The Death of Raymond Zack: No Heroes, Only Bystanders

50-year-old Raymond Zack waded into the surf on an Alameda, California beach and stood calmly in the 54-degree water, apparently waiting to die. His suicide took nearly an hour, but eventually he drowned, with no rescue attempts from any of the 75 San Franciscans who gathered on the shore to watch the entire tragedy.

Why didn’t anyone try to rescue the man?

Apparently it was because nobody was paid to do it. You see, stopping Zack from killing himself wasn’t anyone’s job.

The media’s focus in reporting yet another disturbing incident with echoes of the murder of Kitty Genovese has been exclusively on the inert Alameda police and firemen who witnessed Zack’s suicide. “Fire crews and police could only watch,” wrote the Associate Press.

What does the AP mean, “they could only watch”?  Were they shackled? Held at gunpoint? Were all of them unable to swim? They didn’t have to watch and do nothing, they chose to watch and do nothing, just like every one of the bystanders who weren’t police or firemen chose to be passive and apathetic when saving a life required action and risk. Comment of the Day: “Murder House Ethics and the Validity of Feelings”

"Oh THAT! You would have cared about THAT?"

Tgt, the ghosts of whose earlier argument in series of comments haunted me prompted a revisit to the issue of murder houses and a seller’s obligation to reveal their history to potential buyers, came back with this Comment of the Day, thought-provoking, as usual:

“…I still want to know the line that determines what ethically does and does not need to be disclosed. It was never settled. This post generally boils down to another emotional appeal that something should be done in some cases. I want to know which cases and why those. Otherwise, my argument holds fast. I don’t see multiple murders (the latest clearly having nothing to do with the earlier ones) as being any more relevant than one murder.

“I also believe Jack misrepresented my position on emotion in general. Us rational humanists still mourn our dead, though we try to celebrate their lives more than anything else. While humans are not special in the concept of the Universe, we understand that we are special to ourselves and in our relations with other people. Humanism is about celebrating human life and relationships.

“As for death specifically, I see no need of a grave or burial rites. A dead body is just decomposing flesh. It does not need to be prayed for and cleansed. The person though, the lasting effects they have had on others, the memories of them – these are all important. I cried when a somewhat distant high school friend died in a freak accident at 17. I sent his family flowers on the anniversary of his death for the next 2 years. Why? Because it let his family know that he wasn’t forgotten, that he made an impact on other lives. It let them knew that people cared… people they only knew by name. I cherish the cards they sent in response. Continue reading

Murder House Ethics and the Validity of Feelings

We last visited the issue of the ethical selling of murder houses in February, when  the Jon Benet Ramsey house went on sale. I opined that even though Colorado doesn’t have a legal requirement that a seller must reveal the history of the house as long as it has no structural implications, there is an ethical obligation to let prospective buyers know about house-related events that might cause them to reconsider their decision to buy it:

“The truth is still this: there is something about the $2,300,000 house that makes it undesirable to a lot of prospects, and that means that even if the law doesn’t require the seller to tell interested house-hunters the story of the little dead girl in the basement, fairness and the Golden Rule do.”

The debate over this issue was unexpectedly intense. Ethics Alarms’ resident rational humanist “tgt” objected strenuously, writing,

“I don’t see how you can avoid the slippery slope question. Your basis is 50% of the population having a desire. Is that the cutoff? I think over 50% of people would prefer to live in a house where there hasn’t been child abuse. Go back a few years, and I bet a significant portion of the population would prefer to live in a house that had never had black occupants. Back in today’s world, more than 50% of the population doesn’t want to live in a haunted house. If a previous tenant thought the house was haunted, does the complete nonexistence of ghosts make not mentioning this a material representation? If an event is uncommon, does a realtor need to take a poll before deciding what is material and what isn’t?”

Karl Penny, however, bolstered my position:

“…the question is, does the realtor have an ethical obligation to fully reveal the history of this house. Well, the funny thing about behaving ethically is, it often requires us to act in ways that are not in our own immediate best interest… this may give a potential buyer a leverage point to negotiate a lower price for the house, to the detriment of the realtor, who could end up taking a lower commission as a result. No surprise, then, that the realtor would love to find a reason not to opt for full disclosure. But, if that realtor successfully conceals the house’s history from an actual buyer, one who would not have bought had they known otherwise? The realtor had a simple, human duty to disclose, even if it cost him money (and, yes, even if it cost me money, were I the realtor)….Jack’s right: this is Golden Rule time. If I am willing to treat with someone else in a way that I would not want anyone to treat with me, is that logically consistent (much less ethically consistent)? And would any of us want to live in the resulting society should everyone behave in that fashion?”

Now another house with a Hitchcock-worthy past is on the market: 9337 Columbia Boulevard in Silver Spring, Maryland, a state that also doesn’t require its realtors to disclose when a house has been the scene of a murder…or, in this case, three murders in the last decade. Continue reading

Comment of the Day: “Ethics Dunce: Guitarist Carlos Santana”

Michael has posted the Comment of the Day regarding my post of Carlos Santana’s criticism of Georgia’s new anti- illegal immigration law. The post expresses my continuing amazement and dismay at the strong support for illegal immigrants in the media and in segments of the public, which I view as both irrational and impossible to defend without recourse to rationalizations and dishonesty. In his comment, Michael is less critical of these defenders as he explores the factors that could make reasonable people oppose efforts to crack down on illegals.

“I can understand why reasonable people are against laws that punish illegal immigrants. I understand your conviction that a law should be either enforced or repealed, but sometimes a law is a bad law that, for whatever reason, legislators cannot or will not turn into a good law (given your frequent posts criticizing Congress, you can understand why some bad laws are not changed). When such a bad law is in place, there is often sympathy for those who break it because reasonable people conclude that, if they were in the same position as those who break the law, they would break the law as well. Death Photo Ethics

Even before Achilles dragged the corpse of Hector behind his chariot through the dust around the walled city of Troy, the tradition of demoralizing the enemy by degrading and displaying the bodies of its dead heroes was well-established. The United States was horrified when this was done to our fallen servicemen in Somalia, and it is one of the most barbaric and unnecessary practices of war.  While the Geneva Convention doesn’t mention the displaying of enemy corpses, a 2005 publication by the Red Cross called Customary International Humanitarian Law does. It was written to address issues that international treaties omitted, and its Rule 113 reads:

Ten Lessons from the “Dog Wars” Debate

Wait! Calm down! This is a CARTOON dog.

The “Dog Wars” Android phone app is apparently down for the count, the victim of too many complaints, threats and accusations that it was evil and irresponsible and promotes real, live dog-fighting, even though almost nobody sane makes similar claims about other video games. As with the subject of most posts on Ethics Alarms, however, the ethics issue lingers on, whether or not the specific incident that sparked the commentary has been resolved.

The comments, often passionate, that this post elicited have been fascinating, and had much to teach, even when the comments themselves were dubious. Here are ten lessons from the debate over the game and the Ethics Alarms commentary about it.

The MacDonald’s Beating Video, Another Dead Canary in The Ethics Mine

Last week, In the early hours of  April 18,two teenaged patrons at a Rosedale, Maryland MacDonald’s brutally beat Chrissy Lee Polis, 22, into a seizure. The attack was captured on a video recorded by Vernon Hackett, one of the MacDonald’s workers, on a cellphone camera. Other employees can be heard laughing on the video, and Hackett apparently is heard warning the attackers that the police are coming. He has been fired by the restaurant’s proprietor.  (More on this here.)

His firing was well-deserved, but it doesn’t begin to address the disturbing implications of the incident. Continue reading

My Mother’s Funeral and the Kindness of Strangers

Few things are sadder than a long life commemorated by a sparsely attended funeral. The sadness is based more on illusion than reality, I know: the best way to ensure a good crowd at your funeral is to die young. Still, no son or daughter wants to deliver a eulogy to an empty chapel, even if the attendance figures at a love one’s funeral often say little about the richness of the life being remembered.

Most of the mourners at my mother’s funeral yesterday afternoon at Arlington National Cemetery barely knew her. Many had never met her; I doubt that she would have been able to name half of them if she had encountered them on the street. Yet they came, in the middle of a workday, to make sure that my mother’s family, including my sister and me, did not have to endure the sadness of the empty chapel. It was an amazing group. Among those whose connection to my mother was solely that they knew me, there were several whom I had not seen or spoken with in years, and others whose presence immediately made me feel guilty for being out of touch with them for too long. There were colleagues from jobs I had left long ago, and old friends who had, through the relentless roadblocks that family, work and assorted crises and priorities of living, had receded into names on a Facebook list. A former fiancee…a cast member of a show I had directed long ago. They were all expending time, their most precious resource, to be kind.

I’ve been going to a lot of funerals lately, something I once avoided with a passion. I’m going to start going to a lot more, and not merely just because, to paraphrase a line from the last Indiana Jones movie, I’ve reached the time when life stops giving you things and starts taking them away. As Yogi Berra reputedly said, “You should always go to other people’s funerals, otherwise, they won’t come to yours.” I appreciate the joke, but I’m pretty sure what Yogi was talking about was The Golden Rule.

Unethical Quote of the Week: Actress Reese Witherspoon

Him: "AchOO!" Her: "You disgust me!"

“He had a very runny nose. It wasn’t appealing. It wasn’t pleasant.”

Actress Reese Witherspoon, describing to MTV in decidedly negative terms her sex scenes with “Twilight” hearthrob  Robert Pattinson in the soon-to-be-released film “Watter for Elephants.”

I’ve always liked Witherspoon, but it just doesn’t get much meaner and unprofessional than this.  Love scenes and sex scenes are potentially embarrassing for any actor or actress, and film and stage professionals recognize this and scrupulously apply the Golden Rule. If “kissing and telling” is bad, “fake sex and telling” is worse, not merely a breach of trust and confidence, not simply unfair and disrespectful, but a stunning  violation of professional standards. It is also irresponsible for an actress to attempt to shatter a film’s premise before it even opens.

I don’t know what Pattinson did or said during the shoot that provoked the actress to go out of her way to publicly embarrass him, but good luck to Witherspoon the next time she has to play a love scene with an actor. The ironic part is that Pattinson was being thoroughly professional by gamely sticking to the shooting schedule that required him to portray passion when he was suffering from a bad cold….and this is the thanks he gets.Wow.

Reese Witherspoon’s stock in trade has been playing spunky, nice girls. It seems she’s a better actress than we ever realized.

The “Baby Emma” Saga Revisited: The Core Issue

When the mother of the child an unmarried father co-created with her decides that she doesn’t want to/ can’t raise the child and doesn’t trust the father to raise her, is it ethical to put said child up for adoption without notifying or consulting the father?

That is the ethical issue the “Baby Emma” incident, first discussed here in an earlier post, ultimately raises. It is a question that I did not discuss in that post, focusing instead on the father’s conduct and his current plight, as self-described on his “Baby Emma” website. I made three ethical assessments, each of which are self-evident:

1. The whole situation would have probably not occurred if John Wyatt and Baby Emma’s mother had been married before conceiving a child.

2. Both of them were irresponsible to plan on having a child together without formalizing a mutual commitment to form a family and raise the child together…that apparently archaic institution known as “marriage.”

3. The mother betrayed John’s trust, deceived him, and treated him unfairly.

I also suggested that, absent a marriage, it is fair and reasonable that the mother of a newborn be able to put the child up for adoption if she deems that course better for the child than being raised by the child’s father. I did not say that was the law, or even that I would vigorously oppose a law that directed otherwise, as Virginia’s law does. I only stated that my own belief is that incentives for irresponsible parenthood are unwise. I have been asked why I focused on the issue I did, rather than the other ethical issues raised by the controversy. It was because the issue was brought to me with the presumption that John Wyatt, the father, was a blameless and unequivocal victim in the matter. My ethics alarms sounded: he has significant ethical accountability for the mess, and I explained why.

As to the answer to question above, I can only say this: it depends. The conduct of Baby Emma’s mother is mysterious and extreme. Did she panic? Did she have a mental break? Why would a lifetime friend and partner of a man conceive a child, pretend to plan to raise her with him, and then secretly negotiate to have the baby adopted and taken out of state?
