Morning Ethics Warm-Up, 2/16/18: Guns, Tweets And Blackberry Slingshots

Good morning everybody!

1. Oh, well if David Hogg says so… I just listened to an earnest, articulate Florida high school student named David Hogg tell a CNN reporter, his head nodding sagely, complete counter-factual garbage, with no correction, for what seemed like an eternity. “David Hogg wants Congress to act.” the screen said said as the 17-year-old was speaking. This is lousy, unethical journalism—well, it’s CNN– and irresponsible. I don’t blame the kid for believing the crap he reads and hears from people who are lying to the public, but I expect the news media to correct, not circulate, dishonest talking points. Well, maybe “expect” isn’t the right word.

No, David, “thousands of students” do not die every year. No, David, that “18 school shootings” fake stat is designed to mislead: it includes every time a gun has been discharged in or near a school, not mass or multiple shootings or even fatalities. [See Item #2]

See, David, when people talk about “mental health reform” they are often talking about pre-crime, and removing the rights of citizens before they have done anything wrong, much less criminal. But CNN’s reporter kept nodding.

These are complex issues involving rights and practical realities, and a high school student is not an authority that CNN or anyone should be presenting as an advocate. Until the anti-gun advocates stop intentionally distorting facts and trying to mislead while relying on emotion to swamp legitimate debate, there will be no serious dialogue about whether any policies could stop tragedies like the latest Valentine’s Day massacre, and bumper sticker chants like “Do something!” and “If it saves just one life…” lead away from responsible policy, not toward it.

The “Ghostbusters” Remake Controversy

The fact that I even know about this issue is both my reward and punishment for being a popular culture junkie.

To bring you up to date: Since the stars of the classic movie comedy “Ghostbusters” are now collecting Social Security (and one of them—Harold Ramis— is dead), Hollywood’s only sensible option to try to squeeze some more profit out of the property (and maybe introduce it to a new generation) was to remake the 1984 film. This was a risky enterprise, for even the sequel with the original cast more or less recognizable was a disappointment, and remakes of classics are inherently dicey. If an original film really was special and the stars truly stars, forcing younger contemporary stars to step into iconic shoes is asking for not just trouble, but humiliation. Poor Alex Cord, for example, never recovered from being cast as The Ringo Kid in a misbegotten remake of  1939’s “Stagecoach,” where he was supposed to replace John Wayne. It can work, as with Jeff Bridges’ turn as Rooster Cogburn, not only a Wayne role but the one that got him an Oscar, only if the remake is sufficiently excellent and different enough in tone and purpose that the original and the remake can co-exist without compelling unflattering comparisons. (“True Grit I” is a funny John Wayne valedictory with a great story; “True Grit 2” is more faithful adaptation by the Coen Brothers of a wonderful novel. I still like the original better.)

The best option, though, is often to make the reboot different in appearance and feel by switching race or gender. This is also helpful when everyone over the age of 13 has seen the original on TV about ten times already. The scheme attracts a new audience, ideally—the first “Ghostbusters” had a male teen demographic—and allows the remake to refer to the first version without seeming like pale copy. Almost never are the non-traditional casting versions big hits, but they can be quietly profitable. “Ghostbusters,” moreover, is a merchandising machine. The original spawned cartoon versions and action figures. Why wouldn’t the new movie?

However this is 2016 America, and everything is political as well as partisan. An all-female remake of “Ghostbusters” was launched with feminist swagger. The new version starring Melissa McCarthy (love her) , Kristen Wiig (great)  and Kate McKinnon ( also great), excellent comic actresses, given good material, would show that women can and do everything men can do—fight ghosts, make hilarious supernatural movies, be President of the United States. The July opening in an election year was no coincidence; it is part of the Hollywood effort to join the media’s efforts to make Hillary President despite, well, her lack of fitness to lead.

Although the usual naysayers when a classic is recast were immediately critical, most moviegoers were enthusiastic about the project. I know I was. Then the trailer came out. It is bad (you can watch it above). We are used to seeing great trailers for movies that turn out to be boring and horrible, but good movies with terrible trailers are rare because making previews has become a fine art.

The strikingly unfunny “Ghostbusters” trailer was especially ominous for a comedy. The usual method for hyping a mediocre comedy is to put all the funny bits in the trailer; I hate that, don’t you? Not only is the whole movie an unamusing slog with 6 minutes of laughs in 90 minutes of filler, but you’ve already seen the best gags. What does it say, though, when a trailer for an alleged comedy isn’t funny, and worse, the gags included don’t appear to be as side-splitting as the movie’s makers seem to think they are?

#FreeKesha Ethics: Ignorance, Indignation And Feminist Bias Vs. The Law

Perhaps, if you don’t follow pop music, you managed to miss the long, long ongoing drama of singer Kesha’s (formerly “Ke$ha”—I know, I know… ) legal efforts to get out of her recording contract with  Sony and producer Dr. Luke, (Lukasz Gottwald) who has produced hits by other artists like Katy Perry, Rihanna, Pitbull and Miley Cyrus. It isn’t over, but the unethical caterwauling by Kesha and her supporters both in and out of the industry is deafening.

Also off-key.

Kesha Rose Sebert was 18  and an unknown singer from Nashville  when she signed a five or six (I have read both)  album contract with one of Dr. Luke’s recording companies in 2005. It took five years, but the producer’s faith in her paid off when Tik Tok became the No. 1 song in the country. Kesha released two albums in the next two years, but none since 2012.

In October 2014, Kesha’s legal team sued Dr. Luke for alleged sexual assault and battery, sexual harassment, gender violence, emotional abuse, and violation of California business practices since the beginning of their business relationship. The lawsuit claimed that Dr. Luke had  drugged her, raped her while she was drugged,  and also tormented her to the point where Kesha developed an  eating disorder that eventually required medical attention. Kesha asked that the court let her out of her exclusive recording contract because, as she put it in a sworn affidavit, “I cannot work with this monster.”

Dr. Luke, not appreciating being branded a rapist, filed a countersuit against Kesha and her attorneys for defamation, and accused her, her mother, and her management of fabricating the abuse claims to break her contract with him and his partner, Sony. Last November, Dr. Luke asked the judge to dismiss Kesha’s allegations of sexually abusing her. Continue reading

Once a secret is out, it isn’t a secret any more. Once privacy is shattered, it’s gone: that egg can’t be put back together again. I wish Sony’s e-mails hadn’t been hacked: everyone who isn’t operating under a policy that mandates that their communications must be archived and available for media and public examination, like, oh, say, Hillary Clinton, has a right to have private business and personal communication.

Julian Assange is a fick, and an uncommonly arrogant one. He encourages, aids and abets the theft of proprietary information in the interests of world anarchy, which is in the interests of nobody. So let’s see now…North Korea hacks Sony to chill our First Amendment rights, and Wikileaks helps magnify the damage by spreading private e-mails and documents far and wide.

Yechhh.

But it’s all out there now, and there is no virtue in averting our eyes and plugging our ears. There is a lot of unethical conduct exposed in those 30,000 documents and 170,000 emails hacked from Sony, and while the means by which it was exposed was illegal and wrong, we should still learn from what is now public information.

The fact that PBS and Harvard prof Henry Louis Gates Jr. can’t be trusted, for example, is good to know. Continue reading

Mamoru Samuragochi, the composer sometimes known as “The Japanese Beethoven” because he composed critically acclaimed works despite being deaf, was exposed as double fraud: he didn’t compose the works that made him Japan’s most popular classical composer, and he isn’t even really deaf!  Samuragochi hired a musical ghostwriter named Takashi Niigaki to compose more than twenty compositions for Samuragochi since 1996.

Unethical Artist Of The Year

Performance artist Maximo Caminero, who  walked into the Pérez Art Museum in Miami, entered a special exhibit of sixteen ancient Chinese vases painted over in bright colors by celebrated Chinese dissident artist Ai Weiwei, picked up one of them, and immediately after a security guard instructed him not to touch the exhibit, allowed the vase to fall from his hands, shattering into bits. Caminero admitted that smashing the pottery, which was valued at a million dollars,  was intentional, and was his protest against in support of local artists like himself whose work is not exhibited at the museum while the art of international artists like Weiwei is.

Unethical Veterinarian Of The Year

Fort Worth, Texas veterinarian Lou Tierce lost his license for five years as a result of, among other transgressions, his telling the owners of a Leonburger (it’s a very big dog) that their pet was terminally ill and had to be euthanized, then secretly keeping the dog alive in a small cage so he could use Sid’s blood for transfusions to Dr. Tierce’s other canine patients. Eventually an assistant at the clinic blew the whistle and alerted Sid’s owners, who rescued their dog and sicced the law on the worst veterinarian since Dean Jones menaced Beethoven.

Dr. Nancy Snyderman, NBC’s medical expert, endangered the public by defying a voluntary quarantine for possible Ebola exposure,  because she just couldn’t bear to be without her favorite soup.

There’s really no denying it: some conservatives have persistent hang-ups about race, and it undermines their more rational, perceptive views on other matters. A relatively trivial but revealing example occurred in the aftermath of the Sony computer hack by North Korea (or Hacker X). One of the revelations was that Sony, which owns the James Bond franchise, was seriously considering re-booting the character, currently played by the estimable, but aging, Daniel Craig, with a black  British actor (be sure to mock anyone who calls him an “African-American), Idris Elba.

If you are unfamiliar with Elba, you should watch the British series “Luther” on Netflix. He’s terrific: athletic, sexy, charismatic and passionate, not to mention his  aura of cold-bloodedness and danger—in short, perfect for James Bond. But Rush Limbaugh, apparently seeking to retroactively validate the title of Al Franken’s book, “Rush Limbaugh Is A Big Fat Idiot,” decided to use the threat of non-traditional casting to make liberal heads explode, his mission in life:

“That’s NOT who James Bond is, and I know it’s racist to probably even point this out: We had 50 years of white Bonds because Bond is white. Bond was never black. Ian Fleming never created a black Brit to play James Bond. The character was always white. He was always Scottish.”

It is hard to pack so much idiocy into five sentences, but Rush is up to the task. James Bond is a British secret agent: race doesn’t factor into the stories at all. We’ve had 50 years of white Bonds because that’s the conventional way of portraying the character, that’s all. Rush’s argument here is just “Everybody does it.” So what? James Bond movies are entertainment, and if an entertaining James Bond film can be made with Elba as Bond, and there is no reason in the world why not, then James Bond can be black. Continue reading

Ethics FYI To Hollywood, Pundits And Al Sharpton: There Is Nothing Racist–Or Unethical—About The Hacked Denzel Washington Memo

Does anybody even bother to think about what racism is any more before accusing people of it? Do journalists think about the circumstances before they parrot knee-jerk accusations of racism from the likes of Sharpton and others? Based on the evidence of reaction to the infamous memo from a Sony honcho regarding the performance of Denzel Washington pictures abroad, apparently not.

Everywhere, this screed by an unnamed Sony executive is being called “shocking,” “unbelievable,” and, of course “racist.” It is nothing of the kind. In a scenario that reeks of the surreal Samuel L. Jackson fiasco where Ethics Alarms was virtually alone in noting that Jackson’s on-air accusation that a white TV host had confused him with fellow black star Lawrence Fishburne because “all blacks look the same to him” was unfair and completely meritless, the news media is just running with a demonstrably false accusation.

Here are the relevant portions of the e-mail exchange based on what has been reported in the media:

“I am not saying The Equalizer should not have been made or that African American actors should not have been used (I personally think Denzel is the best actor of his generation.) [But] Casting him is saying we’re ok with a double if the picture works. He’s reliable at the domestic [box office], safe, but has not had a huge success in years. I believe…the non event pictures, extra ‘bets’ should have a large inherent upside… Here there isn’t a large inherent upside….I believe that the international motion picture audience is racist – in general, pictures with an African-American lead don’t play well overseas…Sony sometimes seems to disregard that a picture must work well internationally to both maximize returns and reduce risk, especially pics with decent size budgets.”

Let’s examine this “unbelievable” e-mail, line by line and then as a whole, for ethical misconduct and incipient racism:

“I am not saying The Equalizer should not have been made or that African American actors should not have been used (I personally think Denzel is the best actor of his generation.)”

No problem there, right?

“[But] Casting him is saying we’re ok with a double if the picture works.”

The baseball analogy, a “double” over a “home run,” is a conclusion based on Washington’s films’ grosses and hard facts, not racism. It is a legitimate opinion, and one that in a business context must be made as a matter of fiduciary duty. Foriegn box office is about half (or more) of a typical film’s profit. If a star isn’t as popular in foreign markets as in the U.S., then metaphorically speaking, a “home run” is more difficult, and maybe impossible. Continue reading

“It’s Unethical To Be A Weenie,” Part II: Our Craven, Terrorism-Validating Theater Chains

Regal Cinemas, Cinemark, Cineplex, Bow Tie Cinemas, Carmike and AMC Theatres will not show “The Interview” because the North Korea-based hackers that breached Sony Pictures Entertainment e-mail security threatened movie theaters and moviegoers who attend screenings of the satire. More theater circuits are expected to follow, because terrorism works especially well against weenies.

Leading the way for this disgusting weenieism display were first, Sony itself, which reportedly toned down the film in response to earlier threats from the group, and then the stars of the comedy, James Franco and Seth Rogan. They both cancelled all their publicity appearances and are evidently hiding under their beds, caving to the dictates of unknown critics who are almost certainly not in the country. Oooh, but they’re so scary!

First they stole emails from Sony executives to retaliate for the comedy’s story line, which involves an assassination attempt on the life of North Korean leader Kim Jong-Un by two morons. Then the group issued a warning referencing 9-11 and warning Americans, to stay away from theaters showing “The Interview”:

We will clearly show it to you at the very time and places The Interview be shown, including the premiere, how bitter fate those who seek fun in terror should be doomed to. Soon all the world will see what an awful movie Sony Pictures Entertainment has made. The world will be full of fear. Remember the 11th of September 2001. We recommend you to keep yourself distant from the places at that time. (If your house is nearby, you’d better leave.) Whatever comes in the coming days is called by the greed of Sony Pictures Entertainment. All the world will denounce the SONY.”

Or All your base are belong to us.

The David Manning Liar of the Year: Tim Kaine

Democratic Party National Chairman Tim Kaine’s insulting, damaging and dumb performance before the media in the days leading to the election warrant a brief revival of a monthly award regularly handed out on Ethics Alarms’ predecessor, The Ethics Scoreboard. It is the David Manning Trivial Liar Award, and since I handed the last one out here almost exactly a year ago, I may have to make it a yearly tradition. As I wrote on November 3, 2009, shortly after this blog debuted,

“The David Manning Trivial Liar” highlights the public lies nobody could possibly believe. It was named for Sony’s “defense” when it was revealed that the movie critic, “David Manning,”  whom they advertised as raving about lousy Sony films like “The Animal” (Starring Rob Schneider as a guy who accidentally has animal DNA grafted…oh, never mind…), was a fake invented by their marketing division. Sony said, in essence, that it was no big deal because everyone knows those critical raves in movie ads are mostly lies anyway. I didn’t carry the feature over to Ethics Alarms, because the kind of transparent, shameless, “I’m going to say this anyway even though it will have America rolling its eyes” lie the feature was designed to condemn didn’t come around every month.”

On Obvious Lies and Sen. McCain

I have long been fascinated by the self-evident public lie. Sometimes the product of desperation, sometimes arrogance, sometimes contempt, each example poses a set of equally unattractive interpretations. Does the liar really believe the obvious lie is true, in which case he or she is deranged? Does the liar think that enough people will believe something so demonstrably false, meaning that he or she holds a deplorable lack of respect for the intelligence of the public? Is the liar so fearful and cowardly that he or she cannot summon the integrity to admit what is obvious, even though doing otherwise looks ridiculous? Or, as is surprisingly often the case, does the liar have so little regard for the truth and such a deficit of shame for lying that he or she doesn’t care that the lie is obvious?

When elected officials and others holding high office resort to the obvious lie in a matter of any importance, it should disqualify them from continuing in office. An obvious lie obliterates public trust. For example, when Janet Napolitano had the gall to pronounce department’s anti-terror airplane security measures a success because, be sheer luck, passengers foiled the so-called “Underwear Bomber,” she forfeited any future trust in her honesty of competence. (She is still Secretary of Homeland Security, however.)

The excuse sometimes offered by obvious liars after the fact is an ethics “Catch 22.” They argue that an obvious lie is a harmless lie, because nobody could possibly believe it. (Over on “The Ethics Scoreboard,” a spectacular version of this argument launched the continuing feature of “The David Manning Liar of the Month,” after Sony tried to justify its use of a fictional movie critic, “David Manning,” to attach glowing—but fake— blurbs to lousy films, like the Rob Schneider comedy “The Animal.” When its deception came to light, Sony protested its practice was harmless because nobody believed critical praise in movie ads anyway.) The defense conveniently ignores the question of why anyone would offer a lie they didn’t expect anyone to believe. It is really a consequentialist scam: if I try an outrageous lie and it works, great; if it doesn’t, then it wasn’t a lie.

What do we make, then, of Sen. John McCain’s stunning claim in a recent Newsweek interview that “I never considered myself a maverick” ? Continue reading
