Former Politico staffer Mike Allen published a leaked list of what he says are the names of individuals who were being considered for Hillary Clinton Cabinet jobs.

Nobody knows if the list is accurate or genuine, but Allen is well connected, and many assume it is. For the purpose of the Ethics Quiz, we will also assume the list is authentic, but whether it is or not doesn’t matter regarding the ethical principles involved. Here is the list:

Ethics Hero: Hillary Clinton

The criteria for an Ethics Hero honor here includes doing the ethical thing despite significant countervailing non-ethical considerations, and often at some personal sacrifice. It was Bill Clinton’s duty to be present at Donald Trump’s Inauguration yesterday, but not Hillary’s.  While defeated Presidential candidates usually attend, they sometimes don’t, especially when they feel  particularly aggrieved byt the way the successful campaigns against them were handled. Recent inauguration no-shows include Mitt Romney and Michael Dukakis, both of whom felt, with some justification, that they had been ill-treated on their way to defeat.  Four Presidents didn’t even attend the swearing in of their successors: John Adams (bitter), John Quincy Adams (bitter, and Andrew Jackson hadn’t attended his inauguration, so there!) Andrew Johnson (impeached), and Richard Nixon (persona non grata).

Nobody, especially her supporters, would have blamed Mrs. Clinton if she had passed. However, it was important that she be there, as her presence symbolized acceptance of the result and the orderly transfer of power as much as Barack Obama’s presence did. She came, she was seen, and it was the right thing to do.

It could not have been easy or pleasant. Some in the audience were heard to chant “Lock her up!” when her name was announced. (See: “A Nation of Assholes”) Bill may have embarrassed her by being caught on video seeming to ogle Ivanka Trump. (I wrote a satirical song about Clinton ogling Julie Eisenhower at Nixon’s funeral in 1994, but that was a joke. Good old Bill. ) Jerkish journalists pestered Hillary with the predictable and needless questions: “Madame Secretary, how does it feel to be here today?” and  “How are you feeling, Madame Secretary?” Ann Althouse made me laugh out loud with her comment:

What’s she supposed to say? I’ll say it for her: How the fuck do you think it feels?

The YMCA Slavery Recreation.  You know, even looking through this category was dangerous. I had forgotten about all these stories, which, by definition, were all horrible. This one, from February, however, had to be the winner. The YMCA Storer Camps in Jackson, Michigan included an “educational” activity called “Underground Railroad” in which black children were asked to play runaway slaves, as some teachers and camp instructors acted as slave masters, chasing them down using real horses. Once captured, the children were “auctioned off.” The principal of the school that subjected its pre-teen students to the slavery simulations rather than the other better known YMCA camp activities like nature hikes, kayaking, canoeing, horseback riding and sitting around campfires responded that he didn’t expect the uproar, since no student had ever complained before.

Most Unethical High School Discipline

Red Mountain High School  in Mesa, Arizona. On a dare from a friend, high school football player Hunter Osborn briefly flashed his naughty bits in the team photo. Nobody noticed, including the yearbook’s faculty advisor, so the photo was published in the school yearbook.  Months later, the gag was discovered. Even though the photo was so small that offending nudity was virtually invisible to the naked eye, the school had Osborn was arrested and charged with 69 counts of indecent exposure. The charges were dropped because none of the 69 “victims” pressed charges.

Most Unethical No-Tolerance Action

John Glenn High School in Suburban Detroit.  The offense: “Inappropriate use of electronics in the restroom.” The conduct: Hazel Juco, a 17-year-old student, went to the school’s bathroom to wash her hands. When she turned on the faucet, ugly brown water came out. She then used her cell-phone to take photos of the discolored water and posted it to Facebook and Twitter.

She was suspended, but eventually social media and the local news vindicated her. The water was polluted, and the school district admitted that Hazel was punished for doing the right thing.

Naked Teacher of the Year

Leigh Anne Arthur, In a completely warped and unfair application of the Naked Teacher Principle, school district officials in Union County demanded and received the resignation of the engineering teacher  after a student stole her phone, examined its contents and found a semi-nude selfie  intended for her husband’s enjoyment only.The student, who  warned her that “something bad was coming,” sent the images to other students through text messages and social media Arthur sued the school board for wrongful termination, but recently dropped the suit.  The student was charged with a computer crime and voyeurism. The Naked Teacher Principle holds that

A secondary school teacher or administrator (or other role model for children) who allows pictures of himself or herself to be widely publicized, as on the web, showing the teacher naked or engaging in sexually provocative poses, cannot complain when he or she is dismissed by the school as a result. This obviously does not apply to Arthur. Ironically it would apply to the incoming First Lady if she were a teacher, and arguably applies still, since the First Lady is a role model.

Double Standard Of The Year

Progressives and Democrats, who performed an immediate U-turn as soon Donald Trump won the election, and after having expressing outrage and indignation when Trump had suggested, about a month earlier, that he might not “accept the results of the election,” which he had claimed was “rigged,” immediately challenged the results of the election, and claimed it was rigged.

And they are still doing it today.

Hillary Gets A Standing O On Broadway

Well, good.

Last night, Hillary, Bill and Chelsea Clinton attended the closing performance of “The Color Purple” on The Great White Way. The audience gave Hillary a standing ovation.

This profoundly annoyed the conservative media and blogosphere, which contrasted the warm reception with the booing Vice-President-Elect Pence when he want to see “Hamilton” just down the street. It was a contrast, all right: the audience at “Hamilton” were rude jerks, and the audience at “The Color Purple” treated Hillary Clinton like every audience of fair and respectful citizens should treat anyone willing to endure the rigors and abuse of a Presidential campaign for the privilege of being burdened by one of the most difficult and all-consuming responsibilities on earth, in order to serve and protect the United States of America.

Kind and respectful gestures are never unethical.

I would have stood.

The 8th Annual Ethics Alarms Awards: The Worst of Ethics 2016, Part 1

Welcome, if that’s the word, to the 8th Annual Ethics Alarms Awards.

Last year, in a burst of self-pity as I began this annual task, I wrote,

“It is depressing and discouraging: 2015 was much worse than 2014, which was considerably worse than 2013. What am I doing here? What is the point of spending all of this uncompensated time—it is more profitable bagging groceries!—trying to nurture a more ethical culture and a more ethically competent public when all evidence points to utter futility as the result? Well, that way madness lies, I guess. I’m just going to grit my teeth and do my duty. Last year I began by saying that 2014 was the year of the Ethics Train Wreck. There were far more of them in 2015, and they were more serious and damaging. That should give you sufficient warning of the horrors to come…”

Then came 20i6.

To paraphrase  Margo Channing, “Fasten your seatbelts: It’s going to a bumpy post…”

The Hillary Clinton E-Mail Scandal Ethics Train Wreck

I thought last year was the Year of the Train Wreck. Wrong. In 2016, we had the 2016 Post Election Ethics Train Wreck, the Campus Sexual Assault Witch Hunt Ethics Train Wreck, the Freddie Gray Ethics Train Wreck, the old stand-by Obama Administration Ethics Train Wreck, the still active Ferguson Ethics Train Wreck, and the Ethics Train Wrecks of both Presidential candidates campaigns. Hillary’s e-mails and their related lies in the long trail of cars called the Hillary Clinton E-Mail Scandal Ethics Train Wreck, was a clear winner though.

Passengers included President Obama, Bernie Sanders, Anthony Weiner, the F.B.I., Loretta Lynch, Bill Clinton, James Comey and more. And, of course, it played a significant and perhaps decisive role in bringing us President Trump.

Runner-Up: 2016 Post Election Ethics Train Wreck. It had less than a month to get up steam, but it caused lots of ethics carnage, and is still going strong.

Fraud of the Year

The Trump Foundation, which revealed itself to be a near total sham. RUNNER-UP: Fake lawyer Kimberly Kitchen, who worked as an estate planning lawyer at BMZ Law in Huntingdon County, Pennsylvania, and served as president of the county bar, though she never went to law school, and never took the bar exam, but forged documents to fool everyone that she had.

Most Unethical Act By A Major Church

The Catholic Church, which, incredibly, restored a convicted rapist to the priesthood. Father Joseph Jeyapaul,  a Catholic priest from India, while serving in the Crookston, Minnesota diocese from 2004 to 2005 raped at least two adolescent girls.  After being charged with the crimes, including rape and forcing at least one of his victims to perform fellatio on him, Father Joseph  escaped to India, where an Interpol warrant got him extradited back to Minnesota.  There he confessed, and as part of a plea bargain, received an outrageously light sentence of a year and a day for pleading guilty to one count of molestation. Jeyapaul was suspended from the priesthood and served his time in Minnesota. The U.S. deported him back to India, while the Minnesota diocese had to pay millions in a civil lawsuit, during which we learned that the rapist priest had told one of his victims  in the confessional that she was at fault, and had made Jeyapaul “impure” by letting him abuse her. In February, the Vatican lifted Jeyapaul‘s suspension and restored him to the priesthood. It then assigned him to a new parish in India, where he is now the diocesan head of its commission for education. 

Tell me again why that fake news story that the Pope endorsed Trump was supposed to help The Donald.

Incompetent Elected Official of the Year

Kathleen G. Kane (D), Pennsylvania’s ex-Attorney General.  In October, a judge sentenced her to 10 to 23 months in prison for her conviction on charges of perjury and abuse of her office. You can’t be more incompetent, I’d say, than an elected attorney general who can’t stay out of jail herself. I regret not writing about the Kane saga last year, but her ethical void was fairly apparent back in 2013, the only time I did write about her, after she leaked grand jury testimony, which is illegal. I wrote at the time (I must have been in a bad mood)…

“Leaking grand jury testimony is both illegal and spectacularly unethical for a lawyer, yet Pennsylvania’s Attorney General, Kathleen Kane, appears to have done it for the slimiest of reasons, and is offering the most cynical of defenses in the most offensive of ways. (Incidentally, I don’t understand how this could happen. After all, Kane is a woman, the first Democrat and the first woman to be elected to the post, and since having a vagina alone is supposed to imbue a candidate with trustworthiness, surpassing competence and virtue, this makes no sense at all.)”

A Lawyer Ponders: “Will Obama Pardon Clinton? And If He Does, Will She Accept?” An Ethicist Answers…

Over at The Hill, lawyer David Weisberg examines the questions in the title above. Frankly, I assumed that Hillary needing a pardon from Obama was a dead issue, but Weisberg persuades me that it might not be.

Let’s begin by pointing out that it would be gallactically stupid for the Trump Justice Department to prosecute Clinton. Doing so would be a guaranteed circus; it would inflame Democrats who are already resembling The Human Torch, and it would appear to be a political prosecution. A winning President tries to put his losing opponent in jail would reek of banana republic vengeance, and that’s one reason why no American President has ever done it.

This is Donald Trump we are talking about, however, so who knows? Certainly many of his more angry and less grey matter-blessed supporters would love to see Hillary in the slammer. I am hoping and praying that Trump either is smarter than this or has advisors who can talk him out of his worst ideas, but I am not as confident as I should be. Weisberg makes the reasonable point that Hillary may not be confident either:

“Since being elected, Trump has been remarkably warm towards the person he used to call “Crooked Hillary.” But how confident could Clinton be that the Justice Department, under a Trump administration, would not prosecute? Prosecutorial decisions are supposed to be independent of political considerations, so Trump’s recent friendliness should not be controlling once the new attorney general is in office.”

That last sentence is both true, and following the wretched partisanship of the Obama Justice Department, very much in the category of  legal fiction. Continue reading

“If That Was Transparency, Then I’m A Kumquat” And Other Reactions To Josh Earnest’s Multiple Unethical Christmas Quotes

This morning, Obama Administration paid liar Josh Earnest spoiled my Christmas mellow by telling CNN’s alleged news media ethics watchdog Brian Stelter that there’s really “no constituency in American politics for transparency in government beyond journalists,” as he deflected Stelter’s accounts of journalists complaining about administration foot-dragging on Freedom of Information Act requests. Then he really curdled the ethicist’s eggnog by saying,

“If this constituency of journalists are gonna be effective advocates for the issue that they care about, they need to remember that they have a responsibility not just to criticize those who are not living up to their expectations. Any activist will tell you that the way that you get people to support you and to support your cause is to give them credit when the credit is due, to applaud them when they do the thing that you want them to be doing.”

Finally, Earnest molded my mistletoe by claiming,  “President Obama has been the most transparent president in American history.”

Stelter, of course, being an incompetent, biased and unethical news media ethics watchdog, did not interjection with the mandatory, “WHAT??? You’ve got to be kidding! HAHAHAHAHAHAHAHAHA ACK! ACK! ARRRGH! and drop dead in shock.

That statement is fake news if anything is, rivaling the news media lie that that the Obama years were devoid of major scandals. Before we begin shooting fish in a barrel and deal with that brazen-beyond-belief spin, let’s pause to consider the other stunner in Earnest’s Christmas morning performance:

1. What does Earnest mean that journalists are the only constituency for transparency? Does the Obama administration, and by extension Democrats, really believe that the public doesn’t mind being lied to? If so, that explains a lot, including the nomination of Hillary Clinton.

2. Journalists are not supposed to advocates and activists at all. They are supposed to be devoted to communicating facts and the truth.

3. Is Earnest saying that when a President generally defies a pledge of ethical conduct, he should nonetheless be praised when he doesn’t defy that pledge, and that journalists should highlight the Administration’s rare examples of  transparency while ignoring the overwhelmingly more copious breaches? It sure sounded like it.

That brings us back to the mind-melting quote that this has been a transparent administration by any definition of the word other than “not transparent at all.”

This episode from 2011 nicely encapsulates the issue:

“President Obama was scheduled to receive an award from the organizers of the Freedom of Information Day Conference, to be presented at the White House by “five transparency advocates.” The White House postponed that meeting because of events in Libya and Japan, and it was rescheduled…That meeting did take place – behind closed doors. The press was not invited to the private transparency meeting, and no photos from or transcript of the meeting have been made available. The event was not listed on the president’s calendar…Nor is the award mentioned anywhere on the White House website, including on the page devoted to transparency and good government. Were it not for the testimony of the transparency advocates who met secretly with the president, there wouldn’t seem to be any evidence that the meeting actually took place.”

That’s right: Obama wasn’t transparent about a transparency meeting. That same day, Obama went on TV  and tried to explain why he hadn’t been transparent to the U.S. Congress about his military plans in Libya.  Shortly after that, news leaked that the Fed had secretly sent billions in loans to foreign banks during the financial crisis.

Ah, memories! On his second day on the job, January 21, 2009, that…President Obama famously pledged, in one of his first memos to federal agencies

“We will work together to ensure the public trust and establish a system of transparency, public participation, and collaboration. Openness will strengthen our democracy and promote efficiency and effectiveness in Government.”

He may be right about that last part, or maybe he discovered that it was naive and impractical dream. Under no circumstances, however, can it be said that Obama’s administration was transparent. Ethics Quiz: The Truth About Snopes

Ethics Alarms had already declared the fact-checking website Snopes.com untrustworthy,  based on a series of partisan posts that intentionally muddied the factual waters rather than purifying them, when Facebook named it as one of its select gate-keepers to protect its readers from “fake news.” This was not wise,  since a fact-checker who slants the facts is as useful as an accounting firm that will cook the books for a price. I laid out a series of conditions before I would ever use the service again, and so should Facebook. My non-negotiable demands before I would visit the site, reference it positively, or use it as authority were:

  • Getting out of the political fact-checking business.
  • Firing researchers who have been conclusively shown to engage in biased and shoddy research
  • Confessing its betrayal of trust and capitulation to partisan bias, apologizing, and taking remedial measures.

However, there is more to consider. In an exclusive report so lurid that I assume it is credible only because publishing it without iron-clad verification would be asking for a lawsuit and worse, the Daily Mail has just revealed that…

  • When Snopes  was founded by spouses Barbara and David Mikkelson, they used a letterhead claiming they were a non-existent society to give credibility to their research.
  • The couple is divorced, and Barbara claimed in legal documents that David embezzled $98,000 of company money to spend on “himself and prostitutes.”
  • Now operating Snopes himself, David Mikkelson’s new wife Elyssa Young is employed by the website as “an administrator.” Before that, she  worked as an escort and porn actress.
  • She also ran  for Congress in 2004 as a Libertarian on a ‘Re-Defeat Bush’ platform
  • Kim LaCapria, one of the site’s  main researchers and the author of the baised and misleading “fact-check” on Hillary Clinton’s representation of a child rapist, previously had a blog called “ViceVixen.”

The article also includes this:

David Mikkelson told the Dailymail.com that Snopes does not have a “standardized procedure” for fact-checking “since the nature of this material can vary widely.’” He said the process “involves multiple stages of editorial oversight, so no output is the result of a single person’s discretion.” He also said the company has no set requirements for fact-checkers because the variety of the work “would be difficult to encompass in any single blanket set of standards. Accordingly, our editorial staff is drawn from diverse backgrounds; some of them have degrees and/or professional experience in journalism, and some of them don’t.”

The Electoral College’s Day Of Reckoning, Part II: Dunces, Heroes, Villains, And Fools

The failure of the ugly Electoral College revolt scheme that ended yesterday—let’s ignore the coming storm of frivolous lawsuits for now, all right?—with the official, irreversible, like it or lump it victory of Donald Trump over Hillary Clinton also settled some distinctions, some desirable, some not.

  • Ethics Heroes: All of the Republican electors who resisted the harassment, propaganda, intimidation and bad arguments and did their duty, avoiding a crisis and foiling the attempts of Democrats to cheat, which is exactly what the effort to flip the electoral vote was. The faithful electors get bonus points for making so many Democrats and progressives look silly in the process, a fate they richly deserved.

Come to think of it, it was predictable that Democratic appeals to electors would persuade more Democratic electors than Republicans. Which leads us to…

  • Ethics Dunces: A bevy of Hollywood B-listers joined forces in an offensive video that, like Brezenoff’s petition, misrepresented history and the Constitution to gull star-struck electors into defying the public’s will and its trust that their votes would be respected by electors. Led by Martin Sheen, who has no credentials in government or political science but played a wily President on TV, Debra Messing, James Cromwell, B.D. Wong, Noah Wyle, Freda Payne (Quick: who is Freda Payne?), “Better Call Saul’s” Bob Odenkirk, J. Smith Cameron (?), Michael Urie, Moby, superannuated M*A*S*H stars Mike Farrell and Loretta Swit, Richard Schiff, Christine Lahti, Steven Pasquale, Emily Tyra and Talia Balsam tell the electors that they will be following the Founders’ intent by rejecting Donald Trump. This is flatly dishonest, as they are attributing the contrarian position of Alexander Hamilton, who detested popular democracy, to all the Founders, who rejected Hamilton’s proposals on how the government should be elected and structured.

“What is evident is that Donald Trump lacks more than the qualifications to be president. He lacks the necessary stability and clearly the respect for the Constitution of our great nation,” say the celebrities. Obviously it is NOT evident, since Trump’s voters won the day.  The Federalist accurately describes what was behind the video:

“The message is clear: the candidate for whom these celebrities spent months shilling lost the Electoral College, the metric granted ultimate primacy by Article Two of the Constitution. Now, as individuals with no substantial political background, these celebrities have organized en masse to produce content designed to “educate” our electors, chosen for their political pedigree, on their electoral duty. The whole situation reeks of condescension, dirisiveness, and social hubris. What these self-ordained celebrities are demanding is nothing short of the very opposite of what they claim to be purporting. They assert that they “stand with…all citizens of the United States,” yet admittedly only if those citizens agree with their political viewpoint. If said citizens disagree, then, unfortunately, these celebrities decidedly do not stand with them. In fact, they would prefer electors to actively oppose the wishes of these very citizens, so that the candidate they personally believe to be the best suited has a second shot at the presidency.”

The Electoral College’s Day Of Reckoning, Part I: Revelations

After all the protests, the petitioning, the grandstanding, the misinformation and bad law and false history, after all the harassment and intimidation aimed at getting state electors to violate their pledges, duty and the trust of theirs state voters, all designed to keep Donald Trump from attaining 270 electoral votes and thus forcing the Presidential election into the House of Representatives for the first time since 1876, the results were just another humiliation for the Democrats and Hillary Clinton. Donald Trump was officially elected President of the United States, and it wasn’t close.

Four Democratic electors in Washington, a state Clinton won, voted for someone else, giving her just eight of the state’s 12 electoral votes. They will be prosecuted, apparently, for breaking a Washington statute. Colin Powell, a Republican, received three of the faithless elector votes and Native American tribal leader Faith Spotted Eagle received one, apparently because one elector decided that rather than vote for Senator Elizabeth Warren, a real Native American was preferable. Single  electors in both Maine and Minnesota attempted to cast ballots for Bernie Sanders, but state laws requiring electors to follow the statewide vote invalidated both rebellious ballots. One Hawaii elector did vote for Sanders, an especially outrageous betrayal of the vote since Hawaii went to Clinton even more decisively than California.  Never mind: this unknown, unvetted, undistinguished citizen decided that no, he or she knew better. That’s the model Democrats were promoting.

The one Republican elector, Texas’s Christopher Suprun, of Texas, who had trumpeted his  intention  not to vote for Trump despite his state heavily favoring the President Elect voted for Ohio Governor John Kasich as promised, and another Texas elector defected to vote for Ron Paul. Thus the almost six week Democratic push to use the Electoral College to pull victory from the jaws of defeat had the net effect of increasing Trump’s Electoral vote advantage over Clinton by three, with Hillary Clinton becoming the candidate with most defecting electors in over 200 years.

George Will’s favorite phrase “condign justice” leaps to mind. First the Wisconsin recount increases Trump’s vote total, and now this.
