love-hateHere are some comments reacting to the JetBlue incident from Jezebel, the feminist website. These are not the outliers. These are typical. I’ve checked some of the other progressive sites.  At Talking Points Memo, the consensus seems to be that it’s “fake news.” So far, the vast majority of the coverage is from conservative sites. Most of the left partisan sites don’t report embarrassing conduct by their compatriots if they can avoid it….or perhaps they just don’t want to inspire comments like these.

Jezebel’s blogger set the tone by invoking the “Tit for Tat” and “They had it coming” rationalizations with this coda to the post:

Given Donald Trump’s unabashed love of heckling people in front of a crowd—he singled out NBC reporter Katy Tur so many times she had to get Secret Service protection—I’m just surprised the administration didn’t give Lasner’s husband a cabinet seat right then and there.

I know i’m supposed to feel bad for Ivanka, but I can’t. Fuck her. Fuck her husband. They are going to make billions off the american taxpayer and have no shame or remorse or anything resembling human emotions. I might feel the slightest bit of pity for the kids, except then I remember they’re all fucking rich and will get whatever their bratty asses demand for their entire lives. So i guess i’ll save my concern for the millions of men and women of various races, creeds and sexual orientations whose lives will begin to become progressively worse on January 20th.

Seriously. Let’s not forget:

— At last count, 838 products in Ivanka Trump’s line, and not a single one made in the US.

— She’s already used her father’s position to further her business by selling dresses and jewelry, and she’s sat in on meetings with leaders of countries in which her business stands to benefit.

— It took more than a year for employees at her company to convince her to establish a maternity policy; she told one employee that when she had her baby, she was only out of the office for a week (she neglected to mention her in-home nanny when explaining this).

— For several months now she’s posted a job on her site for a Freelance Graphic Designer, a full-time job, Monday through Friday, 9-6. But as freelance, this person will not receive any benefits, including healthcare and maternity leave; and the contract is month to month, allowing Ivanka Trump’s company to cut that person loose at any time with zero notice. That’s some fine job creation right there.

In short, fuck Ivanka Trump. She’s a hypocrite just like her father, and while I would try to find a way of doing it without getting kicked off a plane, I’d have no problem telling her so.

Late Nominations For 2016 Jerk Of The Year: Lena Dunham And Daniel Goldstein, Ivanka’s Jet Blue Harasser

I’m pretty sure the Ethics Alarms 2016 Jerk of the Year Award was locked up a while ago, but two new challengers for the title at least strengthen the field:

1. Daniel Goldstein, attorney

Goldstein, in the cabin of a JetBlue flight on which Donald Trump’s daughter, Ivanka, was also a passenger, verbally accosted the soon-to-be First Daughter before take-off. Holding a child in his arms, the New York lawyer started shouting, “Your father is ruining the country!” Then he asked, “Why is she on our flight? She should be flying private!”

Ivanka, who had her own kids in tow, tried to ignore him and attend to her family until he was removed from the flight by JetBlue personnel. “You’re kicking me off for expressing my opinion?” he yelled as he was led off the plane.

What a rude and obnoxious jerk.

Sen. Elizabeth Warren, Whitney Tilson, And Bigotry

The PPP Poll on Democrats’ 2020 preferences found that “Joe Biden leads the way for Democrats with 31% to 24% for Bernie Sanders, and 16% for Elizabeth Warren. They’re the only folks we tested with meaningful support for the nomination at this point.” Since Warren is the only one in that groups not eligible for Social Security, she’s at least the putative front-runner for the 2020 race against President Trump. That’s not bad entirely bad news for Democrats. Warren’s smart and passionate, and she’s a fiery speaker.  Unfortunately, she’s also a jerk and more important, a bigot.

Warren has been on an anti-Trump rampage for months, and an anti-Wall Street rampage forever.   She recently graced  Facebook with another anti-business rant to her nearly 2.5 million followers. In it, she condemned Whitney Tilson, who runs Kase Capital, calling him a “hedge fund billionaire” who is “thrilled by Donald Trump’s economic team of Wall Street insiders.” The Massachusetts Senator wrote, “Tilson knows that, despite all the stunts and rhetoric, Donald Trump isn’t going to change the economic system…The next four years are going to be a bonanza for the Whitney Tilsons of the world.”

This gratuitous attack was pure bigotry.  To bigots, what matters is what people are—blacks, whites, Jews, gays, men, women, Muslims, poor people, rich people, Democrats, Republicans. Also Trump voters, feminists, Christians, college students, bankers, and lawyers. Bigots assign unattractive, negative character traits to individuals based on neat categories they can be placed in, and their real beliefs, principles, and most important of all, acts don’t matter. Warren’s reference to “the Whitney Tilsons of the world” is the mark of a bigot. If you work on Wall Street, you are just like all the rest to her. Greedy. Corrupt. Bad.

The  hateful attitude from Warren is especially unfair in Tilson’s case. He was one few financial executives who publicly opposed Trump and supported Hillary Clinton. He is a lifelong Democrat, and he helped start the terrific volunteer teacher program Teach for America; he doesn’t just sit around counting his money.  (Warren, incidentally, is about as rich as he is.) Tilson was also  one of the very few Wall Street executives who  donated to Senator Warren’s campaign for the Senate. Tilson, like Warren, has supports tough regulations for his industry.  “I’m a fan of Dodd-Frank,” he said in a recent interview. ” I think banking should be boring…I worry about Wall Street returning to being a casino.” Continue reading →

“Above the Law”‘s Elie Mystal has crossed over from being a provocative, if often emotion-driven and unprofessional, legal news analyst to being an Angry Black Man for whom law and justice is tangential. As Ethics Alarms covered here, Mystal already has proclaimed that the existence of a single intransigent juror who hung the jury in the Michael Slager trial proves that whites are incapable of race-blind justice. In his latest stage of racist fury, Mystal now wants black jurors to sabotage the justice system.

“Black people lucky enough to get on a jury could use that power to acquit any person charged with a crime against white men and white male institutions. It’s not about the race of the defendant, but if the alleged victim is a white guy, or his bank, or his position, or his authority: we could acquit. Assault? Acquit. Burglary? Acquit. Insider trading? Acquit.Murder? … what the hell do you think is happening to black people out here? What the hell do you think we’re complaining about when your cops shoot us or choke us? Acquit. Don’t throw “murder” at me like it’s some kind of moral fault line where the risk of letting one go is too great. Black people ARE BEING MURDERED, and the system isn’t doing a damn thing to hold their killers accountable. Sorry I’m not sorry if this protest idea would put the shoe on the other foot for a change.”

You can read the rest; it’s all like this. Mystal is bonkers. There’s no reasoning or fairness in his screed. He’s just fulminating, growling and slobbering like a rabid dog. It’s sad. Nobody can take anyone who expresses this kind of irrational hate as a response to frustration seriously. He’s not accurate, he’s not truthful, he’s not responsible. He has left law and logic so far behind he may never work his way back to them.

Some random thoughts on an incredible display of terrible taste, as I wrestle to keep my cranium from blowing…

1. Why in the world would Newt do this? How could he, or anyone, not understand that this would be hurtful to many, and appreciated by none? Has he decided to compete with Donald Trump for most Reckless Twitter-User? Is he trying to make Trump look responsible by comparison? Why, Newt? Why?

2. Perhaps this is the beginning of regular laudatory tweets from Newt in appreciation of other geniuses that did Americans harm.

March 6: “Today we celebrate Santa Anna’s brilliantly executed surprise dawn raid on the Alamo, and his efficient slaughter of more than 200 Texans in 1836”

April 14: “A date for all Americans to commemorate John Wilkes Booth’s superb planning and marksmanship, confounding President Lincoln’s security to shoot him in the head with flair in 1865!”

August 8: “Let us not fail to admire surgical precision with which the dedicated follower of Charles Manson carried out their slaughter of five people in 1968”

September 11…well, you get the idea.

3. What’s truly nauseating is that poor, insecure Newt is so desperate for affirmation that he will use, of all things, the tragedy of the attack on Pearl Harbor to make himself appear, (he thinks), worldly, cerebral and analytical. All he really accomplished is to reaffirm what most cognizant Americans have known for decades…

4. …that Newt is about as big a jerk as this society has ever produced.

 

More Lone Juror Ethics: The Slager Trial, Juries, And Justice

This was what I was afraid of. It is also why Michael Slager, who is guilty as hell, didn’t plead guilty despite slam-dunk, irrefutable evidence that he executed  African-American Walter Scott as he was fleeing arrest last year. It is why I argued that if Slager ethically cared more about the law, his profession, his community and his country than he did about literally getting away with murder, he was ethically obligated to plead guilty so this couldn’t and wouldn’t happen.

A single juror told the judge in the Slager trial last week that he can’t find the ex-cop guilty. In a letter to the court, the would-be Henry Fonda said, “I cannot in good conscience consider a guilty verdict…I cannot and will not change my mind.”

The jury foreperson confirmed  in a separate note  that it was only one juror who was “having issues” convicting Slager, who pulled over Scott’s car in North Charleston, South Carolina last year, and ended up shooting him in the back while a bystander recorded the killing on video. Circuit Judge Clifton Newman sent the jury back for more deliberation, and they are expected to report on their progress at 9 a.m. Monday.

The lone juror holding out for innocence against eleven wanting to convict is celebrated as a courageous and system-defining stand in “Twelve Angry Men,” but it strains our faith in the system when the facts are like they are in this case. Nonetheless, the possibility of a not guilty verdict in the supposedly open-and-shut case is essential to the integrity of our system’s principle that even the most obviously guilty deserve a competent defense and a trial before a jury of their peers. Either we believe, as it has been said by many, that it is better for 100 guilty defendants to go free than for a single innocent citizen to be convicted, then we have to respect and accept the result when a lone juror seems to violate common sense and law.

Is Slager “more guilty” than O.J.? I could argue that they both deserve punishment, but if one deserves it more than they other, I’d pick Simpson, who killed two people, and wasn’t attempting a lawful arrest. (I could also argue that this kind of shooting by a police officer deserves a harsher punishment, because of his profession and his duties to society.) However we feel, we cannot condemn the lone juror without endorsing summary justice and show trials. If we believe in fair trials, we must believe in not guilty verdicts when a defendant seem obviously guilty, and lone jurors who cannot be convinced of guilt beyond a reasonable doubt.

Taking the other approach—emotion, anger and irrational hate—will be the likes of Elie Mystal, who, I think it is fair to say, needs a vacation. The Jerk On The Plane: Boy, I Hate It When My Hypotheticals Come To Life…

On a recent Delta flight from Atlanta, a young man stood up before take-off and started harassing his fellow-passengers with a pro-Trump rant,  yelling “Donald Trump baby!” and “We got some Hillary bitches on here?” while pointing at individual travelers. He also said, “Donald Trump is your President. Every god damn one of you. If you don’t like it, too bad.” Delta initially removed him, but returned him to the cabin. According to one witness, upon returning the man said, “This is what you get for being a patriot.”

He’s an idiot, of course, and there’s no excuse for his conduct. And yet…

How different is what he did, and what the “Hamilton” actors did? Not much. Neither the “Hamilton” audience members nor the passengers bought tickets to be subjected to this. Both were captive audiences. The conduct in both cases constituted harassment. The clearest distinction was that the jerk on the plane wasn’t an employee; if he had been a flight attendant, the incidents would have been even more similar. The jerk on the plane didn’t single out a particular passenger by name, making his conduct better, not worse, than what the “Hamilton” cast did.  On the plane, passengers hadn’t previously jeered the Hillary Clinton voters among them, so the intimidation factor Pence experienced was absent, and it was only one passenger, not a passenger with an imposing  line of others backing him up, like the wall of actors behind Brandon Victor Dixon. Ethics Dunce Collective: The American Music Awards

I can make this uncharacteristically short. Just re-read the post on John Oliver’s nasty full-show, post-election anti-Trump rant, and substitute “American Music Awards.” Also worth reviewing is the list of rationalizations used to justify Oliver, which I posted here, especially since so many of them are also being trotted out to excuse the ambushing of Mile Pence when he dared to exercise his right to enjoy “Hamilton” on Broadway without being personally called out and attacked by the cast.

It can be argued that the American Music Awards’ insults to the duly and lawfully elected POTUS—who has yet to do anything as President— last night were even worse than Oliver’s disrespectful ad hominem barrage. At least Oliver, a skilled satirist, was occasionally amusing. The two AMA hosts from Saturday Night Live were juvenile, desperate and amateurish, counting on their Trump-hating demographic for laughs they didn’t earn. If we ever see a more inept impression of Donald Trump than Jay Pharoah’s, be it in four years or a century, I’ll be shocked. Worst of all, however, was Gigi Hadid’s unfunny, mean and hypocritical imitation of Melania Trump, for the crime of existing.  The principle, just for application to Republican First Ladies, now, is apparently that having an accent  makes you ridiculous and an idiot.

If anyone, anywhere, on a live television show had dared to do such a grotesque mockery of Michelle Obama when she was the incoming First Lady, they would have been tarred a boor, a racist, and a virtual traitor.

I wonder which of the rationalizations will be used to defend Hadid? Whatever they are, the real defense is just this, the same that is being used to defend “Hamilton”: We hate these people, and they don’t deserve to be treated fairly.

Got it.

One clarification: Green Day is a political band, and their decision to shout No Trump / No KKK” during their performance of the catchy and tuneful  “Bang Bang” is as fair as it was predictable…also moronic, but what do you expect? It’s a band.

Revelations From The John Oliver Video Post: What I Have Learned

light-bulb PREFACE: I have just returned from a crazy three day odyssey that had me lecturing on Massachusetts legal ethics in Boston, Washington, D.C. legal ethics in the nation’s capital, and, professional ethics, legal ethics and accounting ethics in Tucson, Arizona. Keeping pace with ethics developments was even more difficult than it usually is when I’m on the road, because I had almost no time in between flights, meetings and various hassles to get to a newspaper, surf the web, or watch TV. And my browser kept crashing.

I wrote the John Oliver post, frankly, as low-hanging fruit. His performance was vile and hateful, barely funny, self-indulgent, and disrespectful in a damaging way, and I didn’t think, and still don’t, that there should be much disagreement on that assessment. I expected the usual “lighten up,” “he was only joking “[he was NOT only joking], and “he has right to free speech” comments, because I always get those any time I point out that a comedian has been unfair and irresponsible. I did not expect,for the post to get more single day traffic than all but one previous Ethics Alarms entry, and so many comments, many of which with troubling social and political significance. I returned to my office to find more comments waiting for moderation than have ever been there at one time, and I apologize for that: I try to get them cleared withing hours if not minutes. Of course, a disproportionate number of them were garbled nonsense, or just invective with no point whatsoever. They didn’t make it.

I also had some tough calls, with repetitious comments that misrepresented the post, made irrelevant or factually mistaken assertions, and also were abusive. I fear that I may have been inconsistent, and perhaps less tolerant than usual, and I’m not referring to the occasional comment I allowed to be published just to show the kind of comments that weren’t being posted. The problem is that this site is a intended to be a colloquy, and poor quality comments just make the threads hard to read, and also undermine the site.

I may have to be more ruthless in moderating comments in the future. I’m thinking about it.

Ethics Dunce: HBO’s John Oliver [UPDATED]

I’m being kind and restrained here. John Oliver is a lot worse than an Ethics Dunce. I’ll let you fill in the blanks.

The video above was Oliver’s final show this season on HBO. It is a full half hour of insults and hate directed at the President-Elect of the United States of America. Some of his insults and ridicule are based on substance, some appear to be  pure bias and stupidity. I almost bailed when Oliver, to the bleating of his all blue, all juvenile audience, implied that being endorsed by the head of the KKK obviously disqualifies someone to be President. Unpack the logic in that contention.

Mostly, however, it is a vicious ad hominem assault on the newly elected President of a level of unfairness and disrespect that has never been directed at any previous President Elect in public. Never, because Americans have always realized that the slate is cleared when someone becomes President, and that the individual inherits the office and the legitimacy of that office as it has been built and maintained by it previous occupants. He (no “he or she” yet, sorry: not my fault) becomes the symbol of the nation, the government and its people, a unique amalgam of prime minister, king and flag in human and civilian form.

That immediate good will, respect for the Presidency, and forgiveness of all that went before has made the transfer of power in the US the marvel of the world, and has kept the nation from violence and division. It is part of our strength as a society. It is part of the election process, and a vital one. John Oliver is intentionally tearing at that process. Continue reading →
