Plan J From Outer Space, And Related Scary Tales

All right, all right, “Plan J” is not really from outer space.  It’s really from the ever fertile mind of Democrats and the resistance, who are now dedicating their efforts on a new, weird, cultural theory to get rid of Donald Trump, one that has its dark routes in Salem, Massachusetts. Plan J—that’s my name for it, not theirs, as I explained here—isn’t quite as bizarre as the Ed Wood camp classic the headline evokes, “Plan 9 From Outer Space,” (If you’ve never seen it, shame on you: you can become culturally literate here) but it’s a lot scarier.

As it has been recently defined, Plan J holds that if  women, who must be believed, accuses a man of sexual harassment or sexual misconduct, no matter how long ago the alleged offense occurred, whether or not it relates to the accused individual’s current psoition,  whether there is any supporting evidence, whether the alleged incident or incidents were a criminal or a civil violation, regardless of how serious they were and regardless of whether the alleged offender denies the allegations or whether the accusations were known to those who placed him or her in their current position, the targeted individuals must be shunned, punished, and forced into virtual exile, if not erased from the culture entirely.

By establishing the new due process-bypassing, proportion-defying and fairness-erasing  social norm, those who have seen their Plans A through I (also enumerated here) either fail miserably or founder have new hope that they may  yet force the President of The United States to resign, thus bypassing those messy and inconvenient things called “elections.”  In order to set this bold new social norm, every celebrity or powerful person who even vaguely fits a Trumpish template regarding accusations of sexual misconduct must be hounded, attacked, derided or shamed.

It’s really remarkable. Of course, Plan J only became feasible as a result of the Harvey Weinstein scandal, and the subsequent rush of #MeToo-ers to see who they could take down, rightly or wrongly.

There is a certain perverted brilliance to Plan J. Sexual harassment is a filthy, unethical perk of the powerful that had been allowed to harm too many for too long, and was an accepted feature of too many cultures, like government, business, and show business.  Thus the pent-up fury sparked by the revelations about Weinstein was justified. But as with The Terror that followed the French Revolution, the legitimate anger and determination to reform the culture also created a different kind of power that corrupted the reformers. The ability to destroy with a pointed finger is intoxicating.

In many cases, the results have been beneficial: the identification of corrupt cultures and the unmasking of genuine workplace predators like Weinstein, Kevin Spacey, and Matt Lauer. In other cases, the fates of the accused have seemed wildly disproportionate to the offenses, although often the reaction of the accused have hastened their demise. The tally of individuals taken down by this frenzy now totals 97 men and one woman—Wait! Make that 98 men: Jerry Richardson, the owner of the NFL’s Carolina Panthers, announced that he was selling his team hours after the NFL announced that it would be investigation sexual misconduct claims against him.  Thus Plan J was born: Hey! Why not President Trump?

If due process and sufficient evidence weren’t required to destroy so many others who once had power and influence, surely Sen Kristin Gillibrand’s insistence that as long as she and enough Trump-hating journalists found his accusers “credible,” the fact that none of the alleged acts were criminal, that they did not occur while he was in office and could not possibly be impeachable, and the fact that he was elected with the public’s full knowledge of the allegations were no longer a bar to an effort to force him to resign.

There are logical and ethical problems that have to be steamrolled in the process, however, if “the resistance’s” dream is to come true. 1  How the NFL defines good leadership..The news today that the most recent result of  examinations of deceased former football players’ brains shows 99% of them with CTE puts an especially harsh light on the NFL’s new contract with Commissioner Roger Goodell, who was promised hundreds of millions of dollars  to serve in the same role he has botched for another seven years. Well, botched is a relative term, I suppose. True, Goodell has made it clear that his league is the least ethical, most venal, and most brutal sports organization on earth. Over his 11 year tenure so far, he proved that the league only regards its star behemoths beating up women after there is a public outcry, then tosses away due process to levy illegal punishments for show. Goodell first denied that the science showing that his game’s routine and unavoidable concussions were deadly, then had his lawyers negotiate an unconscionable low-ball settlement with the desperate families of former players his modern day gladiatorial combat had crippled (it was declared so by a judge, and thrown out), and now says the league is addressing the problem, which it isn’t. Meanwhile, every game, play by play as fans cheer, more young men are  sent on their way to a premature, drooling death by brain damage.

Goodell’s biggest star, Tom Brady, and most successful coach, Bill Belichick, are smug cheaters. For the last year, fans paying three figures a game for their seats have had to watch their National Anthem marred by various player protests about..something. Ratings and attendance have fallen; polls show that the NFL is the most disliked sport in America, which it should be, since it kills people,  promotes felons and cheaters as heroes, and abuses its fans. But this isn’t considered a botch by the Commissioner, says the New York Times, because “during his tenure as commissioner…Goodell has helped team values skyrocket, and the owners are betting that will continue under his leadership.”

That sentence explains everything, doesn’t it?

2. Welcome to “the resistance” Plan J.  Review: Plan A was to reverse the election by hijacking the Electoral College. Plan B was pre-emptive impeachment. Plan C was the Emoluments Clause. Plan D was “collusion with Russia” (The New York Times, to give credit where it is due, actually created a chart to explain this one, and if it isn’t obvious to you how pathetically weak the case is, you played NFL football…), Plan E is”Trump is disabled because he’s a narcissist and a Republican, so this should trigger the 25th Amendment.”, Plan F, the Maxine Waters plan, is to just impeach the President because she really, really doesn’t like him, Plan G is “The President obstructs justice by firing incompetent subordinates,” Plan H is “tweeting stupid stuff is impeachable,” Plan I is “Let’s relentlessly harass him and insult him and obstruct his efforts to do his job so he snaps (see E) and does something really impeachable.”

Senator Kirsten Gillibrand unveiled Plan J, since the others are absurd, when she demanded that the President should resign now for unproven allegations of non-crimes, when none of the misconduct occurred during his tenure as Presidency.  This is impressive, because it is just as ridiculous and desperate as the other plans, and I thought they had exhausted the possibilities. At a Congressional hearing examining Deputy Attorney General Rod Rosenstein  Texas Democratic Rep Sheila Jackson Lee insisted that women who accused non-President Trump of sexual harassment can report it to the FBI.  That’s right: now the FBI should be investigating illicit kisses, “groping,’ and my personal favorite, walking into a Miss USA dressing room where the contestants might be in various states of undress.

These aren’t crimes, they aren’t prosecutable, and they aren’t even close to the FBI’s mission and duties. Continue reading →

The Democrats Are Apparently Determined To Be The Asshole Party, And They Should Be Called On It

The questions by Democratic Congressman Luis Gutierrez  during Deputy AG Rod Rosenstein’s hearing today mark him as far worse than a mere Ethics Dunce. It even exceeds the outrageous disrespect of President Obama displayed by GOP Congressman Joe Wilson when he shouted out “You Lie!” during a State of the Union address. Guiterrez—who opposes the rule of law and advocates open borders, just to put his principles and priorities in context— has been emboldened by the divisive and destructive abuse of the President by Reps. John Lewis, Maxine Waters and Frederica Wilson, among others (including Hillary Clinton), and more recently by the irresponsible and dishonest demand by Senator Gillibrand that the President resign for unproven, non-criminal conduct that took place, if at all, long before he was elected President, and that voters ratified by virtue of electing him.

Mostly, however, Guiterrez was moved to disgrace his office and the House of Representatives because he is an asshole—there’s no other word for it—who knows that his party will not discipline him, as it should,  for this most disgusting display of unprofessional conduct and hate-mongering. Funny, she doesn’t LOOK like Chairman Mao…

“If some innocent men’s reputations have to take a hit in the process of undoing the patriarchy, that is a price I am absolutely willing to pay.”

—Feminist writer Emily Linden, in the most unethical portion of an unethical twitter screed. After it was roundly attacked as the despicable, sexist, Left- facist, “by any means necessary” mind poison that it is, she hid her Twitter account. But of course.

Here is her whole yuck-pooie! rant:

“Here’s an unpopular opinion: I’m actually not at all concerned about innocent men losing their jobs over false sexual assault/harassment allegations…false allegations VERY rarely happen, so even bringing it up borders on a derailment tactic. It’s a microscopic risk in comparison to the issue at hand (worldwide, systemic oppression of half the population)…The benefit of all of us getting to finally tell the truth + the impact on victims FAR outweigh the loss of any one man’s reputation..If some innocent men’s reputations have to take a hit in the process of undoing the patriarchy, that is a price I am absolutely willing to pay.”

Yes, Emily is absolutely willing to pay a price that involves devastating harm to someone else. This woman is allegedly a writer, and yet delivered a rhetorical punch to he own jaw like that. Wow. Continue reading →

Puzzled As To How Any Conservative Or Republican Can Continue To Support Roy Moore? Don’t Be. We’ve Seen This Many Times, And For The Same Reasons…

Here is how Moore’s defenders are thinking, if you can call it that.

The Hill, from 2011:

During an appearance on HBO’s “Real Time with Bill Maher,” [actress/comic] Janeane Garofalo said, “Anthony Weiner deserves to be supported and hopefully he will be mayor of New York one day. I’m serious. He is a Democrat [who] actually fights for the things liberals and progressive and rational people care about.

The man, a member of the House of Representatives, was sending pictures of his penis to women, in some cases without warning or their consent. He, like Moore, then lied about it.

In both cases, the conduct was disqualifying, and any objective individual should be able to see that. But extreme partisans and ideological zealots are not objective, nor rational, nor ethical. Their ethics alarms don’t work; they believe that the ends justify the means, like Garofalo. They are corrupted. This is why public servants like Weiner, Moore, the Clintons, and Trump are ethics corrupters. Then the people they corrupt, like Janeane Garofalo, use their own collection of rationalizations and false arguments to corrupt others.

The defenders of Weiner were exactly the same, in this regard, as Moore’s defenders.

The self-righteous progressives who have repeatedly spoken and written as if Moore’s defenders are some kind of incomprehensible enablers of evil are endowed with remarkable powers of amnesia and a stunning lack of self-awareness. The mocking contempt that is oozing from social media is the apotheosis of rotting integrity.  Boy, those Republicans are disgusting to try to defend and make excuses for Roy Moore! It is disgusting, but if you applauded hyper-partisans doing the same thing when the scandal was on the other foot, you really should shut up. (I’m looking at you, Bill Maher…)

Ethics Alarms, in contrast, has worked hard for the right to condemn every one of them, because it is character and conduct that matter here, not policy positions and ideology.

Ethics Dunce: Donna Brazile, But Not For The All The Obvious Reasons…

“Now, it’s my understanding that as a CNN contributor, you won’t make me follow any of that ethics crap, right, Jake?”

In her new book, “Hacks: The Insider Story of the Break-ins and Breakdowns That Put Donald Trump in the White House,” Suddenly Ethical Donna Brazile takes a moment  to slam Jake Tapper because he harshly criticized her after a leak reveealed that she had used her CNN position to procure debate question and pass them along under the table to Hillary. (Of course, if Clinton had any integrity, she would have refused—what am I SAYING?).

She wrote,

“The next day, even Jake Tapper took a swing at me, calling me unethical and ‘journalistically horrifying’ during a radio interview with WMAL even though I worked for CNN as a commentator not a journalist.When I called him on this, he did not apologize. His attack on me was really about him. He wrote in an email, ‘I don’t know what happened here except it undermines the integrity of my work and CNN … you have to know how betrayed we all feel.”

OH! Donna was a contributor, not a journalist! That changes everything! So as an individual who was contributing to a journalism product, as well as paid to do so, and being relied upon by journalists in a journalism-supplying entity to inform their audience honestly regarding what journalism covers by definition, Brazile as a paid contributor should not have been expected  not required to tell the truth, be fair, maintain standards of integrity, state her biases and conflicts up front, or indeed engage in ethical conduct at all!

Is that the new definition of what “contributor” means? Boy, I think CNN needs to clarify this; I always assumed that if a network employed a “contributor,” that individual was being presented as someone who would be held to the same standards of professionalism as other on-screen employees. A DACA Popeye For NYT Pundit Paul Krugman

Readers often accuse me of being angry. I’m almost never angry about the stories I write; I just write that way. In this case, however, I am angry.

Paul Krugman, a nasty, smug, narrow-minded New York Times pundit who epitomizes the infuriatingly common progressive mindset of condescending to anyone who disagrees with his various, so often biased and ignorant positions on a plethora of issues he knows little about and understands less, used today’s op-ed column to call me a racist. Not just me, of course: all the various constitutional scholars and lawyers, elected officials—and Hillary Clinton, once upon a time—who don’t believe that the United States should be obligated to allow illegal aliens to stay in the United States however they got here, or who don’t believe Presidents should use edicts instead of the legal process described by the Constitution to pass laws, or who don’t believe it is responsible or sensible to create incentives for individuals to break our laws so their children will benefit. For they are all racists according to Krugman. And of course,the President is a racist. Krugman writes,

To yank the rug out from under the Dreamers … is a cruel betrayal. And it’s self-evidently driven by racial hostility. Does anyone believe this would be happening if the typical Dreamer had been born in, say, Norway rather than Mexico?

“Rug”: what rug? There was never a rug, just an incompetent  President who wrongly sent the false message that the United States wouldn’t enforce its sovereignty. What the “dreamers” had was a contrived loophole, and loopholes have a way of closing.

“Cruel” : enforcing a law isn’t cruel unless the law itself is cruel. A nation cannot permit illegal immigration, nor can it tolerate illegal border-crossers inflicting sentiment-inducing problems for the nation in which they have no justification for invading. Thus the law isn’t cruel.

“Betrayal” implies that someone has breached a duty on which another had a reason to rely. The United States has a duty to its citizens to enforce its laws. It owes no duty to law breakers, in this case  illegal immigrants whatsoever. If they relied on misrepresentations by cynical and self-serving politicians and activists, it is their own responsibility.

“Self-evidently driven by racial hostility.” When the progressive collective—you know, like Star Trek’s Borg—have no fair, substantive arguments left, crying racism (sexism, homophobia, xenophobia, Islamophobia…) is so routinely the default tactic that I’m amazed they can keep doing it without covering all their mirrors with towels. This is how low they have sunk: “If you don’t see it our way, you are an evil bigot.” That’s it. That’s all they have, when they run out of rhetorical bullets.

If Norwegians were sneaking into the country, using our resources,  hanging around in parking lots waiting to be hired to clean attics, mow lawns and pick fruit, while ducking law enforcement, voting illegally, forging documents, and some of them now and then raping and killing Americans after being depoter multiple times, yes, Paul, you race-baiting demagogue, this would still be happening. Morning Ethics Warm-Up, 9/8/17: Hybrid Topics! CNN, Hillary, DACA And More…

Good morning, all.

1 The Public Interest Legal Foundation, a conservative non-profit public interest group that focuses particularly on voting issues, claims to have data suggesting that Hillary Clinton’s narrow win in New Hampshire in the 2016 election—about 2,700 votes gave her the state—may have been achieved by fraud. A study showed that more than 6,000 voters in New Hampshire had used the state’s same-day voter registration procedures to register and vote.  The current New Hampshire speaker of the House, Shawn Jasper, sought and obtained data about what happened to these 6,000 “new” New Hampshire voters who showed up on Election Day. Most of them are no longer in the Granite State. Only 1,014 have ever obtained New Hampshire driver’s licenses. Of the 5,526 voters who have not, just 3% have registered a vehicle in New Hampshire.  70% of the same-day registrants used out-of-state photo ID to vote in the 2016 presidential election in New Hampshire and to utilize same-day registration.

All of which suggests that it would be prudent if a group other than a right-wing advocacy organization did an unbiased and objective study.  Since Democrats won several top races last year along thin margins, notably Maggie Hassan defeating Kelly Ayotte in the U.S. Senate race by 1,017 votes, some Republicans are claiming that out-of-state voters illegitimately tilted the election. Of course, for all anyone knows, the same-day voters may have voted Republican. The episode does compel three conclusions:

  • Same day registration is a recipe for chicanery. I am suspicious of any elected official or activist who supports it.
  • The Democratic/ mainstream media cant that there is no voter fraud is incredible on its face, and manifestly dishonest.
  • The nation’s lack of eager, objective investigators without partisan agendas is crippling. I don’t believe what conservative sources and pundits conclude about the New Hampshire vote, and I find the lack of interest the liberal national mainstream news media seems to have in the story— on Google, I see New Hampshire sources and conservative sources like Breitbart, BizPac, Fox and the Washington Times—gives the story more credibility, not less.

2. For those who are still having trouble accepting that the DACA was an illegal measure as executed by President Obama, I highly recommend the article by Constitutional law expert Jonathan Turley, who explains why he regarded it as “a flagrantly legislative act by President Barack Obama.”  So did I, but he’s a legal scholar and I’m just a lawyer. From an ethics perspective, my area of expertise, I’m still disturbed at the attitude of the supporters of this Obama’s end-around the Constitution (and others). which can be summarized as, “Let’s see if we can get away with it, because we like the results.” It translates into “the ends justifies the means,” and epitomizes the drift of the Left toward totalitarian methods and philosophy. From “The Progressive War On Free Speech” Files, The Unethical Website Of The Month: “Leave Your Dog Poop On Crissy Field”

I’d like to take a national poll, a California state poll and a San Francisco poll asking who thinks deliberately littering the site of a planned far-right demonstration with dog shit is an ethical thing to do. I think it would tell us a lot.

Patriot Prayer, a far right group that has held several  “free speech” events in the Pacific Northwest, applied for and was awarded a permit to hold a demonstration today on San Francisco’s Crissy Field.  San Francisco’s officials, being totalitarians at heart and like their increasingly senile but steadily anti-speech member of Congress, Nancy Pelosi, hostile to the concept of free speech, tried to pressure the National Park Service to deny the group a permit. The Service, foolishly hewing to the Constitution, demurred. The city’s police department  planned for a riot.

To foil the demonstrators, an artist named (yes, I checked this one for being a hoax) “Tuffy Tuffington,” had a brainstorm, or perhaps shit-storm is the better description:  to make the beach uninhabitable for Patriot Prayer First Amendment protected proceedings, he urged San Franciscans to plan to festoon Crissy Field, which is normally a lovely beach by the shadow of the Golden Gate Bridge, with piles of their various dogs’ droppings

“I just had this image of alt-right people stomping around in the poop,” said Tuffy, a self-righteous asshole. He is convinced that this is the best way to respond to right wing extremists in the wake of Charlottesville.  Presumably, President Trump will be required under threat of impeachment to declare that there is nothing wrong with defiling a public place and breaking the law to make it impossible for a group to demonstrate, because it is a false moral equivalency to insist that all Americans have equal access to Constitutional speech. Comment Of The Day: “Morning Ethics Warm-Up: 8/24/17”

The debate over what kind of tolerance is required and justified in a democracy inspired reader Chris Marschner to submit a thoughful and thought-provoking comment, as he has before, that takes the discussion in a diferent direction.  I’ll let you read it and have your own reactions; Chris needs no further preface.

Here is his Comment of the Day on the post,Morning Ethics Warm-Up: 8/24/17:

Let me begin with the question, what lies as the foundation of tolerance? Is it understanding, empathy, or a just a willingness to comprehend an alternative perspective? Perhaps it is all three. By definition, tolerance is a willingness to live and let live, so to speak. But, the notion of willingness to live and let live does not preclude the actions of those who seek to change minds through cogent rational argument.

I have listened at great length to those who oppose and support the destruction or removal of Confederate iconography in today’s world. If we start with the assumption that what is right and good will triumph over that which is bad and evil in time without the need to resolve the dispute violently we might move toward a more tolerant and enlightened social structure.

My thesis is neither a defense of nor a condemnation of societal issues that continue to pit one against another. I will merely juxtapose the historical issue which divided the nation into camps that found the practice repugnant and those that found no problem with it an a modern day issue that one group find morally repugnant while others do not and attempt to draw parallels to historical events that sanctified, or at least legitimized social behavior.

Again, I am trying not to cast any judgement on any behavior but to develop my thoughts I needed to find a modern day issue that a majority segment of our population finds morally repugnant and another minority segment sees as perfectly acceptable. I then asked myself the question to what lengths might the minority segment go should the majority segment impose its will by executive or judicial fiat? How much will the minority tolerate before it finds the political majorities imposed will too much to tolerate. What issue might create substantial animus toward the ruling segment that it too may seek to enjoin itself from laws of the land. What parallels in history do we see that might engender such animus and how might future generations view the loser if the debate escalated into a full on confrontation? Continue reading →
