Ethics Hero: Senator Rand Paul

Thanks, Senator, we needed that.

Rand Paul has disqualified himself from being considered for the Presidency by rational voters in many ways. His suggestion to MSNBC’s Rachel Maddow that he would have waited for market forces to end Jim Crow, and voted against portions of the Civil Rights Act was enough all by itself. Paul’s embrace of isolationism—he often sounds like Michael Moore on foreign policy—is as fanciful as it is dangerous. He has no executive experience, and based on some of his statements (and positions), I’m convinced he’s just not very smart.

Not only that, but he is the most arrogant candidate in a field that may contain Chris Christie, and that’s incredible.

Nonetheless, his filibuster-like Senate speech against National Security Agency counter-terrorism surveillance, forcing key portions of the Patriot Act to expire, was a brave, principled, and important act. In the end it was also a futile act, and the Senate quickly passed provisions that Paul opposed. The Daily Beast headlined the story, “It’s NSA 1, Rand Paul 0.”

It was still a public service. Yes, Paul alienated most of his party, and he took a huge risk: a single terrorist attack here will automatically turn him into a national pariah, and coming the same week that we discovered conclusively that the TSA is a joke, the chances of such an event occurring seem likelier than ever. (Saying, however, as Paul did, that “people here in town …secretly want there to be an attack on the United States so they can blame it on me” was inexcusably stupid. Really? People want to see American citizens die to make Rand Paul look bad, when he makes himself look bad on a regular basis?) The point Paul made, however, and it needs to be made again, and again, and again, is that there is no reason to trust the NSA, and no reason to trust the current federal government either. The fact that on security matters we have no real choice is frightening and disheartening, but nevertheless, no American should be comfortable with his or her private communications, activities and other personal matters being tracked by the NSA, which is incompetent (See: Snowden, Edward) and which lies, or the Obama Administration, which doesn’t care if the NSA lies, and has repeatedly shown that it has no qualms about violating the Constitution until a Court stops it. Republicans need a lot of things. Their own Harry Reid—and thus their own smug, unethical, Machiavellian liar who thinks deliberately misleading the public is justified if it helps win the day—isn’t one of them. Nevertheless, the brilliant RNC scientists at its top secret Bio-ideological Warfare facilities in a bunker under Pike’s Peak have apparently made one. (And maybe many...)

Remember the name Colin Reed (they cleverly changed the spelling to hide the fact that he was cloned from Harry’s nose hair clippings), and then forget anything you hear from his conservative opposition research hit-group America Rising. What good is an opposition research hit-group that can’t be trusted to be fair and accurate about what it finds? None, unless you favor slander and cheating. You know..like Harry.

This week, Reed’s Breitbart wannabe released a video that purported to show Hillary Clinton blowing off a supporter who asked for an autograph while she campaigned in New Hampshire. Conservative Hillary-Haters immediately went into overdrive, led by Reed himself (“Maybe these New Hampshire voters would have better luck getting Secretary Clinton’s attention if they wrote a six-figure check to the Clinton Foundation or were a highly-vetted political activist at one of her staged campaign events,” he said.) as the clip went viral. The problem was that the video was deliberately edited to omit Clinton’s actually signing the autograph as the woman beamed and took a photo. Continue reading →

Victims, Victimizers, and Hypocrites: The Dennis Hastert Affair

Former Speaker of the House Dennis Hastert, the longest serving GOP Speaker in history, has been indicted for lying to the FBI and elaborately evading reporting requirements on large cash withdrawals for payments he allegedly made to a male former student whom Hastert sexually abused while he was a high school wrestling coach over 30 years ago. Ethics observations:

1. This is a personal and professional tragedy, no matter what else may be true. Hastert has a family, and once had a career and a relatively solid reputation. The family is still there, though wounded; the rest is gone, presumably forever.

2. Assuming that what is coming out as the reason Hastert was paying millions in hush money is in fact true, he abused his position of trust as a teacher and committed a heinous crime. Nothing that he did subsequently as a public servant, or endured as a consequence of his actions, mitigates the seriousness of that misconduct. Continue reading →

Cover-up: Successful

Somebody tell Rep. Gowdy that his committee’s investigation is futile. The news media and the public just don’t mind being lied to any more.

From USA Today:

One day after the deadly Sept. 11, 2012, attack on the U.S. compound in Benghazi, Libya, the Defense Intelligence Agency concluded the assault had been planned 10 days earlier by an al-Qaeda affiliate, according to documents released Monday by conservative watchdog group Judicial Watch. “The attack on the American consulate in Benghazi was planned and executed by The Brigades of the Captive Omar Abdul Rahman,” said a preliminary intelligence report by the Defense Intelligence Agency, obtained through a lawsuit following a Freedom of Information Act request.

Wait…I thought that Hillary Clinton, State, President Obama and Susan Rice were all laboring under the misconception that the attack was spontaneous and prompted by a YouTube video, and the claims that the Obama Administration was stalling the revelations of what they already knew so Mitt Romney couldn’t challenge Obama’s carefully manufactured narrative that he had terrorism on the run were just partisan sour grapes. That’s been the spin the liberal press has been accepting from the White House for over two years.

What’s going on here? Well, the “narrative” carefully shifted away from the most transparent administration in history lying to the American public to excessive Republican claims that the outpost wasn’t given proper security, wasn’t rescued when it could have been, was the product of criminal incompetence. As soon as those accusations failed, Democrats and the news media promptly adopted the official Obama line: Benghazi was a “nothingburger,” in the contemptuous words of Washington Post columnist Dana Milbank. It was a manufactured scandal of no substance designed to discredit Hillary Clinton.

But no evidence proved that Obama, Clinton and Rice weren’t lying about the attacks being spontaneous and not organized terrorism, and all the evidence has demonstrated the contrary, with this latest piece of the puzzle simply filling in some of the blanks. Of course, the latest story wasn’t even covered by most of the mainstream media; I was shocked to see it in USA Today. Judicial Watch is a conservative organization, you see. To be fair, it’s a whack job conservative organization. That means it could legitimately discover cold fusion and the news media wouldn’t pay attention.

Maybe it isn’t news. After all, the Obama cover-up worked. As Harry Reid said, after admitting his part in the organized effort to make sure that the 2012 Presidential elections was based as much on smears, lies and slight of hand as real issues, “Romney lost, didn’t he?” Hillary’s famous dismissal of the issue in the Benghazi hearings was on the mark: “What difference, at this point, does it make?” Continue reading →

Integrity Fail: Republicans Pass An Anti-Abortion Bill, Thus Undermining Their Argument Against Unconstitutional Overreach By Democrats

I bet this guy is a Republican.

The bill the Republicans in the House just passed to ban abortions after 20 weeks undermines every argument the party has made against the abuse of the Constitution’s Commerce Clause to allow the federal government to meddle in state matters. One’s position on abortion isn’t relevant to the ethics and law here: I agree whole-heartedly with the ban in principle.

Abortion isn’t commerce, however. For decades, the Commerce Clause’s provision giving Congress the power to “regulate commerce . . . among the several states” has been stretched beyond all reason and the limits of language by Democratic majorities. It has been conservative legislators, scholars and pundits who have screamed about it. Indeed, this was the primary basis for the attack on Obamacare in the Supreme Court case NFIB v. Sebelius, and the majority did find that the so-called “individual mandate” exceeded Congress’s Commerce Clause limitations.

The abuse of the Commerce Clause has been the primary means by which the Founders’ intentional restraints on federal government power over the states and individuals have been circumvented by big government advocates. Some of the measures that were ingeniously slipped by the Commerce Clause using dubious justifications have been necessary and beneficial, like Federal laws against discrimination. Those measures, however, greased an ever-slipperier slope that has made the Clause a virtual nullity.

Supposedly, Republicans believed that it was important to start taking the Constitutional limits on Congressional power seriously again, because the alternative would be a Congressional dictatorship over the states. Now we know that the Republicans are just as willing to trample the Commerce Clause as Democrats are, as long as their pet social issues are being served. Continue reading →

Be vigilant, Governor! Next, Obama will be coming after your precious bodily fluids…

I was preparing to comment on Texas Governor Greg Abbott’s absurd, embarrassing and recklessly divisive action of calling on the State Guard to monitor a U.S. military training exercise in the state juuuuust in case that sneaky, fake American Commie dictator Barack Obama is getting ready to put the Lone Star State under bayonet and martial law, as some local wackadoodles are claiming from under their ten gallon tin-foil hats. I decided that it was too obviously stupid to criticize before I read the approving comments by unhinged Texans on the governor’s Facebook post announcing the order.

It received more than 25,000 likes and thousands of comments. Among them (My reactions in bold):

“Thank you, Mr. Abbott, but I doubt they listen to you or anyone, Obama will soon demand Marshall law, We need to keep them totally out of Texas. The devil is breathing down our necks right now. Everyone better pray.” Now Marshall law, I have no problem with…

“Here comes Martial law Folks… get ready! ALL Texans need to be armed. It’s our right! I pray our Military will do what’s right! Not want the Commander and chief ( and I use that term loosely) wants them to do! STAND UP AMERICA… IF we don’t GOD HELP US ALL! If you look at the map that was posted.. Texas is listed as a hostile state, along with other repub. states!” THEY’RE HERE! THEY’RE HERE!!!! Oh, wait, I was thinking of “Invasion of the Body Snatchers”…

Thank you sir I have no trust in our current goverment. Your actions on a day to day basis are giving me hope for our state goverment. If that’s how you’re spelling “government,” I have no hope at all…

Congress’s Ongoing Insider Trading Scandal

The best I can figure is that when the exposure of outrageous corruption will devastate power politicians in both parties, neither party, nor their partisan herds, nor their lackey journalist allies, see it as advantageous to look under that rock. Does anyone have a better theory? Because the fact that almost all Senators and members of Congress, and often their staffs, enrich themselves using their knowledge of what laws are about to be passed, and the fact not only is nothing being done about it, but that most of the public doesn’t even know about it and no one is working very hard to tell them, is maddening.

The latest chapter is typical of the hypocrisy and dishonesty in this long-running ethics fiasco.

In 2012, Congress passed the STOCK Act, a bill that was supposed to stop insider trading for lawmakers and their staffs. Of course, the laws making insider trading illegal should have already stopped the practice, and the ethics rules prohibited it as well with such phrases as “conflicts of interest” and “appearance of impropriety.” Lawmakers aren’t supposed to break laws, you see. No, really. They’re not!

“Negative Polarization,” Bigotry, And Hillary

Today in the Times, last week, and over the weekend, there were numerous essays (like this one, this and this) about a recent study that examined the growing phenomenon I have previously written about here and here. The paper’s authors, Alan Abramowitz and Steven Webster, use the term “negative polarization,” but what they are describing is really a kind of bigotry, citizens making important democratic decisions purely on the basis of conditioned hatred and dislike based on gross generalizations about political parties and their supporters rather than dispassionate analysis and independent consideration.

Their conclusion isn’t original; it’s not even surprising. It closely follows last year’s study out of Stanford reaching the same conclusion. Americans increasingly demonize one party or the other and all their representatives and members, thus automatically rejecting policy initiatives, arguments and positions not because of their content, but based on their origins and the identity of their supporters—pure, blind cognitive dissonance. As a result, they will choose candidates and policies irrespective of any rational analysis, based solely on the assumption that the opposing candidate and policy come from a vile and intolerable source.

These studies indicate that Americans now discriminate more on the basis of party than on race, gender or any of the other great divides— and that discrimination extends beyond politics into personal relationships and non-political associations. Americans increasingly live in neighborhoods with like-minded partisans, date and marry fellow partisans and disapprove of their children partying with members of the other party. They are, the data says, more likely to choose partners based on partisanship than physical beauty or personality.

The Stanford study concludes (the Emory study concludes similarly),

“Unlike race, gender and other social divides where group-related attitudes and behaviors are constrained by social norms, there are no corresponding pressures to temper disapproval of political opponents. If anything, the rhetoric and actions of political leaders demonstrate that hostility directed at the opposition is acceptable, even appropriate. Partisans therefore feel free to express animus and engage in discriminatory behavior toward opposing partisans.”

Naturally, this has set off the usual round of finger-pointing by pundits and the media, which itself shares much of the blame. I know who and what have seeded these dragon’s teeth, and the list is long, beginning with Rush Limbaugh, Mark Levine, Bill Press, the Clintons, Lanny Davis, Matt Lauer, Newt Gingrich, Tom Delay, the idiots who made out Florida’s 2000 ballot, Al Gore, George W. Bush, Dick Cheney, Karl Rove, Paul Begala, Jerry Falwell, Mary Matalin, James Carville, David Axelrod, Chris Matthews, Ted Cruz, the Congressional Black Caucus, Fox News, Donald Trump, Truthers, Birthers, Barack Obama, Joe Biden, MSNBC, Roger Ailes, Rupert Murdoch, Eric Holder, the New York Times editorial board, Charles Blow, the Daily Kos, David Brock and Media Matters, Move-On, Breitbart, Michael Moore, Al Sharpton, Pat Robertson, Harry Reid, Tom DeLay, Nancy Pelosi, the Tea Party, Michael Savage, Salon, Sean Hannity, Sarah Palin, Ann Coulter, Stephen Colbert, Jon Stewart, and many others, a majority of whom made a conscious decision to exacerbate the divisions in our nation for their own gains in power, influence and wealth. Unethical Quote Of The Week: Ohio Governor John Kasich

“[T]he most important thing is, what does the Lord want me to do with my life?”

—Potential GOP Presidential candidate John Kasich, Governor of Ohio, explaining what considerations will determine whether or not he enters the race.

“Governor? It’s for you.”

There is so much wrong with Kasich saying this that the only question now is whether it disqualifies him for elected office.

I guess that’s excessive, though. In a political culture in which Hillary Clinton is considered qualified to be President, almost no one can be truly disqualified. Anything goes, as long as you are wearing the right team colors.

If the Founders knew their democracy would come to this, I think they would have decided to just submit to King George’s tyranny.

Kasich is a skilled governor, just as he was an outstanding House member in a crowd of Republican embarrassments during the Bush years. Then he tried being a talking head for Fox, and had the integrity to quit in disgust. He seemed to have the qualities necessary to elevate the Republican presidential field.

Guess not:

1. He is pandering. The GOP evangelicals and religious right have a lot of power and influence, and they are the only ones who could possibly take Kasich’s statement seriously. “Ah!” they will say, or so Kasich’s shameless advisors have convinced him, “He’s one of us! He believes that weather disasters are visted upon us because of America’s sins! He believes that women belong barefoot and pregnant, that Adam was ducking dinosaurs, that school prayer will cure our ills…that good people ought to be able to shun and exclude the sinful by refusing to sell them services that they provide to everyone else, and that homos are the spawn of Satan.” The statement that Kasich is dictated to by God hints that he thinks a theocracy is hunky-dory. Hey, look at Iran!

2. He is lying. Or he is deranged.

3. The belief that God is likely to choose you as a leader of the most powerful nation on earth is so devoid of humility and so unfair to and disrespectful of the democratic process that it boggles the mind.

4. It avoids personal accountability.

5. The statement is a declaration of incompetence and fecklessness. What other decisions will President Kasich place in God’s hands, or blame on Him when they turn out to be duds?

6. Waiting for God to declare the right course is an intentional abdication of ethics for the moral direction on others, or, if you prefer, Others.

God made you say that, John, so you would not be President. You have your answer.

Tom Delay, Ethics Dunce Emeritus

I know, I know…it’s mean to use the mug shot. Good.

I am grateful to ex-Republican House Leader and former Texas Rep. Tom Delay for putting himself back in the news with a quote remarkable for its ignorance, hatefulness, and corrupting potential. There are many reasons:

1. It provides a little perspective for Republicans who are excessively smug about the unethical depths to which the Democratic leaders, Harry Reid and Nancy Pelosi, will sink. Yes, they are ethically atrocious. DeLay, however, was as powerful as either of them for a very long time and was a major power in causing the Bush years to collapse in a smelly pile of corruption. The fact that the Republican Party would follow such a man is easily as damning as Democrats tolerating Reid and Pelosi.

2. It gives me the opportunity to name Tom Ethics Alarms’ second Ethics Dunce Emeritus. The first was Bill Clinton. Tom Delay makes Bill Clinton look like Atticus Finch. Think about that.

3. I miss pointing out how despicable Tom DeLay is. On Ethics Alarm’s predecessor, The Ethics Scoreboard, he was worth a post on a regular basis.

4. His statement is so ridiculous that it is bound to make thoughtful people wonder if they should be agreeing with the man, and reexamine their current anti-gay positions critically.
