Tillis said he was then asked whether he thought establishments serving food shouldn’t be required by law to have employees wash their hands after using the restroom, and that means using the bathroom in ways that require them to handle their genitals and be in close contact with urine and fecal matter. (Sometimes euphemisms just won’t do.)

Tillis said he responded that that would still be preferable to having the government dictate policy, saying ‘”I don’t have any problem with Starbucks if they choose to opt out of this policy as long as they post a sign that says “We don’t require our employees to wash their hands after leaving the restroom.”

Then, he said, the market would work.

Sen. Tillis was serious.

Did I already ask where Republicans find these people? How about why they find these people? Or why anyone with sufficient IQ to play a can of okra to a draw in Stratego would vote for these people?

So we must conclude from this hilarious anecdote that this high-ranking Republican doesn’t just oppose excessively burdensome regulations, but even regulations requiring conduct that no sane and responsible person could possibly oppose, because it is preferable as a matter of ideological principle for the almighty market to work its magic instead, however long it takes and however much projectile vomiting results in the meantime. Right, Senator? And if it takes three, or ten, or a thousand instances of serious illness or death for the “How about some bacteria with your muffin?” establishments to be run out of business, well, that’s just the price of freedom.

I don’t even know if “unethical” is an accurate description of this position.. It passes irresponsible, laps it ten times, and goes right on to insane. Will there be regulations requiring that sign telling customers that they can expect the delightful taste of turd with their meals be printed in large enough type to read? Or mandating that it be on all pages of the menus, and not on the back? Well, that would be silly: if you are going to pass a law about having to inform your customers that you hire human pigs as cooks and servers, you might as well just pass the law saying they have to wash their hands, and that’s an affront to liberty. So we should also let the market favor the restaurants with servers dripping urine from their fingers that prominently warn diners about their yellow food enhancement over those who put the information in fine print on the napkins. That seems consistent with Senator Tillis’s principles.

Hey, how about dental hygienists? Should they have to wash their hands or wear gloves? If a patient gets sick and dies because they missed seeing the sign, does that bar a lawsuit? It might, since there was a warning, like on cigarette packages. Should laws make nurses and hospital employees wash their hands? Presumably Tillis wants the market system to work in hospitals too, wouldn’t you think? My mother was in the hospital for a minor urinary infection, some employee didn’t wash his or her hands, and she was infected with a bug that ate her colon away and killed her. I have to say, Tillis is right, though: the market system works; I won’t send my mother to that hospital again.

Of course, I don’t have a mother now.

After the session, the moderator joked to Tillis, “I’m not sure I’m gonna shake your hand.” HAHAHAHAHA!!! Funny! What isn’t funny is that we elect people as doctrinaire, rigid, dim-witted, smug and dangerous as Thom Tillis to make our laws and protect our health, safety and welfare, elected officials who really think American citizens dying unnecessarily is less of of a burden on society than reasonable government regulations.

The rule often cited here is “When ethics fail, the law takes over.” “When ethics fail, the market takes over” is not a rule, because the market doesn’t care about right and wrong.

Just In Time For Christmas, Here Are All The Bad Arguments And Rationalizations Against Tipping So You Can Feel Self-Righteous About Being A Scrooge

Vox has published an entertaining screed against tipping, massing all the contradictory, facile rationalizations and faulty arguments against demonstrating one’s gratitude when someone serves you well. This is Vox, remember—Ezra Klein’s uber-progressive website with an agenda. Think about what the alternative to tipping is, and where the critics of tipping are going with these claims. Hint 1: It has nothing to do with democracy or individualism. Hint 2: The piece argues that tipping is classist, racist, sexist, “lookist”…the works.

The full illogical, ethically confused character of this junk has to be read to be fully appreciated, but here is a quick overview:

1. Hoary old quotes. There are these, for example:

English author Lynne Truss on visiting New York: “In this great financial capital … tips are not niceties: give a ‘thank you’ that isn’t green and foldable and you are actively starving someone’s children.” No, Lynne, you’re being cheap, that’s all.

The Village Voice’s Foster Kamer: “It reinforces an economically and socially dangerous status quo, while buttressing a functional aristocracy.”   Ah. You see, if lower paid service professions are treated like robots and underpaid, they will rise up and overturn this monstrosity called capitalism.

 Michael Lewis: “I feel we are creeping slowly toward a kind of baksheesh economy in which everyone expects to be showered with coins simply for doing what they’ve already been paid to do.” Who is being “showered with coins?”

2. “Tipping lets employers off the hook.” Translation: It gets in the way of the progressive “living wage” campaign. Mandatory salary levels drive businesses out of business and reduce jobs. Want to see all restaurants go to the iPad, self-ordering, system running rampant at airport restaurants—and no, I don’t tip a runner who just carried my food to the table—by all means, force restaurants to pay “a living wage.”

3.  “Tipping is undemocratic.” This is the George Orwell, “Peace is War” argument. The government should stop me from giving my money to whoever I want in the name of democracy. Continue reading

Pre-Election Ethics Quiz: The Campaign Fortune Cookie

I have not authored the usual number of unethical campaign tactics indictments this time around. One reason is that their desperation while facing an almost certain GOP wipe-out has led Democratic Party candidates into far more questionable devices than the confident Republicans as the Blues have increasingly defaulted to race-baiting, Koch brothers attacks, scare-mongering on everything from guns to contraception, and the “war on women” chorus. Combine that with the popular integrity breach of  Democratic incumbants virtually pretending that they never heard of the Democratic President in the White House, and I was faced with giving more ammunition to those who accuse me of partisan bias. Looking at the poll projections, it appears that the worst offenders—Wendy Davis, Allison Grimes, Mark Udall, and Mary Landrieu among them—will get their just desserts from voters without additional alarms from me.

Speaking of desserts: this campaign tactic is worthy of note. Ethics Dunce (Tip-Shaming Division): PYT Burger Restaurant and Bar

Tip-shaming over social media is despicable. This example is unusual, as for once it is the owner, not a waiter, doing the deed.

It’s still wrong.

PYT is a hamburger restaurant in Philadelphia. The owner apparently decided to take a stand for a poorly tipped server, because the customer was Philadelphia Eagles running back LeSean McCoy. According to the receipt,  McCoy left a twenty cents gratuity on a bill of $61.56.

Usually the public will side with the tip-shamer even when they shouldn’t, but McCoy is a local sports hero, so the restaurant is getting its buns flame-broiled on the net. (Though actor Charlie Sheen, who apparently has nothing better to do and wouldn’t know an ethic if it took up lodging in his nose, “pledged” $1000 to the supposedly abused waiter. File this one under “PR Grandstanding” …this like John D. Rockefeller handing out dimes to street urchins.) Unethical Website of the Month: Kio’s Asian Stir, Newport, Rhode Island

kios-asian-stir-I hate to pick on a small Chinese restaurant, but this kind of casual incompetence in an electronic age is ridiculous. Besides, I’m tired, hungry, and not in the mood to be tolerant.

I’m in Newport, you see, where I have  presented three-hour legal ethics seminars to two large and responsive groups of lawyers, courtesy of AON and the Rhode Island bar. My wife was kind enough to accompany me, and thus instead of returning from a seminar to a lonely hotel room and endless hours surfing cable TV, I am actually enjoying my surroundings for a change, driving around, checking out galleries, walking along the shore. The only persistent problem is meals. By the time I finish the seminar, talk with participants, get back to our bed-and-breakfast in scenic Newport and walk Rugby (he’s here too), it’s invariably 2:30 0r later; by the time we drive to Iggy’s or Flo’s (double yum) for clams, it’s 4:00, meaning that dinner is up against the hard, generally 9 PM deadline most kitchens observe around here, and the fact that I’m as fried as the clams we ate and barely able to move. This makes carry-out mandatory, but time is tight.

By this time we’re sick of pizza and sandwiches, so after perusing the options, and there goes another 20 minutes, we arrive at the perfect solution: the well-regarded Asian restaurant Kio’s, which is close by (everything is close-by; this is Rhode Island), delivers, and, it announces on it’s website, I can order on-line! I wish this were a joke, (thinking back on the previous post) but apparently it’s not.

The diner gives a 15% discount to customers who appear to say grace before eating. Yes, it’s a public prayer discount. Mary’s  has been doing this for years, a co-owner confirmed to NPR. Finally someone posted a receipt with the line item for “15% Praying in Public ($6.07)” to Facebook.

I detest this kind of thing, and so should you, because it is ethically indefensible and un-American to the core. The policy, whether it is well-publicized or quietly implemented as this one was, exacerbates societal divisions and embraces bias and prejudice. There may be a legal difference between this and charging a premium (that is, a penalty) to those who have Obama stickers on their cars or who are wearing T-shirts with the logo of the local team’s nemesis, but ethically it is all the same: splitting the world into them and us, good guys and bad guys, the virtuous and the reviled. All of “Mary’s” customers are human beings, and that is the only thing that should matter in the United States of America.

Now that this offensive policy has been outed, the question is this: Is it unethical for a non-believer to pretend to pray in order to get the diner’s unethical discount for the godly? Of course it is.

It’s also unethical to patronize a restaurant that discriminates against its own patrons.

Ethics Quiz: The 9-11 Memorial Museum Restaurant

I’m sure this will come as a shock to some, but there are ethics controversies that I do not have strong opinions on, because I think both sides have strong ethical arguments. The dispute over whether the planned restaurant at the recently opened memorial and museum on the site of the Twin Towers bombing is one of them.

Con is  stated succinctly by New York Post columnist Steve Cuozzo, who wrote, “A bar and grill by any name on top of burnt fire trucks and human ashes is just plain gross.” Also being criticized is a black-tie party held at the museum to celebrate the opening. Said a family member of a firefighter who died that day: “This is the final insult and desecration of these 9/11 remains.”

The Pro, or at least the “It’s no big deal” position, is laid out by Ann Althouse, who wrote:

“At some point the taking of offense itself becomes offensive. Maybe out of respect for the dead, no one who still walks the face of the earth should ever laugh or take pleasure in anything every again. More than 100 billion human beings have died, perhaps right where you are standing/sitting/reclining right now. How dare you ever do anything? Look out your window and visualize the ghosts of all the human beings who, over the course of history and prehistory, died within that view. Will you mourn for them… ceaselessly… until you are one of them?”

The ethics issue is obviously respect. What is enough, and what is disrespectful? The analysis involves finding the right analogy, perhaps. There is a gift shop and restaurant at the Gettysburg Battlefield Visitors Center, but not on the site of Pickett’s Charge. The Holocaust Museum has a gift shop and snack bar as part of the complex, but nobody was exterminated in Washington, D.C. There’s no gift shop or snack bar at the Tomb of the Unknown Soldier; you can’t buy a sandwich at the Alamo. Is the 9-11 restaurant like the one at the Pearl Harbor museum, or is it like having a fish and chips eatery over the SS Arizona? The Pennsylvania site where Flight 93 crashed is being treated as hallowed ground, while the section of the Pentagon where its victims perished on 9-11 is back to being a workplace.

Is this just the Ick Factor,  something that feels a little “off,” like watching musicals and comedies in Fords Theater with Lincoln’s empty, ghostly box looming over the stage, or something more?

In a dilemma reminiscent of my ice cream sundae problem last year, I faced the question of how to ethically respond to yet another food service botch. We ordered a modest dinner from the local Chinese carry-out establishment, and after we got the order home, discovered that it was missing an appetizer. It was raining hard, and when I called the restaurant, they agreed, after putting me through the third degree, that they had screwed up. They said they would deliver it. I was prepared to drive over and pick it up, but at least this allowed us to begin eating the rest of the dinner before it got cold. It took about a half an hour, but my precious pan-fried pork dumplings finally arrived, along with profuse apologizes from the deliverer.

Tip Shaming Fraud On The Web: NOW Do You See Why Applebee’s Was Right To Fire Its Vigilante Waitress?

At the beginning of the year, we had a real donnybrook on Ethics Alarms over my contention that Applebee’s correctly fired a waitress for web- shaming a customer who refused to tip another server on the grounds, as the customer wrote on her credit card receipt, that the automatic tip of 18% was excessive since she (a pastor as well as a jerk) gave God only 10%. The indignant waitress posted the receipt on Reddit, which led to locals recognizing the pastor’s handwriting and appropriate antipathy being directed her way. Since the waitress’s conduct was a clear violation of Applebee’s employment terms and because publicly shaming customers who exercise their right not to leave tips is a poor customer relations strategy, she was sacked. Subsequently the unapologetic waitress received a lot of sympathy, while equally misguided observers vowed to punish Applebee’s for not wanting to be known for having  waitresses on the payroll who are prone to misappropriate customer receipts and post them online to bring opprobrium down on the niggardly diners’ heads.

I think Applebee’s is looking prescient and wise right now. Ask Red Lobster, which did not fire Christina Jenkins, a 19-year-old African-American server at the Red Lobster restaurant in Franklin, Tennessee. Jenkins served a $44.53 order to Devin Barnes and his wife. Barnes wrote the word “none” by “tip, ” and, Jenkins claimed, wrote “Nigger” on the receipt as well.  Jenkins then posted a photo of the racist receipt on her Facebook page, writing, “This is what I got as a tip last night…so happy to live in the proud southern states. God Bless America, land of the free and home of the low class racists of Tennessee.” Going the Applebee’s vigilante one better, Jenkins allowed Barnes’ signature to be visible on the receipt.

The photo, and story, went viral on the web and the news media gobbled it up. Mr. and Mrs. Barnes denied that they would write such a thing (they didn’t tip because the order was a carry out), but nobody believed them. After all, everyone knows that white customers in southern states are likely to write “nigger” on receipts, just as everyone knows that sort-of white neighborhood watch members racially profile black kids in hoodies for carrying bags of Skittles. Jenkins, in contrast, was besieged with sympathy and cash contributions: the latest tally was $10,749. A handwriting expert hired by Barnes, however, proved that “nigger” was not written by the customers, but by the waitress herself. Now Jenkins and Red Lobster are being sued by the Barneses, who have been subjected to harassment and threats.
