s Oklahoma congressman Jim Bridenstine (R-OK) who listens as a woman says, “Obama is not president, as far as I’m concerned.  He should be executed as an enemy combatant…I can’t tell you, or I can’t say because we are in a public place, this guy is a criminal,” and then answers by saying that “everybody knows the lawlessness of this president,” without addressing her more outrageous assertions. “The only way I see out of this is to overwhelmingly change the Senate, so that we can then impeach the SOB,” another woman says. “You know, you look so sweet…” says Bridenstine, deflecting. In today’s news, Victoria Nuland,  Assistant Secretary of State for European and Eurasian Affairs and the top American diplomat in Europe, is heard in a viral Youtube video saying “Fuck the EU,” meaning the European Union, meaning the United States’ allies in Europe, meaning the constituency it is her job to get along with,and not insult like a middle schooler.

A U.S. government competent in international diplomacy, serious about international affairs, and familiar with the concepts of damage control and accountability would sack the unfortunate Ms. Nuland immediately. Waiting until she becomes completely useless and the gaffe escalates into a serious international rift with substantive consequences would be incompetent, lazy and stupid. But this, remember, is the Barack Obama Amateur Diplomacy Era. Nuland has apologized for saying “Fuck the EU,” and that, for now, is the best the European Union will get, because the President Obama and his subordinates (fish-rots-head-down) doesn’t acknowledge the ethical principle of accountability, nor professionalism and competence, as far as I can see.

In its actions, if not its words, the administration has been saying “fuck the rest of the world” with some regularity.  Obama’s nominee for Ambassador of Argentina revealed in last week’s confirmation hearings that he has never been there, nor does he speak Spanish. Unlike the many other countries’ languages that our ambassadors assigned to them can’t understand, it really isn’t hard to find qualified diplomats who speak Spanish. Noah Bryson Mamet, however, wasn’t nominated to head the embassy in a major South American nation because he has a clue of how to do that job. He bundled $500,000 for Barack Obama’s presidential campaign, you see, and no fewer than 23 such “bundlers” have received ambassador posts as their pay-off. Continue reading →

—-Sen. Claire McCaskill (D-Mo),  on MSNBC, doing a lousy job rebutting Sen. Rand Paul’s recent statements accusing Democrats of hypocrisy by pursuing their lucrative and politically successful “war on women” attacks on Republicans while continuing to embrace the Clintons, ignoring Bill Clinton’s treatment of his wife, Monica Lewinsky, and women.

Curse anyone who reminds me of anything related to Godfather III, but there was Claire, turning me into Michael: “Just when I think I’m out, they puuull me back in!” I know I write about Bill Clinton too much; I have promised multiple times to enshrine him in the Ethics Alarms Ethics Hall of Eternal Contempt, but haven’t had time to build the damn thing. His sly, shameless, smirking, dishonesty and manipulations drive me crazy, almost as crazy as the way so many otherwise rational ethical people, especially women (oh, that Bill’s a charmer, like so many sociopaths), keep giving him pass after pass to keep on doing it.

When Sen. Rand Paul, whom I generally do not admire but who has his moments, recently turned a “Meet the Press” question about the “war on women” around and attacked the Democratic hypocrisy for making such a claim while defending and cheering on the likes of Bill Clinton, I enjoyed the jiu-jitsu, as Paul was right….but I didn’t mention it! I resisted! I was even about to write a post today criticizing Senator Paul, who has  apparently embarked on a long-term anti-Clinton jihad (fine with me!), for saying that Clinton’s settlement with Paula Jones in 1999, in which he paid $850,000 to settle her claims of sexual harassment, was an admission of guilt, which is an unfair, legally ignorant statement embarrassing for a Senator. I even wrote the headline: Ethics Dunce: Sen Rand Paul. Then Sen. McCaskill has to respond with her display of virtuoso unethical nonsense, and—I’m Michael Corleone.
