All Americans owe a debt to the many non-profit organizations across the country dedicated to freeing innocent prisoners, some of them sentenced to die, who were wrongly prosecuted and convicted as a result of breakdowns in the justice system or prosecutorial corruption. Their work has served as an invaluable fail-safe, it has focused attention on needed reforms, and it has rescued innocent lives before they were completely destroyed. As a reminder of the corruptive power of good intentions, however, the recent release of a convicted murderer put in prison by one of these organizations serves as an ethics cautionary tale. Apparently one such “innocence project” believed that it was worth sending an innocent man to prison for a murder he did not commit in order to save the man originally convicted of the crime from execution.

In 1998,* Illinois death row inmate Anthony Porter, convicted in the 1982 murders of Marilyn Green and Jerry Hillard, was apparently proven innocent 48 hours before his scheduled execution. A Northwestern University professor and his students working with the Medill Innocence Project had obtained a videotaped confession by a man named Alstory Simon, admitting that he, not Porter, was the real killer. Porter was ultimately released, in 1999.

The governor of Illinois at the time, George Ryan, a longtime supporter of the death penalty, claimed that he was so shocked by the near fatal miscarriage of justice that he halted all executions less than a year after Porter’s exoneration. Eventually he commuted the sentences of every prisoner on death row, saying the state’s capital punishment system  could not be trusted. The Simon confession leading to Porter’s exoneration drove the shift in public opinion that caused the Illinois death penalty’s demise in 2011.

Happy ending? Not exactly. In 2005, witnesses who implicated Simon announced that they had fabricated their stories in exchange for money and a promise by the Northwestern professor, David Protess, that he would work to free two incarcerated relatives of one of the witnesses. Then Alstory Simon recanted his confession, saying that he had been persuaded by a faked videotape of witnesses implicating him in the crime, and promises of a short prison sentence and a movie deal if he confessed to a crime he didn’t commit. Last week, an Illinois judge ordered Simon released from prison after  prosecutors agreed that he was probably not guilty. He had spent almost 15 years in prison. Continue reading →

The GOP’s Favorite Unethical Tactic: Deceptive Mailers

McConnell mailerIt’s not sufficient, apparently, that Senator Mitch McConnell’s (R-Ky) Democratic opponent Allison Grimes has thoroughly disgraced herself (See here and here, and that’s not all, but I didn’t want to pick on her with so many other unethical candidates running under the banner of either political party) and probably squandered any chance she had of unseating the GOP Minority Leader. So  the Republican campaign geniuses decided to attack this not-ready-for-prime-time politician using a tactic out of former Republican Chairman Michael Steele’s playbook. That means unethical, for those of you who didn’t follow Steele’s slimy reign.

In 2010, Steele approved the GOP sending out mailers disguised as official U.S. Census documents twice, the second time after the House of Representatives had rebuked the despicable tactic and voted unanimously to make them illegal. Since then, the GOP has hectored those citizens foolish enough to contribute to a Republican candidate with mailings deceptively designed as renewal notices, as if something would expire if you didn’t send in another check. This is a sleazy method of inducing someone to open junk mail, and it shows how thoroughly mass mailing is dependent on influencing the dim, timid and too forgiving that such dishonestly packaged appeals work. Happy Halloween! Scary Unethical Quote Of The Week: MSNBC Host Alex Wagner

“In Georgia, state Democrats printed a flyer warning that the way to prevent “another Ferguson” is to vote. Arkansas residents meanwhile, received a mailer showing a man in a hands-up, don’t shoot position made infamous in the wake of Michael Brown’s killing. The mailer reads: “If we want to end senseless killings like Michael Brown in Ferguson, Missouri, we need to vote . . . It’s important to say that it shouldn’t have to be the threat of undermining civil rights that gets people to vote, but if it does, so much stronger the party is for it.”

—MSNBC talking head Alex Wagner, acknowledging the desperate, last-ditch effort by the Democratic Party to energize its African-American base by racial fear-mongering, and endorsing it in epic “the ends justify the means” fashion.

I remember my father announcing during the Nixon re-election campaign that the cynical GOP “Southern strategy” is which it catered to old-line Southern Democratic voters with direct appeals to racist myths and fears that he was changing his registered party affiliation from Republican to Independent, because he refused to belong to a party that would engage in such divisive and despicable tactics just to win elections. It is hard to imagine any conservative-leaning broadcaster, commenting on these scare-tactics at the time, both acknowledging them and pronouncing them regrettable but, all in all, good for the party. Yet this is exactly what Wagner did.

It exposes many things: the ethical deficit at MSNBC, progressive approval of the strategy of exacerbating racial discord and division in America, and the open, seven year-long strategy of Democrats resorting to race-baiting as the solution of last resort whenever the party’s performance and policies are subjected to fair criticism. The statement also exposes partisans like Wagner as ethics corruptors of all who hear them and are gullible enough to believe they speak the truth. Winning by lies and undermining racial comity in America makes nothing and nobody stronger. Even if such a tactic is successful in the short-term, it is devastating to democracy and the culture. No party that stoops to such gutter tactics is worthy of support by anyone who believes in basic ethical values.

James O’Keefe calls himself an investigative journalist, but that’s not what he is. A real investigative journalist would look for the truth, whichever political party a particular set of uncovered and inconvenient facts happened to make look bad.O’Keefe is only interested in getting dirt on Democrats and their allies.

A real investigative journalist would also follow, or know he was supposed to follow, or at least make some effort to follow, the tenets of journalism ethics, which frown on using trickery, lies and surreptitious recording to obtain stories. This is all O’Keefe does. His oxymoronically named Project Veritas uses people posing as someone they are not, spouting misrepresentations,  to obtain video evidence of corruption in the bowels of political activism…Democratic political activism, that is. Recently, O’Keefe got various supporters of and volunteers for Allison Grimes—you know, that former Democratic National Convention delegate for Barack Obama running for U.S. Senator under the banner of Democratic Party in Kentucky who refuses to say that she voted for the current Democratic President?—to opine that that the candidate’s vocal support for the coal industry was a sham. As always with O’Keefe’s stings, the dedicated Daily Koses huffed and puffed and explained why the videos were misleading (the usual excuse is that the victims “caught in the act of being themselves,” as Candid Camera creator Allen Funt used to say, were “going along” with O’Keefe’s sham. Allison Grimes Ethics: Do Parties, Candidates And Citizens Really Think Lying Is A Legitimate Campaign Strategy?

This is hard for me. Senate Minority Leader Mitch McConnell (R-Ky)is among my least favorite U.S. Senators, and conservative hit man James O’Keefe defines unethical journalism. But O’Keefe’s sneaky tactics, the smug candor of McConnell opponent Alison Lundergan Grimes’ staff and supporters, and her own blatantly misleading statements make it obvious that she and the Kentucky Democrats think that it is acceptable to lie outright about a crucial policy issue to win an election. It isn’t. Any candidate who thinks that way is unqualified for office. I’d love to see McConnell lose to an ethical candidate on his merits. or lack of them. Grimes, however, is a liar, and apparently her staff and supporters are fine with that.

O’Keefe-produced videos show five employees of the Grimes campaign, local Democratic Party affiliates and a key supporter opining that Grimes is faking her support for the coal industry out of political expediency, and will default to the national party’s anti-coal stance the second she hits Washington. Is There An Ethical Interpretation of Hillary’s Response To The Illegal Immigration Activist In Iowa?

In case you missed it while waiting for the next NFL player to beat up someone, Hillary Clinton, who is in Iowa theoretically testing the waters for a Presidential bid, answered this way when pressed by an activist on the rope line to give her views on President Obama’s delay of his promised executive order granting some privileges to illegals…

“I think we have to elect more Democrats.”

What did she intend to convey by this, and can such an intent possibly be defended? Some possibilities:

A. Translation: “I am running for President, and to be successful, I can’t possibly tell you my real views on this topic, since whatever position I take will lose votes. So I’m going to answer with a non-sequitur, as if I didn’t hear the question.”

Is this ethical? No. It’s an important issue, and if she is running for President, she has an obligation to communicate her views. If she has a position but doesn’t have the integrity and courage to communicate it, that’s cowardly and a breach or responsibility.

B. Translation: “We risk losing at the polls in November if voters know what the President really intends to do, and those who stand to benefit from his unilateral act circumventing the democratic process will vote Democratic anyway, even if the delay infuriates them. So it’s the smart move.”

Is this ethical? Surely not. It’s an admission that the President is trying to gull low-information voters, and that she approves of the strategy. It’s an expression of support for allowing the deportation of human beings for speculative political gain. It’s an endorsement of “the ends justify the means.” Continue reading →

 Alcoholism is a national scourge that destroys lives, families and businesses, and  often kills both sufferers and those they interact with. It it is incurable. One of the few effective methods of keeping alcoholism under control is the Twelve Step program developed by Bill Wilson in the 1930s, and taught by the organization he founded, Alcoholics Anonymous. Millions of Americans attend AA meetings every day, including many who are very close to me.

Dean Kendrick works for CBS affiliate KPIX-5 in San Francisco, and he’s apparently an Alcoholic Anonymous member. This means that 1) we shouldn’t know he’s a member, and 2) especially that he shouldn’t be revealing, especially on television, that anybody else is a member, and 3) he absolutely should not be revealing what someone said or how they acted at a meeting he attended, and 4) this even applies to Robin Williams, dead celebrity that he is. PETA’s Unethical Treatment Of Human Beings

From whence comes PETA’s compulsion to periodically make the organization look as unethical and/or deranged as possible? If I were not charitable by nature, I would say that it was because the leadership of the organization is constitutionally unethical, and nuts. I suspect that the real answer is close to that, but it’s not exactly right. I think that PETA’s concept of ethics begins and ends with “the ends justfy the means,” that they are so besotted with the rights of animals that they dehumanize people, and that arrested juveniles run the organization.

The latest jaw dropper from People for the Ethical Treatment of Animals is to use money to induce poor people in Detroit to comply with PETA’s vision of an ethical lifestyle. From the PETA website:

“With jobs in Detroit disappearing, many residents are struggling. As they’re forced to choose which bills to pay, the Detroit Water and Sewerage Department has chosen for them―shutting off water and leaving many people high and dry. The department put the shutoffs on a temporary hiatus, but people’s water bills are mounting. So with the help of a generous PETA member, we have come up with one small way to assist Detroit residents and save animals, too.Thanks to this donor, PETA will be able to pay off the water bills for 10 families who commit to going vegan for one month. We’ll also help them get started by giving each family a basket of healthy vegan foods and recipes.”

In other word, PETA is exploiting the most vulnerable citizens of the urban wasteland known as Detroit to turn them into human billboards for the group’s utopian vision of an animal-friendly world. Continue reading →

Flunking Responsibility, Honesty, Common Sense and Ethics: Gov. Deval Patrick, Sen. Patrick Leahy, Daily Kos, and Anyone Else Who Repeats This Idiotic Analogy

I thought I might run an ethics quiz asking whether this current and mind-bogglingly stupid argument that keeps popping up from my sentiment-addled Facebook friends is more unethical than the pro-Hamas hashtags being appended to twitter comments by the “Think of the children!” saps led by celebrities like Jon Stewart, Selena Gomez, and John Cusack. Pondering on it, however, I realized that as ethically misguided as Stewart at al. are, the above quote and its ilk are worse….especially since state governors and U.S. Senators have more credibility than comedians and Disney pop tarts. Not that they should, mind you.

If I really have to make a detailed argument explaining why Deval’s quote and  Leahy’s ( “Think of all those Jews that went to the ovens because we forgot our principles. Let’s not turn our backs now.”) are unforgivably irresponsible, we are just as dim-witted as those demagogues (or, more likely, as dim-witted as they hope and think we are.) The statements are no more nor less than an invitation to every parent of every child in every poor, war-torn, politically foul, culturally poisoned, dangerous, corrupt nation in the world to somehow get them to the U.S. border, paying shady and often treacherous agents to do so, because the United States will not “turn its back,” and turn them back. The question isn’t whether this is a legitimate, responsible or sane position worthy of debate and serious consideration: of course it isn’t. The question is how anyone can think it is.
