A Brief Message From The Ethics Bunker

Ethics Alarms was happily bumping along at record-setting pace this year for traffic and comments, and suddenly hit a wall about mid-April. Visitors have been down 10% or more ever since. Ironically, this occurred just as the registers followers of the blog took a large leap forward after being in a rut for almost six months. 2016 is still well ahead of EA’s previous best year, but an unexplained crater like this is troubling. Usually May is the blog’s best month.

At least one heavy contributor has gone AWOL due to Trump/Clinton depression, which I share.  I would not be surprised if EA lost a significant number of  Never Hillary readers because of the official position here, which will not change, that voting for one of the most untrustworthy candidates in U.S. history is the only rational, patriotic and ethical response to the existential danger to the nation posed by the candidacy of Donald Trump. Speaking before an audience at the American Law Institute, U.S. Supreme Court Justice Sonya Sotomayor said that she advocated mandatory pro bono service ( that is, for no compensation) to poor citizens by all lawyers. “If I had my way, I would make pro bono service a requirement,” she said.

“I believe in forced labor.”

This is the quality of thought that we get on the highest court in the land, that must decided our most difficult, controversial and society-molding legal. This is what we end up with when a Justice is appointed in order to check off group identify boxes for “diversity” rather than on the basis of ability.

Sotomayor made the comment at the American Law Institute’s annual meeting in Washington, in response to a question from institute director Richard Revesz about the problem of improving access to low-cost and effective legal services for low-income individuals. I’m pretty sure the “forced labor” comment was delivered as a joke, but it looks terrible in print, and immediately drew a predictable response from conservative pundits. “YOU BELONG TO THE STATE” quipped Instapundit’s Glenn Reynolds.

Ethics Dunce: Above The Law

The legal news, commentary and gossip site Above the Law—Ethics Alarms uses it a s a source for legal ethics issues from time to time, usually to disagree with its writers—has announced that it is banning comments on the site. This has become an increasing trend on-line. The argument for doing this is always the same, with variations: they don’t add value, they too often are vulgar or abusive, they just aren’t as good as the used to be. Here’s ATL today:

“Today the comments are not what they once were. Although occasionally insightful or funny, ATL comments nowadays are generally fewer in number, not very substantive (often just inside jokes among the commentariat), yet still often offensive. They also represent a very small percentage of our total traffic (as we can tell because of the click required to access them)”

The site also comforts itself that increasingly “everybody does it”:

“What we do know is that the decline in comment quality is not unique to ATL. As noted by Wired, NiemanLab, and Digiday, numerous websites have eliminated their comments sections in recent years, largely because they felt that the comments were not adding sufficient value and that discussion had migrated to social media.”

Yes, I’ve noticed all that high-quality, nuanced commentary on Twitter.

A Brief Note On The Site’s Background Images

The Ethics Alarms web design uses backgrounds to illustrate ongoing ethics issues in the news. For some time, the background has featured a photo of Donald Trump, whose candidacy I regard as a long-running ethics train wreck of uncertain destination. I could justify leaving it up until sanity regains control and he is finally subdued and returned to the Crackerjack box from whence he came. That could take eight years, however.

Sorry. I know that made you throw up in your mouth a little. Me too.

Lately, readers whose gorges react similarly to mine when forced to view Mr. Trump’s visage have been calling on me to take him down, which I have reluctantly done. I can’t promise that he won’t be back, but the new background is the very strange photo from yesterday of President Obama letting his hand and arm go limp as it is raised by Cuba’s dictator—but his health care is grrrrreat!— Raul Castro.

I’m not sure what exactly is unethical here, or who is the unethical one, but something is. I would only suggest that if an American President chooses to boost the credibility and prestige of a ruthless tyrant, he can’t simultaneously act like his host has cooties. It certainly looks like Obama is saying, “Oops! I don’t want to look as if I am friends with this guy!”

I would suggest that this awkward moment is something that should have been worked out well in advance, as it was wholly predictable.

Unethical Restaurant of The Month, Busted Ethics Alarms Division: Joe’s Crab Shack

“Wait, someone took offense at the photo of a lynching that we had as a placemat? Who could have predicted that?”

Yes, in a case of a staff-wide ethics alarms breakdown that defies the laws of probability, Joe’s Crab Shack in Roseville, Minnesota thought it would be cute and entertaining to its diners to place on a table a large photo depicting the hanging of a black man before white onlookers. Labeled “Hanging at Groesbeck, Texas on April 12th 1895,” the placemat included a speech bubble coming from the doomed black man that  says, “All I said was that I didn’t like the gumbo.”

I don’t understand this at all. I know that Minnesota has as many African Americans as Washington, D.C. has albinos, but still: who would think this was appropriate decor anywhere in the U.S.?  And if there was one employee who did, due to a lesion or something, how did no other employee or no one in management intercept this atrocity, saying, “Whoops! Gotta watch Cletus the Closed Head Injury Busboy more closely, everyone. Look what he put on this table!” 

Surely most people in 2016 have better racism detectors than this. Please. Tell me this was a social science experiment or something. Please.

The evidence, though, suggests that the entire establishment is run by Cletuses…or maybe crabs! That would explain it—the Joe’s Crab Shack chain is operated by crabs! Crabs are notoriously insensitive. That would explain the restaurant’s apology: Continue reading →

Although it appears to have substantially eluded our political pundits, one of the major reasons Donald Trump’s presidency would be a disaster for the culture is that he would further degrade political discourse by validating vulgarity, boorishness and bullying as legitimate and acceptable conduct by elected officials. That contagion will spread to the public at large, decreasing the likelihood of substantial communication and persuasion, and increasing bitter divisions with a likelihood of violence.

In fact, the process of rot is starting already.

Nevada’s GOP state representative Michele Fiore—she’s the one who sent out the Christmas card with her whole family, including toddlers, holding guns—is running for a Congressional seat. Her opponent, Annette Teijeiro, criticized Fiore for her comments about “flying to Paris” to  shoot terrorists there herself. This prompted the honorable rep to stand up and challenge Teijeiro, saying, “You want to have a fight with me?” She challenged Teijeiro to put her microphone down and acted like she was ready to rumble.

A video of the incident was posted on Facebook, and Fiore is getting encouragement, presumably from Trump fans…you know, morons.

Maybe the reason I can’t believe it is that it’s difficult to believe anything when one’s brains decorate the walls.

The Detroit News  reports, in a story that I initially assumed was a hoax, that the YMCA Storer Camps in Jackson, Michigan included an  “educational” activity called “Underground Railroad”) in which black children were asked to play runaway slaves, as some teachers and camp instructors acted as slave masters, chasing them down using real horses. Once captured, the children were “auctioned off.” One of the young “slaves” complained to her mother, who wrote an e-mail to the elementary school that subjected its charges to this fun exercise, reading in part:

“As the mother of an African American son and daughter, I am dismayed that Pardee Elementary would authorize and condone such an extremely racially insensitive and damaging activity…The slave masters (camp instructors and teachers) had certificates which allowed them to pay for the slaves, and the students were required to hold up the certificates when they were bought or sold.”

“My daughter said she was scared,” another mother complained. “One of the guys (camp instructors) re-enacted killing a deputy. They should not do that in front of a 10-year-old, and not when kids are hundreds of miles away from home. If they want to teach black history, they should do that in the classroom.”

Rep. Alan Grayson, Incivility, Predicting Unethical Conduct…and Donald Trump

It should come as no surprise to anyone that Rep. Alan Grayson (D-Fl.) is under investigation by the House Ethics Committee for serious ethics violations. This was pre-ordained by the proclivities he has shown throughout his political career. In his case, the primary tell is his complete lack of civility, which is symptomatic of a crucial respect deficit. Those who do not regard displaying respect for colleagues, fellow citizens, political adversaries and, more broadly, societal standards of fairness and decency as an important behavioral mandate cannot be trusted to respect any other ethical values either. Occasionally one will find someone who deals in insults and personal denigration who is otherwise ethical, just as one will occasionally encounter a baby goat with two heads, but it is rare indeed. If you go through life avoiding uncivil, verbally abusive people like the plague (indeed, such people carry the plague of de-civilization) you will not miss out on very many good companions, and you will spare yourself a lot of misery as well the danger of personal corruption.

Grayson is without question the most uncivil, rudest, least professional member of Congress. I was amused to find that I had mentioned him in a post from 2010 about how many ethics scandals were predictable, given the past conduct of their principle actors. Once Tom DeLay was out of Congress, Alan Grayson was easily the most likely candidate for a scandal, because the man has no ethics alarms. In my very first post about Grayson, I wrote (in 2009),

“Grayson is the Congressman whose explanation of the GOP position on health care was that “they want you to die.” He said that Dick Cheney speaks with “blood dripping from his teeth.” His mode of debate and persuasion, in other words, is insult and hyperbole. Respect for opposing views: zilch. Civility grade: F… He has endorsed unethical rules and plays by them…”

That post was about Grayson trying to get the Justice Department to shut down a website that mocked him. Yes, he doesn’t believe in freedom of speech, either, when he is the target of insults rather than the generator of them.

All of which led me to react with a smile and a yawn when it was revealed that the disgusting congressman, now running for the U.S. Senate–Sure! Why not?—has been secretly moonlighting as a hedge fund manager. It sounds like a Saturday Night Live skit: “By day, a Wall Street-bashing, 1% hating, populist Democratic Congressman! By night, a wheeling and dealing hedge-fund manager!”

Do I need to explain why this is a slam-dunk conflict of interest with the appearance of impropriety? I don’t think so. It also smells of insider trading and using information privy to elected officials for personal gain. On the other side, he used his position as a U.S. House of Representatives member to attract clients.

Jenrry Mejia, The Inexplicable Ethics Mega-Dunce

What is the explanation for this?

Jenrry Mejia is a young New York Mets relief pitcher who until recently had a bright future as a star closer and a guaranteed multi-millionaire.  Now, entirely on his own initiative, he has become the first player ever banned from baseball for using steroids .

This is not easy, though Mejia did it with ease…and speed.  After recovering from Tommy John surgery, Mejia was establishing himself as the Mets closer by the end of the 2014 season. But he began the 2015 season with an 80-game suspension for testing positive for a common PED (Performance Enhancing Drug), then, even before completing that punishment,  flunked another urine test and earned himself a 162-game suspension a few months later.

Knowing full well that a third positive test would end his career, Mejia tried a different banned steroid, was caught again, and that third strike triggered a lifetime expulsion from major league baseball under the sport’s rules. Nobody has been that reckless and stupid, not even Manny Ramirez (who was caught twice), and Manny’s picture is in the dictionary under “reckless and stupid.” Continue reading →

Dead Ethics Alarms And Dead Brains In Cleveland

In other words, be just like Cleveland, Ohio.

When I read that Cleveland was trying to bill the family $500 for the fatally wounded  Tamir Rice to be carried by an ambulance after an incompetent police officer shot the 12-year-old boy as he played with a toy gun in a city park, I began a mental countdown. How long would it be before a public outcry forced the Cleveland municipal government to cover the bill and apologize? It took about a day.

It doesn’t matter how one regards Rice’s death: a racist murder by a cop, excused by the justice system ( black activists, anti-polce race-hucksters  and too many journalists and pundits), blatant incompetence on the part of many adults and institutions, leading to the negligent, tragic death of an innocent child (Ethics Alarms), or something in between. The incident was a massive humiliation for Cleveland, its leadership and the police, justifying all of the anger and raw emotion in its aftermath. Tamir and his family were undeniably victims, and the city was the entity that harmed them. If there is a single individual on the city payroll who is incapable of immediately recognizing the grotesque insult of billing the family for removing the body of the dead child killed by city police, then the city itself is untrustworthy and dysfunctional. As it happens, many city employees must have been aware of the disgusting bill, and every one of them should have been smart enough to know that this was one expense the city had to eat or else. Now we know how and why Tamir died. Incompetent people are running the city, and incompetent people are dangerous.

Cleveland Mayor Frank Jackson apologized at a news conference yesterday, and said that the city would pay whatever wasn’t covered by Medicaid. “It was mistake in terms of us not flagging it, but it was not a mistake in terms of the legal process,” Jackson said. This logic echoes the rationalizations for the conduct of “The Worst Aunt Ever,” who sued her 12-year-old nephew to get insurance covered damages. Continue reading →
