Morning Ethics Warm-Up, 6/21/18: Assholes, Frauds, And Hypocrites

Good morning!

1. “A Nation of Assholes” Update: A congressional intern, can be heard yelling, “Mr. President, fuck you!” at President Trump this week as he arrived at the Capitol for a meeting with Republican lawmakers, as heard in a video clip recorded by NBC’s Frank Thorp. Nice.  This is what “the resistance” and allied Democrats—and Robert De Niro, Samantha Bee, Stephen Colbert and the rest, like Peter Fonda, Jane’s younger, less talented brother, who tweeted, “We should rip Barron Trump from his mother’s arms and put him in a cage with pedophiles and see if mother will stand up against the massive giant asshole she is married to”— have produced. Hold them accountable. Hold the members of Congress who employs her responsible too: she obviously is reflecting the attitude she absorbs in the office all day long.

As that 2015 post makes clear, making someone like Trump our leader, and thus our culture’s ethics role model—yes, that’s how leadership works—does lead to this kind of disgusting, divisive and un-American conduct. However, it doesn’t justify those who sink this low. She must be identified and fired. Those rationalizing her outburst should be rebuked, just as those who tried to justify Rep. Joe Wilson’s unforgivable “You lie!” during an Obama State of the Union address should have been rebuked.

Besides, after she is fired, MSNBC will probably give her a show.

2. You know, such incidents are making it hard for me to maintain my ethical objections to boycotts. Department of Homeland Security Secretary Kirstjen Nielsen was having a working dinner at Cocina Mexicana, a popular Mexican restaurant in Washington, DC.  Protesters from the Metro DC Democratic Socialists of America entered the restaurant and began harassing her, based on the controversy over the handling of illegal immigrant families at the Mexican border. You can read their content-free chants here; the only one that interests me is “”No borders! No walls! Sanctuary for all!”, which is signature significance for a lawless, ignorant fool. She had to leave after about ten minutes.

Why were the protesters allowed to enter the restaurant and interfere with a customer’s meal? It doesn’t matter who the diner is: the establishments duty to is treat guests as guests while they are in the establishment. Has Cocina Mexicana apologized to Nielsen? It doesn’t matter, really: that kind of abuse should not be permitted even once. Are we now going to have establishments segregated by ethnicity and sympathy for open borders?

Women Of America: PLEASE Don’t Make Me An Anti-Feminist By Talking Like Anti-Male Bigots!

Apparently we can’t have mutual respect, equality, fairness and opportunity. There has to be a boot on someone’s throat, hate, envy, anger, payback, pecking orders, groveling and discrimination. The inevitable result of all that is backlash, and when it comes, it’s earned.

The most recent wretched example of this discouraging state of the culture is the escalation of anti-male, feminist chauvinism, though the trend has been building for a long time. Hillary Clinton’s primary argument for electing her President was that she had two X chromosomes, and anything else was a bonus. Long before that, Christiane Amanpour led a despicably sexist panel one memorable Sunday morning  in which she and three other women discussed how women are obviously better than men when it comes to leadership, management, decision-making, and conflict resolution.

Mid-Day Ethics Refreshment, 6/12/2018: “Ethics Isn’t A Horse Race, It’s A Marathon” Edition

Good afternoon…

1. Culture rot symptoms. Once upon a time it would have been unthinkable and shameful for the owner of a losing horse in a Triple Crown race to claim that dirty tactics have affected the outcome. That, however, was before the loser of the 2016 Presidential election did the equivalent sour grapes act, loudly and continuously. This is how important cultural ethics norms fall off in chunks.

Justify becoming the only undefeated Triple Crown champion after Seattle Slew as he won the Belmont Stakes was immediately smeared  by Mike Repole, co-owner of fourth-place Vino Rosso and last-place Noble Indy. He didn’t claim Russian collusion, just equine collusion.

“Justify is a super horse. He is a Triple Crown winner and he’s undefeated,” said Repole “But I can see the stewards looking into this over the next couple of days. I probably expect them to look into reckless riding by Florent and bring him in to question him about what he was thinking and what his tactics were.”  He accused jockey Florent Geroux of riding Restoring Hope, Justify’s stablemate, to clear the way for Justify to win the race.

“It definitely seemed to me [Restoring Hope] was more of an offensive lineman than a racehorse trying to win the Belmont,” Repole told reporters, “and Justify was a running back trying to run for a touchdown.” Nice. the complaint instantly became the main story of the race, before Justify’s jockey and owners were able to bask in the rare accomplishment for a day or two. Ironically, Repole’s own Vino Rosso was assisted by similar “lineman” tactics by another horse, Noble Indy, like Vino Rosso trained by Todd Pletcher. Concludes racing expert Pat Forde,  “It’s almost certainly why Noble Indy was entered. Basically, Pletcher’s two-horse racing tactic simply ran up against a better two-horse racing tactic.”

And the tactic is legal. Never mind. Graceful losing is on the way out, thanks to our politicians.

2. He gets it, and he doesn’t even read Ethics Alarms! The Ethiopian cabbie who drove me home from the morning mandatory legal ethics seminar that I teach every month for newly-minted D.C. lawyers spent that first half of the trip complaining about President Trump. Then he said, “Now, I didn’t vote for him, but I respect him. I respect him because he is the President of my country, and my fellow citizens elected him. I can complain about him to you, because you are an American too. If a foreigner gets in my cab, however, and starts insulting the President, I pull over and order him out.” Continue reading →

Morning Ethics Warm-Up, 6/8/18: Breaking Radio Silence

Adventures in Woburn, Mass.:

1. The Event. I guess I should have assumed that some commenting here would go on yesterday about the unpleasantness involving an ex-participant here, while that dispute was causing me to lose all of yesterday between travel and court. (I alomot tried to put up a post late last night, but was too fried.) I have little to say on the matter, which is still being considered, except that I did learn some surprising things, such as that

  • …the weakness of the concept of “lawyer-in-all-but-degree” tends to be exposed in court;
  • …being banned from an ethics website is an existential catastrophe, and actionable, according to “lawyers-in-all-but degree”;
  • …having a great poker face is an essential talent for a judge:
  • ….in  lawyer-in-all-but-degree schools, they apparently teach that the position that “judicial misconduct” and “judicial ethics” are essentially the same topic is ridiculous and libelous, and
  • ….playing the part of Van Johnson in “The Caine Mutiny” just isn’t as much fun in real life as it seems to be in the movie, if you get my drift. It’s kind of embarrassing and sad.

2. A airport encounter:  In the airport on the way to Boston and waiting for my flight in an early morning mob, I was anxiously wandering through the crowd when I heard a quiet male vice say, “Nice tie!” It was not obvious who had spoken, but I decided it had to be a young African American airport employee who was helping a traveler in a wheel chair. “Did you just say ‘nice tie’?” I asked him, though he was not looking at me. Then he lit up, said that he had, and got into a long conversation with me about ties. He is a tie aficionado. He has photos of his ties on his cell phone! He loves talking about ties! And thus I connected with a fellow human being in a chance encounter, when he took the step of breaking through the silence and mutual disinterest that increasingly marks the daily interactions of Americans, even neighbors. I also ensured that he would not feel like I was ignoring his existence when he had taken the risk of an unsolicited overture to interact. [Unlike the female jogger I write about here.] Contrary to some of the comments that I received then, I don’t think anything about the chance encounter yesterday should have been different if the participants had been different ages, races, ages, or stations in life. Morning Ethics Warm-Up. 6/5/18: Cakes And Fakes

1. Dummies or Liars? In a comment about yesterday’s 7-2 SCOTUS ruling favoring the Christian cake shop in another baker vs. gay couple controversy, Still Spartan wrote, ” I also don’t want to spend the next few months explaining the ruling to non-lawyer liberals who already are beginning to tear their hair out because they don’t understand the opinion.” Unfortunately, that’s exactly what she will have to do, and the rest of us, as there is already a deliberate effort underway to misrepresent the decision and deceive members of the public too lazy to read Supreme Court opinions, or too under-educated to understand them. (It really isn’t that hard.) This is fear-mongering, and also an effort to undermine the Supreme Court, which can be expected to be blocking a number of left-driven totalitarian measures in the not-too-distant future.

For example, on “The Late Show,” where a disturbingly high percentage of millennials get their news commentary, the smug, insufferable Stephen Colbert described the ruling this way:

“It’s a bad day for gay rights in America. And also for cake rights because this morning, the Supreme Court ruled in favor of a Colorado baker who refused to bake a cake to celebrate the marriage of a same-sex couple. That is tough news. But to lighten the blow the Supreme Court did send the gay couple a lovely cake” which was a cake in the shape of the middle finger.

Hilarious! And a complete misrepresentation of the opinion. The question is, did Colbert and his writers really not understand the ruling? What are the odds that any of them read it? If they didn’t know what the ruling was, isn’t it irresponsible to pass along false information? Or did they know that the opinion in no way undermined the rights of gays to be served in public accommodations like everyone else, but found, and correctly so, that the process was rigged against the baker because of open hostility to religious freedom? If so, the “joke” was deliberate misrepresentation.

The fact that the lie would have been in service of a joke is not a justification. Spreading falsity in public is harmful, and it does not matter who does it, or why.

2. From the “Stop making me defend the New York Yankees!” files:  This is an integrity vs. cash test for Major League Baseball. ESPN announced that it was picking up the Yankees’ one 1 o’clock Sunday, July 8 game with the Blue Jays in Toronto for its 8 p.m. Sunday night Game of the Week. This decision, however, was announced after the Yankees and Orioles players agreed to make up last week’s rained out game as part of a doubleheader on July 9.  As now scheduled, the Yankees will have to play three games in a 24 hour period. The Yankees would probably not leave the ballpark in Toronto until midnight, then have to go through customs, getting into Baltimore at 4 or 5 a.m., into their hotel rooms around 7, and be due at Camden Yards in a few hours.

This is potentially dangerous to the players (baseball is hard to play while asleep), and also undermines the team: the Yankees are expected to be in a neck-and-neck race with the Boston Red Sox for primacy in the American League East, and a single game could be crucial. If the Yankees are forced to play Sunday night on July 8, the Yankee management and players are threatening to retaliate against ESPN by refusing all interviews with ESPN broadcasters. Of course, killing those in-game interviews will only improve the broadcast.

Then the Yankees will claim that the Red Sox were colluding with ESPN, and there will have to be an investigation… Continue reading →

Ethics Observations On The Masterpiece Cake Shop Decision

The Supreme Court ruled today in favor of Jack Phillips, the Christian baker in Colorado who refused to bake a custom wedding cake for a same-sex couple. The Court  found that the Colorado Civil Rights Commission infringed on Phillips’s rights in ruling that he violated the Colorado anti-discrimination law barring merchants from refusing service based on race, sex, marital status, or sexual orientation. The ruling is narrow; it does not empower merchants to deny service based on sexual orientation.  It is based entirely on  the Colorado Civil Rights Commission’s  hostility toward Phillips’s religious views in ruling against him.

Observations:

1. Justices Ruth Bader Ginsburg and Sonia Sotomayor were the only dissenting votes, meaning that the decision was 7-2, and not a “conservative vs liberal” outcome. Even the dissent is based on narrow legal and factual distinctions rather than ideological ones.

2. Read the opinion, and the dissent. Also, if you really want to impress your friends, access the resources available here.

3. These statements from Justice Kennedy’s majority opinion, cited by Justice Ginsberg, help clarify matters in the right legal and ethical direction:

  • “[I]t is a general rule that [religious and philosophical] objections do not allow business owners and other actors in the economy and in society to deny protected persons equal access to goods and services under a neutral and generally applicable public accommodations law.”
  • “Colorado law can protect gay persons, just as it can protect other classes of individuals, in acquiring whatever products and services they choose on the same terms and conditions as are offered to other members of the public.”
  • “[P]urveyors of goods and services who object to gay marriages for moral and religious reasons [may not] put up signs saying ‘no goods or services will be sold if they will be used for gay marriages.’ ”

The ruling could have hardly been less of a ringing endorsement of either “side.”

Morning Ethics Warm-Up, 6/4/2018: 500 Days Edition

Good Morning!

1.  In one respect, it is his fault. The most infuriating defenses of the Samantha Bee cunt-fest may be the rationalizations who pronounce her blameless (and thus Turner/TBS) because President Trump made her do it. (Well, maybe the second most infuriating: CNN fake-ethics commentator Brian Stelter actually referred to the episode in a tweet as the “feckless” controversy. You see, Brian, when your field is journalism ethics, you can’t play deceit games like that, because…oh, why do I bother?). To be fair, however, while Bee and the other potty mouthed resistance members and DNC leaders should be held responsible for their own ugly conduct, electing Donald Trump did give a cultural green light to incivility and assholery.

Since nobody else gives me credit and public recognition when I’m right before most of the chattering class (Ethicists Don’t Matter), I have to do it myself. Here is what I wrote in part on September 10, 2015:

We have elected Presidents without experience, who were narcissists, sociopaths or psychopaths, who were not too bright, who were unjustifiably cocky, who spouted policy nonsense, who had only style without substance, who acted tough, who were the product of marketing rather than talent. Some of them turned out to be pretty good; some of them surprised everyone and changed their ways. None of them wrecked the nation. I am confident that even at this difficult time in our nation’s history, reeling from the serial incompetence of  the Bush and Obama administrations, the United States could survive a Trump Presidency as a nation.

We could not, however, survive it as a culture.

Placing a man with Trump’s personality and his rejection of the basic features of civilized conduct and discourse to an extent that only the obscenely rich or the resolutely misanthropic can get away with would ensure that American culture would deteriorate into a gross, rude, selfish, assault muck in which no rational human being would want to live…

Even if Trump was a policy whiz, a political magician and a foreign policy master who balanced the budget and restored American’s primacy in the world, it would not be worth what would be lost: dignity, fairness, civility, caring, respect.

Morgan Freeman, Cultural Shifts, And The Dirty Old Man’s Dilemma

I wondered how it was that Morgan Freeman, black, progressive, a Barack Obama enthusiast and the owner of a squeaky clean image, was hit with career- and reputation-endangering accusations of “inappropriate conduct” that were on balance far, far less alarming than the borderline or outright criminal offenses claimed by the victims of most of the #MeToo targets. Now we know: Morgan Freeman, then 79 , was interviewed by a young, attractive CNN reporter before the Harvey Weinstein story broke. The actor made creepy, sexually suggestive comments to her, and they bothered her as she continued to consider them during her maternity leave, which began soon after the interview. When she returned, Harvey Weinstein had been exposed, #MeToo was in full swing, and the reporter, Chloe Melas, had a new and unexpected male celebrity to investigate and perhaps take down.

This does not appear to be another example of a vicious abuser whom the Weinstein story allowed to finally meet justice after years of victimizing those who came within his sphere of power. All of the claims against Freeman are garden variety dumb, blundering sexual harassment without malice, almost exclusively by the spoken word. Although the news accounts mention “unwanted touching,” the only description of such touching involves Freeman touching a woman’s skirt and threatening to lift it. There have been no “groping” accusations, at least not yet.

Never mind. The allegations so far have already harmed, probably irreparably, the Academy Award-winning actor’s career. Visa has dropped him as its long-time spokesman. Honors he has received are being reconsidered. More penalties are sure to come.

Freeman issued a clumsy, non-apology apology, saying,

“Anyone who knows me or has worked with me knows I am not someone who would intentionally offend or knowingly make anyone feel uneasy. I apologize to anyone who felt uncomfortable or disrespected — that was never my intent.”

It’s a poor apology, but I believe him. He never intended to make anyone uncomfortable, and it didn’t occur to him that any woman would make a big deal out of being—from his perspective—flirted with, even naughtily, by a very old man and iconic movie star. In this, he falls not in the ugly Cosby, Harvey, Kevin, Matt and Charlie category but into the sadder George H.W. Bush class, which I will call “The Dirty Old Men Division.” Continue reading →

Ethical Quote Of The Month: Sarah Palin

“I attribute a lot of what we’re hearing and reading regarding McCain’s statements to his ghostwriter or ghostwriters. I don’t know all the details of his condition right now. It happens to me also where people speak for me and a bell is rung, and you can’t un-ring the bell. I don’t know unless I heard it from Sen. McCain myself…In spite of everything that has erupted in these past days with his spokesperson – or perhaps he himself – saying that he regrets that they chose me to run on their ticket—despite all that, he has been my friend.”

—Sarah Palin, responding in an interview to the statement in Senator McCain’s new book that he regrets choosing her as his 2008 running mate.

As discussed in an earlier post, the ailing Senator’s slap at Palin was unfair, cruel and gratuitous. I cannot imagine a more restrained and gracious response than Palin’s, under the circumstances.

Comment Of The Day: “A Particularly Sad Ethics Dunce: Senator John McCain”

I am bumping Steve-O-in-NJ’s reaction to the depressing drama of Senator John McCain spending his last days in anger and bitterness up in the queue of  pending Comments of the Day, which is long right now. The reason is that his analysis fits neatly into a post I was about to write, but will summarize here as a preface.

The impulse to defend McCain’s recent conduct, notably disinviting President Trump from his funeral in advance, is one more in a long line of signature significance moments, definitively identifying late stage sufferers of anti Trump hysteria. (Trump Derangement Syndrome just isn’t an accurate diagnosis, because it suggests equivalence with the more unhinged critics of Presidents Clinton, Bush and Obama. There is no comparison. It is like comparing a bad cold to the bubonic plague.) The grotesque theater of a public figure choosing, rather than to end his life with grace, forgiveness and unifying good will, choosing to emulate the mad Ahab, screaming,

“To the last I grapple with thee; from hell’s heart I stab at thee; for hate’s sake I spit my last breath at thee!”

He has gone full-Ahab. You never go full Ahab. But because the equally mad haters of the elected President relish the thought of any insult, attack or indignity hurled Trump’s way, the can’t perceive the obvious. Defending McCain’s prospective snub is as clear a symptom of anti-Trump hysteria as a dog recoiling from water signals rabies.

My usual course is to make an ethics analysis and then check the opinions of analysts who I trust as generally fair and perceptive. Here was Ann Althouse’s take, in part:

It’s very strange — these statements coming from a dying man about what he wants at his funeral. I can’t remember ever hearing anyone talking about his own funeral with the assumption the President of the United States wants to attend and then taking a shot at the President saying don’t attend. I mean, how do you get to be the sort of person who, facing death, imagines everyone clamoring to attend your funeral and then telling some of them you don’t want them there? It’s similar to a Bridezilla, thinking everyone’s so interested in attending her wedding and then being dictatorial toward these people.

I don’t understand it…good Lord! What would possess you to think your funeral is going to be such a hot ticket people will be put out if they can’t attend and then letting it be known who you want on the outs?

I’d like to see more dignity and privacy around McCain as he plays his final scene. It’s his brain that is wrecking him. Shouldn’t his family enclose him and protect him?

Those who respect and care about McCain want him to stop.
