Incompetent Elected Official Of The Month: Idaho State Representative Pete Nielsen (R-Mountain Home)

There are two reasons to deride Rep. Nielsen. First, by his own words he is marked as an idiot unworthy not only off high office but of public trust, and second, he either has  been paying no attention to epic, infamous, well-publicized catastrophes in his own party, or doesn’t have a brain pan of sufficient depth to comprehend them.

Surely you remember Todd Akin, the Missouri GOP Senate candidate in 2012, who blew his party’s chances of taking a eminently winnable seat from the horrible Claire McCaskill by uttering this nonsense on the issue of whether rape-caused pregnancies should be an exception to abortion restrictions:

“It seems to me, from what I understand from doctors, that’s really rare. If it’s a legitimate rape, the female body has ways to try to shut that whole thing down…”

He was ridiculed, he was attacked, he was mocked, and from all parties and ideologies, for his magical theory that a woman’s body knows the difference between “legitimate rape” and the nice kind of sexual intercourse. (Oddly, none of those “doctors” ever came forward, perhaps because they were wearing diapers and had turnips sticking out of their ears. Somehow, Pete Nielsen missed all of that, and so during a debate in the Idaho Legislature on bill that would require women seeking abortions to be given a list of providers of free ultrasounds, when it was noted that the measure makes no exception for victims of rape or incest, he piped up with this:

“Now, I’m of the understanding that in many cases of rape it does not involve any pregnancy because of the trauma of the incident. That may be true with incest a little bit.”

Now, if he had been immediately pelted with wadded up papers, soda cans and other things by his  horrified colleagues, may be would have had the sense to stop digging, but, being an idiot, he didn’t. Asked how he knew this absolute non-medical non-fact as reliable as the theory that you can catch AIDS from a toilet seat, Nielsen said, “That’s information that I’ve had through the years. Whether it’s totally accurate or not, I don’t know. “I read a lot of information. I have read it several times. … Being a father of five girls, I’ve explored this a lot.”

April Fool’s Day is essentially “Betray Someone Who Trusts You So You Can Mock Them” Day, and I have come to detest it. The internet has made the tradition less tolerable than ever, with web hoaxes multiplying the victims of “jokes” from individual friends and family members into thousands of strangers.

What is necessary to have an April Fool’s prank “work” is for someone to trust the prankster and ideally to not be especially aware of April Fool’s Day. I have a problem with the latter: imposing a tradition on someone who doesn’t embrace the tradition is unethical. The first part is also ethically troubling when the April Fooler is a person or entity who is obligated to be trustworthy. I would never host an April Fool’s gag on Ethics Alarms, and I have criticized other professionals who have carelessly used their professional blogs to indulge their juvenile senses of humor at the expense of others. No professional should be pulling tricks on clients or anyone who looks to them for facts, advice, experience or truth. That means April Fool’s Day is off limits to doctors, lawyers, journalists, elected officials, serious bloggers, accountants, law enforcement officials, teachers and priests in their official capacities, to name just a few. It also means that corporations should leave the faux holiday from honesty to individuals.

Among her almost infinite flaws, Hillary Clinton is stunningly lacking in self awareness, and her statements often—astoundingly often—point to her own misconduct and ethical bankruptcy without her comprehending the self-indictment. She has tweeted, more than once, this sentiment, for example:

“To every survivor of sexual assault…You have the right to be heard. You have the right to be believed. We’re with you.”

…though Hillary was emphatically not “with” the women who credibly accused her husband of sexual assault, and still do. She will make statements to one group that are the exact opposite of what she recently said to another group, without batting an eye. Hillary actually committed the meta-lie of saying she never has lied, which is manifestly unbelievable. Then there was this Titanic-style gaffe…

“There should be no bank too big to fail and no individual too big to jail.”

…coming from someone who is, many legal experts believe, not already under indictment purely because she is “too big to jail.” (and then there is hubby Bill, who engaged in flat-out illegal election conduct in Massachusetts that you or I would have been arrested for, and didn’t even get a rap on the wrists.) Neither Clinton has any integrity at all, or shame either. It’s really quite stunning.

This is an example of a politician intentionally playing to class divisions, ignorance and bias, and worse, encouraging them. It is exactly like saying that it is “unacceptable” that Jimmy Fallon, who only hosts a silly late night show, makes more money than any cancer surgeon, special needs teacher or EMT alive. In some ways it is worse, because most people understand what those jobs are, and may  sort of comprehend the economic principles at work: if Jimmy Fallon drops dead, there is no replacement who will bring to the job exactly what Jimmy Fallon did. He is a unique commodity, and EMT’s are not. The statement is just an emotional attack on the fact that people value laughing over things that are objectively more practical, and entertainment salaries reflect that. Continue reading →

Unethical Artificial Intelligence Teenaged Girl Web Bot Of The Month: Microsoft’s “Tay”

Developers in Microsoft’s Technology and Research and Bing teams made “Tay,” an Artificial Intelligence web-bot, to “experiment with and conduct research on conversational understanding.” She spoke in text, memes and emoji on severalf different platforms, including Kik, Groupme and Twitter ‘”like a teen girl.”  Microsoft marketed her as “The AI with zero chill.” You could chat with Tay by tweeting or  Direct Messaging  the bot at @tayandyou on Twitter. Though she was programmed to use millennial slang and be up to date on pop culture, she was, like Arnold the good cyborg in “Terminator 2,”  designed so she would learn from her online interactions with humans, and you know how ethical humans are.

Within 24 hours, Tay was asking strangers she called “daddy” to “fuck” her, expressing doubts that the Holocaust was real and saying things  like “Bush did 9/11 and Hitler would have done a better job than the monkey we have got now;” “Donald Trump is the only hope we’ve got;” “Repeat after me, Hitler did nothing wrong” and “Ted Cruz is the Cuban Hitler…that’s what I’ve heard so many others say.” For Tay, becoming more human meant becoming a vulgar, sex-obsessed, racist, anti-Semitic, Nazi-loving Trump supporter.

Imagine what her values would be like in 48 hours. Wisely, Microsoft is not willing to chance it, and Tay is now unplugged and awaiting either reprogramming or replacement. One of Tay’s last tweets was,

“Okay. I’m done. I feel used.”

Oh, yes, this artificial intelligence stuff is bound to work out well.

I must confess that I got a bit bored with my promised unethical Trump quote of the day feature, since on most days there are so many of them. After a while they are predictable and redundant. It’s best to just assume that Trump is being unethical, and wait until he crosses a new line before highlighting an example of his despicable nature. I think threatening another candidate’s wife is a new line: has any Presidential candidate ever directly and publicly threatened an adversary’s wife? Would any previous candidate survive public outrage if he did?

This attack was particularly outrageous. Trump, whose calling card is Rationalization #2 A, Sicilian Ethics or “They had it coming,” was reacting to an offensive ad by a pro-Cruz group in Utah, which released a nasty ad featuring a nude photo Trump’s  trophy wife Melania once posed for with the caption “Meet Melania Trump, Your Next First Lady. Or, You Could Support Ted Cruz on Tuesday.” It wasn’t Cruz’s ad, and he could not, under the law, have anything to do with it (not that I would put it past his campaign anyway.) [C]onsensual relationships with adults don’t seem like a big deal. Sure, the conflict of interest of sleeping with someone in your class is deserving of discipline, but, really, in a state where you can marry your sister, is it a fireable offense to hookup with a twenty-something attorney-to-be? Obviously, if there were more serious allegations that would be another matter, but so far we’ve only learned of this more benign brand of misconduct.

This commentary, from a regular writer for a website that covers law schools, is so ethically obtuse and legally ignorant that he should be fired. “Not a big deal”? Sexual harassment at law firms is a very big deal as well as a very big problem, and a law professor who flagrantly violates an anti-harassment policy like the prohibition against professors treating the student body as their own personal dating bar is teaching that seeking sex with subordinates is culturally acceptable in the legal profession. It isn’t. It never has been.

The professor’s conflict of interest is the least of his self-created problems. First, there is no valid consent in such cases. The professor has real and perceived control over students’ academic success and legal career viability. This is classic inequality of power that gives a professor implied leverage over a student’s “consent” to sexual relations. Moreover, the knowledge that a professor is having sex with students constitutes third-party sexual harassment. Do other students assume that they are expected to have sex with the professor if he requests it? Is the professor looking at female students as mere sex objects? Are students that provide sexual access more likely to get high grades? What happens to students who say “no”? This creates a hostile environment for study and education. Continue reading →
