Yale’s Core Values Betrayal: The Case Of The Student’s Unnecessarily Provocative Philosophy Essay

It certainly appears as if U.S. higher education is sailing toward the shoals of ethics bankruptcy, full speed ahead. It also appears that Yale, although it’s part of a tightly bunched armada, is leading the way.

A law suit called Doe v. Yale tells a jaw-dropping tale that once would have been unbelievable, “once” meaning “before a large segment of the culture accepted the proposition that free expression and thought were undesirable unless they met certain lockstep requirements that will ease the way to a progressive utopia.” The plaintiff, a male student, claims that Yale punished him for the offense of writing a class essay that offended a female teaching assistant.

According to his lawsuit, in late 2013 a philosophy teaching assistant filed a complaint with the university’s Title IX office, complaining about a short paper “Doe” had written in the class she was helping to teach.  The essay discussed Socrates’ discussion, recounted in Plato’s “Republic,” of the three divisions of the soul and their relationship to justice. It applied the Greek philosopher’s ideas to rape, arguing that the crime was also an irrational act in which  the soul’s appetites and spirited components overwhelm its reason, which must have primacy for mankind to be moral and just.

The Title IX coordinator, an associate dean in the Graduate School of Arts and Sciences named Pamela Schirmeister, told Doe that his essay was “unnecessarily provocative.” By daring to discuss rape, he had committed an offense against the teaching assistant. He was told to have no contact with the teaching assistant, and ordered to attend sensitivity training at the university’s mental-health center—re-education and indoctrination, in other words. “Doe” was now, he was told, a “person of interest” to Yale, meaning that that the college was now going to be watching him with a grounded suspicion that he was a potential danger to the campus.

What followed, a few months later, were two dubious accusations of sexual assault by female students, both handled with the slanted, pro-accuser, due process-avoiding  approach that has become epidemic on campuses since President Obama’s Dept of Education issued its infamous “Dear Colleague” letter in April of 2011.  Ethics Alarms has discussed some of these cases and the letter, but that is not the topic before us today.

From The Ethics Alarms “Do The Ends Justify The Means?” Files: The Breast Cancer Survivor’s Inspiring Scam

At one point, profiling the double-mastectomied Paulette Leaphart’s 1,000-mile walk from  Mississippi to Washington, D.C….topless…CNN reporter Jessica Ravitz writes,

“If even one woman’s life was saved thanks to a conversation Paulette started, wasn’t that enough? So what if our hero was flawed?”

Oh, no: the “just one child/just one life” rationalization again! (Which, I now notice, isn’t on the Rationalizations List, and it should be.)

Ravitz writes this to begin a long, detailed, infuriating narrative about the well-publicized and much-hyped crusade of Leaphart, whose journey, displaying her scarred chest,  was to ostensibly demand more funds for cancer research cure and  better and more affordable health care. She said she was a champion for women without breasts “to believe in their beauty and be proud of their strength.”

“By showcasing and embracing her scars, she hoped to inspire others to do the same,” Ravitz writes. “Her journey was bold, visual, moving. It offered a hero to admire and, given Paulette’s audacious decision to walk shirtless in the face of strangers, a rich spectacle to witness. It spoke to African-American women, who face the highest breast cancer mortality rate. It inspired legions of survivors. And it spoke to many who’d lost someone to the disease.”

Ravitz is conflicted, clearly, as she tells the complicated story of the woman whose official cause is admirable, but whose motives are murky, and whose credibility is non-existent. While explaining the mounds of evidence she uncovered that the woman has a record of deception, venality and financial flim-flam, that she sees the long walk as a ticket to fame and cash, and that she has lied and fabricated aspects of her ‘inspirational story” repeatedly while the efforts of journalists to pin her down. Yet Ravitz still ends up by  being wishy-washy and equivocal:

“There’s no way to measure how much of a difference Paulette Leaphart made in shaping the conversation about cancer in this country. She touched many minds and hearts, but whether she did so in the most honest and transparent way remains questionable.”

What? There is nothing questionable about whether Leaphart has been honest and transparent—she hasn’t. Ravitz documents her deceptions impressively. She lied about her cancer treatment. She lied about her eligibility for Medicaid and financial resources. She lied to a documentary team that had arranged to follow her, leading them to end the relationship. She lied on her Facebook page, representing her health travails by using the experiences of a friend. Her unguarded comments suggest that she began the walk as a way to make money for herself as well as research. The Washington Post’s Very Bad, Very Revealing Day: How Often Does This Have To Happen Before Journalists Decide Their Bias Is Making Them Stupid…And Untrustworthy?

Yesterday, the Washington Post, one of the three alleged standard-bearers of U.S. print journalism, published gossip and lies as news, got caught and humiliated..twice!.., and again illustrated vividly why the distinction between hoax stories, what the mainstream media condemns as “fake news,'” and their own false reporting due to incompetence and bias, is illusory.

First, the Post published a weird and alarming story about how Secretary of State Rex Tillerson was behaving like a sultan and ordering subordinates to lower their gaze in his presence:

“Many career diplomats say they still have not met him, and some have been instructed not to speak to him directly — or even make eye contact”

This, of course, sparked widespread ridicule by the Left’s bloggers, commentators, journalists and other tweeters, despite the fact that no sources were named to back up the claim. We have here an example of confirmation bias at its most foolish,  on the part of the reporter, the editor, the paper, and the eager partisan bigots who think businessmen are monsters and the Trump administration is made up of freaks and creeps.  The Huffington Post happily published a collection of celebrities, politicians and random social media users reacting to the  story, including Democratic Congressman Ted Lieu , who said he found the article “disturbing.”

So do I. I find it disturbing that the Post, like the New York Times, cannot be trusted to check out inflammatory slurs against public official before declaring them facts. Note that the quote says the diplomats SAY they have not met him, but that some HAVE been instructed not to make eye contact. The Post stated what sounds like obvious holdover-staff rumor-mongering and sabotage as truth, opening the door for widespread contempt and disrespect of the Secretary of State without justification. Yes, that’s disturbing.

It was fake news. I didn’t believe it. I assumed this was the Post’s anti-Trump bias once again seeping into its deteriorating organizational brain. To his credit, Associated Press reporter Mike Lee immediately called foul, B.S., and fake news. Lee said that he had heard the allegation about employees being forced to avert their gaze in the presence of the Secretary of State two weeks before the Post’s story was published, and after checking into the claim,  determined that it was a rumor without basis.

“It’s compelling gossip. I have looked him  in the eyes and not turned to stone. At least not yet…This is not true and people repeating it are making it more difficult to address very real issues.”

When challenged to back up his statement that the story was false, Lee replied,

“Because I have covered State since 1999. Because I know people who didn’t start in 2009 [that is, Obama era partisans].”

Can anyone defend this Post sliming as anything but biased hackery?

Comment Of The Day: “The Equal Voices Apology To LGBT Individuals”

I must admit, when my head topic scout Fred flagged the Equal Voices apology for the antipathy toward LGTB (or is it LBTG? Does it matter, if the letters still stand for the same things?) engendered by organized religion, I didn’t expect it to be controversial. As the comments revealed in due course, it was. Looking back deep into Ethics Alarms posts and even into the foggy past of the Ethics Scoreboard, I have tried to clarify the distinction between the moral rejection of homosexuality by those who are faithfully following a religion that still holds to ancient taboos, and those whose attitudes toward gays are rooted in irrational fear, gate and bigotry. Ethically, however, the distinction became hard to jutify. The harm is palpable, and the facts are clear. The religious tended to embrace false facts (no, homosexuals do not indoctrinate heterosexual children; no, same sex marriage does not threaten Western civilization; yes, gays are a likely to be decent, law-abiding, ethical people as anyone else) to avoid doubting their faith; the bigoted and hateful frequently used religion to justify their bigotry.  The Equal Voices apology, I believe, is just one more positive step towards full cultural acceptance of the sad truth that the treatment of gays was a mistake, based in ignorance, and no longer defensible on religious or any other grounds. Ethics evolves when morality does not; that’s what’s good, and unsettling, about ethics. Things we thought were right turn out to be wrong, and vice-versa. There’s no shame in that, unless one denies what is right in front of one’s face.

Now comes veteran Ethics Alarms commenter Pennagain with a general commentary sparked by the post, focusing not on LGBT bias but bias against the religious and irreligious.

The Equal Voices Apology To LGBT Individuals

Equal Voices is a movement of Australian Christians, focusing specifically on the relationship between Christians and  “lesbian, gay, bisexual, transgender, intersex and queer (LGBTIQ+) realities and experience,” calling itself “a non-judgmental, non-denominational, ecumenical body…who seek to work for reconciliation and to equip LGBTIQ+ people and their friends and advocates to bring into being a truly inclusive and welcoming Australian church.”

This is the apology it has issued on its website and invited members to sign. It is a Level #1 apology*, but but more than that, a sensitive  and thoughtful starting point for reconsideration of the ethical issues involved. Here it is…

An apology to my LGBTIQ+ friends, and to all who have been adversely affected by the teachings and behaviour of Christians and their churches

Considering the ways in which you have been hurt by me, and by other Christians and churches, I ask for your forgiveness:

  1. For being too slow to acknowledge that we need to say sorry to you;
  2. For not speaking up against the damaging, isolating, and often violent mistreatment you have been subjected to;
  3. For speaking about you, without first listening to you;
  4. For not creating safe environments within our churches where people can speak openly and honestly about their struggles and understandings;
  5. For perpetuating stereotypes, and for not taking full account of your actual lived experiences;
  6. For talking to you or about you in such a way as to suggest that sexual and gender differences are not part of your true identity as humans made in the image of God;
  7. For perpetuating the mistaken belief that sexual orientation and gender identity should be treated, healed or changed;
  8. For rejecting and harming people with intersex variations because we fail to understand or accept your non-binary biological sex characteristics;
  9. For not acknowledging that Christians who are seeking to be faithful to their Lord and to the Scriptures are coming to different conclusions on matters of gender, sexual orientation, non-binary biological sex, and marriage.

I commit myself to:

1. Honour and support you in every way I can;

2. Be open to your correction and gentle guidance;

3. Act in love to hold others to account for words, behaviour or practices which hurt, harm or exclude;

4. Promote respectful, inclusive and informed discussion about issues of Biblical interpretation and application;

5. Work with you to bring about transformative change within our churches.

Catching Up On “Instersectionality,” And Finally Paying Attention

There are more than 22,000 tags used here, even if you eliminate the duplicates due to my typo problem, and still  “intersectionality” is not among them. I have seen the term, mostly recently, but only in contexts that led me to dismiss it as leftist, scholarly jargon, the kind of word radicals throw around to confuse their opposition and make people think they are intellectual when they are really arguing nonsense. I wasn’t wrong: it is one of those words. Still, it is a useful one, because it helps explain several phenomena of great importance, which can be collectively described as the increasing totalitarian tilt of the political left, especially since the election of Donald Trump. I should have realized the importance of the word long  ago and investigated: I apologize. Bias makes me  stupid too.

Over at New York magazine, Andrew Sullivan had one of his lucid moments—when he can bypass his anger at anti-gay attitudes (the bias that makes HIM stupid), Sullivan can be brilliant—, and delivered a perceptive essay about “intersectionality,” beginning with the recent disgrace on the Middlebury College campus, where a student protest designed to prevent sociologist Charles Murray from speaking turned into a violent riot, injuring a professor. Do read all of Sullivan’s article, but here are some key passages:

[W]hat grabbed me was the deeply disturbing 40-minute video of the event, posted on YouTube. It brings the incident to life in a way words cannot. At around the 19-minute mark, the students explained why they shut down the talk, and it helped clarify for me what exactly the meaning of “intersectionality” is.

“Intersectionality” is the latest academic craze sweeping the American academy. On the surface, it’s a recent neo-Marxist theory that argues that social oppression does not simply apply to single categories of identity — such as race, gender, sexual orientation, class, etc. — but to all of them in an interlocking system of hierarchy and power. At least, that’s my best attempt to define it briefly. But watching that video helps show how an otherwise challenging social theory can often operate in practice.

It is operating, in Orwell’s words, as a “smelly little orthodoxy,” and it manifests itself, it seems to me, almost as a religion. It posits a classic orthodoxy through which all of human experience is explained — and through which all speech must be filtered. Its version of original sin is the power of some identity groups over others. To overcome this sin, you need first to confess, i.e., “check your privilege,” and subsequently live your life and order your thoughts in a way that keeps this sin at bay. The sin goes so deep into your psyche, especially if you are white or male or straight, that a profound conversion is required….

Like the Puritanism once familiar in New England, intersectionality controls language and the very terms of discourse. It enforces manners. It has an idea of virtue — and is obsessed with upholding it. The saints are the most oppressed who nonetheless resist. The sinners are categorized in various ascending categories of demographic damnation, like something out of Dante. The only thing this religion lacks, of course, is salvation. Life is simply an interlocking drama of oppression and power and resistance, ending only in death. It’s Marx without the final total liberation.

It operates as a religion in one other critical dimension: If you happen to see the world in a different way, if you’re a liberal or libertarian or even, gasp, a conservative, if you believe that a university is a place where any idea, however loathsome, can be debated and refuted, you are not just wrong, you are immoral. If you think that arguments and ideas can have a life independent of “white supremacy,” you are complicit in evil. And you are not just complicit, your heresy is a direct threat to others, and therefore needs to be extinguished. You can’t reason with heresy. You have to ban it. It will contaminate others’ souls, and wound them irreparably….Murray’s old work on IQ demonstrates no meaningful difference between men and women, and Murray has long supported marriage equality. He passionately opposes eugenics. He’s a libertarian. But none of that matters. Intersectionality, remember? If you’re deemed a sinner on one count, you are a sinner on them all. If you think that race may be both a social construction and related to genetics, your claim to science is just another form of oppression. It is indeed hate speech….This matters, it seems to me, because reason and empirical debate are essential to the functioning of a liberal democracy. We need a common discourse to deliberate. We need facts independent of anyone’s ideology or political side, if we are to survive as a free and democratic society. Trump has surely shown us this. And if a university cannot allow these facts and arguments to be freely engaged, then nowhere is safe. Universities are the sanctuary cities of reason. If reason must be subordinate to ideology even there, our experiment in self-government is over.

This outburst was apparently too much for Andrew, his old libertarian/conservative persona emerging full-force after a long hiatus, so his piece suddenly shifts into a standard issue anti-Trump rant. It’s fascinating to see, because Andrew apparently hates the President so much that he can’t perceive that the same antipathy created by “intersectionality” that he rebuts regarding Murray (after all, Sullivan is friends with Murray), applies to the President (whom he detests) as well. The proof is how Trump’s misogyny and opposition to illegal immigration has led the Left to presume that he is racist, classist and homophobic as well. He’s not. But, to quote Sullivan against himself, “But none of that matters. Intersectionality, remember? If you’re deemed a sinner on one count, you are a sinner on them all.”

Thus Sullivan pivots to blaming all of the social and political tilt he correctly deems as dangerous on Donald Trump, and in doing so, he becomes the partisan hack he so often appears to be: Continue reading

Ethics Observations On That “This Is The Future That Liberals Want” Meme

Boubah Barry, a Guinean immigrant and real estate student, saw a striking pair  riding on his subway into Manhattan on February 19. He snapped a photo, and posted it to his Instagram page. The post was shared by the Instagram account “subwaycreatures,” and eventually  /pol/ News Network attached it to a tweet this week with the message “This is the future that liberals want” as a warning about the  danger posed by progressive policies. Naturally, progressives saw nothing alarming about the scene, flooded the site with defiant endorsements of diversity, and shot the meme around the Internet with the same message: This is the future that liberals want, and so there! Then the satirists, adsurdists, and apolitical got into the act—thank god—and we had this kind of thing…

Ethics Hero Emeritus Desmond Doss, And “Hacksaw Ridge,”

Desmond Doss, who died on March 23, 2006 at the age of 87,  was the very first hero to be enshrined in the Ethics Alarms Hall of Heroes. I wrote about him before there was an Ethics Alarms, shortly after he died.  I had never heard of Doss before, and I remember being angry that I had never heard of him. Everyone should know about him. There literally are no Americans who were any more heroic, and whose ethical conduct was any more astounding, than Desmond Doss.

If the values of this nation, and especially Hollywood, were healthy and correctly aligned, he would be a household name, and the film about his World War II heroism would have been made long ago. Finally “Hacksaw Ridge” was produced in 2016, and has been nominated for an Academy Award, although it will never win.

When I first read about Doss, I couldn’t get my mind around what he had done to be awarded the Congressional Medal of Honor, the only conscientious objector ever to achieve that honor during combat. During the battle of Okinawa, we were told that he survived heavy enemy fire as he struggled to carry seventy-five wounded soldiers to the sheer cliff at Hacksaw Ridge, personally picking up each one and lowering them over the edge the cliff 400 feet to safety.   How is that possible? Now that I’ve seen the film, it still seems impossible.

Desmond Doss proved that principled opposition to violence against his fellow human beings need  not be based on fear, self-interest or self-preservation. It is often impossible to tell whether those who oppose armed combat really object to the spilling of all human blood in battle, or only their own. With Desmond Doss, there was never any doubt. He didn’t like the term “conscientious objector,” preferring the term “conscientious cooperator.” He enlisted in the army following Pearl Harbor, believing that the war against the Axis had to be fought and wanted to be part of the war effort despite believing, as a devout a Seventh Day Adventist, that it was a sin to kill, with no exceptions. Thus he refused to carry a rifle (or shoot one, even in training) but yet insisted that he be involved in combat as a battlefield medic. He achieved conscientious objector status  but would hot accept a deferment. Assigned to the 307th Infantry Division as a company medic, Doss was hazed, abused and  ridiculed  for his dedication to non-violence, and as the Mel Gibson-directed film shows, many of his tormentors eventually owed their lives to his astonishing heroism. All of his compatriots were amazed by his evident fearlessness under fire and remarkable dedication to duty, never hesitating to go after a wounded soldier no matter what the personal risk. As a combat medic on Guam and at Leyte in the Philippines, Doss had already been awarded the Bronze Star  before the three-day battle at Hacksaw Ridge.

Many of the soldiers in Doss’s 307th Infantry, 77th Infantry Division were driven off the ridge by a furious Japanese counter-attack, and  wounded G.I.s were stranded atop it. Doss remained with the wounded, and, according to his Medal of Honor citation refused to seek cover, carrying them, one by one, to the edge of the ridge in the face of enemy fire, some of them from behind enemy lines. He lowered each man on a rope-supported litter he improvised on the spot, using double bowline knots he had learned as a youngster and tying the makeshift litter to a tree stump to serve as an anchor. Every wounded man was lowered to a safe spot 35 feet below the ridge top by the 145 pound medic. Finally, Doss came down the ridge himself, incredibly, unharmed. Continue reading

I Forgot George Washington’s Birthday! In Penance…

If there is any American whose birthday none of us should fail to note and celebrate, it is George Washington. In my case, he is in good company, since I have had difficulty my whole life remembering birthdays of close family members and friends, with the exception of my son’s, once the Boston Red Sox finally won their first World Series in 86 years on the same date, and my own, which I have been trying to forget ever since finding my dad dead in his chair on that date eight years ago. Nonetheless, my failure to salute the first and indispensable President is especially disgraceful for an ethics blog, and I apologize both to George and to all of you.

Time flies: I hadn’t issued a post specifically devoted to George’s remarkable character since 2011. (Something has gone seriously wrong when one has 287 posts on Donald Trump and only six about Washington.) In penance, allow me to atone with my favorite entry’s on the list of ethical habits some historians believe made him the remarkably trustworthy and ethical man he was, ultimately leading his fellow Founders to choose him, and not one the many  more brilliant, learned and accomplished among them, to take on the crucial challenge of creating the American Presidency.

Directed to do so by his father, young Washington had copied out by hand and committed to memory a list called “110 Rules of Civility & Decent Behavior in Company and Conversation”  It was  based on a document  composed by French Jesuits in 1595; neither the author nor the English translator and adapter are known today. The elder Washington was following the teachings of Aristotle, who held that principles and values began as being externally imposed by authority (morals) and eventually became internalized as character.

The theory certainly worked with George Washington. Those ethics alarms installed by his father stayed in working order throughout his life. It was said that Washington was known to quote the rules when appropriate, and never forgot them. They did not teach him to be a gifted leader, but they helped to make him a trustworthy one.

Finally, A 2017 Inspiring Ethics Story! A 5th Grade Basketball Team Teaches Adults About Priorities And Values

I love this story out of New Jersey.

A Catholic Youth Organization 5th grade basketball team out of Clark, New Jersey had played all season with an 11-child roster including nine boys and two girls. In late January the director of the CYO league informed the team that the word had come down from the archdiocese that playing as a coed team offended Jesus or something and thus violated league protocol T team would either have to remove the two girls from the team or forfeit the rest of its season.

The adults running the team had screwed up, you see.

Oops. Sorry kids. Our bad, you pay for it.

These options were unacceptable, and any 10-year old would see it. In fact, any 10-year old did. Continue reading
