The Jeff Zucker Scandal’s Emerging Details Confirm The Long-Time Ethics Alarms Verdict: This Is And Has Been A Corrupt, Untrustworthy News Organization

And it, meaning its unethical and unprofessional leadership, management and employees, was allowed to manipulate public opinion, national politics, and the nation. Think about that.

We didn’t need more to know CNN President Jeff Zucker was a slimy, ruthless hypocrite—his network was proof enough— but the unfolding scandal has certainly provided spectacular confirmation. You need to thoroughly update yourself at the links, but here are some basics:

  • CNN’s President Jeff Zucker announced on February 2, 2022, that he was resigning from the company, over his illicit affair with subordinate Allison Gollust. The spin on this includes calling her a “colleague.” No, she worked for Zucker. That makes the relationship toxic, not just “inappropriate.” Both Gollust and Zucker left their marriages during the affair.

Who knows what employees, or female or minority employees, were passed over so Zucker could advance his lover’s career? That’s a major reason why the boss having affairs with subordinates is always wrong, always destructive, and must be addressed.

  • CNN talking heads and execs are making excuses for Zucker. One CNN executive told The Daily Beast, “People are pissed. No one thinks the punishment fits the crime.” And that proves how thoroughly ethics brain-dead Zucker has left CNN. When the head of any organization is caught violating that organizations rules and policies, he or she must resign of be fired.

Morning Ethics Warm-Up, 1/7/2020: Oh, Great, A Red Sox Ethics Scandal….

Bad Morning.

1. Fire this copy writer: Boll and Branch sheets informed me this morning that their product is “loved by THREE American Presidents.” Well, that settles it: I’m running right out and buying these sheets if Presidents—well, three, anyway, love them. Actually, I’m making the sheets an early target of my new rule to personally boycott any product that insults my intelligence with their ads or packaging.

So much for Chex-Mix.

2. I just realized what climate change hype is like. I’m slow, I guess. I was reading a typical Paul Krugman column about how we are doomed by climate change and only the mean, stupid Republicans refuse to accept it. (The runaway brush fires in Australia, he said, can’t be proven to have come about by climate change, the brilliant economist said, but everybody knows its climate change. All Democrats, anyway.) It then hit me: climate change is like all the reflex explanations for bad things that primitive civilizations, cults and Machiavellian leaders have used to relieve public fears of  random misfortune since the beginning of time. The devil, angry gods, witches, Jews…anything to be able to rationalize events that otherwise have no explanation.  If you sacrifice people to the gods, hang the witches or exterminate the Jews, you’ll feel better—you’re doing something by addressing the cause of all your pain. Of course, these imaginary “causes” aren’t really responsible for what’s happening, but its comforting to “do something.” In the case of climate change, the proxy trouble-makers are capitalism, personal liberty and democracy. Just get rid of them, and everything will be all right again.

I don’t know why it too so long for me to figure this out. I think it’s because I persist in the romantic notion that we all get smarter over time. I certainly don’t. Continue reading

Interview Ethics: Sabotaging A Job Candidate, With A Kavanaugh Hearing Flashback

Frequent commenter and old friend Vinnymick flagged this one, thus proving that someone took my recent appeal for out-of-the-way ethics topics seriously. He pointed me to a Washington Post article, which lays out its topic thusly:

“While browsing Twitter recently, I came across a post that suggested an innovative interview technique: Take a job candidate out for a lunch interview, then secretly ask the server to intentionally mess up the candidate’s order. The purported goal: to see the candidate’s true nature. “It’s easy to say how you would handle when things go wrong, [but] hard to fake your reaction as it happens,” the post concluded.”

Or, as another type of sabotage, have an old high school colleague of the interviewee sit down at the table and accuse him of sexual assault. Then observe how he reacts to that!

The Kavanaugh debacle came to mind immediately, in part because so many who rationalized the Democrats’ abuse of Justice (now, judge then) Kavanaugh was that it was a “job interview.” No, it wasn’t, as I repeatedly had to explain to people (but, you know, when progressives are in the process of a Trump-related freak-out, you can’t explain anything to them(, in a real, fair and professional job interview, the interviewer hasn’t already decided that he or she doesn’t want to hire you, as nearly every single Democrat regarded Kavanaugh before the hearings began . In a job interview, you are being interviewed by your potential supervisors and those who you will be working with if you are hired. The Supreme Court doesn’t report to the Senate, take orders from the Senate, or work with the Senate. In a job interview, there is a presumption of good faith between the job seeker and the interviewer. No, the Kavanaugh hearings were a transparent effort to sabotage the  judge’s nomination from the outset.

Now back to the article’s hypothetical: Of course pulling a stunt like the one described is unethical. An earlier Ethics Alarms essay on “silly job interview ethics”—it’s pretty good, I must say, and I had completely forgotten that I wrote it— recommended that if an interviewer starts abusing you, and this is abuse, excuse yourself, saying, “I’m sorry. I was under the impression that I was applying for a position with an organization that respected serious professionals, and that would never exploit the interview process for its own amusement at the discomfort of someone who expected fair and courteous treatment. I apparently was mistaken.”

I added,

I think the use of odd interview questions is a symptom of an arrogant and essentially untrustworthy corporate culture. There may exceptions, but I don’t believe it’s worth the gamble. If the interviewer starts messing with your emotions and confidence, tell him or her to cut it out, or better yet, leave.

One More Reason Not To Watch “Bull”

Harassed and harasser. Guess who stayed employed?

“Bull,” the CBS legal drama starring Michael Weatherly as a roguish, brilliant jury consultant who violates so many ethics rules on behalf of the submissive lawyer who employs him that it actively makes viewers dumber, reached my boycott list almost immediately. It’s a shame, because I could get a lively post, sometimes several, out of virtually any episode, since the show’s respect for ethics, professional and otherwise is non-existent.

Now there’s another good reason to avoid “Bull.” CBS has investigators checking the depth and length of the cultural norms of sexual assault, harassment and cover-ups at CBS, where CEO Les Moonves was recently fired after it was revealed that he was a serial sexual predator. That was odd, too, because the other networks enjoyed painting Fox News as a den of sexism after founder Roger Aisles was exposed as exactly the sort of pig who would make his female talent dye their hair blonde and dress like cocktail hostesses. They also had their news reporters sneering and preaching about evil Candidate Trump boasting about “grabbing them by the pussy” while their execs and stars were actually doing it. (My guess? Every one of the major networks has corrupt, harassment-supporting cultures like Fox and CBS. Every single one.) One of the revelations was that actress Eliza Dushku, the bad vampire slayer on “Buffy,” was harassed repeatedly by “Bull” star Michael Weatherly, and when she complained about it, was fired. To cover-up, Dushku was paid nine million dollars as damages and hush money. As you know, this must have been a campaign financing violation.

The story is disgusting. Read it and retch. to summarize, Weatherly, who apparently is very much like the charming jerks he plays, pet making sexual comments to Dushku, calling her “Legs” on the set, suggesting that she participate in “threesomes” and similar comments. Soon other men on the show were doing the same. Dushku, who had been signed up play a continuing role on the show, complained—as she should have—and Weatherly had her fired. Then CBS paid to cover it up.

Nice.

It is amazing to me that even in the ethics cesspool of show business, this behavior continues to happen, and big corporations continue to allow it, indeed facilitate it. Weatherly says he was misunderstood, that he was joking—like when he said in front of the cast and crew that he would bend her over his leg and spank her, or when he said he would take . Dushku to his “rape van,” which he said was filled with phallic objects and lubricant—that this is just the way he is, that he didn’t mean anything by it and is sorry that he upset anybody.

Bull.

This is classic sexual harassment, and would have been rude, unprofessional and abusive conduct before the term “sexual harassment” was invented.

I have had many female peers and subordinates in my embarrassingly diverse career, including many who were single, attractive, and who caused my heart to skip a beat every time I saw them. I never once made a sexually suggestive comment to any of them; it would not have occurred to me to do so. The reason is that I was raised properly to be respectful to women, and because I instinctively understood that the workplace, even the confusing workplace of show business, was not a locus where basic manners and common sense were suspended. This shouldn’t be hard. That particular ethics alarm should be installed and fully functional by the time a child is 10.

Weatherly, of course, as the star of a successful, popular and lucrative show, assumed that he was immune from discipline, and he was, sadly, right. What should have happened was that the producers should have called him in to grim scene with lawyers present. He should have been told that his conduct was not only stupid and vulgar but illegal. He should have been required to apologize to the actress and to make an appropriate statement to the cast and crew. Finally, he should have been told that a single instance of this kind of conduct, or any hint or retaliation against Dushku, would result in his dismissal for cause.

Disney and ABC, you will recall, fired Roseanne Barr from her own show for a single tweet. Even a CBS show had acted decisively when “Criminal Minds” fired star Thomas Gibson for kicking a writer. Ah, but one instance was racism, and the other was violence. The tragedy is that too many organizations and powerful men, especially in Hollywood and Washington, D.C., still don’t see sexual harassment as all that big a deal. No, it certainly doesn’t help the the President of the United States also doesn’t think it’s a big deal, but you can’t blame CBS’s conduct on him.

There is no excuse for this. There was never any excuse for this.

Comment Of The Day: “The Viral Google Diversity Memo”

The perspective Ethics Alarms readers often add to topics based on their personal experiences is a often great enhancement to the discussions here. This Comment of the Day by Alex is a perfect example, as he clarifies the context of the Google diversity memo through his own observations as an employee of another large tech company.

Here is his Comment of the Day on the post, “The Viral Google Diversity Memo”:

Rather than rehash the memo or analyze it or say what is right or wrong with its reasoning, I’ll instead add my experience dealing with internal policies and “requests for comment” at a large tech (software) company – this is a direct competitor of Google, based in the Pacific NW and employing ~100,000 people (you can figure out who they are with that). My background is in Electrical Engineering with a strong focus on Computer Science, and I was hired by my previous employer just out of college after spending a summer internship with them. I worked there for 12 years, until the summer of 2016 (actually today is my one year anniversary at my new job). In my time there I can only describe diversity and HR policies around race and gender are schizophrenic, even if well-intentioned. These are my stories [insert Law and Order opening notes].

The official harassment/discrimination policy as stated in the employee handbook (which was updated every year) is incredibly vague, and this is intentional (although no one will come out and accept it publicly). We are in an at-will state, so you can be easily dismissed based on that one vague rule; and it has been used as a negotiation tactic on borderline performance dismissals to settle for a lower severance package. (“Do you really want us to state that you’re leaving for violations of the harassment policy? No? Ok, how about you settle for 2 weeks instead of 4?”) But I also have to state that the cases where I saw this section being arguably misused can be counted with the fingers of one hand. Also, I am certain that there are good intentions behind this policy, but as is the case with many well-intentioned rules, it is when the rubber meets the road that things get messy.

Every year we had to take Standards of Conduct training. Every year we had a new edition, and every year there was at least one case study dealing with gender or racial discrimination. Some years were better than others, but in general the training was terrible. If you had the cognitive abilities of a 7-year-old you could figure out what were the right responses without watching the videos or reading the policies. (The Saturday morning cartoons I watched in the 80s – G.I. Joe, He-Man, Transformers – had more complex moral dilemmas). I remember one year around the middle of my tenure when the videos and cases were actually interesting and engaging. A case that I still remember from that time is about an ambiguous situation between a male manager and a female engineer not in the same chain of command. There was a big internal debate about that one, and the next year we had the blandest possible training to avoid controversies.

The above two points are to set the stage: corporate policies are clear, you should toe the line, do not do anything that might be misconstrued, you can be dismissed for very small transgressions.

And then… well… tech companies are rebels, they thrive in chaos, and you’re expected to rock the boat. In many (may be even all) groups you can only grow so much by being a technical expert, you are expected to influence larger and larger teams as you get promoted to keep getting good performance reviews. You can be the only expert on a certain software component, but unless other people know about you and have been “influenced” by you, you are not considered good enough. This has the effect of incentivizing “visibility”. Other people and other teams should know you exist and be willing to state that you’ve had a positive impact for the company. Continue reading

Sexual Harassment, Victim Blaming, Toxic Corporate Cultures, President Trump’s Defense and Other Ethics Notes On Bill O’Reilly’s Fall (Part II))

The Ethics Alarms audit of the Bill O’Reilly canning by Fox (okay, technically it wasn’t a firing, but it was) continues…

9. One problem with the Left’s thinly veiled joy at getting O’Reilly is that it encourages the Right’s narrative that O’Reilly’s only crime was being conservative. Also not helping were President Trump’s interview statements about O’Reilly to the New York Times, in which he said in part,

“I think he’s a person I know well — he is a good person… I think he shouldn’t have settled; personally I think he shouldn’t have settled. Because you should have taken it all the way. I don’t think Bill did anything wrong.”

Stupid, stupid, stupid; irresponsible. Maybe two stupids and two irresponsibles. Do otherwise good people engage in sexual harassment? Of course: good people do bad things. But when a prominent individual says publicly that a sexual harasser is a good person, it sends a message that sexual harassment, like all abuse, doesn’t create a rebuttable presumption that someone is not a good person. Add to that Trump’s last statement, “I don’t think Bill did anything wrong,” and the toxic messaging is complete. Either that statement means that the President is, based on nothing, claiming that the allegations against O’Reilly are untrue, or worse, he is saying that there is nothing wrong with sexual harassment. Based on his infamous exchange with Bill Bush, there is good reason to believe that this is exactly what he means.

10. That interview, in turn, led inevitably to this fatuous and offensive article by conservative blogger Roger Simon. Sure, Roger, you dummy, O’Reilly did nothing wrong except support Donald Trump. Count the rationalizations in this piece of offal by one of the shimmering stars in the Pajama Media firmament of conservative thought-leaders.

The sad truth is the many conservatives—most?—really don’t think sexual harassment is a big deal. It is one of many ethics blind spots.

Sexual Harassment, Victim Blaming, Toxic Corporate Cultures, President Trump’s Defense and Other Ethics Notes On Bill O’Reilly’s Fall (Part I)

As you probably know by now, Twenty-First Century Fox Inc ended its relationship with Bill O’Reilly at Fox News following what are being called allegations of sexual harassment, the revelation of them in the news media despite Fox’s pay-out of over $13,000,000 to the women who were involved, and a subsequent wide-spread boycott of his high-rated show “The O’Reilly Factor.”

Ethics Observations:

1. Good. Long, long overdue, but good. Fox News should have fired O’Reilly after the first sexual harassment episode which was years ago; it is a firing offense in ethical organizations for most employees, and the fact that Fox allowed its most influential and most profitable star to skirt accountability and survive to harass again was a classic example of the rationalization known as The King’s Pass, or The Star Syndrome.

2. The fact that Fox News creator, leader, and boss Roger Ailes was also jettisoned after a sexual harassment scandal showed at the time that the organization had developed an unethical culture that was hostile to women….as Ethics Alarms pointed out last July. (“There seems to be a culture of sexual harassment at Fox, coming down from the rotting fish head in charge, Roger Ailes.”)  This was the other shoe dropping.

3. O’Reilly issued a carefully crafted statement composed with the assistance of a “crisis consultant”:

“Over the past 20 years at Fox News, I have been extremely proud to launch and lead one of the most successful news programs in history, which has consistently informed and entertained millions of Americans and significantly contributed to building Fox into the dominant news network in television,” O’Reilly said in a statement. “It is tremendously disheartening that we part ways due to completely unfounded claims. But that is the unfortunate reality many of us in the public eye must live with today. I will always look back on my time at Fox with great pride in the unprecedented success we achieved and with my deepest gratitude to all my dedicated viewers. I wish only the best for Fox News Channel.”

I would say the Bill is lying through his teeth with the “unfounded” part, but sexual harassers often don’t think they have done anything wrong. They think they were just being “nice,” or they think their advances were misunderstood, or they believe that the harassment accusations are a cover for something else. Ailes also denies that he did anything wrong. This is typical. It would have been a wonderful thing if O’Reilly could admit that his conduct was wrong and apologize to the victims while sincerely promising to change, but like most harassers, he couldn’t mount the character and the acknowledgement of hard reality to do it.

4. What is more damaging, perhaps, is that so many of O’Reilly’s fans and followers will believe his self-delusion because they also don’t “get” sexual harassment, and think the whole issue is manufactured feminist nonsense and political correctness. Boys will be boys! Everybody does it! 

5. If there is anyone who is informed and intelligent and still followed Bill O’Reilly without constant cognitive dissonance, they should be ashamed of themselves. If one was alert, Bill constantly revealed himself as a blowhard who was convinced he was smarter than he was, or perhaps more accurately, knew he was faking it and adopted a assertive, intimidating and self-righteous persona as cover for his own insecurities.  Continue reading

Oddly, Though Ethics Alarms Had Already Named Comcast “Corporate Asshole Of The Year,” The Company Felt It Had Something Left To Prove…

I really don’t understand this at all. In October, when the viral story of how Comcast managed to get a customer fired from his job for insisting that the communications giant address his legitimate complaints, I wrote:

I have never heard of even one customer of any company losing his job as a consequence of that company’s refusal to address legitimate complaints. That is why Comcast gets its Corporate Asshole of the Year award early. Nobody’s going to top this.

Yet amazingly, Comcast has managed to have yet another tale of atrocious service and customer abuse get widespread publicity. This video, by YouTube exhibitor Sweetlethargy, tells the whole  jaw-dropping story:

In any normal consumer setting, a customer able to prove that he was  induced by a company representative to purchase a service under false pretenses would immediately receive an apology, and the service promised for the price offered. In this case, however, as you can see in the excruciating video, Comcast’s reaction is, “Sorry, we won’t honor what you were told.” Translation: Screw you. Sue us. Good luck with that.

The is reminiscent of the running gag that was once famous on “Rowan and Martin’s Laugh-In,” the chaotic Sixties comedy show, in which comic Lily Tomlin would play a cruel, smug, nasal-voiced and snorting Bell telephone operator named Ernestine (above). Her specialty was telling infuriated customers who were receiving rotten telephone service that their complaints were futile. “We don’t care. We don’t have to care. We’re the telephone company!” she’d say.

Apparently this is Comcast’s attitude. Horror stories about Comcast service are all over the internet and social media, and heads aren’t rolling, the Board isn’t screaming, press releases aren’t issuing, and documented customer abuse keeps turning up. The company has nurtured a culture of carelessness, callousness and arrogance, and apparently believes that its services are too essential to suffer significant consequences.

Uber Ethics: Emil Michael Has To Go

What a dilemma. You are a 17 billion dollar technology firm, known for developing the technology application that supports the burgeoning car-hiring business, and most recently for expanding into music streaming by partnering with Spotify. Then one of your key executives is recorded, Mitt Romney-style, as he tells a reporter at a business gathering that the company should deal with negative publicity by doing “opposition research” on reporters and exposing their private lives in retaliation. Now what?

This is where hot tech start-up Uber is at the moment. The executive is Uber Vice President Emil Michael, a key figure in the company’s growth and success.  At a private company dinner in New York, he speculated that Uber could spend $1 million to hire a team to do the equivalent of “opposition research” on journalists who were critical of Uber, to dig into their private lives and family secrets. A reporter from BuzzFeed who was a guest at the event made Michael’s off-the-cuff comments public, setting off several rounds of high visibility attacks from various quarters—Sen. Al Franken called for an investigation—and apologies from Uber management, including Michael, whose statement said…

“The remarks attributed to me at a private dinner – borne out of frustration during an informal debate over what I feel is sensationalistic media coverage of the company I am proud to work for – do not reflect my actual views and have no relation to the company’s views or approach. They were wrong no matter the circumstance and I regret them.”

A Frightened Little Girl, and a Frightening Culture Of Incompetence At United Airlines

Bob Sutton’s blog post is titled “United Airlines Lost My Friend’s 10 Year Old Daughter And Didn’t Care”  and I believe every bit of it. I also believe this was not an isolated occurrence, because my own experience with United indicates that the airline doesn’t care, or at least allows its employees to adopt that attitude.
