Sunday Morning Ethics Warm-Up, 5/27/18: On Bullies, Dogs, Signs, Cheats, And The Worst WWII Movie Ever

Good morning.

1. BOY, is that a lazy and inaccurate movie! As usual, they are playing every war movie they can dig up on Memorial Day weekend. I just watched the tail end of  “The Battle of the Bulge,” the 1965 Cinerama Hollywood portrayal of the decisive 1944 WWII battle in the Ardennes that reminds me of my dad, buried in Arlington National Cemetery, more than any other war film, and not because it was in that battle that my father earned his Silver Star. No, the film reminds me of Dad because he hated it so much. He regarded it as an insult to the veterans who fought the battle, and  a cretinous distortion of history in every way. His name for the movie was “How Henry Fonda Won the Second World War.”

The most striking of the endless misrepresentations in the movie is the absence of snow. The battle’s major feature was that it was fought in freezing, winter conditions, on snow covered terrain sometimes up to two feet deep. Some battle scenes are shown being fought on flat and bare plain, about as distinct from the mountainous, thickly forested territory where the actual battle took place as one could imagine. My father also started complaining during the film, loudly, about the use of modern American tanks to portray the German Tiger tanks.

Former President (and, of course, former Allied Commander) Eisenhower came out of retirement to hold a press conference to denouncing “The Battle of the Bulge” for  its gross  inaccuracies. THAT made my father happy.

2. Funny! But…no, it’s just funny. Scott Campbell, the owner of the Pell City Fitness gym in Pell City, Alabama,  put up a sign that says “tired of being fat and ugly? Just be ugly!” City officials told him to take down the sign or be fined, saying it is too big and needs a permit, but other business owners told the local news media that they have never heard of the ordinance the city is citing being enforced. The suspicion is that Campbell is being singled out because some have complained that the sign is “insensitive.” No, it’s just funny…

This is the ethical problem with excessively restrictive laws, rules and regulations that are not consistently enforced. Prosecution can be used for ideological and partisan discrimination. Not only is the sign benign, it is not even original: that same language is on fitness company ads all over the country. So far, it looks like the community is supporting Pell and that the city will back down, but this is Alabama. Call me pessimistic, but I doubt the sign would be allowed to stand for long in Washington State or California if an ordinance could be found to justify pulling it down.

THAT’S The Concept I Was Looking For—“Cultural Vandalism”!

Does he still seem like God to you?

“Cultural vandalism”!

Perfect! That’s the ideal description of what artists, especially performing artists, do when they engage in such revolting conduct that it becomes difficult or impossible for us to enjoy their work the way we could before we knew they were disgusting human beings.

We owe Vulture writer a debt of gratitude, not only for identifying the conduct as cultural vandalism (a term usually reserved for acts like stealing the Elgin Marbles), but also for explaining, in his article The Cultural Vandalism of Jeffrey Tambor, clearly and powerfully, why it is a serious ethical breach beyond the misconduct itself.

He writes in part,

Once I know something like this, it makes it impossible for me to look at the actor and not think of the horrible things they’ve allegedly done. I don’t care to argue whether this is rational or not (I think it is), or whether I hold inconsistent opinions of works that are problematic for whatever reason (everyone does). The repulsed feeling is still there, and it makes a difference in how I react as a spectator…This sort of thing seems categorically different from, say, watching a film starring an actor whose political beliefs are different from yours (though there, too, a line could be irrevocably crossed). Once you believe that a particular actor or filmmaker or screenwriter is a predator or abuser, you’re aware that the environment that produced your entertainment — the film set — was engaged in a conscious or reflexive cover-up, in the name of protecting an investment. You can still be passionately interested in the thing as a historical or aesthetic document — seeing it through the eyes of, say, an art historian who can contextualize Paul Gauguin within the totality of 19th-century painting, or an African-American studies professor who’s fascinated by Gone With the Wind — but you can’t lose yourself in it anymore. You can’t be in love with it. You can’t really enjoy it in the most basic sense, not without playing dumb.

You didn’t do that to the artist. The artist did that to himself…

And it’s awful. People’s lives get ruined, their careers get interrupted or destroyed. The emotional, physical, and financial damage that problematic artists inflict on people in their orbit should always be the first and main subject of discussion…On top of all that, we also have the collateral damage of cultural vandalism. Fun, meaningful, even great works that dozens or hundreds of people labored over, that built careers and fortunes and whole industries, become emotionally contaminated to the point where you can’t watch them anymore…. in recent years, an entire wing of African-American cultural history has been vaporized by the Bill Cosby allegations and his recent felony sexual-assault trial, including the most popular sitcom of the ’80s (The Cosby Show), some of the top-selling comedy albums of all time, the precursor to the R-rated buddy comedy genre (Uptown Saturday Night and its sequels), and the first Saturday morning cartoon with a predominantly black cast (Fat Albert and the Cosby Kids). Predators’ careers are getting raptured, as well they should be. But unfortunately — perhaps inevitably — their work is getting raptured along with it, imploding into dust as the culture moves on to things that aren’t as problematic (or that might have skeezy stuff going on behind the scenes that we don’t know about yet)….

…Nobody is stopping anyone from watching these works (though they’re no longer as easy to find, and you probably have to own a DVD player). We can still talk about them, study them, write about them, contextualize them. But the emotional connection has been severed. The work becomes archival. It loses its present-tense potency, something that significant or great works have always had the privilege of claiming in the past.

That’s all on the predators. It’s not on you. None of us asked for this.

Giving Credit When Credit Is Overdue: The Great Paul Frees And The Untold Secret of “Some Like It Hot”

I’m going to reveal a secret.

Paul Frees certainly isn’t a secret, or shouldn’t be. You know Frees, even if you don’t know his name. He was a brilliant vocal talent who, like his better-known contemporary Mel Blanc (the voice of Bugs Bunny, et al.) was called “The Man of A Thousand Voices.” Frees was more versatile than Blanc, however, and more ubiquitous as well. He was the voice of Boris Badenov in the “Rocky and Bullwinkle” cartoons, as well as the voice of Santa Claus, Jack Frost and dozens of other characters in the Rankin-Bass animated specials that are still shown every Christmas.

Frees did a killer Orson Welles impression that was used is several films, and by Stan Freberg as the narration for his immortal comedy album, “Stan Freberg Presents The United States of America (Part I). He was the voice of both John and George in the Beatles’ animated TV show, and  Ludwig Von Drake for Disney. He recorded the “Ghost Host” of Disney’s Haunted Mansion ride; indeed, his voice turns up in many rides in the theme parks, including “Pirates of the Caribbean.” In commercials, he was Poppin’ Fresh, the Pillsbury Dough Boy;  Toucan Sam, the Fruit Loops mascot who sounded like Ronald Coleman for some reason; and Boo Berry, who was a spoof of Peter Lorre. His Peter Lorre imitation had been honed as a member of Spike Jones’ troop of musical maniacs, and his Lorre-rendition of “My Old Flame” is a highlight of “The Best of Spike Jones” album, which I play often to maintain my sense of humor in dark days…

Blue Monday Ethics Warm-Up, 5/7/2018: Fake Brain Death, Horrible History, Bad Bills And Worse Journalism

It’s Monday!

1  In thousands of little ways...Insidious, biased, deceitful, distorted and unfair information is fed to the public by the news media, unflagged or corrected by editors, presented as legitimate punditry and journalism either intentionally to warp public opinion for leftward political gain, or out of pure incompetence, depending on how much one accepts Hanlon’s Razor. The little ones, like the tiny repetitive concussions that over time give NFL players brain disease, may be more insidious than the whoppers.

Here is a typical example. Progressive op-ed writer David Leonhardt concludes his column about how Amazon is a dastardly monopoly endangering his beloved book stores by writing,

“Once the country emerges from the Trump presidency, I hope we will have a government that takes monopolies seriously.”

It takes magnificent gall to lay the power of Amazon at Trump’s doorstep. The internet giant built its virtual monopoly to its current power on Obama’s watch, with a Justice Department that looked the other way. Why? I wonder if it had anything to do with the massive co0ntributions Amazon magnate Jeff Bezos sent the Democrats’ way, or the fact that his newspaper, The Washington Post, was a reliable cheer-leader for Obama through is entire administration. Never mind: Leonhardt’s editors allow him to mislead readers into believing that Amazon is being allowed to do its worst because of Donald Trump.

Oh…did you notice the conflict of interest disclaimer pointing out the Post-Bezos-Amazon connection for those readers who might want to know that the Times’ rival for national newspaper primacy is owned by Amazon’s CEO? Neither did I. Maybe when the Times emerges from its fake news and blatant partisanship stage, it will start taking ethics seriously.

2.  Today’s Fox News incompetence note. I literally stopped on Fox News for 45 seconds this morning, and heard a lovely, buxom, Fox blonde clone report this story by saying, “the boy was brain dead for two months, then woke up.” [The original typo had “bot” instead of boy. A good time was had by all]

No, you idiot. He was not brain dead at all, because when you are brain dead, you’re dead, and you don’t wake up.  Doctors may have thought he was brain dead. He may have seemed to be brain dead. But he wasn’t brain dead.

Fake news, and stupid news.

Fox News.

3. The logic of Hollywood anti-gun zealots in a horror movie. A decent horror move could be made about the San Jose Mystery House, where Winchester rifle heir Sarah Winchester built a maze of rooms and stairways to keep her personal demons at bay. “Winchester” isn’t it, because its mission was to bludgeon audiences for two hours with perhaps the silliest anti-gun message ever devised. You see,  rumors persisted while Sarah was alive that she was building rooms for all the ghosts of victims of her father-in-law Oliver Winchester’s repeating rifle to reside. Thus workmen claimed the site was haunted. “Inspired by real events,” as the film says (the “real events” being the sensational tabloid tales), “Winchester” posits that the ghost of a Confederate soldier whose two brothers were killed in the Civil War has returned to get revenge. Sarah is racked with guilt, because, she says, the Rebel muskets were no match for the North’s repeating rifles, and “they never gave them a chance.”

Yup, those are the rules in war, all right: always give the soldiers trying to kill you a chance. Later, all the angry victims of the evil Winchester come out to glare: Native American, children, suicides, slaves. Continue reading

Morning Ethics Warm-Up, 5/5/2018: “Why We Can’t Have Nice Things” Edition

Good Morning!

(I’m happy to report that my Clarence Darrow ethics program for a lawyer group yesterday in Annapolis was received wonderfully, in no small part due to actor Paul Morella’s moving and powerful recreations of Darrow’s courtroom oratory. As is often the case, attendees said that they didn’t realize a legal ethics presentation could be so interesting. If fact, there is no excuse for any kind of ethics NOT being interesting…)

1. I call this “cultural defacing.” At 10:30 last night, I watched the end of “The Princess Bride,” and was thrilled to arrive just as the final showdown between Ingo Montoya (Mandy Patinkin) and Count Rugen (Christopher Guest). Here is the scene, a classic one, which begins with the Count apparently fatally wounding Inigo with a dagger:

Inigo Montoya: Hello, my name is Inigo Montoya. You killed my father. Prepare to die.

[Inigo advances on Rugen, but stumbles into the table with sudden pain. Rugen attacks, but Inigo parries and rises to his feet again]

Inigo Montoya: Hello, my name is Inigo Montoya. You killed my father. Prepare to die.

[Rugen attacks again, Inigo parries more fiercely, gaining strength]

Inigo Montoya: Hello! My name is Inigo Montoya! You killed my father! Prepare to die!

Count Rugen: Stop saying that!

[Rugen attacks, twice. Inigo avoids and wounds Rugen in both shoulders. Inigo attacks, bellowing:]

Inigo Montoya: HELLO! MY NAME IS INIGO MONTOYA! YOU KILLED MY FATHER! PREPARE TO DIE!

[Inigo corners Count Rugen, knocks his sword aside, and slashes his cheek, giving him a scar just like Inigo’s]

Inigo Montoya: Offer me money.

Count Rugen: Yes!

Inigo Montoya: Power, too, promise me that.

[He slashes his other cheek]

Count Rugen: All that I have and more. Please…

Inigo Montoya: Offer me anything I ask for.

Count Rugen: Anything you want…

[Rugen knocks Inigo’s sword aside and lunges. But Inigo traps his arm and aims his sword at Rugen’s stomach]

Inigo Montoya: I want my father back, you son of a bitch!

[He runs Count Rugen through and shoves him back against the table. Rugen falls to the floor, dead]

Except “you son of a bitch” was cut!

We settled this when the TV showing of “Gone With The Wind” let Clark Gable’s iconic exit line, “Frankly my dear, I don’t give a damn” remain uncensored, and later,when John Wayne as Rooster Cogburn uttered the words, “Fill your hand, you son of a bitch!” before charging Ned Pepper and his gang. It is unfair and disrespectful to wreck the best work of writers and actors for the few remaining people on earth who take to their fainting couches when rude language meets their ears. You don’t edit Rhett, or Rooster, or Inigo, or even John McLane when he says, “Yippee ki yay, mother fucker!” Show the movie, or don’t show the movie, but don’t ruin the movie for the most easily offended in the audience. Morning Ethics Warm-Up, 4/30/18: Going Out Like A Lamb

Good Morning!

It’s especially good because this is the last day of one of the worst Ethics Alarms months ever, with the lowest daily average of views for an April since 2013. I have no idea why, and I wouldn’t change anything anyway. I have my dark suspicions, though….

1 Pig brain ethics. Researchers at Yale University restored circulation to the brains of decapitated pigs, and kept the organs alive for several hours.  Now ethicists are wondering if this was ethical.

Hmmmm:

  • I’m going to go out on a limb here and guess that if you asked the pig, he’d say that cutting his head off was more unethical than keeping his brain alive afterwards.
  • Like a lot of bioethics controversies, this is more “ick” than ethics.
  • Go on, make a “Futurama” joke.

2. Human brain ethics. Is we getting dumber? This Facebook quiz claims that “nobody” can get even 5 of these 10 questions right, and that if you get all ten right, you’re a genius. I hope that isn’t true. I would say that anyone who can’t get at least 8 of the 10 right is either under 15 or cognitively damaged. I really want to know what the average score is. If most Americans really can’t answer these, then we need to dismantle the public school system and start from scratch. And any teacher who can’t answer at least nine of the ten questions should be fired. Continue reading

Comment Of The Day: Morning Ethics Warm-Up, 4/7/2018: #2: “Williamson No Longer Of The Atlantic’”

This is an epic Comment of the Day using an unusual approach. Michael West explores aspects of public discourse that is at the core of ethical misunderstanding and ethics malpractice by focusing on a multi-party twitter exchange regarding an issue discussed on Ethics Alarms, the firing of former National Review writer Kevin Williamson after he doubled-down on an extreme position regarding abortion: he believes it is murder, and therefore believes that capital punishment is a fair punishment for what should be considered a crime. Moreover, he said that because of the violent and depraved nature of the crime, a violent execution, like hanging, would be appropriate for the women who allowed their fetuses to be aborted.

Michael also used his comment to highlight a concept we have not used on Ethics Alarms, at least by name, “the Overton Window.” That is defined as “The spectrum of ideas on public policy and social issues considered acceptable by the general public at a given time.” Of course, what the “window” is can be tricky to determine. Donald Trump broke the alleged window repeatedly. My preferred approach to this “window” is to challenge it, and to try to expand its boundaries, consequences be damned. I equate the Overton Window with de facto censorship and thought-control.

I am especially glad that this comment again raises the Williamson firing and the related ethics issues. These are rich topics, and yet the matter fled the blogs and commentary sites quickly, paved over by successive outrages of the day.

Here is Michael West’s Comment of the Day on #2 in the post, Morning Ethics Warm-Up, 4/7/2018: “Ruggles Of Red Gap” And “Williamson No Longer Of The Atlantic’.”  This is a bit challenging to read, but worth the effort. For clarity, Michael’s commentary is in bold italics.

I think this is an informative tweet dialogue on a handful of levels. For one, it reveals some informal fallacies that inevitably ruin any discourse and are especially ruinous tendencies in any summarized forum (which twitter represents the extreme end of the spectrum). It also reveals what I think is the fundamental problem with the discussion [on Ethics Alarms.]. I think we’re operating on two different meanings of “mainstream”. Simultaneously this reveals two different attitudes regarding the Overton Window.

As for the term “mainstream”, Almaqah below seems to mean it as “anything someone is willing to hear another person discuss.” I presume [commenter Chris’s]  friendliness toward Almaqah’s opinions implies [he] generally believe the same. When I use it, and I think when most others use the term, we use it as more of a quantitative assessment, where “mainstream” means “anything that a sufficient percentage of people believe”, to which it might be effective to add “that it holds enough weight to begin to sway policy discussions” …but that’s not essential.

I think Almaqah’s subsequent side-bars reveal a somewhat concerning attitude towards diversity of opinion as well as tolerance of that diversity. He seems to think that acceptable discourse should be extremely narrow and that anything outside of that window should not be tolerated one bit.

Here, Almaqah subtly shifts the accusation. The topic is the specific stance that women who kill their unborn children should be executed. Almaqah expands this to “Punishing women who seek abortion.”.There’s a significant difference here where his latter use of “punish” compels the person he’s arguing with to either agree or disagree to a general assertion which may or may not reveal an actual attitude towards the specific assertion. This isn’t rhetorically responsible dialogue.

Molly Hemingway, is playing the typical journalist role of saying something triggering to her base, “Fired for being pro-life”, when she knows he was fired for having a stance about how to enforce those who have abortions. She isn’t being responsible with her tweet, and Almaqah capitalizes on this. But in reality, we know he wasn’t fired for being pro-life, but standing up *for* him and his right to hold opinions, is not an endorsement of those opinions NOR is it a claim that the opinions are “mainstream” (unless you insist on the Narrow Overton window definition of mainstream).

Here, Almaqah quotes the same Reason article, by Katherine Mangu-Ward, which [Chris] referred to and is linked in Jack’s piece.

So by saying that his hanging position puts you outside the spectrum you are saying something about what the “baseline” opinion is that they dislike. Sort of like how a lot of mildly racist conservatives didn’t fully agree with Trump’s more forceful racism but didn’t feel it should be condemned as outside the pale because they though of their own more mild racism as the midpoint for views on minorities.”

Almaqah, relying on the narrow, intolerant view of the Overton Window, again shifts the term from the specific “execution” to the broader term “punishment.” Fyodor does a great summary rebutting him here. Almaqah’s reponse is to belittle the notion of tolerating an individual, who while generally in agreement with most actual mainstream opinions, holds one or two more extreme ideas. This is problematic. If Almaqah’s attitude is to reign, we cannot tolerate individuals having anything other than exactly the same lock step views on every opinion we grant “mainstream” status…we must, upon discovery that one of our “orthodox” fellows, when holding even a single “out of whack” viewpoint, must be shut up and sent out of the camp.

Morning Ethics Warm-Up, 4/7/2018: “Ruggles Of Red Gap” And “Williamson No Longer Of The Atlantic'”

 

Good Morning…

(Do you remember when Saturday morning was fun? Stupid, but fun…)

1. Your cultural literacy note of the day. The Charles Laughton classic “Ruggles of Red Gap” was on Turner Movie Classics last night. The movie itself is wonderful—I recommended it in an Independence Day post here—but it is also a cultural literacy triumph.  In 1935, when the film was released, Lincoln’s Gettysburg address was in the process of falling out of the public’s consciousness. The film’s most famous scene, however, revived it. In a saloon, reference is made to “what Lincoln said at Gettysburg,” and all the cowboys in Red Gap ask each other, “What did Lincoln say at Gettysburg?” Then, quietly, unexpectedly, Ruggles the English butler (Laughton) and the only foreign-born man in the room, recites the speech. TCM host Ben Mankiewicz, in his post showing observations, revealed that when the film was first shown, audiences frequently stood and applauded Laughton’s rendition, and the Address itself became more widely known and quoted.

This is how popular culture works when it is in sync with national values, and not attempting to undermine them.

John Wayne Western Ethics: Just Thought I’d Mention This…

“Chisum” is a lesser effort by the Duke for sure; I saw the Western when it came out in 1970, and it made no impression on me at all, apparently. When I watched it again two days ago, almost nothing seemed familiar. There was one scene, however, that raised my eyebrows.

The story is very loosely based on John Chisum (of  Chisum Trail fame) and his involvement in the Lincoln County War of 1878 in the New Mexico Territory. At one point in the story, British rancher and Chisum’s neighbor Henry Tunstall rides to Santa Fe to seek help from Territorial Governor  Sam Axtell in the increasingly tense range war.  Henry does not know that he has been framed for cattle rustling, and when he  is intercepted by two deputies (they are in on the plot, but he doesn’t know that) who accuse him and tell him he is under arrest, he objects strenuously.  Saying he is late, Tunstall starts to reach into a pocket. One of the deputies shoots him dead. The two then plant a gun on Tunstall to back the story that the deputy fired in self defense.

“Melanie Wilkes” Loses Her Defamation Lawsuit…But Was She Right?

A California appellate court yesterday dismissed a defamation lawsuit brought Dame Olivia de Havilland against FX Networks. De Havilland, now 101, is one of the last surviving—and lucid—members of Golden Age Hollywood royalty. Those who are culturally literate know her as Melanie Wilkes, Scarlet’s angelic sister-in-law, in “Gone With The Wind,” Maid Marion in MGM’s definitive “Robin Hood” with Errol Flynn (de Havilland’s most frequent leading man),  my personal favorite, poor Bette Davis’s evil tormentor in “Hush, Hush, Sweet Charlotte,”  and many other roles in an epic career that won her two Academy Awards. (If you don’t know her, get cracking! What’s the matter with you?)

De Havilland had  sued for damages, claiming her portrayal in the Ryan Murphy-produced 2017 docuseries, “Feud: Bette and Joan” about the feud between Davis and Joan Crawford, misappropriated de Havilland carefully nurtured image without her consent, and harmed her reputation by portraying her inaccurately, especially a scene where she is shown referring to her sister, actress Joan Fontaine (“Rebecca,” “Jane Eyre,” “Suspicion”—What is the matter with you?), as a “bitch.”

“When ‘Feud’ was first being publicized, but before it went on the air, I was interested to see how it would portray my dear friend Bette Davis,” de Havilland wrote the New York Times, explaining the suit. “Then friends and family started getting in touch with me, informing me that my identity was actually being represented on the program. No one from Fox had contacted me about this to ask my permission, to request my input, or to see how I felt about it. When I then learned that the Olivia de Havilland character called my sister Joan ‘a bitch’ and gossiped about Bette Davis and Joan Crawford’s personal and private relationship, I was deeply offended.”

“Feud,” she said, represented itself as historically accurate fiction, but falsely portrayed her as a hypocrite “with a public image of being a lady and a private one as a vulgarity-using gossip,” undermining what de Havilland  described as a hard-earned reputation for “honesty, integrity and good manners.” Continue reading
