Oddly, nobody is refusing to call Lassana Bathily a Muslim, perhaps because he is one, but also because he’s a good Muslim, as most are.

He is the young clerk at a Paris Kosher grocery store who saved several people by hiding them in a walk-in freezer when a gunman began shooting up the store on Yesterday. Actually, I don’t see why his religion is relevant in the least, but that is leading most news reports front and center.

The terrorists who mounted a bloody attack on the satiric publication Charlie Hebdo, however, and who did so while spouting Islamic slogans as planned revenge on cartoonists for engaging in blasphemy against Mohammed, should not be called Muslims. Why? Because they’re not good, you see. Since they’re not good, ignorant and hateful bigots in the United States will attribute their characteristics to all Muslims, and use this as an excuse to harass discriminate and persecute them.

Howard Dean, who is the left’s answer to Sarah Palin: you interview him knowing he will say something that drives conservatives nuts, immediately clarified the rules:

“You know, this is a chronic problem. I stopped calling these people Muslim terrorists. They’re about as Muslim as I am. I mean, they have no respect for anybody else’s life, that’s not what the Koran says. …But I do not think we should accord them any particular religious respect, because I don’t think, whatever they’re claiming their motivation is, is clearly a twisted, cultish mind.”

2014 was the year of the Ethics Train Wreck. They were coming so fast that they were getting tangled up with each other, and old wrecks from past years started rolling again, or the damage that was triggered a year ago or more started kicking in. I don’t know if every year really is more ethics free than the year before, or that it just feels that way because I’m getting better at sniffing it out. By any standards, it was a wretched year, with epic ethical misconduct across the culture. But I can’t stall any more: let’s wade into it. There will be more installments this year, so the misery is coming in smaller bites. You’re welcome.

It’s a tie!

The Ferguson Ethics Train Wreck and The Obama Administration Ethics Train Wreck

The obvious winner is the Ferguson Ethics Train Wreck, which has managed to hook up with the 2012 winner, The Trayvon Martin- George Zimmerman Ethics Train Wreck, as well as a the sub-EthicsTrain Wreck attached to the death of Eric Garner, to further degrade U.S. race relations, undermine the stability of numerous cities, get several people, including the recently assassinated NYC police officers killed, revive race riots, give vile demagogue Al Sharpton unprecedented power and influence, and pick up such distinguished riders as President Obama,  Missouri Governor Jay Nixon, New York Mayor de Blasio. It is also still barreling along at top speed after many months, and is a good bet to continue its carnage well into 2015. 

Yet, it became clear to me this summer with this post that the entire Obama Administration has become an Ethics Train Wreck, and one that is neck-and-neck with the one spawned in Ferguson in threatening short and long-term damage. Incompetence, dishonestly, lack of transparency and arrogance have hardened cynicism in the public, corrupted the ethical values of defenders, let journalists to disgrace themselves, and fertilized festering potential disasters internationally and domestically. This is also, I now see, a wreck of long duration that started in 2009, and had gathered momentum with every year. It also has sparked other wrecks, including the one that now keeps it from being the sole 2014 winner. How much damage will The Obama Administration Ethics Train Wreck do in 2015? Which agency or department will prove itself to be corrupt, incompetent and mismanaged, which official will continue in a post after proving himself unfit to serve, which inept pronouncement or abuse of power will further degrade American trust and freedom?

I’m not looking forward to learning the answers.

Fraud of the Year

The U.S. Justice Department, which allegedly participated in a plot to force  Sierra Pacific Industries and other defendants  to pay $55 million to the United States over a period of five years and transfer 22,500 acres of land as settlement of charges brought against the company by DOJ for causing a 2007 wildfire that destroyed 65,000 acres of land in California. Naturally, the national news media has barely covered this scandal, which is still in litigation. Runner Up: The Victoria Wilcher scam, which made KFC pay for plastic surgery for a little girl when there was no evidence that the company was in any way involved with her injuries. Unethical Quote Of The Month: Sen. Claire McCaskill (D-Mo)

“Frankly, it is irritating that anybody would be distracted by which statistics are accurate.”

—Sen. Claire McCaskill (D-Mo), in response to Justice Department statistics that show that the “1 in 5 women will be raped on campus” statistics cited by her and other elected officials and women’s rights advocates were not just inflated, but ridiculously so.

Yes, Senator, isn’t it irritating when stubborn facts interfere with ideological narratives?

Yet it is not half as irritating as knowing that we have so many elected leaders who think like McCaskill. That 20% statistic has been used by the Obama Administration to bully colleges into removing due process and fairness from campus sexual assault allegations, and to push the false impression on the public that there is a rape epidemic, when in fact the incidence of rape, on campus and elsewhere, has fallen precipitously.

In September, when President Obama announced his “It’s On Us” initiative to address college sexual assault, he said that “an estimated 1 in 5 women has been sexually assaulted in her college years—one in 5.” Like the infamous “women make only 77% of what men are paid for the same job” fake statistic that Democrats and women’s rights advocates still repeat despite definitive debunking, it is a number designed to fool the gullible and satisfy those infected by confirmation bias, but it is much, much worse. The recently Justice Department statistics on rape and sexual assault on college age females showed that the chances of a women being raped on campus was 6.1 per thousand, juuust a bit less, at .61 %, than the 20% figure touted by Obama and McCaskill. KABOOM! or Unethical Quote of The Month? You Decide…I Can’t, Because My Head Just Exploded All Over The Christmas Tree

“I actually think that it’s probably in its day-to-day interactions less racially divided.”

—President Obama on National Public Radio, giving his assessment of race relations in the U.S. today compared to when he was elected in 2008.

It’s kind of pretty, really.

That explosion (see Kaboom!) was based—I’m guessing now, since I don’t control when my brain blows—-on my shock that the President actually could be President and believe that, as well as not be aware how deluded he appears to assert such something so contrary to evident reality. Is he really that estranged from what is happening in the country he leads? Frightening. Is he really incapable of comprehending the single biggest, most damaging, most unexpected and most dangerous failing of his entire administration? Pathetic. Does he not watch TV? Read blogs? Does he exist in a separate, narcissist parallel reality where everything is as he wills it to be? Wow.

I know that the networks he watches and the newspapers he reads didn’t report them for the most part, but every poll shows that the public overwhelmingly believes that race relations have worsened. You can dispute the value and accuracy of polls with considerable justification, but these are the kinds of polls most likely to be accurate. How plausible is it that race relations, defined as how the races feel about each other and how they are getting along, could improve with the public believing they have worsened? Here’s polls from Pew, Gallup (“The percentage of Americans naming “race relations” or “racism” as the most important problem in the U.S. has climbed dramatically to 13%, the highest figure Gallup has recorded since a finding of 15% in 1992, in the midst of the Rodney King verdict.”), NBC, IDB ( “By an almost 3-1 margin, Americans say race relations have worsened under the man who was supposed to usher in a golden era of “post-racial” relations.”), Bloomberg, and Politico, and there are many others, all with the same message. Moreover, all of them were taken before the ‘killer racist cops ‘ campaign by Sharpton  and his cohorts culminated in the assassination of two police officers by a deranged African American seeking to take “two of theirs for one of ours.” Let’s see a show of hands: how many think race relations have improved in the last two weeks?

Contest Entry For Most Unethical Column, Post Or Essay About The Ferguson Ethics Train Wreck: Hip-Hop DJ Jay Smooth

It goes without saying that my efforts to avoid more Ferguson commentary is a failure. The race-baiters, grievance-mongers, police-haters and cynical Democratic-base-goosers are engaging in an orgy of self-righteousness, aided by an uncritical news media and encouraged by public sentimentality and ignorance. This is horrible for the rule of law, law enforcement, race relations and the nation, but to close our eyes and repress our gag reflexes, hoping it will go away, is cowardly and irresponsible. This stuff is dangerous, to be blunt. Lies always are, and public policy built on lies will always result in harm and distrust.

The onslaught is much more powerful than I expected: several member of the Congressional Black Caucus actually brought the false “Hands up! Don’t shoot!” rallying cry onto the House floor yesterday. Charlie Rangel is using the lawful shooting of Brown based not on race but on his conduct alone to re-open demands for slavery reparations.

In this context, I’m entering this video blog by John Randolph, a.k.a “Jay Smooth,” a popular and outspoken hip-hop DJ with pretenses of social relevance.  It is genuine mind-poison. “Smooth” is sure smooth: he’s articulate, facile, a good actor, attractive, and facts mean absolutely nothing to him. Here he spins a persuasive justification for the Ferguson riots based on a series of demonstrably false premises: garbage in, but insidiously persuasive garbage out, especially to his audience. It begins with an apparently popular tweet he made before the grand jury results came out, which said, “The fundamental danger of a non-indictment is not more riots, but more Darren Wilsons.” If Wilson was not indicted for lawfully protecting himself from a subject who attacked him, more police will protect themselves from attacking suspects? The tweet is cleverly misleading: it assumes, without stating, that a racist cop murdered a black youth, and the video blog proceeds accordingly from that assertion. The truth is that the danger of having an indictment would be to allow mob justice and vengeance to preempt due process and fairness. Not surprisingly, Smooth later reveals that he sent essentially the same dishonest tweet about the George Zimmerman trial. Continue reading →

It Appears Likely That Michael Brown Did NOT Have His Hands Up When He Was Shot… Now What?

How does the culture, the news media, the civil rights  industry, and politicians determined to benefit by making African-Americans suspicious, paranoid, racist and, of course, lifetime Democrats, make amends for this? How do they undo the damage to mutual trust and American society?

Obviously they don’t. They don’t even try. In fact, all indications are that they will refuse to acknowledge that the entire, national effort to portray the tragic confrontation between Michael Brown and Officer Wilson as a race-triggered execution was based on a lie that was presumed to be accurate despite much reason to doubt it.

The original claim that Brown was shot and killed after putting his hands in the air came from his friend and partner in crime, Dorian Johnson. Johnson, who already had a record of lying to police, was with Brown prior to the August 9 confrontation, and had joined him in the petty robbery that occurred just before Brown’s arrest. In his TV interviews  after the shooting, Johnson said that Wilson shot Brown in the back, causing him to turn around with his hands up, pleading, ‘I don’t have a gun, stop shooting!’ Before the grand jury, Johnson, who admitted that he hid during the incident and later ran home to change clothes so he wouldn’t be identified, even elaborated and provided minute details to his fabrication, stating under oath that the shot in his back caused Brown’s body to “do like a jerking movement, not to where it looked like he got hit in his back, but I knew, it maybe could have grazed him, but he definitely made a jerking movement.” The forensic evidence showed that Brown was not shot in the back. With More Evidence Of Pre-Election Obama Administration Sleight-of-Hand, I Ask Again: How Do Democrats React To This?

The post is intended to follow-up on this one, asking supporters of the President who are unbiased, fair and honest, how they continue to trust this administration in light of the repeated pattern of hiding negative developments as long as possible, assisting the compliant news media in burying them, and intentionally delaying admissions, disclosures and bad news until after elections.

It is not a partisan question, but a legitimate ethics inquiry. As I explained in discussing the recent election eve Fast and Furious document dump, there is not any legitimate question about whether this is ethical conduct by the Obama Administration, or whether it is in any way consistent with the pledge of transparency made by Candidate Obama in 2008 and currently posted on the White House website. It isn’t, on both counts. There is no argument about that—I know that. What I don’t understand, and very much want to, is why anyone—Democrat, progressive, Federal worker, journalist, MSNBC hack, Markos Moulitsas, Harry Reid, anybody at all—would excuse or try to justify it sufficiently to say “Yes, I trust these people.” I asked, and nobody took up the challenge.

Is it because everyone actually realizes how inexcusable and sleazy this is, and nobody trusts the Administration any more? That can’t be it: otherwise, I wouldn’t be reading all these amazing blog posts about columns about how stupid the American voting public was to send an emphatic “We’re sick of the Democrats” message at all levels of government, across states of all political persuasions. Is it because all the Obama supporters are in the throes of  DODD (Desperate Obama Defense Derangement)? I suppose that’s possible. It is also possible that Obama defenders are gun-shy here, since their standard refrains of “Republicans are obstructing everything,” “it’s all Bush’s fault,” “everybody does it,” “it’s because he’s black,” and “nobody’s perfect” not only fail to persuade but attract well-deserved derision.

I don’t know the answer, but I want to understand, Trust is the basis of democracy, and trust must work both ways. The Obama Administration consistently shows that it does not trust the American public to approve of its policies and conduct if the public has timely information about what the facts are. Why do so many people trust a leader who doesn’t trust them, and has contempt for its trust?

The Justice Department has previously been held in contempt by Congress and hit with increasingly tough court orders from a federal judge over its obstruction of efforts to secure evidence in the notorious Fast and Furious operation. Many have accused Attorney General Eric Holder of acting blatantly political in withholding documents to protect Democrats from backlash before the elections. As if to prove that view, the Justice Department waited until late on election eve to finally dump more than 64,000 pages of documents congressional lawmakers have been seeking for years. The timing was almost taunting in its impact. Guaranteeing that the content could not be viewed before people voted, the Obama Administration’s long obstruction resulted in this troubling image of a politically timed release….The election eve dump to the House Oversight and Government Reform Committee involved 64,280 pages withheld for years by the Obama Administration.

All Americans owe a debt to the many non-profit organizations across the country dedicated to freeing innocent prisoners, some of them sentenced to die, who were wrongly prosecuted and convicted as a result of breakdowns in the justice system or prosecutorial corruption. Their work has served as an invaluable fail-safe, it has focused attention on needed reforms, and it has rescued innocent lives before they were completely destroyed. As a reminder of the corruptive power of good intentions, however, the recent release of a convicted murderer put in prison by one of these organizations serves as an ethics cautionary tale. Apparently one such “innocence project” believed that it was worth sending an innocent man to prison for a murder he did not commit in order to save the man originally convicted of the crime from execution.

In 1998,* Illinois death row inmate Anthony Porter, convicted in the 1982 murders of Marilyn Green and Jerry Hillard, was apparently proven innocent 48 hours before his scheduled execution. A Northwestern University professor and his students working with the Medill Innocence Project had obtained a videotaped confession by a man named Alstory Simon, admitting that he, not Porter, was the real killer. Porter was ultimately released, in 1999.

The governor of Illinois at the time, George Ryan, a longtime supporter of the death penalty, claimed that he was so shocked by the near fatal miscarriage of justice that he halted all executions less than a year after Porter’s exoneration. Eventually he commuted the sentences of every prisoner on death row, saying the state’s capital punishment system  could not be trusted. The Simon confession leading to Porter’s exoneration drove the shift in public opinion that caused the Illinois death penalty’s demise in 2011.

Happy ending? Not exactly. In 2005, witnesses who implicated Simon announced that they had fabricated their stories in exchange for money and a promise by the Northwestern professor, David Protess, that he would work to free two incarcerated relatives of one of the witnesses. Then Alstory Simon recanted his confession, saying that he had been persuaded by a faked videotape of witnesses implicating him in the crime, and promises of a short prison sentence and a movie deal if he confessed to a crime he didn’t commit. Last week, an Illinois judge ordered Simon released from prison after  prosecutors agreed that he was probably not guilty. He had spent almost 15 years in prison. Continue reading →
