Australia Embraces Pre-Crime

It is crucial to understand is that if you are willing to discard ethical values as soon as they become inconvenient, you never really accepted them in the first place.

Thus  Australia’s looming decision to take away the passports of previously convicted pedophiles because officials are sure that some of them are taking child sex “vacations” to Asian nations active in the illegal trade tells us that when it is crunch time down under, ethics is disposable.

Under a proposed new law backed by the Prime Minister and the judiciary that still needs to be approved by the Australian Parliament, registered child sex offenders will lose their Australian passports as a draconian measure aimed at preventing  pedophiles from abusing children in foreign lands. Advocates proudly call the policy a “world first” in the fight against child sex tourism.

They don’t get it, but then, many people don’t. Many American communities continue to oppress registered sex offenders after they have paid their debts to society, restricting their access to public places like libraries and parks. Vigilante groups publish their addresses so they are subject to harassment and worse. The Constitution, however, limits the extent of the abuse, though that still doesn’t make what many registered sex offenders endure just or fair. Australia has no such limitation.

“The Australian” reports that the law would affect an estimated 20,000 registered offenders who have served their sentences but are still under supervision. Last year, approximately 800 Australian registered child sex offenders traveled overseas. Half of them went to Southeast Asia, where child sex-trafficking is epidemic. Nobody knows how many of the 400 or so travelers actually engaged in the criminal activity, but never mind: Think of the children! Undoubtedly some of the past offenders were traveling to do disgusting things to innocents, and if even one child is saved….well, you know the rationalizations.  Here are the ones the Australians appear to be relying upon:

  1. The Saint’s Excuse: “It’s for a good cause”
  2. The Comparative Virtue Excuse: “There are worse things.”
  3. The Coercion Myth: “I have no choice!”
  4. The Revolutionary’s Excuse: “These are not ordinary times.”
  5. The Altruistic Switcheroo: “It’s for his own good” 
  6. The Troublesome Luxury: “Ethics is a luxury we can’t afford right now”
  7. Victim Blindness, or “They/He/She/ You should have seen it coming.”
  8. The Maladroit’s Diversion, or “Nobody said it would be easy!”
  9. The Desperation Dodge or “I’ll do anything!”
  10. TheApathy Defense, or “Nobody Cares.”
  11. The Universal Trump, or “Think of the children!”
  12. The Golden Rule Mutation, or “I’m all right with it!”
  13. The Ironic Rationalization, or “It’s The Right Thing To Do”

The primary theory here, however, is “the ends justify the means.’

“This new legislation represents the toughest crackdown on child sex tourism by any government, anywhere,” Foreign Minister Julie Bishop said, while noting that Australia is “determined to prevent the sexual exploitation of vulnerable young children overseas.” The “crackdown” means that over 20,000 law-abiding Australian citizens will have their right to travel taken away because of what some of 400 travelers to Southeast Asia might have done.

This is pre-crime. The proposed law, and there is little chance that it won’t pass, punishes people who might commit a crime before they do, taking away the basic human right to go where they want to go because they have a particular history or characteristic in common with actual offenders. Maybe some child trafficking will be curtailed.

This end does not justify the means. The fact that the culture in Australia has come to believe it does should constitute a warning that human rights are not sufficiently safe there.

Ethics Dunce doesn’t do justice to Portland’s Mayor Ted Wheeler, nor his city’s residents for electing a First Amendment opponent to lead them. Incompetent Elected Official Of The Month comes closer, but describing mayors who refuse to acknowledge the rights of free speech and freedom of assembly as merely incompetent isn’t strong enough either. Wheeler (Guess his party!)  has asked federal authorities to cancel two upcoming rallies organized by conservative groups in the wake of the recent incident in which two passengers were fatally stabbed on a commuter train last week after confronting a man shouting anti-Muslim slurs. He wants the feds to revoke the permit for a June 4 “Trump Free Speech Rally” in downtown Portland as well as to refuse the requested  permit for a “March Against Sharia” scheduled for June 10.Wrote the mayor on Facebook yesterday,

“Our city is in mourning, our community’s anger is real, and the timing and subject of these events can only exacerbate an already difficult situation…I urge [the events’ organizers] to ask their supporters to stay away from Portland. There is never a place for bigotry or hatred in our community, and especially not now.”

The ingenuity of anti-speech progressives is impressive, but there is no “city in mourning-anger-timing’ exception to the First Amendment. Citizens of the United States, yes, even in Portland, have a right to make statements that the Anointed Arbiters Of What Is Politically Acceptable—you know, like Wheeler—don’t agree with, even if the AAOWIPAs try the neat trick of calling such  statements “bigotry” and “hatred”, or “hate speech,”  which they continue to claim, in a classic use of the Big Lie method, isn’t protected by the Constitution. It is protected.  As the ACLU of  Oregon said in ringing rebuttal to Wheeler,

“The government cannot revoke or deny a permit based on the viewpoint of the demonstrators. Period. It may be tempting to shut down speech we disagree with, but once we allow the government to decide what we can say, see, or hear, or who we can gather with history shows us that the most marginalized will be disproportionately censored and punished for unpopular speech.”

Oh no, you misunderstand my pure motives! the Mayor protesteth through his office. It is only violence we seek to avoid!

From “The Good Illegal Immigrant” Files: If You Want To Enforce Our Laws Against Illegals, Apparently You Deserve To Die, And Democrats Will “Get You”

Texas state Rep. Philip Cortez (D) told the Washington Post,  “We were just on the floor talking about the SB4 protests, and [state Rep.] Matt Rinaldi came up to us and made it a point to say, ‘I called (ICE) on all of them. And this is completely unacceptable. We will not be intimidated. We will not be disrespected.”

Who is “we”? It Cortez an illegal immigrant? I hope not, because that would be illegal and a violation of the Texas Constitution. Why would he be intimidated and disrespected by an elected lawmaker reporting law breakers to appropriate authorities? It is clear that he wasn’t  intimidated or disrespected. What kind of elected official feels disrespected when he is told, “I just reported those people who are holding signs that say, ‘I broke the law, and I’m proud of it, nyah nyah nyah!.“?   This is just the unconscionable rhetorical slight of hand being habitually used by open-border advocates and unprincipled Mexican-American lawmakers to pander to their constituency.

It is not “completely unacceptable” to report illegal immigrants to ICE. It is completely unacceptable for an elected official to make the nonsensical, rule-of-law rejecting statement that doing so is unacceptable. Continue reading →

From The Ethics Alarms Double Standards Files: The Women-Only “Wonder Woman” Screening [UPDATED]

The infuriating thing is that that not only are they flaming hypocrites, they are self-righteous about it.

Writes the pop culture website Too Fab, a proud young social justice warrior pop culture hangout,

“A “Wonder Woman” screening exclusively for women at the Alamo Drafthouse theater in Austin has pissed off a lot of fragile men.”

No, the outrageous double standard represented by the screening has pissed off anyone with a modicum of ethics comprehension, and should.

If you don’t immediately see the problem, you’re part of it. Even the galactically tone-deaf Hillary Clinton didn’t hold a women-only campaign rally (although her post-campaign rally at the Wellesley College graduation yesterday was pretty close to one.)  Barack Obama’s most rudimentary ethics alarm would have sounded if an aide proposed a blacks-only event. Hey, let’s promote the NFL with a men-only exhibition game! Given their promotional instincts, I’m surprised Alamo Drafthouse theater didn’t have a screening of the racist, “Whites are trying to destroy us all!” horror film “Get Out” restricted to endangered African-Americans, and maybe balance it off with a whites-only classic film screening of “Birth of a Nation.”

The striking aspect of this per se double standard display is that the Left is defending it, and mocking its critics using Swiss-cheese logic worthy of an evolution denier.

In Denver, A Cautionary Tale: Absolute Devotion To Unethical Partisan Doctrine Corrupts Absolutely

All right, maybe he’s got a bad temper, but only a xenophobe wouldn’t want him as a neighbor…

Time was when this story would have made my head explode. Not any more. Progressive and Democratic fanaticism regarding the rightness of facilitating and honoring illegal immigrants has been driving that side of the ideological divide farther and farther away from reason and responsible citizenship. This, as horrible as it is, now is just one more incremental step toward madness.

The Left’s strategy of tarring all principled objections to illegal immigration as “racism” and “xenophobia” has mandated that to them all immigrants, legal and illegal, are just immigrants. Thus their furious battle to keep deserving illegal immigrants from being deported (all illegal immigrants deserve to be deported, though it is impractical at this point to do it) slides easily into a passion for preventing deserving legal immigrants from being deported. What legal immigrants—non-citizens who are U.S. visa holders and legal permanent residents do our laws and common sense dictate do not deserve to stay here? The answer is those who commit serious crimes, of course. Non-citizen aliens are guests here. When a guest in your home is caught stealing a vase, or sexually assaulting your daughter, you kick him out, and rightfully so. If America’s guests can’t respect out laws, they can’t be trusted, and if they can’t be trusted, we don’t want them here. We certainly don’t want them to become citizens.

Yet the Denver City Council agreed this week to change to local sentencing guidelines specifically to shield legal immigrants from deportation proceedings when they are convicted of domestic abuse. In a 12-0 vote, council members reduced criminal penalties for several “low-level” crimes, reducing the maximum sentence to less than 365 days in jail because under federal law, a legal alien resident who is convicted of a crime resulting in a sentence of a year or more can be deported.

A GOP Candidate Wins A House Seat In Montana Despite Attacking A Reporter The Night Before The Election. What’s Going On Here?

Yesterday, in an Ethics Alarms post pointing out that nobody should vote a person who physically attacks reporters, or indeed, who attacks anybody, into Congress, I wrote,

What kind of person would vote for Gianforte after last night’s display? The kind of person who argues that character doesn’t matter in elected officials, only their positions.

And idiots, of course.

Candidate/Thug Greg Gianforte, the Republican candidate, won the election nonetheless with over 50% of the votes. Rob Quist, the Democrat, received only 44%. Does this mean that over 50% of Montana voters are idiots? No, that wouldn’t be a fair conclusion. An estimated 60% of voters had turned in their ballots already, so the Gianforte voters in that batch weren’t necessarily idiots. (As I implied in the post yesterday, the advocates for voting before election day, thus allowing late-arriving information about the candidates—as in, “Hey! This guy is an unstable, volatile jerk with the judgment of a bar room goon!” to have minimal effect on  election results, have embraced an irresponsible, idiotic even, policy.)

Gianforte’s victory illuminate  other ethics issues, hwoever:

1. Addressing supporters in his victory speech, Gianforte apologized to the reporter he body-slammed, the journalists who witnessed the attack, and Montanans, saying “When you make a mistake you have to own up to it. That’s the Montana way.”

Ugh, yecchh, gag, petui!

If that’s the Montana way, why did Gianforte sit back and allow his campaign to blame the episode on the reporter? Remember, the statement from Gianforte’s staff, which is to say Gianforte,  said that the reporter,

“entered the [campaign] office without permission, aggressively shoved a recorder in Greg’s face, and began asking badgering questions….After asking Jacobs to lower the recorder, Jacobs declined. Greg then attempted to grab the phone that was pushed in his face. Jacobs grabbed Greg’s wrist, and spun away from Greg, pushing them both to the ground. It’s unfortunate that this aggressive behavior from a liberal journalist created this scene at our campaign volunteer BBQ.”

That isn’t owning up. That’s covering up, spinning and lying. Does the new Congressman’s apology mean that he acknowledges that his campaign was lying? When will he own up to that?  An apology now is cheap, cynical and meaningless, for Gianforte won, and Montana is stuck with him for two years.

2. A Montana TV station refused to inform its viewers that Gianforte had assaulted and battered a reporter. NBC affiliate KECI, recently purchased by the conservative media conglomerate Sinclair Broadcasting, adamantly kept the report of the attack and the audio of the incident,  arguing that “The person that tweeted [Jacobs] and was allegedly body slammed is a reporter for a politically biased publication.”  That “biased publication” was the Guardian, and the tweeter was Ben Jacobs, the victim. His account was confirmed by reporters from Fox News…you know, that liberal network that is always trying to make Republicans look bad. The anchor of the evening newscast, Laurel Staples, read a statement that said, in part, “NBC Montana takes pride in reporting only verifiable facts from an independent, reliable sources.”

 NBC News, including the Today show and affiliates across the country, played the audio of the altercation between Jacobs and Gianforte, who was charged with misdemeanor assault, indicating that reports of the episode were reliable. Continue reading →

This is the second Comment of the Day on the post about the Alexandria, VA gym that kicked white supremacist, aka “Nazi”, Richard Spencer out because a Georgetown professor found his presence there, in town, in the universe, offensive.

Stipulated: This person believes things that we think are wrong, and we want him, ideally, to stop believing them.

I assert that shunning him is counterproductive with regards to getting him to stop believing these things. He is almost certainly aware of the public opinion of Nazis, and he evidently doesn’t care, so peer pressure is already shown not to work. Besides, truth is not determined by a majority vote, so if we act like our numbers are the major argument against the Nazi ideology, or whatever similar ideology this person subscribes to, it not only weakens our position in his eyes, but also leads us to forget the real reasons for what we believe.

Suddenly there is a bumper crop of Comments of the Day on Ethics Alarms; two more are slated for re-publication today, both in response to Spartan’s provocative opinion that she would leave a gym that allowed white supremacist Richard Spencer work out there, even if he restrained his urge to heil. 

First up is Mrs Q, a relatively recent addition to the ethics colloquy here, and one who has distinguished her self quickly for non-nonsense posts of clarity and purpose. Her reference in this post to the “socialist shithole” of Portland was especially timely: yesterday we learned that the city’s social justice warriors had driven a local burrito business to close for the offense of “cultural appropriation.”

…In my mind I don’t see myself as a quadruple minority. Yes my skin color is brown, I’m a lady married to a lady, work from home due to disability…but I don’t think of myself in terms of “special classes.” I’m probably more like a country conservative old school hippy stuck in a socialist shithole (Portland OR). However how do you think many of the young white liberals here tend to treat me? Well some dismiss me because I don’t agree with their stances. My initial response to this comment by Spartan on the post about Richard Spencer being harassed while trying to use his gym membership and the gym’s response of kicking him out rather than his harasser was in part:

“A very clear and well-stated exposition of an unethical point of view that many misguided people agree with…thus imperiling our pluralistic society.”

It troubles me greatly that so many intelligent Americans are thinking this way in 2017.

Here is Spartan’s Comment of the Day on the post, “Ethics Dunce: Old Town Sport And Health in Alexandria, VA. Why? Because White Nationalists Have A Right To Work Out Too”:

This guy is a public figure and he will be recognized. He chose to be in the limelight. Gym members are allowed to quit their memberships because they don’t want to work out with an asshole. Now imagine (in liberal Old Town) that 75% of the members decide to quit their memberships at this gym because they don’t want to be around him. The business will now suffer.

I used to go to this gym, and I can tell you that I would not want to be around this man. So, although I would not circulate a petition or demand that the gym expel him, I would quit my membership. And, I probably would tell all of my friends why, so I imagine many of them would quit as well. Also, keep in mind that this gym is super tiny — you are pretty much forced to interact with other members.

In this scenario, the gym might end up closing because of lack of membership. So, this is trickier than you make it out in your hypothetical. I am not obligated, as a private citizen, to be polite or even silent around odious human beings. While I do not support a gym’s decision to terminate membership based on political (although I’m being generous here) beliefs, the fact is that people can vote with their feet.

Ethics Dunce: Old Town Sport And Health in Alexandria, VA. Why? Because White Nationalists Have A Right To Work Out Too

Let me be clear what you are saying, Professor: when you engage in harassment and bullying, that’s good, but if the bad guys do the same thing, it’s despicable. Do I have that right?

Last week, controversial speaker and white nationalist Richard Spencer was working out at the Old Town Sport&Health gym where he is a member, minding his own business,  when C. Christine Fair, an associate professor at Georgetown University’s School of Foreign Service, recognized him and got in his face.

“Not only are you a Nazi — you are a cowardly Nazi,’ ” Fair says she told him.  “I just want to say to you, I’m sick of your crap — that this country belongs [to people like you]. . . . As a woman, I find your statements to be particularly odious; moreover, I find your presence in this gym to be unacceptable, your presence in this town to be unacceptable.”

Spencer called for a trainer, who happened to be black, to stop Fair and allow him to go back to working out.

“Seriously? This superior race of a white man needed the help of a female African American? What kind of martial race member is he?” Fair wrote in a post about the incident. Fair continued to harass Spencer, and another gym member stepped in to defend him. Fair said she told the woman, “Right now you’re being ignorant, and you’re actually enabling a real-life Nazi.”

So, naturally, Old Town Sport&Health terminated the professor’s membership for bullying and harassing other members.

Just kidding! It terminated Spencer’s membership for having the audacity to hold different views than Professor Fair. Whether Alexandria kicks him out of town on the same theory, as Fair believes is the right thing to do, is unknown.

Boy I hate it when people make me defend racists. I especially  hate it when smug, self-righteous totalitarians and noodle-spined, unprincipled  gym owners make me defend racists. Nonetheless, Spencer was the abused victim here, Fair was the offender, and she, not he, should have been told to work out somewhere else.

I’m so weary of reading about restaurants that give discounts to diners who pray, and bar owners who declare that no Democrats are welcome and Maine propane dealers who tell their customers that they can freeze to death if they voted for Donald Trump. I’m tired of pointing out what should be obvious to everyone in a pluralistic society, but suddenly isn’t, particularly, it seems, to proto-totalitarians like the Georgetown professor, who is doubtless hard at work indoctrinating her young charges into believing that those with non-conforming views should have their rights taken away for the greater good. I detest Spencer’s views, but I consider Fair and her kind the far greater threat to the nation, in part because there are so many of them. Continue reading →
