That memorable exchange from Jurassic Park came to mind constantly when major break-downs in the Healthcare.gov website were being called glitches by government toadies and the news media (but I repeat myself), and it came to mind again when the President was taking his absurd victory lap in April after the enrollment figures came out, as if the public’s ability to finally make the damn website work was the final definition of success.

Like the pathetic Hammond, the visionary who built his dinosaur theme park only to see it fall victim to Chaos Theory and hubris, Obamacare’s army of deceitful supporters and cheerleaders resolutely refuse to admit what should be apparent. The project was too ambitious, badly designed, sloppily executed, and dependent on too many untrustworthy contractors—like Dennis Nedry, who was just Newman in disguise. The evidence has been obvious, but as has now become standard operating procedure for this epically incompetent, amateurish, dishonest and unaccountable administration, the strategy has been to deny, delay, confuse, posture and accuse, while hoping some miracle or collective amnesia prevents the day of reckoning.

A Chaos Theory Law, An Anomalous Case, And Charles Grodin’s Lament

Charles Grodin doesn’t like the felony murder rule.

The felony murder rule, which essentially holds that anyone who is proven to have been involved with a felony during which someone was killed is guilty of First Degree Murder, is one of the harsher devices in American jurisprudence. I must confess, I sort of like it, and always have. Like all laws, however, it doesn’t work perfectly all the time.

The reason I like the rule is that it acknowledges the real danger of initiating felonies, crimes that are serious and destructive. If you burn a business down to collect the insurance, for example, you should be held responsible by the law if the fire gets out of control and someone is killed. The law combines criminal and civil offenses; the felony murder rule is like a negligent crime principle. It is a law that implicitly understands Chaos Theory at a basic level: actions often have unpredictable consequences, and even if the consequences are worse than you expected or could have expected, you still are accountable for putting dangerous and perhaps deadly forces in motion. If you commit a felony, you better make damn sure you know what you are doing, because if people get killed,  you will be held to a doubly harsh standard. Better yet, don’t commit the crime. Grassy Knoll Ethics: How Deception Breeds Distrust

We once again must squarely face the hoary  quote from Walter Scott’s epic poem Marmion: “Oh what a tangled web we weave when first we practice to deceive.” It is hoary because it is true, and this month’s Smithsonian Magazine reminds us of how true it is, recounting how well-intentioned deceptions by the news media regarding evidence in the assassination of President Kennedy helped create a conspiracy theory that will not die, and that may have begun the slow, relentless deterioration of America’s trust in its own government that has reached dangerous proportions today.

Frame 313 of Abraham Zapruder’s accidental record of one of the pivotal moments in U.S. history gave him nightmares, and when he sold the rights to his amateur movie to Life Magazine, he insisted that frame be withheld from the public, and not published. “We like to feel that the world is safe,” documentary maker Errol Morris explains in the article.“Safe at least in the sense that we can know about it. The Kennedy assassination is very much an essay on the unsafety of the world. If a man that powerful, that young, that rich, that successful, can just be wiped off the face of the earth in an instant, what does it say about the rest of us?” I understand, but withholding the truth is not the way to make the world seem safer. I try to think about the ethics of war as little as possible, much less write about it. It is too frustrating, and ultimately a waste of time: the same debates and philosophical arguments have been made, eloquently and passionately, for not just hundreds but thousands of years, and only the mechanics of warfare have changed.

My father, a war hero and a man who would have loved to have devoted his life to the military if his wounds hadn’t prevented it, used to say that war was the stupidest of all human activities. “There is nothing good about war,” Dad said. “Yet it is sometimes necessary and unavoidable. And don’t ask me to reconcile those statements: I can’t. Nobody can.” I remember asking him about General Patton, who led my father and his comrades during the Battle of the Bulge. “Patton supposedly loved war,” I said. “He did,” my father replied. “He was insane.” He loathed Patton.

The Syria crisis has triggered all the same arguments again, and I want no part of them. Ethical analysis doesn’t work where warfare is concerned. The conduct of ritualized killing combatants and innocents is, at best, an extreme utilitarian act that always creeps into  ethically indefensible “the ends justify the means” territory before the end of hostilities. So many invalid rationalizations are used to justify killing—“It’s for a good cause,” or the Saint’s Excuse, prime among them, with “They started it!” following close behind—that it is useless to tote them up. The war most often cited as a “moral war,” World War II, still involved the killing of innocent non-combatants by the Allies. ( My father remained amazed at the efforts at “limited war” in Iraq, noting that Allied soldiers were expected to accept civilian deaths as unavoidable and not a matter of concern. He also felt that the current dedication to half-measures just guaranteed longer wars, more deaths, and less satisfactory results. “It’s war,” he said. “You can’t make it humane or sensible; you can only make it shorter. Telling the military that it has to waste time and military personnel to avoid civilian deaths makes no sense. There is no such thing as a humane war.” Naturally, he approved of Truman’s decision to drop the atom bomb, in part, he admitted, because he was slated to be in the Japanese mainland invasion force that was likely to sustain up to a million casualties.) The Allies engaged in atrocities too, such as the fire-bombing of Dresden.

You want to talk about the problem of supporting terrible people and factions to defeat another? World War II is the champion on that score. The U.S. partnered with Stalin, who was a greater mass murderer than Hitler, and defeated Japan, the enemy of China, allowing Mao, a greater mass murderer than Stalin and Hitler combined, to enslave a billion people. The peace negotiated after the Second World War was only slightly less destructive than the one that ended the First World War (and led directly to the Second): The U.S. handed over half of Europe to Communism, laying the seeds of the Cold War that only avoided ending humanity in a nuclear holocaust by pure moral luck. The fact that WWII is the “best” war powerfully makes the case: ethics and war have nothing to do with each other. Each renders the other useless and incoherent. Continue reading

The Complete “It’s A Wonderful Life” Ethics Guide [UPDATED]

 Frank Capra’s 1946 masterpiece “It’s A Wonderful Life” is one of the great ethics movies of all time, perhaps the ethics movie of all time. In 2011 I prepared a guide through its complex ethics thicket. The post was divided into three separate posts, and I eventually combined them s0 readers can have the pleasure, if one can call it that, of watching the film like I do: having ethics arguments the whole way through. And now, here is your guide. Additions are welcome and encouraged.

1. “If It’s About Ethics, God Must Be Involved”

The movie begins in heaven, represented by twinkling stars. There is no way around this, as divine intervention is at the core of the fantasy. Heaven and angels were big in Hollywood in the Forties. Nevertheless, the framing of the tale advances the anti-ethical idea, central to many religions, that good behavior on earth will be rewarded in the hereafter, bolstering the theory that without God and eternal rewards, doing good is pointless.

We are introduced to George Bailey, who, we are told, is in trouble and has prayed for help. He’s going to get it, too, or at least the heavenly authorities will make the effort. They are assigning an Angel 2nd Class, Clarence Oddbody, to the job. He is, we learn later, something of a second rate angel as well as a 2nd Class one, so it is interesting that whether or not George is in fact saved will be entrusted to less than heaven’s best. Some lack of commitment, there—then again, George says he’s “not a praying man.” This will teach him—sub-par service!

“It’s A Wonderful Life” Ethics, Part 3

Here is the final installment of the Ethics Alarms overview of the ethical issues raised in Frank Capra’s classic. Some of the comments on Parts 1 and 2 have suggested that my analysis is unduly critical. Nothing could be further from the truth. I love the movie, and have already said that I find it ethically inspiring. Noting that characters act unethically in a movie about ethics is no more criticism than pointing out that people in horror movies never just leave when things start getting weird (as I would). I know that their actions drive the plot and are necessary. This is, however, how an ethicist watches a movie with as many ethical choices as “It’s A Wonderful Life.” I can’t help it.

Now back to George, Mary, and Bedford Falls:

11. Uncle Billy screws up as we knew he would

11.  Christmas Eve arrives in Bedford Falls, and Uncle Billy manages to forget that he left the week’s deposits in the newspaper he gave to Mr. Potter. Thus more than $8,000 is missing on the same day that the bank examiner is in town. Why is Uncle Billy still working for the Savings and Loan? He’s working there because George, like his father, is putting family loyalty over fiduciary responsibility.  Potter, of course, is a thief; by keeping the lost money to trap George, he’s committing a felony, and an unnecessary one. As a board member on the Savings and Loan, Billy’s carelessness and George’s negligence in entrusting him with the bank’s funds would support charges of misfeasance. Mr. Potter, had he played fair, might have triumphed over George legitimately, and no Christmas miracle or guardian angel could have saved him. But this is the inherent weakness and fatal flaw of the habitually unethical: since they don’t shrink from using unethical devices, they often ignore ethical ways to achieve the same objectives that would be more effective.
