John Garrison’s incisive Comment of the Day decisively adds Kaitlyn Hunt’s parents to the Kaitlyn Hunt Ethics Train Wreck, which has already enlisted them, the vigilante group Anonymous (itself a self-perpetuating ethics train wreck), the lazy news media, which apparently misreported the essential facts of the case, and the social media as passengers since my first post on the debacle.

“There are a number of things that concern me about this case. First, I do agree that the law is very harsh in Florida. But we never seem to get the actual story from Kaitlyn’s parents. At first, they said that they were 17 when they started dating, and that the parents vindictively waited until Kaitlyn turned 18. That story seems to have changed around the time the police report was released stating that actual ages of the girls. At that time, the family claimed that the police not redacting the address was retaliation against them going to the media, even though it is not remotely unusual for the police not to redact the address of the accused.

As happens all too often with these viral ethics stories, the facts in the Kaitlyn Hunt case as represented in the first accounts appear to be wrong. Kaitlyn did not first become involved with her girlfriend when both were minors. According to an arrest affidavit , Kaitlyn and her girlfriend began dating in November 2012 when the younger girl was 14 and Kaitlyn was already 18.

Sorry, but that changes everything. Unless one is ready to assert as fact that lesbian relationships in which an adult, however young, becomes involved with a child are less dangerous and potentially damaging than heterosexual ones, Kaitlyn broke a law that is legitimate and sensible as it applies to her, and that law should be enforced. A 14- year old is not capable of meaningful or legal consent, and the opportunity for older, more experienced teens to exploit their inexperience, innocence and deference to older peers is significant and a genuine source of parental—and legal, and societal— concern. If the law permitted an 18/14 year-old sexual relationship between female teens, it would be difficult to explain why 18/12  year-old sexual relationships were materially different, and that being so, legal prohibition on 18-year-old young men seducing 12-year-old girls would be difficult to maintain. Once again, one of my favorite news aggregation websites, the prolific and often hilarious Fark, is laughing at child rape. Its comment on the story from Nehalem, Oragon about the arrest of a 31-year-old model for sex crimes involving at least three under-age boys—15 and 16 years old—was this…

Not funny. An adult woman using—that’s the correct word, using—teenage boys as her personal sexual aids isn’t niiice—it’s criiiiminal. In October, I gave Fark an ethics dunce cap for an earlier wink-wink-nudge-nudge comment about a teacher who added statutory rape to her duties, and that was surely worse; after all, she was a teacher, and violating the trust of the school, the parents, the students and the community to get herself laid. Nonetheless, the conduct of model Anna Walsh was neither harmless nor trivial. I know: Fark’s official stance is sophomoric; I get that. I also get that sophomores, and other morons, have staked out the position that any male child who has obtained a sufficient level of sexual maturity to be used as a human dildo by a “hot” woman is a lucky dog. Well, that spectacularly stupid and unethical position does a great deal to help sexual predators like Walsh victimize children, who are misled into feeling that something must be wrong with them if they really don’t want be used.

Since the site is a repeat offender, I’m sure Fark’s wags intend to keep doing this. So I guess Ethics Alarms will have to keep reminding everyone what irresponsible ethics dunces their warped sense of appropriate treatment of young boys shows them to be.

Unethical Quote of the Week: Drew Curtis’ Fark

“Seduced by your teacher at 16 thereby robbing of your childhood, oh yeah that’s surely worth 10 million…”

—Drew Curtis’ Fark, satirical news aggregation site, commenting on a mother’s 10 million dollar lawsuit against Brooklyn and the teacher who had repeated sex with the mother’s 16-year-old son, whom she was supposed to be tutoring.

Let me begin by saying that Fark is one of my favorite sites. It is consistently irreverent and funny, and its news links have inspired some of the most interesting exchanges on Ethics Alarms. Let me also say that I understand that the point of the site is to make snarky, often irreverent, sometimes obscene and intentionally outrageous tongue-in-cheek comments about news stories  trivial, major and odd, and that for the most part, it accomplishes its mission with wit and good humor.

This comment, however, is wrong, unethical, because whatever value it has as humor is outweighed by the harmful attitude it reinforces. Whether it is the  sentimental, , “Summer of 42” myth of the beautiful right-of passage of a teen-aged boy with the help of a loving, lovely, adult woman, or the macho “All right–I sure would have loved to have had a roll in the sack with MY hot high school teacher!” reaction of the locker room crowd, the idea that an adult teacher seducing and having sexual relations with a minor student is anything but sexual assault, rape, and a dastardly breach of trust, position and power does affirmative and continuing harm. The currency and resiliency  of this enabling attitude (read the comments to any online news story about a female teacher prosecuted for having sex with a student) emboldens sexual predators in the schools, reinforces an indefensible double standard ( a male teacher who has sex with a female student is an unequivocal villain, but a boy being raped by a female teacher is a lucky stiff) ) and worst of all, makes student victims more vulnerable.

The cultural assumption that a boy who is seduced by a teacher has been given some kind of gift is in the same category as the claim that women who are raped secretly “want it.” It is important that this theme be rejected, which means that websites like Fark shouldn’t reinforce it even in jest, because the jest does reinforce it.  Hitting communities, schools and teachers with tough jury verdicts is an essential part of eliminating this far too common crime in our schools. Ten million dollars in damages properly states how wrong and intolerable the conduct is, and like all forms of rape, it is nothing to laugh at.

Disturbing Ethics Quote of the Week: Terri Miller

Erica Depalo (right): Teacher of the Year, vanguard, child-molester

Miller’s quote was prompted by the recent arrest of West Orange High School English teacher Erica DePalo, 33,  who is accused of having a sexual relationship with a 15-year-old male student she taught in her honor’s English class. Prosecutors charged DePalo with first-degree aggravated sexual assault, second-degree sexual assault and endangering the welfare of a child. DePalo, who teaches Honors English to ninth and tenth-graders and is also the school’s junior varsity tennis coach, was honored as Essex County’s top teacher for 2011-2012  as part of the state Department of Education’s “New Jersey Teacher of the Year” program. Accepting her award, she said, “I am merely a representative of all the hardworking dedicated teachers, especially those with whom I work at West Orange High School … teachers who are committed to their students, who consistently advocate for their students, and who exceedingly go above and beyond their everyday duties and job descriptions.”

Yes, I’d say having sex with 15-year-old student qualifies as going above and beyond their everyday duties and job descriptions. Or perhaps below and beyond. Continue reading →

Child rapist teachers! LOL!

Two nights ago, Tonight Show host Jay Leno included in his monologue a joke about Christine McCallum, the Brockton, Mass. teacher convicted of having sex with a 13-year-old boy over 300 times. Jay can make jokes about whatever he wants, but the fact that we are laughing about this kind of conduct by teachers rather than asking hard questions and insisting on some accountability for the schools shows how tolerant our society is of a supposedly essential institution and a once respectable profession that have both fallen into rot and ruin.

In 1996, when Mary Kay LeTourneau was revealed to have made an undereage student her lover and fathered a child by him, it was national news. For me, it was the first I had ever heard of a teacher abusing her power and profession to that extent. This month alone, March 2012, I have counted thirteen such cases making the local news across the country, including McCallum, and I’m sure I missed some. I’m also reasonably sure that for every one of these cases that get prosecuted, many more are covered up or never discovered at all. Continue reading →

A Brief Note Regarding The Supposed Difference Between Male and Female Teens Exploited For Sex By Adult Authority Figures

I am posting this as my contribution to the epic argument on the post about Nevada’s wrist slap to the teacher who had various kinds of sex with multiple students. The gist of the dispute is whether it is appropriate to give disparate (harsher) punishment to male teachers who take advantage of female students than is given  to their female counterparts in the sexual predator world,  because “boys are different,” and are more likely to enjoy the sexual awakening without long-term adverse affects.

Yesterday’s sexual predator story (for there is indeed at least one every day, it seems) came from St. George, Utah, where a female fitness coach was sentenced after pleading  guilty  to two counts of forcible sexual abuse as part of a plea deal in which prosecutors agreed to dismiss three additional counts of forcible sexual abuse and five counts of forcible sodomy….of a 14-year-old boy she was supposed to be training.

The boy, now 16, says that he is treated completely differently in school now because of  his “experience.” Was he lucky to be made the sex toy of a hot adult fitness coach? It doesn’t sound like he thinks so. Nonetheless, the woman told the boy, “Well, you learned a whole lot, didn’t you?’ in a secretly taped conversation in which she tried to talk him out of helping prosecutors.

You see?  The attitude being advocated in the comments encourages and rationalizes the actions of female predators.

Scylla and Charybdis in the Schools

Responding to one of the recent posts here about the deteriorating relationships between students, teachers and administrator, teacher Brook Styler alerted us to his own crisis, a situation right out of “The Children’s Hour” in which vengeful female students, aided and abetted by parents, circulated rumors that lost him his job.

Styler has launched a website, Teacher Hunt, to collect the experiences of teachers, who, like him, have been victimized by false accusations from students. I plan on visiting it often. But the site appears at a time in which teachers using their students for sexual gratification is either on the rise, or is being uncovered with remarkable efficiency. Every day, one or more cases of teachers preying on students is in the news. Yesterday, it was Rachel L. Farrell, 25, a  Bangor, Maine  high school teacher  charged with having sex with a 17-year-old student on “numerous occasions” while she was supposed to be tutoring him in English. Authorities believe she had sexual relations with as many as three other students. Today, it was the still unfolding horror of Mark Berndt, 61, a teacher at Miramonte Elementary School in the Los Angeles community of Florence-Firestone, who was charged with 23 counts of committing lewd acts on children after over 400 photos were discovered by a CVS clerk, showing pornographic conduct involving his students (age 7-10) over a five year period. Berndt, now being held on $23 million bail, regularly told his students that they were going to play a “tasting game,” in which children were blindfolded and, in some cases, gagged with tape, authorities say. They were then fed the teacher’s semen, administered to them on a blue plastic spoon and, according to one alleged victim’s father, on cookies.

Incomprehensible Nevada Justice For A Sexual Predator

Pop quiz: Can you guess the sentence for this criminal?

Hey! Let's show some compassion for these sexual predators, people!

Bethyl Shepherd, a 35-year old high school teacher,was

  • convicted of having various forms of sexual relations with seven of her male students. In addition…
  • The boys ranged were as young as 15.

She got 60 days in jail, with the rest suspended.

I detect in the country a progressive deterioration of rational attitudes toward official punishment, and this case is an unnerving example. The news story makes it clear that everyone, including prosecutors and the parents of the boys, wanted leniency for Shepherd, and no jail time. The judge rejected their misguided pleas, but just barely.

Why so little punishment? Well, this is Nevada, where the attitude toward dubious sexual relationships is uniquely tolerant. Nevertheless, Shepherd is a sexual predator who exploited the trust of students and their parents for her own sexual gratification. This was not one foolish teacher-student crush, as in other cases that have sent teachers like Mary Kay Le Tourneau into prison for long periods. It appears that much of the sympathy for Shepherd stemmed from defense testimony that she was bi-polar and that this affected her judgment (let’s see how far Jerry Sandusky gets with that strategy) and the fact that her life has spun out of control as a result of her arrest, as she has lost her job, her career, her husband, her children, and has had to sell her car.
