No, There’s No Comparison Between Bill Cosby And Woody Allen And No “Double Standard”

One of these things is not like the other….

Newspapers should make us more informed and smarter, not less informed and dumber. Thus a Washington Post feature this morning qualifies as journalism malpractice, incompetence exemplified. Its theme: “Gee, why is Woody Allen signing a new deal to do a streaming comedy series for Amazon, while Bill Cosby lost his deal with NBC?” The print edition sub-heads: “Crisis responses may explain…”

No, they don’t. This is a false comparison based on superficial similarities: two comics who initially peaked in the same era, both in their seventies, shadowed now by sex scandals. The effort to use one to question the treatment of the other is either intellectually dishonest or so analytically unsound that it should forfeit the authors’ privileges of being assigned to write anything for mass consumption (the Post piece is by Stephanie Merry and Amy Argetsinger, and shame on them). The question of why Allen and Cosby are being treated differently in the court of public opinion isn’t worth asking, but since they asked, here are the obvious answers:

1. Woody Allen’s art, comedy, and persona have never had anything to do with virtue, stable families or being any kind of a role model. As a performer, he has presented himself as perpetually horny, neurotic, obsessed with sex and masturbation, prone to lying, and open to adultery, betrayal, stealing friends’ lovers; in “Manhattan,” he happily romanced a virtual child. In real life, he says things like “The heart wants what the heart wants,” which is a rationalization for any act unethical or illegal, involving sexual or romantic desire. If you were ever a fan of Woody Allen after the age of 13, you were so because he was funny, accepting the fact that he is at best a sexually obsessed, maladjusted creep.

None of this is true of Cosby, who has always aimed his comedy at innocence, functional families and traditional virtues, and represented his own values as consistent with these when speaking for himself. Sex was not any part of Cosby’s art or image. He was an iconic good guy. Continue reading →

Ethics Corrupter of the Year

(Awarded to the unethical public figure whose prominence, popularity and success most corrupts the public’s ethical values)

Janay Palmer Rice, beloved punching bag of NFL star Ray Rice, who was caught on camera smooching with her man shortly after being cold-cocked by him in a hotel elevator, married him, and has repeatedly defended her husband, prompting confused female pundits to defend her. She is not only the embodiment of Rationalization #42. The Hillary Inoculation, or “If he/she doesn’t care, why should anyone else?”, she is also a good bet to get some young women killed by giving them a role model who stands for standing by your abusive man with the hard right hook.

Double Standard Of The Year

In a year of double standards, the treatment of soccer star (and accused child abuser) Hope Solo by her sport, feminists, the media and the public takes the prize. The standard, as I understand it, is that big, strong female athletes can beat up smaller, weaker family members with impunity, and it’s no big deal, but when a male athlete does the same, he is scum. Got it.

Uncivil U.S. Official of the Year

Victoria Nuland, Assistant Secretary of State for European and Eurasian Affairs and the top American diplomat in Europe, was caught saying in a viral Youtube video saying “Fuck the EU.” Now that’s diplomatic. Of course, she wasn’t fired, because she works for the Obama Administration

The Jesse Jackson Award

(For the Year’s Worst Amateur Diplomat)

First Lady Michelle Obama, who helped her husband make the U.S. look weak and ineffectual (he needs no help), by engaging in this ridiculous effort at hashtag diplomacy. Those kidnapped girls were never found, and Boko Haram, the Nigerian terrorist group that took them, I learned today, just killed a reported 2000 more victims. Time for another sad picture, Michelle!

Most Unethical Sports League

The NFL, last year’s winner, was even more unethical this year, with the Ray Rice and Adrian Peterson fiascos, Commissioner Roger Goodell showing no innate instinct for right and wrong and both the league and its teams making up rules and policies according to talk show calls, polls and wet fingers in the air. Meanwhile, it’s still making billions paying young men to lobotomize themselves. What a great sport.

Sports Cheat of the Year

Alex Rodriguez, suspended Yankee star, had denied, denied, denied, threatened to sue Major League Baseball and the union, and insisted that he had not, as an investigation had determined, used performance enhancing drugs supplied by Biogenesis. Then, just as his season-long suspension was lifted, it was revealed that A-Rod had, under oath, admitted using steroids from 2010 to 2012.

Michael Fine, the Ohio lawyer who allegedly hypnotized female clients in order to sexually molest them. Runner Up: Alexa Van Brunt. She didn’t do anything unethical; she just advocates ethics rules that would eliminate the core of legal ethics, proving that she doesn’t understand her own profession.

Unethical Judge of the Year

Wade McCree, the handsome devil pictured above (he circulated this selfie), who, presiding over a felony child-support case, conducted a secret sexual relationship with the woman seeking support from the defendant. This was just the latest of his embarrassments. Runner up: Texas District Judge Jeanine Howard, who handed down a stunningly lenient sentence of probation and 250 hours of community service at a rape crisis center for a man who confessed raping a 14-year old girl at her school.

Unethical National Broadcast Journalist Of The Year

CNN’s Carol Costello. She was biased, smug and incompetent all year long, but reached her nadir when she gleefully played a recording of Bristol Palin explaining to police how she had been assaulted, saying to her viewers, “You can thank me later.” She refused to apologize on the air, or to Palin. 2014 was the year of the Ethics Train Wreck. They were coming so fast that they were getting tangled up with each other, and old wrecks from past years started rolling again, or the damage that was triggered a year ago or more started kicking in. I don’t know if every year really is more ethics free than the year before, or that it just feels that way because I’m getting better at sniffing it out. By any standards, it was a wretched year, with epic ethical misconduct across the culture. But I can’t stall any more: let’s wade into it. There will be more installments this year, so the misery is coming in smaller bites. You’re welcome.

Ethics Train Wreck of the Year

It’s a tie!

The Ferguson Ethics Train Wreck and The Obama Administration Ethics Train Wreck

The obvious winner is the Ferguson Ethics Train Wreck, which has managed to hook up with the 2012 winner, The Trayvon Martin- George Zimmerman Ethics Train Wreck, as well as a the sub-EthicsTrain Wreck attached to the death of Eric Garner, to further degrade U.S. race relations, undermine the stability of numerous cities, get several people, including the recently assassinated NYC police officers killed, revive race riots, give vile demagogue Al Sharpton unprecedented power and influence, and pick up such distinguished riders as President Obama, Missouri Governor Jay Nixon, New York Mayor de Blasio. It is also still barreling along at top speed after many months, and is a good bet to continue its carnage well into 2015.

Yet, it became clear to me this summer with this post that the entire Obama Administration has become an Ethics Train Wreck, and one that is neck-and-neck with the one spawned in Ferguson in threatening short and long-term damage. Incompetence, dishonestly, lack of transparency and arrogance have hardened cynicism in the public, corrupted the ethical values of defenders, let journalists to disgrace themselves, and fertilized festering potential disasters internationally and domestically. This is also, I now see, a wreck of long duration that started in 2009, and had gathered momentum with every year. It also has sparked other wrecks, including the one that now keeps it from being the sole 2014 winner. How much damage will The Obama Administration Ethics Train Wreck do in 2015? Which agency or department will prove itself to be corrupt, incompetent and mismanaged, which official will continue in a post after proving himself unfit to serve, which inept pronouncement or abuse of power will further degrade American trust and freedom?

I’m not looking forward to learning the answers.

Fraud of the Year

The U.S. Justice Department, which allegedly participated in a plot to force Sierra Pacific Industries and other defendants to pay $55 million to the United States over a period of five years and transfer 22,500 acres of land as settlement of charges brought against the company by DOJ for causing a 2007 wildfire that destroyed 65,000 acres of land in California. Naturally, the national news media has barely covered this scandal, which is still in litigation. Runner Up: The Victoria Wilcher scam, which made KFC pay for plastic surgery for a little girl when there was no evidence that the company was in any way involved with her injuries. “Hypnotism 101” isn’t required in law school, but it’s recommended…

…he might be Michael Fine, 57, a Sheffield, Ohio attorney who has an even more effective method for raping women that the Cos’s drug-and-drink trick. Police say that Fine convinced female clients to let him hypnotize them, and then had sex with them while instructing them to forget everything but their legal discussions. He agreed to have his law license suspended temporarily while the Lorain County Bar Association and the Ohio Supreme Court deal with the results of the police investigation, or perhaps until he can hypnotize all of them and make them forget the whole thing. Or believe they are chickens or something.

Fine allegedly told the women that his hypnotic machinations were a meditation and relaxation technique that he used to help his clients. Don Lemon’s Ethics Foul Wasn’t “Insensitivity.”

[I am typing this in an airplane, sitting crunched in a bulkhead seat crushed between the wall and a 275 pound guy in the middle seat. If you thought my typos were bad before…”]

Between my logging off the blog to go to the airport and now, as I thought about what I would write about CNN anchor Don Lemon’s awful ethics alarm failure while questioning Joan Tarshis, one of Bill Cosby’s growing list of alleged victims, Lemon apologized. That was fast, but I assumed the barrage of criticism heading his way would be furious, and it was. His apology was a non-apology apology, by the way, a classic “I’m sorry you misunderstood me” that, you should notice, didn’t include an apology to Tarshis.

I didn’t misunderstand him. Lemon wasn’t being insensitive; he is in the throes of cognitive dissonance, just like Whoopi Goldberg. Bill Cosby is someone he admires, and sexual assault is something he deplores. If Cosby is a sexual predator, then Lemon has to resolve his dissonance: he can either lower Cosby in his estimation, or elevate what his hero almost certainly did to all these women to the “not that bad” category. (The latter was the choice of most of Bill Clinton’s conflicted offenders, by the way. Lying about sex is normal! Other presidents cheated! It was consensual! Monica seduced him: he was a victim! Why is Bill Cosby’s past avocation as a Hollywood power-abuser and serial sexual predator suddenly so upsetting to Hollywood that they are recoiling from him now?

Unethical Quote Of The Month (Lawyer Representing A Hypocritical And Unethical Client Division): Keith Wyatt

“She lied to her mother so she could have sex with her teacher. She went to a motel in which she engaged in voluntary consensual sex with her teacher. Why shouldn’t she be responsible for that?”

—-Lawyer Keith Wyatt, L.A. Unified School District’s trial attorney who successfully defended it in a law suit by the family of a middle school girl who had been engaged in a six month sexual relationship with her math teacher. The girl’s family claimed the district negligently permitted the teacher’s criminal conduct to occur and that the teacher’s exploitation of the girl had caused emotional damage to their daughter. Wyatt also told a radio interviewer that it was a more dangerous for a 14-year-old to cross a street in traffic than to have sex with her middle-school teacher.

Yes, he’s an idiot.

Yeah, those middle school tarts all want it, right, Keith?

The school district fired him, disavowing and apologizing for his comments. Yet they were willing to let Wyatt argue in court—on the school’s behalf, remember— that a 14-year-old middle school student was mature enough to consent to having sex with her 28-year-old teacher, and that she shared responsibility for what happened. Wyatt introduced the girl’s sexual history into evidence as proof of his client’s lack of culpability.

There is nothing wrong or unethical about Wyatt’s tactics in the trial itself. State law is weird in this area—this is California, after all, home of Hollywood, Roman Polanski fans, Woody Allen enablers, Miley Cyrus and the Kardashians—for while the age of consent is 18 in criminal cases, two appellate court rulings have held that the argument that a minor can consent to sex with an adult is permissible in civil law suits. He did what the law permitted him to do in defense of his client. That’s not just ethical lawyering, it is at the core of legal ethics. The argument won. Wyatt did what he was trained to do, paid to do, and obligated to do if he agreed to take the case

However, it is a revolting and irresponsible argument for any school or school district to make. Wyatt should have made this clear, and maybe he did (though that quote doesn’t support such a supposition.) Who in their right mind–well, OK, this is L.A.–would send their child to a school system that takes the position that a 14-year-old student is responsible when she is raped by her 28-year-old teacher, and that she’s really not being harmed if he does? The teacher, Elkis Hermida, was convicted of lewd acts against a child and sentenced in July 2011 to three years in state prison. Continue reading →

Under that bus is Monica Lewinsky, and it wasn’t Matt Drudge who threw her there.

It truly pains me to have to write anything negative about Monica, who was exploited and humiliated by a President of the United States, and had her life permanently derailed because she trusted and even loved a rogue who regarded her as little more than an animated sex toy. Her re-emergence now, however—yes it is sad and desperate and makes me furious at Bill Clinton all over again—in the new guise of a “cyber-bullying” victim is intolerable, a delusion on multiple levels, despicable blame-shifting, and a welcome weasel-out of-accountability-free card for the Clintons. Yeccch.

I’m sorry for what happened to you, Monica, but you’re 40 now: it’s time to start seeing life more clearly—especially your own and the reasons why you are in the mess you are.

“Overnight, I went from being a completely private figure to a publicly humiliated one. I was Patient Zero,” Lewinsky said in a speech Monday to Forbes’s Under 30 Summit in Philadelphia. “The first person to have their reputation completely destroyed worldwide via the Internet.”

It has to take a near-fatal injection of self-serving historical air-brushing for the ex-intern to say this with a straight face, and it tells us volumes about the audience that it didn’t start throwing tomatoes:

She wasn’t a “completely private figure.” She was a woman having a sexual affair with the President of the United States while he lied about it—to his wife, his staff, and under oath (I haven’t covered all of the lying, either.) That makes her an individual who is engaged in conduct with tremendous public and official consequences who is only “private” because a powerful official is using his power to make it so. The proper term is “inevitable public figure waiting for the dam to break.”

The reason for her humiliation was and is William Jefferson Clinton, and no other. He is the one who described her as “that woman,” while denying what was true. He is the one who made his relationship with her part of a legal record while he was trying to avoid the consequences of another “bimbo eruption,” as his long-time “fixer” liked to call them.

Unethical Quote Of The Week: Tina Brown

“The Monica Lewinsky confessional in Vanity Fair brings back a torrent of unfond memories of the appalling cast of tabloid gargoyles who drove the scandal. Remember them? Treacherous thatched-roof-haired drag-queen Linda Tripp, with those dress-for-success shoulder pads? Cackling, fact-lacking hack Lucianne Goldberg, mealy-mouthed Pharisee Kenneth Starr—the whole buzzing swarm of legal, congressional and gossip industry flesh flies, feasting on the entrails. And, of course, hitting “send” on each new revelation that no one else would publish, the solitary, perfectly named Matt Drudge, operating in pallid obsession out of his sock-like apartment in Miami… They were the face of the future. The things that shocked us then—the illicitly taped conversations, the wholesale violations of elementary privacy, the globally broadcast sexual embarrassments, all the low-life disseminated malice—is now the communications industry as it operates every minute of every day.”

This is an unethical statement for the ages. It launches an dishonestly titled piece with an unethical premise and unethical motives, virtually every phrase in it is despicable, and it reveals the dearth of admirable values not only within Brown, but within the millions of people who think like her, many of whom she and her cohorts corrupted.

In Abby Mann’s important drama, “Judgment at Nuremberg” (it had three forms of presentation: TV drama, film, and finally, stage), based on the third and final stage of the post World War II war crimes trials devoted to trying the Nazi judges, a vulnerable female witness and victim of Nazi justice is harshly cross-examined about an infamous case at the heart of the trials. Her humiliation is interrupted when one of the defendant judges (in the film, Bert Lancaster), stands to halt the inquisition, asking, “Are you going to do this again?”

The answer clearly coming from the Bill and Hillary Clinton Ethics Amnesia Team is clearly “Yes! It worked before, why not now?”

Monica was responsible for the whole impeachment train wreck, you see, and all that followed. That was Hillary’s position (once the original cover lie that it was all the fabrication of a vast right-wing conspiracy became unsustainable, with that stained dress and all), and as outrageous and audaciously despicable as it is, that it is still what the corrupt, corrupted and corrupting supporters of these two Machiavellian blights on our culture and politics are determined to make Americans believe, no matter how much bending of history, facts, logic, fairness, decency and responsibility it requires.
