KABOOM! So It Has Come To This: The Book-Of-The-Month TV Commercial

We have discussed here the increasingly common phenomenon of companies building their TV ads on the juvenile gag of suggesting a vulgar, obscene or rude word, or a topic not discussed publicly in polite society but not really saying what is clearly implied.

Kraft Heinz Company advertised its products with a TV ad in which a boss caught  his employee becoming sexually aroused by his lunch, with the tagline: “Food You Want to Fork.” Get it? HAR! Heineken featured a gay-themed beer ad about “flipping another man’s meat”–“Huh? It’s just barbecue! You must have a dirty mind!.” Wonderful Pistachios uses “nuts” as sexual innuendo, Booking.com uses “booking” in phrases suggesting “fucking,” and K-Mart uses “ship” to suggest “shit.” Reese’s Peanut Butter Cups has run commercial featuring the tags Women want like to make it last…Men are done in seconds…Typical.”  Last year, Volkswagen had Dean Martin crooning about “The Birds and the Bees”  while we see a VW bouncing up and down as the couples within engage in vigorous sexual intercourse, unless they are tying to use pogo sticks.

Ethics Hero: Lord Michael Bates

Lord Michael Bates, Britain’s international development minister, was set to answer questions before the British House of Lords on yesterday, but arrived to the session a few minutes late for his scheduled Q and A session. When it concluded, Lord Bates rushed  up to the lectern,  and said,

“It’s been my privilege to answer questions from this despatch box on behalf of the government. I’ve always believed we should rise to the highest possible standards of courtesy and respect in responding on behalf of the government to the legitimate questions of the legislature. I’m thoroughly ashamed of not being in my place and therefore I shall be offering my resignation to the prime minister with immediate effect.”

With that, he walked out of the chamber .

Bravo. Promptness and punctuality demonstrates respect for one’s colleagues and professional duties, and holding oneself to the highest standards of conduct is the epitome of ethical public service.

Afterwards, a spokesman for the Prime Minister said:

“With typical sincerity, Lord Bates today offered to tender his resignation, but his resignation was refused as it was judged this was unnecessary.As a hard-working and diligent minister, it is typical of his approach that he takes his responsibilities to Parliament so seriously. He has received support from across the House and we are pleased he has decided to continue in his important roles at the Department for International Development and HM Treasury.”

Dear Lord Bates: please come to America and run for Congress, They need you. We need you.

 

Ethics Dunce: Logan Paul

I was blissfully unaware of the existence of Logan Paul until this morning. He’s a unique creation of the cyber-age, a 22-year-old college drop-out whose occupation is “social media entertainer.” He makes daily videos–“vlogs”—that he posts on his YouTube channel. It has 15 million followers, along with his hundreds of thousands of others across social media, and is regarded as major cultural force, for what, I have no clue. He is, of course, rich.

In pursuit of more followers and cash, he posted a video, since  removed from YouTube available elsewhere online, that features a dead young man, lying in a Japanese forest known as the “Suicide Forest,” which lies at the base of Mount Fuji. Paul began by telling his YouTube fans,

“This definitely marks a moment in YouTube history Because I’m pretty sure that this has never hopefully happened to anyone on YouTube ever. Now with that said, buckle up!”

With that titillating intro, Paul described the reputation of the Aokigahara Forest at the base of Mount Fuji. It is a popular site for distraught Japanese to end their lives, and is thus known as “the Suicide Forest.”  Locals also say the forest is haunted, another exiting feature that Paul and his companions hyped as they walked along. Then they come across the dead body. The video blurred his face. “Yo, are you alive?” Paul shouted at the dead man. As a camera zoomed in, Paul described the body’s condition, and speculated that the death was recent.

After making the obligatory observation that depression and mental illness are not a joke, Paul’s group left the scene and he began joking, with the mugging and giggling his fans are accustomed to seeing on his vlogs. At the end of the video he encountered a young fan and told him, smirking and pointing the way, “I have one piece of advice. Don’t go over there!”

And yes, he was wearing that hat (above) the whole time.

 The video was posted over the weekend, and did not receive the desired response. Many expressed horror that a young man’s body would be used a a prop, and that Paul would be cavalier about mental illness, depression and suicide. Now the Cyber Furies are after him, and threatening to turn him from web star into a web pariah. Continue reading

A single line in this morning’s  Warm-Up sparked this fascinating exposition by Ash. Here was the context:

Jay Malsky, an actor who has appeared in drag as Hillary Clinton. Melsky, while watching  the Hall of Presidents attraction at Disney World, began shouting at the audio-animatronic Donald Trump. (The Huffington Post said he “mercilessly” heckled the robot, showing  derangement of its own. Robots don’t need mercy, and you can’t “heckle” one either.)

Here is Ash’s Comment of the Day, primarily a quote but a perfectly chosen one, on the post, Morning Ethics Warm-Up, 12/30/2017: Is Robert Mueller Biased? Are The Patriots Cheating Again? Is Larry Tribe Deranged? Is President Trump A Robot?:

You should date this and file it, because I guarantee you, the way you treat Siri and Alexa and Cortana and Ok Google is *already* being described as problematic.

It’s A Comment Of The Day Weekend! First Up…Comment Of The Day (3): “An Ethics Alarms Holiday Challenge! Identify The Rationalizations, Logical Fallacies, Falsehoods And Outright Errors In This Essay…” AND, In Related News, Another Bakery Gets Slammed In Oregon

I’m not exaggerating: I have at least four Comments of the Day stacked up on the Ethics alarms runway after this one, and there are usually COTDs arriving on Saturdays. I can’t promise to get all of them up today, especially since I’m hacking away at the 2017 Ethics Alarms Awards, and this is a long working weekend at ProEthics. Still, I will get a lot of them to you, and it’s a provocative group, as you will soon see.

But first, a prelude and some context.

An Oregon appellate court this week upheld a ruling against the owners of the since-closed Sweetcakes by Melissa,  Aaron and Melissa Klein, forcing them to pay emotional-distress damages of $135,000 to Rachel and Laurel Bowman-Cryer, a lesbian couple for whom they refused to design and sell a wedding cake almost five years ago. The Klein’s argued that state Labor Commissioner Brad Avakian violated state and federal laws and their rights as artists to free speech, their rights to religious freedom and their rights as defendants to  due process.

The Oregon court ruled that the Kleins’ argument that their cakes entail an artistic expression is “entitled to be taken seriously,” but it’s not enough for the couple to assert their cakes are pieces of art:

“Although we accept that the Kleins imbue each wedding cake with their own aesthetic choices, they have made no showing that other people will necessarily experience any wedding cake that the Kleins create predominantly as ‘expression’ rather than as food.”

This mess commenced  when Rachel Bowman-Cryer went to the suburban Portland bakery with her mother in January of 2013. When Aaron Klein was told that the wedding did not involve a male partner,  he said that the bakery did not make cakes for same-sex weddings. They left, but soon the mother returned to argue with Klein as Rachel sat in the car, weeping. her mother went in to speak with Klein. The mother told Klein she had once thought like him, but having two gay children forced her to see the error of her ways.  Klein retorted with Leviticus: “You shall not lie with a male as one lies with a female; it is an abomination.”

The complaint and action by Oregon’s Bureau of Labor and Industries followed. You can read the opinion here.

Ethics Quote Of The Week: Peggy Noonan

“Why does all this matter? Because we are losing history. It is not the fault of Hollywood, as they used to call it, but Hollywood is a contributor to it. When people care enough about history to study and read it, it’s a small sin to lie and mislead in dramas. But when people get their history through entertainment, when they absorb the story of their times only through screens, then the tendency to fabricate is more damaging. Those who make movies and television dramas should start caring about this. It is wrong in an age of lies to add to their sum total. It’s not right. It will do harm.”

—-Former Reagan speechwriter and current columnist Peggy Noonan, after citing the material historical misrepresentations in the Netflix series “The Crown” and the new Spielberg film, “The Post.”

I have written about the ethics of misrepresenting history in films many times, always facing the “Lighten up! It’s just a movie!” chorus. As Noonan explains deftly, the stakes are different now, in an age of rotten public education, mass media and internet indoctrination. The first time I wrote about this issue was 2010, in the post “Titanic” Ethics. It concluded in part,

I don’t blame Cameron for not basing his portrayal on evidence that only was clarified years after his film. I fault him for discounting the testimony of survivors, and misinforming the public by plastering a false version on a giant screen for millions to see, knowing that they would trust that a man who would insist that the doomed ship’s china pattern was accurate…Now the film is back, bigger than ever, and false representations of Officer Murdock, “Unsinkable” Molly Brown, the sinking itself, and other aspects of the iconic event will be embedded even deeper into our historical understanding. It didn’t have to be that way, and it is wrong that it is. History, the public, and the 1500 who died that night in 1912 deserve better.

I’ve seen “The Crown,” and like it a lot. The portrayals that Noonan complains about, however, especially the suggestion that Jack Kennedy abused Jackie, rang false immediately. From The “UGH! Will They EVER Stop Making Me Defend President Trump?” Files: The Kennedy Center Honors Double-Bind

I really, really wanted to bury this one in the Morning Warm-Up. I’m thoroughly sick of writing about the dishonest manipulation of facts and principle used to attack President Trump every day, many times, in the mainstream news media. I am sick of pointing out how unprofessional the Trump-hating publications are that uncritically publish screeds that they would never accept as meeting basic standards of ethical journalism if it weren’t for the identity their target: this President of the United States. I’m also sick of readding proyests from readers trying to rationalize such miserabl ejournalism and punditry. I know readers are sick of all of this too, but the important point is that gullible members of the public and partisan journalists are not sick of the tactic, or ready to play it straight.  They are counting on those who care about fairness, process and truth to give up before they do.

Well, they will wait a long time for me, especially when they publish opinion pieces as bad—misleading, unfair, and unethical— as this one, by playwright Sarah Ruhl.

Ruhl criticizes the President in inflammatory terms for not attending the Kennedy Center Honors ceremony as its host. The White House announced in August that the Trumps would not participate in the December 3 event in Washington, D.C. to avoid “political distraction.” “The president and first lady have decided not to participate in this year’s activities to allow the honorees to celebrate without any political distraction,”  Sarah Sanders said in a statement, adding that the president and Melania Trump “extend their sincerest congratulations and well wishes to all of this year’s award recipients for their many accomplishments.”

Ruhl criticizes the decision in the most inflammatory terms:

“In dictatorships, the artists are often the first to go. Or maybe they are the third to go, after the press and the intellectuals. The refusal of the president to celebrate them is a chilling and clear departure from American values. Perhaps the Trumps didn’t want to compete with the Obamas, who at the 2016 Kennedy Center awards received the longest standing ovation of the evening.”

What unbelievable gall!  Nowhere in Ruhl’s piece, which unflatteringly compares Trump to previous Presidents who attended the gala, does she mention a material fact. Did you catch the omission? Do you think Times readers and the people who are being primed to detest the President did?

The announcement that the Trumps would not be attending came only after honoree Norman Lear, creator of “All in the Family,” “Maude” and “Sanford and Son,”—and also of the ultra-left advocacy group People for the American Way—said that he would boycott the White House reception in protest of the President’s proposed funding cuts to the National Endowment for the Arts and the National Endowment for the Humanities. His fellow 2017 honorees musician Lionel Ritchie and singer Gloria Estefan also hinted that they were considering making a snub of their host a centerpiece of the event. Continue reading

The Christmas Asshole, Neil DeGrasse Tyson

“Merry Christmas to the world’s 2.5 billion Christians. And to the remaining 5 billion people, including Muslims Atheists Hindus Buddhists Animists & Jews, Happy Monday.”

What would justify a public figure tweeting that kind of arrogant, hostile, belittling message  at his fellow citizens  on Christmas Eve?

Nothing.

This was one of Neil deGrasse Tyson’s tweets yesterday. I’m sure the nation’s most prominent and least deserving pop intellectual assumed that his many Twitter followers who hang on every word of revealed wisdom he utters  would appreciate his giving Christmas the metaphorical back of his hand, which only means this asshole has a lot of asshole followers.

Why do this? It is not as if there is any delusion among Christmas revelers that “billions” of others in the world do not have the pleasure of celebrating the world’s most inclusive and ethical cultural holiday. Tyson’s intent was not to inform, it was to diminish, using a version of the Golden Rationalization: “Everybody does it;” in this case, “More people do it, so what you do instead isn’t as great as you think it is.”

Asshole. Tyson doesn’t have to observe Christmas, and he doesn’t have to absorb the wisdom that Scrooge learned so traumatically, he need not acknowledge an annual ritual in which we are all encouraged to embrace love, peace, generosity, ethics, respect, charity, empathy, selflessness and hope for at least a day, opening the possibility that the enlightenment may last longer, and even a lifetime, as it did for Ebeneezer.  If he had any decency or common courtesy, however, he wouldn’t try to spoil the holiday for anyone else not so blighted. As Richard Fernandez wrote yesterday, deftly exposing the flaw in fatuous efforts among  various sad enclaves of progressives more concerned with triggering some offense with a “Merry Christmas!’ than with the health of society itself, it is helpful to understand

“…Christmas as playing a role analogous to the fictional baseball field in the movie Field of Dreams: not a place or day but a reverie. To paraphrase the famous speech to Ray, when people come to Christmas, …”it’ll be as they’d dipped themselves in magic waters. The memories will be so thick, they’ll have to brush them away from their faces. …  It’s been erased like a blackboard, rebuilt and erased again.” But Christmas has marked the time. Marked the time because, as C.S. Lewis once adventured,  Christmas is not an idealized memory of childhood but of something glimpsed in childhood.

“These things—the beauty, the memory of our own past—are good images of what we really desire; but if they are mistaken for the thing itself they turn into dumb idols, breaking the hearts of their worshipers. For they are not the thing itself; they are only the scent of a flower we have not found, the echo of a tune we have not heard, news from a country we have never yet visited.”

…The effort to erase Christmas will probably fail for no other reason than that it meets a human need that a mechanical bureaucratic day off cannot fulfill. Humanity needs a time to mark the growth and change in the family, an occasion to renew hopes and put aside fears and a chance to remember something we once knew: that everything’s going to be alright in the end. It really will.

Welcome To The Slippery Slope! Fordham’s Coffee Shop Bigotry

A recent episode at Fordham illustrates quite effectively the way American society could unravel as a result of a Supreme Court decision supporting the Masterpeice Cakeshop’s claim that its faith-based objection to same sex marriage should justify restricting service to some customers.

Rodrigue’s Coffee House is an off-campus coffee shop run by a student club at Fordham University.

The shop has a “Safer Space Policy” that reads…

“Rodrigue’s strives to be a safer space on Fordham’s campus. For these reasons, consider the following:

Do not make assumptions about someone’s gender, sexuality, race, class, or experiences. Be aware of your own identity, while being considerate of the personhood of your peers. Be mindful of the ways in which your words and actions impact others. Be aware of the boundaries of other’s space, physical or otherwise, and respect their consent. No racism – No sexism – No homophobia. If you feel that someone has transgressed this policy, we want you to feel comfortable confronting them or approaching a member behind the counter, who is available as a resource to assist you.”

This is Authentic Frontier Gibberish and first degree virtue signalling, and could be fairly translated as “We are pompous and oppressive social justice warriors who are intolerant of the views, statements, or opinions of anyone who does not share our rigid and undeniably correct ideology. We hereby declare our right to ostracize such non-conforming individuals on the basis of what we, in our sole discretion, consider hate speech. Fear us.”

Fordham College Republicans visited the coffee shop wearing MAGA hats. Sure, they did this to provoke a response, knowing what the likely reaction would be, much like a gay couple deliberately asking for a wedding cake at a Christian bakery.  Memorialized in the video above, the president of the club didn’t disappoint, and angrily ordered the College Republicans to leave the premises.

“This is a community standard—you are wearing hats that completely violate safe space policy. You have to take it off or you have to go…I am protecting my customers,” the president said. Note that she was “protecting” his customers from exposure to the thrice-removed (initials, the phrase “Make America Great Again” which is benign on its face, and its association with the Trump campaign) message on a cap.

“We are your customers, we bought something,” one of the young Republicans replied.

“I don’t want people like you supporting this club… no one here wants people like you supporting our club,” the president answered. “I am giving you five minutes….You are threatening the integrity of our club. This is a community standard—you are wearing hats that completely violate safe space policy. You have to take it off or you have to go.”

When one of the students then asked her to explain what she thinks the MAGA hat stands for, to which she shouted, “Fascism, Nazis! You have three minutes.”

Legally, of course, this conduct is distinguishable from the conduct of the same-sex marriage decrying cakeshop owner. There is no law prohibiting a proprietor from behaving like a vile, intolerant, rude, bigoted asshole, just basic standards of decency.  Nor is there a law protecting conservatives from invidious discrimination in public accommodations based on passively displayed political beliefs, although if this kind of thing starts proliferating, there will be.

However, the toxic effects on the culture by the two examples of intolerance and disdain for other citizens and human beings is exactly the same. Each is similarly mean-spirited, each is based on excessive self-righteousness, and each equally harms society, and the nation by elevating tribalism to standard practice. The theory of the coffee shop proprietor, I suppose—that the mere presence of a hat with initials on it is “unsafe” —-is marginally more outrageous and idiotic than the baker’s claim that selling a cake for a wedding he will not attend, is not invited to, that will never impose on his consciousness once the customers walk out the door unless his cake turns out to be poisoned, and that will take place whether he provides the cake or not,  is a burden on his religious faith. Marginally. They both constitute  unethical mistreatment of other human beings who deserve better, and breaches of the Golden Rule. That in both cases the victims of the unethical conduct may have intentionally presented themselves to be abused does not mitigate the abuse.

I might as well state the obvious, that the members of the intolerant club operating the shop are 100% behind the cause of forcing the cakemaker to sell the gay couple a wedding cake, but believe it is fair and just to refuse to sell Republicans a muffin.

Sometimes I am embarrassed that I even have to write a post. This is one of those times.

If higher education is manufacturing future citizens who think and act like the club president running the coffee shop, then higher education is doing the nation more harm than good.

I hate to answer for the baker, so I hope you don’ mind if I respond with how I would answer.

What if I walked into the shop and asked for a wedding cake for no reason at all? Nobody’s getting married; I just want the cake. Is it against his religion to make that style of cake for anything other than weddings?

It would not be against my religion, no.

One thing I want to point out about your line of inquiry here is that you are divorcing the mechanical action of making a cake from the purpose of making a cake. A cake is a cake, and apart from any purpose, it remains a cake with no further meaning than a configuration of confectionery molecules. But the purpose for making the cake defines the context. If you wanted me to bake you a cake so you could bury it in your backyard, I wouldn’t have any religious objections to that, but I would certainly object to having the fruits of my labor just thrown away. Just as I would object if you wanted me to write you a book so could use the pages of the book as toilet paper.

The purpose of making a wedding cake is for it to be displayed and consumed at a wedding. If you aren’t going to use the cake for a wedding, ontologically speaking, could it even be a wedding cake?

Do I have to show him a marriage license?

I wouldn’t require that. My general standpoint would be to take people at their word. That being said, if I knew you and you were known for pranks, were opposed to marriage in general, and nothing I knew about your recent activities hinted at a wedding, I might want some actual proof that a wedding was occurring.

I’m an atheist; will he refuse to acknowledge my marriage because you can’t have marriage without a god? Does only the Christian deity count for a “real” marriage?

Since I’m Catholic, I’ll just toss out what the Catholic Church teaches about marriage. Marriage is universal. Historically, marriage permeates pretty much every culture. Marriage is an institution that has, for the most part, united a man and his wife to the children they bear together. Marriage does not require a profession of faith, because it is a foundational institution of mankind. That is why eating, drinking, and shelter don’t require a profession of faith. They are also foundational aspects of the human condition. So, there is no objection to two atheists marrying.

Where the religious context comes into view is with the nature of that marriage. Catholics profess that Jesus elevated the institution of marriage to a sacrament. This means that a valid marriage between baptized individuals cannot be dissolved save by the death of one of the two parties. But that does not mean every marriage is sacramental. If one of the two parties is not baptized, the marriage is still a valid marriage, but it is not a sacramental marriage. Thus it could be dissolved, and either party would be free to re-marry.

A funny oddity of terminology crops up in Catholic teaching. Since a valid, sacramental marriage cannot be dissolved, but since parties can licitly separate for serious reasons (abuse, abandonment, adultery, addiction), a Catholic can be married and divorced at the same time…

I would argue that the artistic quality of the cake has nothing to do with who is getting married, or if there’s even a marriage at all–at least, as far as religion is concerned.

I agree with you to a certain extent, here. The artistic quality is its own concern. It is the teleological purpose of the cake that is the true contention. So that raises a question: if I bake a cake that I do not intend to be used at a wedding, but looks just like a cake that I do intend to be used at a wedding, is it a wedding cake? To use some technical terms, there is the essence of a thing, and there are the accidents of a thing. The essence of a thing is what is essential to a thing being that thing; accidents are just features that particular thing has that are not essential to a thing being that thing. The essence of a chair is something to sit on. Accidents of a chair are having one leg, or three, or four, having a back, not having a back, etc. So what is the essence of a wedding cake, and what are the accidents of a wedding cake? I think the only essential difference between a wedding cake and a non-wedding cake is the intent for which the cake is made. The only part I waffle on is the cake-topper…

On a separate note, I assert that religion ultimately must be subordinate to the law of the land.

I’m uncomfortable with how you phrase this, so let me toss out what I think about this, and let me know if it does or doesn’t conform with what you’re thinking. Continue reading
