Comment Of The Day: “Saturday Ethics Warm-Up, 10/12/2019…” Item #2, Dan Hudson’s Paternity Leave

“Wait, What??? YOU’RE SKIPPING THE GAME THAT WILL DECIDE THE PENNANT???”

In a post sparked by the the current National League Championship Series (boy, I hope I don’t have to add that the sport is baseball) I had written in part,

“The ethical thing would have been [for Washington Nationals relief pitcher Daniel Hudson, the team’s closer] to pass on the opportunity to take the game off. The Nationals major weakness is a terrible bullpen, and Hudson is one of the few reliable  relief pitchers on the team. As it happened, the Nats won a close game, but that’s just moral luck. They might have lost because of his absence. That loss might have cost the team its chance to go to the World Series. Millions of dollars would be lost to the franchise that pays Hudson seven figures to improve its fortunes. The careers, lives and family fortunes of his team mates would be affected; the jobs and income of hundreds of merchants and others who rely on the success or failure of the team would have been put at risk. How could anyone argue that the emotional support Hudson would lend his wife during childbirth outweighs all of that, or constitutes a superior ethical obligation?”

Who? Why reader Tim Hayes, that’s who, who not only argued thusly, but did so at a Comment of the Day level, and then responded to my subsequent challenges with equally excellent responses. This gave him the Ethics Alarms equivalent of a three home-run game, and I’m going honor him with the whole sequence.

Counter-argument on the Hudson situation – For the Nationals to have placed themselves in a position where a single player taking advantage of a promised benefit at his job (the paternity leave) created a realistic chance of them losing the game (due to their lack of hiring sufficient healthy talent into their bullpen) is inherently unethical as an organization, because it creates a situation where all the groups you mentioned can be placed in dire straits by what happens to a single performer. Attaching the consequences for the team’s unethical staffing decision to Hudson’s personal behavior is unfair; The team did not choose to get him to negotiate away the benefit he invoked (which, for the appropriate compensation, they presumably could have), and was therefore at least aware of the possibility that something outside their control could sideline Hudson. That it was his wife giving birth, and not Hudson being hit by a self-driving car, which resulted in their not having access to him, was merely a result of luck (pregnancy and births being both notoriously difficult to plan, and the Nationals presence in the playoffs being, from the admittedly little I understand of baseball, something which was unexpected to say the least). Morning Ethics Warm-Up, 9/19/2019: Easy Ethics Edition [Corrected]

I’m baaaack!

Ann Althouse has boasted that she has only missed one day of blogging since she started the Althouse blog, long before Ethics Alarms took its first metaphorical breath. This has enlightened me regarding how much time tenured professors must have on their hands. Missing a full two days of ethics commentary, as I did this week, makes me feel like an irresponsible slug-a-bed who is betraying loyal readers who depend on a service, but it was literally impossible for me to research a post, never mind write one, between hotels, meetings with my teaching partner, meals, travel and the seminars themselves. When I finally arrived at home and office, I almost immediately had to handle a long conference call in which I was quizzed on some tricky legal ethics issues, and then was officially brain dead for the rest of the evening. It is hard to think clearly about ethics when one is exhausted. And I still am, but the warm-up format is a relatively safe way to ease myself back into the saddle.

1. Getting the really important stuff out of the way first...Sean Spicer made his debut on “Dancing With The Stars.” I posted last month about the double -standards and bias of the pundits who criticized the show for having the former White House spokesman as a contestant, and their animus is still one more example of unethical mainstream media partisanship. However, Spicer taking a pay-off to look ridiculous on national television—he gets $125,000 for each week he “dances” before he is mercifully voted off—is unprofessional, even though increasing numbers of public servants are doing it. Spicer is giving media critics of the President another stick to beat him with, and denigrating his own role as well as the administration by casting himself as a clown.

Spicer was a slow loris even by the miserable recent standards of press secretaries, and emblematic of how the President’s pledge to appoint and hire “the best people” appears in retrospect as a cruel joke. I can’t say I feel sorry for him, still, in presenting himself as target, he has provoked the mistreatment media into exposing its pettiness and apparently irrepressible gratuitous hostility to the President. The New York Times covered Spicer’s terpsichoral misadventures in the politics section, so it could write sections like…

In the White House, Mr. Spicer held a job that has usually been considered a golden ticket to future respectability and financial comfort. His predecessors have landed in lucrative corporate gigs at Amazon and United Airlines, or become the hosts of their own television programs. But trading in his famously ill-fitting suit to become a trending neon GIF felt like the culmination of a different kind of post-White House journey, one that is q.uintessentially Trump.

The job has been a “golden ticket” for “respectability” for recent press secretaries of Democratic administrations, because the mainstream news media seldom had adversarial relationships with Presidents they helped elect. Of course, the Republican varieties who have been hired by Fox News aren’t respectable. Spicer’s fate is “quintessentially Trump” because the current President is the first that the press has refused to grant even minimal respect from the beginning of his administration. In Baltimore, a young, slugging first baseman is leading the charge to get the Baltimore Orioles into the American League play-offs. He is on a home run pace that could net him 60  or more, and fans voted him the starting first baseman on his league’s All-Star team. Because his production this year far exceeds anything he had accomplished before, however, Chris Davis’s emergence isn’t being celebrated as much as it is being suspected. Another steroid scandal looms over major league baseball, one which threatens to engulf two former MVPs, as well as other players. Fans and sportswriters don’t trust players any more, or their power totals, not since Mark McGwire and especially Barry Bonds juiced and injected their way to shattering the game’s home run records.

This bothers lawyer/baseball blogger Craig Calcaterra, and it should., as someone concerned with justice. Of the smearing of Davis, he calls it…

“…utterly baseless speculation; Davis has always had tremendous power but is now, in the past year, matched it up with better plate discipline — is the product of a media landscape which has decided that every power hitter is a ‘roider. Jose Bautista got this treatment a couple of years ago. Davis is getting it now. Everyone who engages in this business does so because they’ve been convinced by the baseball media that such speculation is not just justified but necessary. It’s neither of those things. The drug testing system put in place had avoiding these parlor games as one of its primary justifications. But that’s not good enough for some, apparently.” Continue reading

Thanking Dick Williams…Finally

If you are not a baseball fan, or under the age of thirty, you probably never heard of Hall of Fame manager Dick Williams, who died yesterday at the age of 84. I never met Williams myself, but I have been indebted to him for four decades. I never told him the immense difference he made in my life, just by doing his job.

In the winter of 1967, I was a devoted fan of my home town team, the Boston Red Sox, and had been since 1962.  Over that period I had listened to every single baseball game on my transistor radio when a game wasn’t on TV, which was most of the time, or when I wasn’t at the game, which was almost always the case. I was the only person I knew who followed the team, and for good reason: it was torture. The Red Sox were hopelessly mediocre on the way to awful, and hadn’t had a winning season in more than ten years.

It is a great character builder to follow the fortunes of a terrible baseball team. Almost every day, for six months, you are let down, and yet return to the scene of your despair the next, attempting to muster hope while steeling yourself against likely disappointment. You find yourself finding things to appreciate other than winning: the gallant veteran player who “plays the right way” (Eddie Bressoud, shortstop, 1962-1965); the exciting rookie who gives promise of a better future (Tony Conigliaro, right fielder—rest in peace, Tony); the unique talent who is worth watching for his own sake (Dick Radatz, relief pitcher, 1962-1966). These things help, but following a perennial losing team and caring about them is like being punched in the gut four or five days a week without knowing which day you’re getting it.

Since 1965, I had always reserved seats for the first day of the season and one of the last two home games, just in case those last games would be crucial to a (hahahaha!) Red Sox pennant drive. This was especially pathetic, since the team was getting worse. They had finished in a tie for 9th place in 1966, and as the 1967 season loomed, Vegas had them installed as 100-1 underdogs to win the American League pennant. In truth, the odds should have been longer. Nonetheless, I wrote the Red Sox and got my tickets, this time for the next to last day of the season.

The team was full of rookies and near rookies, and appropriately had hired a minor league manager, Dick Williams, to be the new skipper. Williams was something else, however: he was a gifted leader. One day, in the middle of Spring Training, a Boston scribe asked the new manager what the prospects were for the upcoming season. Would the team escape the cellar? Would there be forward progress? Williams’ answer was instant front page news:
