#MeToo Ethics Fiasco In Colorado: The Vengeful Frankened Democrat

Colorado legislators last week voted overwhelmingly to kick out State Representative Steve Lebsock, a Democrat, after five women had accused him of eleven total instances of sexual harassment. To say Lebsock did not go gentle into that good night is an understatement.

One of the accusers was a colleague and fellow Democrat, Rep. Faith Winter, who claimed that Lebsock “acted aggressively” toward her when she turned down his sexual advances during an end-of-session party in 2016. She claimed that he grabbed her elbow, causing her to feel threatened. Lebsock denies the allegations of all of the women, and claimed that he was being railroaded out of his seat to help his accuser, Winter, win a state Senate seat in November. So vigorous was Lebsock in his defiance that two other Democrats, Assistant House Majority Leader Rep. Alec Garnett and Rep. Matt Gray, announced in speeches that they had been wearing bulletproof vests in the chamber for weeks in response to his threats.

No, Steve Lebsock didn’t order a hit. He was more creative. To enact his revenge on his party for making him Colorado’s Al Franken, he formally switched his party registration from Democrat to Republican just minutes before the state House expelled him. As a result, Republicans, rather than Lebsock’s original party, get to fill the vacancy left by Lebsock’s expulsion.

Of course, nothing says that the Colorado GOP couldn’t treat this technical maneuver as the petty payback it is, and in the interests of comity and fairness, let Democrats choose who will fill Lebsock’s seat by allowing Democratic governor John Hickenlooper to appoint his replacement.  Nah!  Colorado Republican Party Chairman Jeff Hays said a vacancy committee would meet later this month to pick Lebsock’s replacement, saying,

“Statute clearly assigns our vacancy committee the authority and responsibility to fill this seat. After careful consideration, we concluded it would be dereliction of duty to punt the appointment to Gov. John Hickenlooper. We owe it to the people of House District 34 to give them the experience of ethical representation, which the Democrats, when they controlled the seat, signally failed to provide.”

The rationalization for this argument is that the Democrats had known about Lebsock’s harassing conduct all along, and covered it up before the #MeToo fervor struck. Of course, if the Democrats knew, it’s likely that his Republican colleagues knew as well. Continue reading

Where’s that whimpering sound coming from?

1 Don’t make America stupid, ABC. The new ABC legal drama “For The People” premiered last night, and lost me forever. I can’t trust the writers. In the final moments of the episode, a veteran female defense lawyer was consoling a young lawyer who was upset after losing a case. The older lawyer evoked the memory of a 1951 rookie for the New York Giants, who went hitless in his first Major League games and was devastated. But his manager put him in the line-up again, and he hit a home run in his first at bat, and never stopped hitting.

“Ah,” said the young lawyer, “Willie Mays. The greatest player who ever lived.” The older lawyer nodded sagely.

By no measure was Willie Mays the greatest baseball player. Is this racial politics by series creator Shonda Rhimes? I assume so: there is no other plausible explanation. The odds of two randomly selected baseball fans asserting that Mays was the greatest baseball player would only be more than miniscule if anyone who knows baseball believed that. Willie was the greatest centerfielder of all time, the greatest African-American player of all time, quite possibly the most charismatic and entertaining player to watch of all time, and very possibly the second most gifted baseball player of all time. But he wasn’t the greatest. The best player by every measure, statistical, modern analytics, WAR, JAWS, OPS, contemporary reports and common sense was, of course, Babe Ruth. He was the greatest hitter who ever lived, a great pitcher before that, and no athlete in any sport ever dominated it like Babe did in the Twenties.

Now, any individual can hold an eccentric opinion that Willie was better. But that was not how the assertion was presented. It was presented as an accepted fact that two random baseball fans agreed upon. This is irresponsible misrepresentation. I was trying to think of an equivalent: I think it’s like a TV show having someone quote the Declaration of Independence, and a listener then  say, “Thomas Jefferson. Our greatest President!” as the other individual nods sagely.

2. Four Regans, or, if you prefer, Linda Blair Heads.This is the new Ethics Alarms graphic for unethical media spin. The number of Regans can range from one to four, with four Regans signifying “spinning so furiously her head might fall off.” (If you don’t get the reference, you are seriously deficient in cultural literacy.) The four Regans go to the polar news media spinning yesterday’s special election in Pittsburgh, Pennsylvania, where Democrat Conor Lamb appears to have narrowly won a seat in a Republican stronghold, though the race is still too close to call. The Wake-Up Call And The Power Cord

As you may have noticed, your host has been involuntarily separated from Ethics Alarms for about 24 hours. Several things occurred that under normal circumstances would have had me dashing off a post while waiting for flights or preparing to check out of my hotel—and there were definitely several comments that had me reaching for a phantom keyboard—but I was without laptop, thanks to leaving the power cord behind in my previous hotel.

So I have a little story to tell. I stayed at a decent Boston hotel last night, not a 4 star hotel like the one I just left  in Atlanta (The Four Seasons), but a nice one, professionally run, dependable. Yet this morning this was my wake-up call, via recording:

“It’s 7 AM. This is your wake-up call for March 8, 2018.”

Almost at the same time, David Hogg was on CNN, explaining how darned easy it was to create a system that would prevent school shootings forevermore.

Wrong. Systems break down, you experience-free, arrogant, disrespectful, know-nothing puppet.  The belief that human beings can devise systems that will solve every problem, or any problem, and do what they are designed to do without failing miserably at the worst possible times and in the worst imaginable ways is signature significance for a fool, or a child. O-Rings fail. Police don’t act on warnings that a kid is violent. Obamacare raises health care premiums.  Political parties end up nominating Hillary Clinton and Donald Trump. Jack Ruby breaks past police security. Communism ends up killing hundreds of millions rather than creating a worker paradise. The Titanic hits the wrong iceberg exactly where it’s weakest. Hitler takes a sleeping pill during the Normandy invasion.

Tales Of The King’s Pass: The Rainmakers

Are you also an asshole? Because if you’re enough of a rainmaker, you can be as big an asshole as you want!!!!

Wow. You don’t get much more cynical than this.

Here’ s Karen Kaplowitz, the founder of The New Ellis Group, and a business development strategist and coach for over 20 years, essentially denying the existence of ethics and integrity in law firms as a business necessity.  In a piece on the ABA Journal titled Abuse of power within law firms: The rainmaker dilemma, she begins,

Despite their obvious economic value to their organizations, Bill O’Reilly, Matt Lauer and Harvey Weinstein were quickly sacked. Law firms by contrast have often tolerated bad actors who are major rainmakers. Can law firms tolerate abusive rainmakers in the current business climate? Do firms need to be more aggressive about confronting abuses of power?

Can they tolerate abusive rainmakers, in this or any other business climate? Sure they can. Should they? Absolutely not. “Do firms need to be more aggressive about confronting abuses of power?” What? Does this question have to be asked?

How Many Rationalizations Can You Spot In This Op-Ed? [UPDATED!]

 

At the beginning of the month we discussed the scandal in Nashville, Tennessee, where the female mayor, —the news media tried oh so hard to bury her party affiliation deep in reports, but she’s a Democrat— was carrying on an adulterous affair with the head of her security detail.  Some quotes from the Ethics Alarms essay to refresh your memory for the horrors to come:

—She apologized “for the harm I’ve done to the people I love and the people who counted on me” but said she won’t be resigning. In a news conference, she said nothing illegal happened and no policies were violated.

—“I know that God will forgive me, but that Nashville doesn’t have to,” Barry said. “And I hope that I can earn their trust and I can earn your trust back, and that you will forgive me

—-This is classic appearance of impropriety.

—-In the Bill Clinton mold, the mayor is framing this as a matter of marital fealty rather than official misconduct—which it is—so she can argue that it’s just “personal private conduct.”

—-The conduct is unethical whether there are policies or not.

—-This is sexual harassment. The officer was a subordinate, and she was his boss, with the power to fire him or worse. There can be no genuine consent in such situations. In these cases with the typical genders reversed, neither the news media, nor the public, nor, in all likelihood, a hypothetical jury, would see it that way.

—-Barry’s playing the God Card is grounds to remove her all by itself.

—-Come on, #MeToo, show some integrity. Get this workplace predator kicked out of office.

Interestingly, a prominent and respected female, feminist Democrat who comments here with distinction argued in the comments to that post that this wasn’t even a newsworthy story outside of Nashville. Also interestingly, the New York Times disagrees, and even published a spirited—but stupid!—defense of Barry’s conduct, arguing that unlike, say, Al Franken, who was forced to resign for pre-political career conduct and unproven post-political career allegations, the fact that a Democratic mayor—FEMALE! Don’t forget that she is female!–was using state-paid employees under her supervision as a personal, state-funded dating pool does not mean she’s untrustworthy or qualified for high office.

Okey-dokey then! What we have here is an old-fashioned convenient double standard!

And this just in! Nashville’s main newspaper, the Tenneseean, reports that Rob Forrest, the Mayor’s married lover, earned substantially more overtime than the other bodyguards on Barry’s secuirty detail, $173,843.13  between July 2015 and January 2017, which was nearly $53,000 more than the other four bodyguards received combined. But, as several internet wags have noted, let’s be fair: Rob was doing more for the mayor than those other bodyguards..

Now let’s all read the op-ed*, by Margaret Renkl , whom the Times proudly describes as ” a contributing opinion writer.” This time around, I won’t get into such matters as the odd silence of the #MeToo warriors, who have set out to destroy successful men who were accused of being boorish on a single date. I won’t even question the competence of the Times editors, allowing such unethical, illogical, poorly reasoned hypocrisy to make its way into its pages to make Times readers more ethically inept than they already are. No, I just want to focus on Renkle and her claim that Barry shouldn’t have to resign, and the unethical rationalizations for wrongful conduct she gainfully employs along the way.

The Other Alleged Collusion Scandal: Baseball’s Unemployed Free Agents

Major management-labor troubles are brewing below the surface in Major League Baseball. With the 2018 Spring Training camps opening in a few days, over a hundred free agents remain unsigned, including many of the best players on the market. The Players Association is preparing to open a special training camp just for all the unsigned players, and shouting foul. They are alleging illegal collusion among the team owners to keep salaries down.

A lack of signings on this scale has never happened before, and agents and their player clients are increasingly hinting that dark forces are afoot. Fanning the flames are sportswriters and commentators, whose left-wing sympathies are only slightly less dominant than in the rest of the journalism field. The content on MLB’s own radio station on satellite radio has become an almost unbroken rant about how unfair it is that the players aren’t getting “what they have worked so hard for.” The theory appears to be that employees decide how much they are worth, and their self-serving assessments shouldn’t be challenged.

It is not that many of the free agents haven’t offers for their services on the table. It’s not that they don’t have multiple year contracts that will pay them millions of dollars on the table. They do, and thus  many of the unsigned players can substantially fix the bitter impasse by saying “yes.” Oddly, they are finding that public opinion is not substantially in their corner as they choose to bitch instead.

The poster boy for this controversy is, as luck would have it, a player who is sought by my very own Boston Red Sox. He is J.D. Martinez, a slugging outfielder just entering his thirties who had the best year of his life in 2017. Naturally, he wants a large, multi-year contract that will leave him set for life; this is his big and probably only shot. He also has the most aggressive, successful and, in my view, unethical of sports agents,  Scott Boras, who began the free agent auction season by announcing that J.D. would be seeking a contract worth 250 million dollars or more.

The problem is that not a lot of teams can afford such a contract, and those that can are, finally, wising up. Multiple year contracts have a way of blowing up in a team’s face. Analytics are now widely used to allow teams to make intelligent projections regarding just how much a player will add in value and wins. This year, most of the richest clubs are not hurting for home run hitters or outfielders, which leaves the Red Sox, who despite winning their division last year for the second year in a row didn’t hit as many homers in doing so as the spoiled Boston fans are used to, as the most obvious landing place for Martinez. Sure enough,  the team offered Martinez a five year deal reputed to be worth 125 million bucks. No other team has offered anything close, and it is unlikely that any team will. Boras and J.D. still say it’s not enough. They want a sixth year, and more cash. The Red Sox see no reason to bid against themselves, and have said, in essence., ‘There’s our offer. Take it or leave it.’  Somehow the baseball writers and the player see Boston as the villain in all this.

Morning Ethics Warm-Up, 2/9/2018: Post 2016 Election Ethics Train Wreck Update Edition. Sorry.

 

Good Morning.

I don’t say “I told you so” as often as I could or would like to. One continuing theme at Ethics Alarms since the 2016 election that drove progressives mad has been the accusation leveled at me that I have been under-emphasizing the existentially perilous character and conduct of the President while concentrating too much on the conduct of his critics. My answer has been that I believe that the reaction of progressives, Democrats and the news media to President Trump’s election has been, by far, the most disturbing ethics story of the past year, and in historical context one of the most serious and dangerous periods in U.S. history. That conclusion has been reinforced as the year progressed. I was and am right.

None of that makes the ethical conduct of the Trump Presidency any better than it is; as I made clear in last year’s ethics audit,  he has largely behaved as I expected he would when I declared him, over and over again, unfit and unqualified. However, if our institutions and the public’s trust in them remain as strong as they have through-out U.S. history, a single odd-ball President, even for two terms, will not do irreparable damage. What the resistance and its allies in the Democratic Party and the news media are doing, however, threatens to wreck many of those institutions and tear down public trust to a point of no return. That’s my professional assessment. It is not one based on partisan politics or ideology, but on American history, cultural history, and ethics.

1 Fake news and fake history. I knew it was manufactured nonsense when my Facebook friends, Democrats, pundits and the mainstream news media began once again screaming “Fascist!” and claiming that the President’s expressed desire for a major military parade was a terrifying departure from American tradition. I knew a little research would prove it so, but then, I thought, surely some news source would have the integrity to do its job, and some “nationally recognized historian,” like go-to Democratic shills like CNN’s Douglas Brinkley, would set the record straight. Why should I have to do the work for free that these people are paid handsome fees to do, and have a duty to do besides?

Yet few corrections from these supposedly objective sources were registered while Rep. Adam Smith (D-CA) said, “A military parade of this kind would also be a departure from the values of our constitutional democracy,” and Rep, Ted Lieu (D-CA) sneered, “Because authoritarian regimes like Russia and North Korea hold massive military parades does not mean that we must as well. Politico headlined, “Trump’s Military Parade Draws Bipartisan Rebuke.” The Washington Post told readers,  “Military Parades Are About Ego and Power. Of Course Trump Wants One.”  Normally reasonable bloggers were similarly triggered, like Prof. Jonathan Turley, who wrote, “The United States has long rejected the holding of military parades featuring tanks, missiles and other heavy weapons as a symbol of authoritarian regimes like the Soviet Union, North Korea and other countries.”

I guess this depends on what one’s definition of “long” is. Such parades have been out of style since the Vietnam War caused much of the public and the political class to turn against the military, though politicians still give deceit-laden lip-service to “supporting the troops,” just not what they do. Military parades featuring heavy weaponry were not uncommon between the end of the Civil War in 1865 through 1961 during the peak of the Cold War, when it was arguably strategically beneficial to remind the USSR that if it was going to bury us, there would be a fight.  Many of these parades, in 1919, 1942, 1946, 1953, 1957, 1961, and as recently as 1991, featured tanks, missiles, and sometimes many thousands of troops  Let’s see: that’s Presidents Wilson, Roosevelt, Truman, Eisenhower, Kennedy, and George H.W. Comment of the Day: “Ethics Quiz: The Tip-Sharing Plan”

We have a rare Ethics Alarms Quote of the Day hand-off. Responding to the ethics quiz about the ethics of tip-sharing,  veteran commenter JutGory wrote,

“My understanding is that, in some places, servers collect the tips and “tip-out” to the others (kitchen staff, etc.) at certain rates. If that is the culture (I have never been a server; not my skill set), why is a server trusted more than the employer to be fairer than the employer in tipping out?”

I have written about tipping ethics issues for years, and never encountered the concept of “tipping out,” perhaps because the minimum wage jobs I had in my youth never involved tips of any kind. Still Spartan picked up JutGory’s baton and dashed for the finish line. Here is her Comment of the Day on the post, Ethics Quiz: The Tip-Sharing Plan: 

I used to work at a fancy restaurant and that was the system. The percentage of tip out was based on total food sales, so you couldn’t cheat. And, if I received really generous tips, I was incentivized to tip more because I wanted the hostess to seat good customers at my table, my drinks up first, my tables bussed quickly, etc. I would never work at a place that pooled tips because I was quite frankly better than most servers. I was quick, friendly, and rarely made a mistake. I could up-sell my customers on liquor and food which meant more money for me at the end of the night. And you people think I am anti-capitalist! Chefs aren’t tipped and they make a lot more than $3/hr., and although it is a hard job, at least their revenue is consistent. Many managers are well-paid too and often double as hosts or bartenders. I would be pissed if they had the ability to collect my tips.

The real solution to this problem is to pay servers a living wage and just have it incorporated into the price of food.

Comment Of The Day: “Ethics Quiz, Super Bowl Edition: Justin Timberlake’s Integrity”

John Billingsley elaborates on the import and implications of the troubling research results regarding the brain disease CTE and participants in contact sports, especially football.

Here is his Comment of the Day on the post, Ethics Quiz, Super Bowl Edition: Justin Timberlake’s Integrity:

I agree that with 99% of NFL players and 91% of college players showing CTE on autopsy there is no ethical justification for American football and we don’t need it. Do we actually need any contact sports? CTE has been demonstrated in participants in multiple other contact sports including basketball, boxing, ice hockey, rugby, soccer, wrestling, and baseball. Unfortunately, there is not as much information available about the rates of CTE in those sports. There was an autopsy study demonstrating CTE in the brains of 21 of 66 individuals who participated in different contact sports at various levels, but no CTE in the brains of 198 controls who had no history of participating in contact sports. A study looking at high school athletes who participated in various contact sports from 2005 to 2014 found that there were about 300,000 concussions annually. That study found that the sport with the highest rate of concussions adjusted for the rate of participation was girl’s soccer. A concussion does not mean CTE will develop but repeated head injury is the etiology of CTE. Continue reading

Morning Ethics Warm-Up, 2/5/18: Churchill, Philly, Trump, Uma, And The FBI

1 This has little to do with ethics, except that it proves I wasn’t watching the Super Bowl, but…Here’s my report on “The Darkest Hour,” which my family saw last night in an almost empty theater. Apparently most people would rather see young men risk future dementia than celebrate a great man who may have saved civilization.

[ Aside: On that question, this article in the Federalist says in part, “Super Bowl Sunday seems the appropriate day to bring you the cheerful news that football is doomed. The sport is dying and cannot be saved, at least not in America, its traditional home. The cause of death is science. Simply put, football is a sport in which the audience entertains itself by watching men violently turn each other’s brains to mush…What happens if football becomes a game where white middle-class people pay millions to watch poor and minority kids bang up each other’s brains? I don’t think that’s going to be tenable….That means it’s only a matter of time before participation rates drop off precipitously and it no longer seems like the cool thing to do.The science has turned against football, and it can’t last. So enjoy today’s game, while you still can.” ]

You can skip to the next item if you don’t like your ethics polluted by film reviews.

The film is very good; not “Best Picture” great, I think, but very good. It did a better job making clear what was going on and the stakes at Dunkirk than “Dunkirk,” for which I’m grateful; maybe thay should show the two movies as a double feature. The last fade-out shot was “The Natural”-style over-the-top, out of whack with the style of the rest of the film and it left a sour taste, I thought. Artistic integrity would be nice. It reminded me of ET’s spacecraft leaving a rainbow trail

I’ve now seen four Churchill portrayals recently: Albert Finney’s in the 2002 HBO film “The Gathering Storm,” Brian Cox in “Churchill,” Gary Oldman, and John Lithgow in “The Crown.” My ranking: would also be in that order: Finney, Cox, Oldman and Lithgow lagging far behind. I’m a big Lithgow fan, but he looks and sounds so little like Winston (and so much like himself) that he just can’t measure up to the other three..

Finney, Cox and Oldman were all excellent: it’s very close. Oldman has by far the best part of the story to work with (the chronological order is Finney, Oldman, Cox and Lithgow) and the best screenplay, though “The Gathering Storm” is also strong. Oldman’s scene in the “Tube” is the best scene in any of the productions. It probably didn’t happen, but Churchill was known to wander around London talking to Londoners during the Blitz, so it COULD have happened.

All of the top three Winstons had moments when I forgot the actor and really believed I was watching the historical figure, my test in biographical films. This was something Lithgow couldn’t pull off for a second.  (Actors who could in other historical movies: Paul Scofield as Thomas More, Daniel Day Lewis as Lincoln.) Finney’s big advantage over Cox and Oldman, I think, is that he is a star as well as a great actor, and Churchill, as a Great Man, needs to radiate that presence and star quality too. Oldman feels small physically (though he’s actually taller than Churchill was, and no shorter than Finney), and his voice is light; there’s nothing he can do about that. I could make a strong argument that Brian Cox, who is one of the most under-rated actors around, was the best Winston, but the film itself was unforgivably careless and ahistorical.

If you haven’t seen Finney’s performance, which won him several awards, you should. It was probably his final great turn, since he’s in his 80s now and hasn’t made a movie since “Skyfall” in 2012.

Finney’s Clementine, Vanessa Redgrave, wins the award for that role, though her daughter, Miranda Richardson, was also fine in the same role with Cox. Apparently every actor who plays King George is great, but “Churchill”‘s King, James Purefoy, was wonderful (he’s another under-rated actor) and in a fair world, would be looking at an Academy Award nomination for Supporting Actor. The acting in that film is so excellent; it’s a shame its history is so messed up.
