1 A Russian Jumbo!  And it worked! In Russia, Irina Kudinova was charged with mocking the Church after she  posted a photograph that prosecutors alleged was obscene and thus constituted the “deliberate desecration of a religious object” and “insulting the feelings of believers.”   Gee, I can’t imagine why anyone would think THAT..Here’s the photo:

The judge ruled that it was merely a photo of an Easter cake and nothing more. Elephant? What elephant? Or maybe “What elephant phallus?” would be more accurate. Kudinova was awarded 20,000 rubles in a court action for false accusations.

Few cases better illustrate the principle that in Bizarro World attempts at ethical acts become unethical. The problem is that Russia has laws that discourage free speech. In order to undermine an unethical law, the judge in this case made a ruling that is obviously contrary to reality, and what anyone can see with their own eyes. If judges can ignore evidence and deny reality to protect citizens from an unjust law, then they can do the same to unjustly punish citizens who break no laws at all.

I’m happy for Kudinova, but the Russian judge is a well-intentioned ethics dunce. His solution does as much damage as good.

Morning Ethics Warm-Up, 1/3/2018: Lists, Lust, Tweets and Twits…[UPDATED!]

Good Morning, Ethics Lovers!

1 Fake news or just bad journalism? These year-end lists are sometimes very valuable. The Washington Examiner has published what it calls “our catalogue of the shoddiest political reporting beginning Jan. 20, 2017,” It’s no surprise that most of the items appear to spring from anti-Trump bias, but not all. I’m certain the list is not complete; I’m very certain that Fox News is treated far too leniently. It’s still a useful list.

This example from the list is the kind of misleading spin that Ethics Alarms will continue to label fake news: anti-Trump distortions designed to further a Democratic constituency’s false narrative. This one was generated by a reporter’s confirmation bias that the White House was hostile to LGBT citizens, then not checked, and given a pass by an editor who was also influenced by confirmation bias:

March 29: The Golden Easter Egg

The Claim: In a first for the White House, the eggs used for the annual Easter Egg Roll will be gold instead of the usual rainbow and pastel colors.

The Source: A New York Times reporter.

The Facts: This was not the first time that the White House has used golden eggs for the annual hunt. The Obamas had golden eggs as did previous administrations.

Hell, I knew about the golden eggs. It would have been easy to check, but the journalists leaped to the conclusion that would support anti-Trump fearmongering.

2. Add it to the list! Ann Althouse caught this one:

I’m reading “Trump’s claim that he prevented air-traffic deaths is his most questionable yet” by Philip Bump at the Washington Post (and similar attacks on Trump elsewhere). But what Trump tweeted was:

“Since taking office I have been very strict on Commercial Aviation. Good news – it was just reported that there were Zero deaths in 2017, the best and safest year on record!”

Those are 2 separate sentences. They do create the impression that they have something to do with each other, but he’s only claiming that he’s been “very strict on Commercial Aviation.” (Don’t get me started on the capitalization.) He never says because of my strictness there have been zero deaths. If you see a claim, you made an inference.

Bingo. And inferences should not be published in major newspapers as facts. Trump did not claim that he prevented air-traffic deaths, and even if he had, it certainly would not be “his most questionable yet.”

3. He just can’t help himself.  I wonder how many extra approval points President Trump would have if he just had a smart, savvy, responsible tweet editor with veto power. Stupid tweets like yesterday’s retort to “Rocket Man”…

“North Korean Leader Kim Jong Un just stated that the “Nuclear Button is on his desk at all times.” Will someone from his depleted and food starved regime please inform him that I too have a Nuclear Button, but it is a much bigger & more powerful one than his, and my Button works!”

…are nothing but destructive. a) This kind of flippant talk involving nuclear war is per se irresponsible. b) It reinforces fears that the President is reckless and untrustworthy. c) It is childish, and reduces international diplomacy to playground taunts. d) It shows a flat learning curve and a frightening lack of discipline and judgement. e) It’s crude, and unpresidential.

But you knew that without me having to explain it, right? So why didn’t he?

1 Ethics Alarms Holiday Challenge! report: You did not disappoint  me. I have not read all the comments in detail yet, but the various evisceration of NBC’s jaw-droppingly stupid call for an end to freedom of speech produced at least five strong Comment of the Day candidates. I won’t re-post all of them, because Noah’s inept screed doesn’t warrant that much space, frankly. Good job!

On a related administrative note, I’m really going to try to get all the Ethics Alarms Best and Worst completed this year (having fallen short the last two), and would appreciate nominations in all categories. (Some examples are here and here, but don’t feel constrained. New categories are welcome.)

2. Doesn’t help…President Trump couldn’t resist tweeting this:

‘In the East, it could be the COLDEST New Year’s Eve on record,’ he tweeted from Mar-a-Lago Thursday night, where it is currently a balmy 78 degrees Fahrenheit Perhaps we could use a little bit of that good old Global Warming that our Country, but not other countries, was going to pay TRILLIONS OF DOLLARS to protect against. Bundle up!’ 

Ugh.

  • These are the tweets that try men’s souls. It’s just never a good thing for the leader of the country to broadcast his ignorance and deficits of critical thought.
  • It would be a bit less annoying—but still unpresidential and self-destructive,  if the President were satirizing the climate change chorus, which despite the fact that the science they claim to revere so much says its nonsense to do so, still cite individual weather events as “proof” of global warming, most recently the 2017 hurricane season. Or if he were trolling his foes, which he is often masterful at doing, trying to lure them into hypocrisy. Predictably, journalists took the bait anyway, with many suddenly becoming sticklers for the key distinction between  climate change, and weather after years and years of intentionally blurring in in their interviews and reporting. Sadly, there is no reason to believe the President was doing anything but trumpeting his own scientific illiteracy.
  • I wonder what the President’s approval ratings would be if he had never sent a tweet after taking the oath of office?

See? What does Comey have to complain about?

Fred, my topic scout, sent me this and suggested that it was the apotheosis of  Rationalization #22, Comparative Virtue or “It’s not the worst thing.”

Boy, was he right.

In last night’s episode of the Tucker Carlson show—right-wingers are actually impressed with Tucker’s skills at taking down lame liberal fanatics, which is sad in so many ways—featured the Fox News conservative dilettante agreeing with guest James Rosen, who was making the fatuous and ethically offensive point that people shouldn’t get so upset about what Trump does because the Civil War and the Cold War were worse.

This argument is the Mother of All Terrible Rationalizations, and especially bad because it spoils a good point, which is that absent historical perspective, it’s not easy to know what a real crisis is. Arguing that people shouldn’t object to something, however, because something else was worse is the mark of desperation as well as intellectual deficiency. Explain why the alleged crisis isn’t one (as in the Comey firing); explain why the assumed harm is exaggerated, or being hyped, or the product of bias and emotion. But to say, as Rosen, a “conservative historian,” which only means he isn’t an aggressive leftist like almost all of his colleagues, did,

“During Watergate, the term ‘crisis’ was thrown around as well and there were people at that time who were old enough to remember when there were legless Civil War veterans still in the streets of Washington.”

And I’m sure conservative historians were reminding those Civil War casualties while their legs were being sawed off without anesthesia that the Civil War wasn’t nearly as horrible as the Black Death. “Ah, I feel much better now,” they smiled. “Just call me ‘Stumpy!’

Never Mind “Fake News,” How Do We Protect Ourselves From “Fake Newsweek” And An Industry That Won’t Police Itself?

A Newsweek editor admitted Wednesday that he and other staffers didn’t actually read their recalled commemorative “Madam President” election issue before it was published.

Newsweek political editor Matthew Cooper said Wednesday on Fox News’ “Tucker Carlson Tonight” that the magazine’s issue, which incorrectly anticipated a Hillary Clinton win, was not produced by Newsweek but by a third party.

“Well, no one on our staff wrote that,” Cooper said. “Again, we subcontract out to a company.”

Cooper later stated that  “we did not review it before it went out.”

Carlson, who was aghast, asked at one point what would have happened if the sub-contractor, a hack outfit called Topix Media Lab, had printed “Mein Kampf” in the special edition under Newsweek’s banner.  “That would have been even worse,” answered Cooper. Continue reading →

I’m really sorry you didn’t get any in high school, Tucker (maybe it was the bow tie), but it’s still no excuse.

I’ve called out the Tucker Carlson’s conservative news and commentary website The Daily Caller for this before. Apparently this is Carlson’s sick and unethical obsession: I guess he can’t stop his sophomoric fantasies and pain arising out of being a high school nerd gazing hopelessly at cheerleaders and the occasional attractive teacher from infecting his judgment and ethical values. Thus he—and his “education editor,” Eric Owens—think rape is ethically acceptable if the rapist is hot enough.

Once again, the site reports on an example of high school teachers exploiting their male students for their own sexual satisfaction with a slimy wink-wink-snort coded piece making it clear that the Daily Caller regards the episode is one big joke. This time the tongue in cheek headline, accompanied by the photographs of the two women involved, conveys Tucker’s attitude:

I’m sorry that these two are so dominating the awards. They also dominated the posts last year. If they dominate the awards next year, God Save The United States of America…

Double Standard Of The Year

The deference accorded to anti-white protesters on dozens of college campuses, not just by spineless administrators but much of the news media. Similar protests, conduct and rhetoric by white students would be immediately condemned for what it would be: blatant racism.

 Lie of the Year

Hands Up! Don’t shoot! The lie was uttered in 2014, but acquired new status after the Justice Department unexpectedly and definitively determined that the evidence did not support the inflammatory myth that Mike Brown was shot dead in Ferguson while trying to surrender to Officer Wilson. Never mind: the lie is part of the manifesto of Black Lives Matter and similar groups; it is still alluded to by activists and shameless politicians; it still divides the nation and focuses hate on police departments; and it has contributed to getting police officers killed while making communities more vulnerable to crime. It may be the Lie of the Decade.

Uncivil U.S. Official of the Year

Justice Antonin Scalia, who crossed all lines of judicial restraint, collegiality and civility when he excoriated his colleague, Justice Kennedy, who was the fifth vote in the majority of SCOTUS’s ruling  that same-sex marriage was a Constitutional right no state could deny, with this comment in a footnote:

“If, even as the price to be paid for a fifth vote, I ever joined an opinion for the Court that began: ‘The Constitution promises liberty to all within its reach, a liberty that includes certain specific rights that allow persons, within a lawful realm, to define and express their identity,’ I would hide my head in a bag. The Supreme Court of the United States has descended from the disciplined legal reasoning of John Marshall and Joseph Story to the mystical aphorisms of the fortune cookie.”

The Jesse Jackson Award 

(For the Year’s Worst Amateur Diplomat)

Barack Obama.  I know, this is snarkier than I like to be in these awards, but the signature diplomatic measure of the past year, the astounding, one-sided, dangerous and Munich-like deal with Iran, could only be the product of an ideological tyro placing wishes and hopes over diplomatic responsibility, and not for the first time. For most Presidents, trading dangerous terrorists for a deserter would be nadir. History has seen many tragedies seeded by world leaders with no diplomatic skills: the disastrous Treaty of Versailles,  Potsdam, and the treaty that this one most resembles, negotiated by the hapless Neville Chamberlain. We can only hope that the worst case scenario doesn’t materialize, but if it does not, it will be moral luck.

The NFL, for the third year in a row. “Concussion,” Tom Brady, Deflategate, more evidence that NFL players are slowly killing themselves with brain damage, Johnny Manziel.  What a great sport pro football is.

Sports Cheat of the Year

Tom Brady, New England Patriots ball-deflating quarterback.  Brady eventually avoided punishment because the NFL botched both its investigation and its imposition of penalties, but his smirking, cynical comments about the incident made it clear that he thinks cheating is no big deal, and most of his fans agree.

Not surprisingly, Brady supports Donald Trump.

Unethical Lawyers of the Year

Law Firm Division:  Lawyers Stephen Diaco, Robert Adams and Adam Filthaut of the Florida firm Adams & Diaco were found to have “maliciously” set up the drunken-driving arrest of their opposing counsel in a  high-profile defamation trial. The plot involved a comely paralegal and a cooperative DUI cop. Last I checked, it looked like all three lawyers would be disbarred for life.

Scary Lawyer Division: California lawyer Douglas Crawford  held a can of pepper spray a yard from the face of the opposing lawyer saying, “I will pepper-spray you if you get out of hand.” Then the lawyer pointed a stun gun at Traver’s head and said, “If that doesn’t quell you, this is a flashlight that turns into a stun gun.” To show he wasn’t kidding, Crawford discharged the stun gun the startled lawyer’s face.

Hard-working Lawyer Division: Massachusetts lawyer,  Karen Andrade, was  charged with prostitution after a police investigated a report by a suspicious neighbor and  found online reviews of both the lawyer’s legal services and her escort services

Celebrity Lawyer Division: Michael Cohen,  one of Donald Trump’s lawyers, told the Daily Beast that it was legally impossible for a man to rape his wife. He was only a couple of decades and many court cases behind on his research. That piece of legal scholarship came after he had threatened the website’s staff in language usually associated with loan sharks and pimps.

Tucker Carlson is the founder and publisher of the conservative commentary and news site, The Daily Caller. In this post, I recently discussed Carlson’s ethical obtuseness in pulling a column by a Daily Caller contributor because it criticized Fox News, where Carlson has a gig as a weekend host of the network’s embarrassing happy conservative talk morning news show. I wrote,

The conflicts of interest on display here, the insensitivity to them, and the lack of any pretense of journalistic fairness or integrity is staggering. Carlson has placed The Daily Caller in the same, discredited ethics no-man’s land of Media Matters, Move-on.org, the Daily Kos and other sites that blatantly distort the news and their commentary on it for specific, ideological and personal agendas, and a personal agenda is the most unethical and cynical conflict of all. Carlson likes his Fox paycheck, apparently. Well, then, his ethical obligation is to have an independent journalist edit his website. In the alternative, he needs to refuse to work for Fox unless the network agrees to allow him full reign to say and write what he believes on his website, and to allow others to do so as well.

Apparently Carlson doesn’t read Ethics Alarms—I am shocked and disappointed—and moreover, has the imagination and ethics problem-solving skills of a banana slug.  Mediaite reports that he was discussing his ethics problem with RealClearPolitics, and admitted that he was totally flummoxed about what to do, poor dear:

“I have two rules,” Carlson said, “One is you can’t criticize the families of the people who work here, and the other is you can’t go after Fox” because he works there. Sigh. “Yes, it’s a conflict, for sure…but I don’t know what to do about it.” Continue reading →

It Appears, And Not For The First Time, That Tucker Carlson And The Daily Caller Do Not Understand This Thing Called “Ethics”

Conservative blogger Mickey Kaus wrote a piece criticizing Fox News for not meeting its obligation (as Kaus sees it) to take on the role of media opposition on the issues of illegal immigration and amnesty, and instead, as Kaus told Politico, “filling up the airwaves with reports on ISIS and terrorism.”  (Kaus is wrong, but never mind) Kaus posted his commentary on the DC only to discover later that Daily Caller founder and editor Tucker Carlson had taken it down. Carlson’s explanation: “We can’t trash Fox on the site. I work there.'”

Indeed, Carlson, who co-founded The Daily Caller in 2010, is a conservative contributor to Fox News as well as the host of its weekend edition of “Fox & Friends,” on which he has been known to fall asleep on the air. Carlson told Kaus that the ‘no criticizing Fox News, ever’  policy was an unwaivable rule.

Some jerk, individual or collective, thought that having an intentionally misleading headline on a story hundreds of thousands would read while skipping the article itself would be a hoot, even if it added PR and image problems to the troubled life of a young woman, Lindsay Lohan, desperately trying to get her career and mental health back on track. Lohan Arrested For Drunk Driving

It is accompanied by a photo (above) with the star’s face prominently displayed, and her mother shown in the background. Mom, Dina Lohan, was the one arrested, the story (authored by Bigler) explained. The incident reported had nothing to do with Lindsay Lohan, who by all accounts is clean, sober, employing a full-time sobriety coach and trying to overcome multiple substance abuse problems and the consequences of years of irresponsible conduct that have reduced her name to a punchline.
