This blog doesn’t discuss evil very often because it is not a term appropriately associated with ethics. Evil is a concept related to morality. In an ethics discussion, I would take evil to mean something extremely, irredeemably unethical by any ethical analysis or system. The statement “I think abortion is evil, but it is a necessary evil” appeared parenthetically in a comment by Beth, a frequent commenter on Ethics Alarms who is a mother and a lawyer, regarding the Planned Parenthood videos. Though the news media appears to have successfully distorted that story by focusing only on whether the videos were evidence of illegal “trafficking in body parts” by Planned Parenthood, that was not the reason I posted the essays, and it is not the reason those videos are significant in the ongoing debate over abortion rights. Two high ranking individuals in the organizations casually discussed the crushing and crunching of the heads and torsos of living and helpless individuals with the sensitivity I would associate with stepping on a roach. If this doesn’t disturb you, it should. If it does disturb you, as it did Beth, what does that mean?

Abortion is one of the most important and difficult ethics issues in the culture, indeed in world culture. It involves millions of lives and millions of deaths, law, bioethics, religion, social policy, science, human rights and feminism, as well as society’s ultimate respect for life itself. I have written about the ethics of the abortion debate frequently (you can find most of the relevant posts here), but to summarize the Ethics Alarms views on the topic:

1. Abortion is an ethics conflict, meaning that there are ethical principles in opposition to each other, requiring society to set priorities.

2. The absolutist position on the anti-abortion side is that abortion involves the taking of innocent human life, which begins from conception, and is thus unethical in all cases. It is a strong position if one accepts the underlying assumption.

3. However, no absolute position is really absolute. Every ethics absolute has an exception, or several: there must be some circumstances when abortion is necessary and right. (This is not true of moral absolutes, since moral absolutes are self defining. If the power dictating a moral precept says it is absolute, it is so.)

4. The absolutist position on the abortion side of the argument holds that a woman’s right to have complete dominion over her body, reproductive activity and health justifies abortion in all cases. This is not a strong position, and in fact is one that cannot be honestly argued or sustained. It supports abortion on demand for any purpose or preference, entirely at the mother’s discretion.

5. To make that argument, extreme pro-abortion advocates have had to deny the humanity and human rights of unborn children, even to the point of arguing that they are not individuals at all, but mere “parasites,” or “tumors.” The removal of a second life from the equation that is at the core of the abortion problem makes the abortion decision easy and guilt-free; it also settles the debate by pretending the central issue doesn’t exist. That issue is that there is another life involved, not just the mother’s.

6. The debate over the ethics of abortion has been handicapped by the tactic of both sides to pretend a legitimate interest championed by the other doesn’t exist. A woman’s ability to control her own life, career and what happens to her body is an important societal issue, yet the term “pro-life” ignores it entirely. It is not the only important interest involved in the abortion decision, however, as the term “pro-choice” suggests.

7. Neither absolute position, whatever its theoretical virtues, is practical from a policy perspective. Desperate women who are pregnant will seek abortions, people will help then (or exploit them, or kill them), and public policy cannot pretend otherwise. Society will not tolerate punishing women for aborting their unborn children, whether they deserve to be punished or not. Yet allowing mothers to have unborn children killed on a whim leads to the callous, ugly, dangerous attitude toward innocent life on display in the Planned Parenthood videos. Callousness toward any human life, history has shown us, is a slippery slope with the potential of doing terrible harm to the culture.

8. Roe v. Wade was a premature Supreme Court decision and a badly reasoned one. Until and unless it is overturned, abortion is a right. That does not mean, and never meant, that abortion necessarily is right.

9. Because absolutism fails here, abortion is a problem that demands utilitarian analysis–balancing of interests and values, in the best interests of society, long and short-term, and everyone in it, according to the facts as we understand them.

10. Balancing requires an honest acknowledgement that there is something to balance. The “pro-choice” and “pro-life” dichotomy doesn’t acknowledge that in their most extreme incarnations, and since abortion is currently a right, the pro-choice lobby detects no reason to yield to logic, science and reality. War, Syria, Leadership and Ethics

I try to think about the ethics of war as little as possible, much less write about it. It is too frustrating, and ultimately a waste of time: the same debates and philosophical arguments have been made, eloquently and passionately, for not just hundreds but thousands of years, and only the mechanics of warfare have changed.

My father, a war hero and a man who would have loved to have devoted his life to the military if his wounds hadn’t prevented it, used to say that war was the stupidest of all human activities. “There is nothing good about war,” Dad said. “Yet it is sometimes necessary and unavoidable. And don’t ask me to reconcile those statements: I can’t. Nobody can.” I remember asking him about General Patton, who led my father and his comrades during the Battle of the Bulge. “Patton supposedly loved war,” I said. “He did,” my father replied. “He was insane.” He loathed Patton.

The Syria crisis has triggered all the same arguments again, and I want no part of them. Ethical analysis doesn’t work where warfare is concerned. The conduct of ritualized killing combatants and innocents is, at best, an extreme utilitarian act that always creeps into  ethically indefensible “the ends justify the means” territory before the end of hostilities. So many invalid rationalizations are used to justify killing—“It’s for a good cause,” or the Saint’s Excuse, prime among them, with “They started it!” following close behind—that it is useless to tote them up. The war most often cited as a “moral war,” World War II, still involved the killing of innocent non-combatants by the Allies. ( My father remained amazed at the efforts at “limited war” in Iraq, noting that Allied soldiers were expected to accept civilian deaths as unavoidable and not a matter of concern. He also felt that the current dedication to half-measures just guaranteed longer wars, more deaths, and less satisfactory results. “It’s war,” he said. “You can’t make it humane or sensible; you can only make it shorter. Telling the military that it has to waste time and military personnel to avoid civilian deaths makes no sense. There is no such thing as a humane war.” Naturally, he approved of Truman’s decision to drop the atom bomb, in part, he admitted, because he was slated to be in the Japanese mainland invasion force that was likely to sustain up to a million casualties.) The Allies engaged in atrocities too, such as the fire-bombing of Dresden.

You want to talk about the problem of supporting terrible people and factions to defeat another? World War II is the champion on that score. The U.S. partnered with Stalin, who was a greater mass murderer than Hitler, and defeated Japan, the enemy of China, allowing Mao, a greater mass murderer than Stalin and Hitler combined, to enslave a billion people. The peace negotiated after the Second World War was only slightly less destructive than the one that ended the First World War (and led directly to the Second): The U.S. handed over half of Europe to Communism, laying the seeds of the Cold War that only avoided ending humanity in a nuclear holocaust by pure moral luck. The fact that WWII is the “best” war powerfully makes the case: ethics and war have nothing to do with each other. Each renders the other useless and incoherent. Continue reading

Drone Ethics: The Policy and the Memo

With the leak of the Obama Administration’s Justice Department memo laying out  alleged legal and Constitutional justification for targeted drone killings abroad, the ethical debate over this practice finally began in earnest. Back in October of 2011, I visited this topic in a post titled, “The Ethically Messy, Legally Muddled, Drone Killing of Anwar al-Awlaki,” who was an American citizen and also an al-Qaida leader and terrorist, and wrote…

“I am far less confident of a conclusion that the killing was legal than I am that the killing was ethical in a situation where traditional rules and considerations don’t fit the situation well, meaning that decision-makers must go outside the rules to find the right, meaning ethical, course of action.  And I’m even not 100% confident of that.”

This still accurately encompasses my view, although my confidence in the position has declined materially, in part because of the memo. However, my position in 2011 was based on the assumption, using the Bush Administration’s position, that the United States was engaged in a de facto war with al-Qaida, and as a tool of war, killer drones  are within ethical bounds by my analysis. The leaked memo, however, begins with the assumption that the drone strikes are not part of ongoing declared warfare, but rather a new variety of cross-border lethal intervention that has no legitimate statutory basis. I think that under those assumptions, targeting drone killings are illegal, unethical, and to the extent that they give the President of the United States the power to kill someone in any nation based on his assessment that person needs killing, ominous.

The Los Angeles Times, War, and the Reckless, Arrogant News Media

The Los Angeles Times feels that you need to see this photo, and sensationalism has nothing to do with it. No, really.

Our national news media, which is as biased as ever, more untrustworthy than ever, and less professional than ever, is also more self-righteous than ever, which, I suppose, figures. The most recent display of self-righteousness, along with gratuitous recklessness and arrogance, is the Los Angeles Times’ decision to publish photos of American soldiers posing happily next to the bloody mess that had been the bodies of Afghan suicide bombers. The Pentagon asked the Times not to run the photos, for obvious reasons. The mission in Afghanistan is hanging by a thread as it is, our relationship with the government and the populace serially wounded by a series of unnecessary events that placed the U.S. in a terrible light: in January, a video of Marines urinating on dead Taliban soldiers; in February, the botched disposal of copies of the Quaran, and shortly thereafter, the rampage of a deranged U.S. soldier, who went door to door killing Afghan civilians. Such episodes, and the publicity they receive, jeopardize American interests and cost lives, as Secretary of Defense Leon Panetta explained while condemning the Times’ irresponsible decision. Reflections On President’s Day, 2012: A United States Diminished in Power, Influence and Ideals

Rep. Ron Paul is fond of saying that the United States shouldn’t be the world’s policeman, and thanks to irresponsible stewardship of America’s resources and horrific maintenance of its ideals, his wish has already come true. One result is a world that has no functioning opposition to evil, a world at the mercy of chaos with no champion or guiding inspiration in sight. The other result is a United States that no longer stands for its own founding principles.

For proof, we have only to look as far as Syria, where a brutal dictator is killing his own people at an accelerating rate. Although his people have tired of his tyranny, Hafez al-Assad, like Gaddafi before him, seems determined to kill as many of his own countrymen as he has to in order to stay in power. Our President, Barack Obama, has delivered stern admonitions and disapprovals, which is this President’s style and approximately as effective as tossing water balloons. The Secretary of State, Mrs. Clinton, expresses frustration, for all the good that does. The killing, of course, goes on.

If you think I’m going to advocate U.S. action in Syria, you are wrong. Quite simply, we can’t afford it—not with a Congress and an Administration that appear unwilling and unable to confront rising budget deficits and crushing debt with sensible tax reform and unavoidable entitlement reductions. Yesterday Congress and the President passed yet another government hand-out of money it doesn’t have and refuses to raise elsewhere, among other things continuing to turn unemployment insurance, once a short-term cushion for job-seekers, into long-term government compensation for the unemployed. Part of the reckless debt escalation was caused by the last President unconscionably engaging in overseas combat in multiple theaters without having the courage or sense  to insist that the public pay for it, and the current administration is incapable of grasping that real money, not just borrowed funds, needs to pay for anything. The needle is well into the red zone on debt; we don’t have the resources for any discretionary military action.

Ron Paul thinks that’s a good thing, as do his libertarian supporters. President Obama, it seems, thinks similarly. They are tragically wrong. Though it is a popular position likely to be supported by the fantasists who think war can just be wished away, the narrowly selfish who think the U.S. should be an island fortress, and those to whom any expenditure that isn’t used to expand  cradle-to-grave government care is a betrayal of human rights, the abandonment of America’s long-standing world leadership in fighting totalitarianism, oppression, murder and genocide is a catastrophe for both the world and us. The Ethically Messy, Legally Muddled, Drone Killing of Anwar al-Awlaki

Ah, those were the good old days: when warfare was simple, fair, brutal and stupid!

The C.I.A. drone killing of Anwar al-Awlaki, an American citizen who was also an Al Qaeda leader, is raising multiple ethical controversies that pollute each other,  making ethical coherence all but impossible.

The issues:

  • The target was an American citizen. Whatever his crimes, shouldn’t he have the right to a trial before being summarily executed?
  • There is no conclusive proof that he actually did anything that resulted in violence against Americans, or posed an imminent threat to national security. Was he targeted for his words, rather than his conduct? How can it be legal or ethical for the U.S. to target a citizen for death because of his political views?
  • The United States has officially forsworn assassination as a military or intelligence tactic. Yet this appears to have been one.
  •   Yemen is not a field of combat, and there was no imminent threat to human life creating an exigency to require U.S. forces to target someone there, whether he was a citizen or not.

Richard Cohen, National Interests, and the Ethical Duties of the US to the World

There used to be no columnist who infuriated me more consistently than Richard Cohen. Those were the hazy, golden days before I discovered E.J. Dionne, Paul Krugman and Harold Mayerson, however, whose rigid ideology virtually precludes objective analysis. Cohen isn’t biased, he’s just wrong more often than not. But he is also capable of bursts of moral and ethical clarity. Today was an example, as he took on the isolationist voices on the left and the right that make up a large component, if not the majority, of our elected leadership today.

Cohen begins by recounting a section from  Erik Larson ‘s book,“In the Garden of the Beasts,” about how the American foreign policy establishment in the Thirties resisted efforts by William Dodd, then ambassador to Germany, to protest the Hitler government’s increasing persecution of Jews. Humanity, and the U.S., paid a steep price for its inward-turning perspective after World War I, as we abdicated our traditional role as defender of liberty, freedom, democracy and human rights on the world stage. Are Citizens of Warring Nations “Innocent”?

“Innocent” and “civilians” apparently go together like a horse and carriage, if one is to believe the cliché used with increasing regularity by journalists, bloggers and even elected officials. The instance that finally provoked me to write about the irresponsible acceptance of this falsehood was the gratuitous appropriation of it by a sportswriter, who, if I understand him correctly, feels the United States has no standing to object to baseball star Barry Bonds’ lying and cheating because it dropped atom bombs on “innocent civilians” in Hiroshima and Nagasaki. (The sportswriter neglects to mention that these act occurred during wartime; perhaps he doesn’t know.) The exoneration of civilian citizens for the acts of their governments is a relatively new phenomenon, one happily endorsed by the habitually politically correct. It is untrue, and it is time to blow the whistle. Ethics foul. Continue reading

The Ethics of Commemorating Hiroshima

I missed it, but apparently the son of the commander of the Enola Gay told Fox News that for America to send a diplomatic delegation to Japan to memorialize the 65th Anniversary of the bombing was a de facto apology that for a necessary wartime action.
