In a legal ethics seminar I taught this week for government attorneys, the vast majority of them voted that Marilyn Mosby’s vainglorious announcement of charges against six officers in the death of Freddie Gray was prosecutorial abuse, and a blatant violation of professional ethics rule 3.8, which directs that (this is the Maryland version)…

The prosecutor in a criminal case shall:

(a) refrain from prosecuting a charge that the prosecutor knows is not supported by probable cause;


(e) except for statements that are necessary to inform the public of the nature and extent of the prosecutor’s action and that serve a legitimate law enforcement purpose, refrain from making extrajudicial comments that have a substantial likelihood of heightening public condemnation of the accused and exercise reasonable care to prevent an employee or other person under the control of the prosecutor in a criminal case from making an extrajudicial statement that the prosecutor would be prohibited from making under Rule 3.6 or this Rule.

Of course it was a breach of ethics, and an outrageous one. Her statement, which I discussed here, not only overstated her justification for bringing the charges, which were rushed and announced before a careful investigation was completed, it also stated that the officers were guilty, and worse, that the charges were being brought because the demonstrating and rioting protesters has demanded it. A Woman On The $10 Bill, Because Pandering To The Democratic “Base” Is One Thing The Obama Administration Can Do Competently

I guess they couldn’t announce that they were putting Hillary on the $10 bill as the first female President because she isn’t dead. This also ruled out such equally worthy possibilities as Sandra Fluke, Gabrielle Giffords, Mattress Girl, Caitlyn Jenner and, of course, Michelle.

Yesterday’s announcement by Treasury Secretary Jack Lew was inevitable the second a feminist started lobbying for it. Never mind that that her effort was ignorant and self-refuting: the list she generated of women proposed as potential faces on the currency contained none whose historical contributions to the nation come within miles of the achievements of Alexander Hamilton, Andrew Jackson, George, Tom, Abe and Ben. Some of the women—Patsy Mink?—are footnotes at best, one (Margaret Sanger) balanced her leadership of the birth control movement with ugly advocacy of white supremacy and eugenics,  and one of the most qualified candidates, Abigail Adams, didn’t make the list at all.

In a year in which President Obama’s party is trying to justify running a corrupt, unqualified, untrusted candidate for President on the sole justification that she has a vagina, nothing was going to stop his administration from putting someone on a bill for the same “reason,” as well as the other reasons, affirmative action, cynical group identification politics, and trying to deflect attention from this crew’s utter incompetence in matters of national interest and substance.

For example, the week has been filled with the jaw-dropping story of how the Office of Personnel Management was hacked by China as a result of utter, unforgivable management incompetence. You know, like the utter, unforgivable management incompetence (or worse) at Justice, HHS, the Secret Service, the IRS, the Veterans Administration, Homeland Security, the TSA, Hillary’s State Department and others—I don’t want to rub it in by running the whole list. President Obama and his wife, Michelle invited about 500 guests to a White House party where pop icons Prince and Stevie Wonder entertained guests. Among the guests were Al Sharpton, Seattle Seahawks quarterback Russell Wilson and his date, singer Ciara, Jon Bon Jovi, James Taylor, Tyler Perry, Connie Britton, Angela Bassett, Gayle King, Tracee Ellis Ross, fashion designer Naeem Kha, American Express exec Ken Chenault,  former Attorney General Eric Holder, Education Secretary Arne Duncan and National Security Adviser Susan Rice, as well as about 480 others of doubtlessly equal glitter who didn’t squeal about the blow-out on Twitter or Instagram or who weren’t mentioned by other guests who did.

The party was not mentioned on the President’s official schedule, and it almost managed to occur without publicity until the White House news briefing on Monday afternoon, when Josh Earnest was grilled about it. The White House spokesman said two interesting things, one audacious in its blatant dishonesty and Orwellian logic, and the other ….interesting. The first:

“I think the fact that we’re talking about a private event and the fact that details of this are known is an indication that the president is committed to being transparent. At the same time, the president and first lady are going to reserve the right to host private parties at the White House, and they did it on their own dime.”

Further proving how transparent the President was, Earnest announced that no guest list would be provided to the press or the public. Now that’s transparency. The other statement:

[T]”he President and First Lady are going to reserve the right to host private parties at the White House, and they did it on their own dime. I think that’s consistent with the kinds of values that they have talked about.”

(AP) — The mayor of a coastal North Carolina town where two young people were severely injured in shark attacks this weekend says she doesn’t think emergency workers had enough time between incidents to close the beaches. A 12-year-old girl was attacked just after 4 p.m. Sunday in Oak Island, and a 16-year-old boy was attacked less than two hours later about two miles away. The girl lost part of her arm and suffered a leg injury. The boy lost his left arm…

Beaches were open for the two-hour stretch Sunday but closed after the second attack.

Oak Island Mayor Betty Wallace told The Associated Press on Monday that she didn’t think that gave workers enough time to decide to close the beach between attacks. …Wallace says that even if the beach had closed after the first attack, the order might not have extended to the area of the second incident.

It was unclear whether the same shark attacked them…

The beaches were open Monday, with a boat and a helicopter patrolling the water.

OK, I know what happens next! The helicopters spot a fin in the water, and there’s a panic on the beach, and it turns out to be two kids with snorkels and a fake shark fin. The younger boy points to his brother and says, “He made me do it!” Meanwhile, the Great White goes over to the lagoon and bites the leg off a guy with a bad fake Boston accent.

If, as I suspect, Mayor Wallace is Amity Mayor Larry Vaughn come to life from “Jaws” and identifying as a woman as well as disguising herself accordingly to get another job as a resort town mayor—which means that she is a woman, of course—then old Larry sure has a flat learning curve. On the other hand, if Mayor Wallace isn’t Larry Vaughn, someone needs to make her watch “Jaws,” quick. Is it unethical—irresponsible, negligent, incompetent— for any Mayor of a coastal town not to be aware of the lessons of that film?

Lincoln Chafee’s Batty Ethics Argument For The Metric System

Ugh. I can’t let this pass.

Yesterday I happened upon Lincoln Chafee on one of the Sunday shows, giving his elevator pitch for why he should be President. You may recall that Chafee, former Republican Senator and Governor of Rhode Island, turned independent after being defeated for re-election and now is following Bernie Sanders’ example, declaring himself a Democrat for the purpose of getting nominated. Chafee is another politician, like the Bush bothers and Hillary Clinton, who owes his initial political prominence to being related to a popular political figure rather than his own innate abilities. As he made obvious the more he spoke…

His two primary campaign positions were 1) “Wage peace”—whatever that means. This is right up there with John Lennon songs as serious policy discourse,  though I’m sure ISIS is fascinated by the concept, and 2) Adopt the metric system. Chafee borrowed this from the idea machine known as the Andrew Johnson administration, as Andy was the first President to officially acknowledge the benefits of the U.S. adopting the less eccentric measurement system used by Europe. I’m sure we all can agree that this is one of the most pressing issues facing the country today.

However, Chafee really got my attention, and sparked this post, when he attempted to combine his two prime objectives, which is no mean trick. I tried to find a transcript, video or a news report to document this, but so far I have failed: maybe everyone is trying to be nice. I swear I am not making this up, though I wish I were.

Chafee argued that the United States should adopt the Metric system because it invaded Iraq and didn’t find the weapons of mass destruction.

Explain to me why this story isn’t national news, while a principal pulling a valedictorian off the graduation program when he insisted on making graduation a vehicle for his coming out as gay—to his parents—is. Never mind. We both know know. Journalists see discrimination and homophobia even where it isn’t, but fascism increasingly bothers them less and less.

That’s because, I fear, they are Democrats. I will return to this surprising and alarming theme in a moment.

At Northwest Mississippi Community College, where the graduation ceremony for Senatobia High was held,  the superintendent asked the crowd not to scream or cheer and to hold their applause until the end. As always happens—always, always,always–a few relatives couldn’t contain themselves. Four guests shouted various felicities and exhortation to their graduates out of turn

They are strict in Mississippi: all four were kicked out of the event.

But that’s not all. They are really strict in Mississippi: Senatobia Municipal School District Superintendent Jay Foster filed ‘disturbing the peace’ charges against the people who yelled at graduation, and police  issued warrants for their arrests with a possible $500 bond.

KABOOM!

Well, my head’s been threatening to explode for quite a while now*, and this finally did it, big time. Congratulations Jay Foster, you foolish, unethical, unkind, tin-god fascist. You did it.

Foster refused to be interviewed on camera, but told the media that he’s determined to have order at graduation ceremonies. I recommend snipers, Jay. Or maybe duct tape. TSA’s Incompetence: Combining David Brooks’ Scandal-Free Fantasy With United’s Anti-Soda Can Policy For Muslem Passengers

Now we have this:

Washington (CNN)Airport screeners failed to detect explosives and weapons in nearly every test that an undercover Homeland Security team conducted at dozens of airports, according to an internal investigation.

The Transportation Security Administration found that “red teams” with the Department of Homeland Security’s Office of the Inspector General were able to get banned items through the screening process in 67 out of 70 tests — 95% — it conducted across the nation.

In other words, since those deadly Islamic terrorists can easily smuggle explosives and weapons on board United flights (or any others), it’s really silly to rob them of the pleasure of sipping a Diet Coke from a freshly opened can as they wait to send everyone to Allah.

In more words, all of the hundreds of thousands of hours, pointless inconvenience and hassle, emptying of pockets, taking off of shoes and belts, moving laptops in and out of bags, showing IDs and boarding passes, as well as the occasional intrusive and unpleasant feel-up pat-downs by strangers wearing rubber gloves that have been inflicted on air passengers (like me) have been stupid, useless, and as effective at keeping airplanes safe as being checked by a blind marmoset with a divining rod.

Of course, David Brooks wouldn’t call the TSA’s gross failure an example of inexcusable incompetence, lack of oversight and breach of trust a scandal either, because it doesn’t involve sex (well, at least in most of the patdowns)  or criminal acts, and is the responsibility of Barack Obama, whose administration is amazingly scandal-free, so this can’t be a scandal by definition.

I beg to differ. The stunning incompetence and lack of competent management, accountability (watch: nobody will be fired for this) or oversight exemplified by this latest fiasco is an ongoing scandal of the worst kind, one of many, or, if you prefer, just the single, devastating, huge, two-term scandal that is the Barack Obama presidency, the most arrogant and incompetent administration in U.S. history.

Ethics Observations On NYT Columnist David Brooks’ Astounding Quote

Amazingly, Obama hasn’t had any.

Here is the quote:

“President Obama has run an amazingly scandal-free administration, not only he himself, but the people around him, not only he himself, but the people around him. He’s chosen people who have been pretty scandal-free. And so there are people in Washington who do set a standard of integrity, who do seem to attract people of quality. And I think that’s probably true of the current group.”

Yes, it was almost a Kaboom!, causing my head to explode. Yes, I think it is stunning thing for anyone to say, but especially a pundit who is respected–by some, anyway—for his careful thought and moderation. Yes, it is ridiculous on its face.

Fascinating and enlightening though!

1. Brooks, though he has wavered occasionally, has always had a man-crush on Obama. Acknowledging this as he has, it shows remarkable lack of bias-control to let it run wild to this extent.

2. It is a terrific example of how linguistics can warp ethics, and vice-versa. The only possible way someone can make such a statement honestly—yes, I do believe Brooks really thinks this, as plainly counter-factual as it is—-is to consciously or sub-consciously define “scandal” so extremely that it omits anything connected to the Obama Administration. If Brooks believes that “scandals’ only involve theft, criminal activity and sex, he has a barely supportable thesis. Barely. Well, not really even then.

3. Not just scandal-free, but “amazingly” scandal free! This gets into Big Lie territory; perhaps “Big Hyperbole” is a bit more accurate. To be “amazingly scandal free,” we would hold up this Administration as the ethics model for all future administrations. Be still, my expanding head…

4. Is this clinical denial? I have mentioned here before that a disturbing number of Democrats and progressives, as well as African Americans, defend Obama by just asserting that everything is wonderful, no matter what goes wrong, and that Obama himself is a great President, despite near complete incompetence in every sphere. Some of these are professional liars and ideological warriors, of course; some are also just not too bright. Brooks, however, doesn’t fit in those categories. Continue reading

P.S. 120’s Pay-To-Play Carnival: How Can We Entrust Our Children’s Education To People Like This?

I don’t know why my head didn’t blow up with this one. Maybe I’m building up resistance. (Is that good or bad?)

PS 120 in Flushing, Queens, held a carnival for its students last week during school hours, with nearly 900 kids, pre-K to fifth-grade, taking turns in 45 minutes shifts.  There were inflatable slides, a space-bounce, rides,popcorn, ices, music and more. It also cost parents $10, and if they didn’t pay, their kids were forced to sit in the auditorium and listen to their richer classmates having fun.

Now the carnival operator is offering to hold a repeat for the excluded children. “If I had known that there were kids not allowed to attend the carnival, I would have paid for them,” he now says.   That’s nice (and smart PR), but the damage is done.

All the teachers, administrators, the PTA and the principal involved in planning this event, and not one had the functioning ethics alarm to say, “WHAT? We can’t exclude kids who can’t pay. That’s unfair and cruel.”  Wow.

Find another way to fund the event. Find a sponsor. Tell the parents who can pay that they will also be paying for poorer families that cannot. Cancel the event, but whatever you do, you can’t punish kids because their parents can’t or won’t pay ten dollars.

Oh—the school made a nice profit on the carnival!

People this incompetent and lacking in compassion and common sense shouldn’t be allowed alone with children, much trusted to teach them.

One day after the deadly Sept. 11, 2012, attack on the U.S. compound in Benghazi, Libya, the Defense Intelligence Agency concluded the assault had been planned 10 days earlier by an al-Qaeda affiliate, according to documents released Monday by conservative watchdog group Judicial Watch. “The attack on the American consulate in Benghazi was planned and executed by The Brigades of the Captive Omar Abdul Rahman,” said a preliminary intelligence report by the Defense Intelligence Agency, obtained through a lawsuit following a Freedom of Information Act request.

Wait…I thought that Hillary Clinton, State, President Obama and Susan Rice were all laboring under the misconception that the attack was spontaneous and prompted by a YouTube video, and the claims that the Obama Administration was stalling the revelations of what they already knew so Mitt Romney couldn’t challenge Obama’s carefully manufactured narrative that he had terrorism on the run were just partisan sour grapes. That’s been the spin the liberal press has been accepting from the White House for over two years.

What’s going on here? Well, the “narrative” carefully shifted away from the most transparent administration in history lying to the American public to excessive Republican claims that the outpost wasn’t given proper security, wasn’t rescued when it could have been, was the product of criminal incompetence. As soon as those accusations failed, Democrats and the news media promptly adopted the official Obama line: Benghazi was a “nothingburger,” in the contemptuous words of Washington Post columnist Dana Milbank. It was a manufactured scandal of no substance designed to discredit Hillary Clinton.

But no evidence proved that Obama, Clinton and Rice weren’t lying about the attacks being spontaneous and not organized terrorism, and all the evidence has demonstrated the contrary, with this latest piece of the puzzle simply filling in some of the blanks. Of course, the latest story wasn’t even covered by most of the mainstream media; I was shocked to see it in USA Today. Judicial Watch is a conservative organization, you see. To be fair, it’s a whack job conservative organization. That means it could legitimately discover cold fusion and the news media wouldn’t pay attention.

Maybe it isn’t news. After all, the Obama cover-up worked. As Harry Reid said, after admitting his part in the organized effort to make sure that the 2012 Presidential elections was based as much on smears, lies and slight of hand as real issues, “Romney lost, didn’t he?” Hillary’s famous dismissal of the issue in the Benghazi hearings was on the mark: “What difference, at this point, does it make?” Continue reading
