Ethics Quiz: The Re-cycled Sperm Trick

I think we all will agree that a woman obtaining a man’s semen via oral sex, secretly saving it, and using it to impregnate herself is unethical, correct? And that even if some fool court requires the deceived man to pay child support, the entire episode is outrageously dishonest, irresponsible and unfair?

This apparently happened to a Chicago man five years ago, and he is suing his former Lewinsky for the infliction of emotional distress. This seems inadequate. The use of a man’s sperm to produce his child without his consent in a surreptitious, deceitful manner should probably be a criminal offense—applying the Ethics Alarms principle that the law must often step in when ethics fail—and your challenge is to determine:

  • What conduct should the theoretical law prohibit?
  • What is an appropriate punishment for violating the law, as in the Chicago case?
  • How, if at all, should the law address the welfare or the innocent child?

Or do you think there should be a law at all?

My answer, after I’ve absorbed all of your wisdom, will follow.

On a related note, one upside of this revolting incident may be that it ends the ridiculous, Bill Clinton-fertilized argument that fellatio isn’t sex. I sure hope so. If only this had happened to Bill…what a great Lifetime movie it would have made!

    It happened in 2000, he brought suit in 2003, the article you cited was from 5 years ago. Thinking about this one for a while, eh?

  3. This is way beyond the “ick factor.” This poor man is paying child support because he had oral sex with some bimbo?

    I think he should be suing her for grand theft — it was HIS sperm, she stole it, and now is using the product of same for significant personal gain.

    The local Child Protection Agency should take the child away from this sick, pathetic, greedy, woman. She committed a felonious act, in my opinion.

    • I’m not sure you could go with theft, as the sperm was freely given. However, if it could be proved that it was obtained via fellatio (an act which cannot lead to pregnancy, making his intent not to impregnate her clear) I would go for extortion charges, as you could make a good case she did this solely to bilk him for child support.

  4. Kant said (and I may butcher it here) that it is right if we treat men not as a means to an end, but as an end in themselves. This woman created a life for the SOLE purpose of keeping someone else inextricably connected to her. What shall this child experience when he or she (I don’t know which) is old enough understand her father’s lack of involvement in her creation, and the extraordinary depths of her mother’s treachery?

    This event, in itself, is evidence of her maternal unsuitability. If justice never meets this loathsome mother and she becomes the first person to get away with this, then she should also be the last woman to get away with it as well.

    I don’t think I can think clearly enough on this issue to formulate a law or corresponding punishment that would be fair.
