Tales Of The Great Stupid: Clarence Darrow’s Worst Idea Takes Hold In New York City

America’s greatest trial lawyer, Clarence Darrow, defended guilty criminals in part because he believed that it was cruel and unjust to punish citizens who committed crimes, even violent ones. Darrow, a pioneering progressive, lectured, debated and wrote that people committed crimes because of conditions beyond their control: bad parents, stupidity, mental illness, no education, poverty. Since those who committed crimes literally couldn’t stop themselves, punishment was revenge without reason. Sending someone to jail, far from advancing civilized conduct, not only destroys the life of the perpetrator but also creates a false sense of accomplishment, ignoring the socioeconomic “root causes” of crime. Nobody born free, the lawyer fervently held, should lose his or her liberty because of bad genes or bad luck.

It was and is a batty theory, and until very recently, one wouldn’t find anyone advocating it who wasn’t lying, ignorant, or a criminal himself. No longer. Today Darrow’s worst idea is running amuck in several big cities in the grip of woke Democratic government, and where it stops, nobody knows.

Take New York City…please.

The Big Rotten Apple has decided not to prosecute “quality of life” offenses, from littering to public urination to jumping subway turnstiles, with the predictable result that the quality of life for law abiding New Yorkers has cratered. Last summer, the Mayor’s Office of Criminal Justice crowed that “the number of New Yorkers held in New York City jails had shrunk by 27% in 10 weeks, bringing the city’s incarcerated population down to the lowest level since 1946.Wow! Isn’t that great? Of course, by some coincidence, murders and shootings were rising more quickly than ever before.

Sunday Evening Ethics Nightcap: Not Watching The Olympics Edition

Happy birthday Louise Joy Brown, the world’s first “test tube baby” conceived via in vitro fertilization in Manchester, England, on this date in 1978 to parents Lesley and Peter Brown. The bioethics controversies that flowed from this landmark event and subsequent scientific advances have not stopped yet.

1. When the George Floyd Ethics Train Wreck meets the Olympics, this is the sort of garbage you are going to get, at least from Kurt Streeter. He’s the black New York Times sports columnist who really appears to believe that the main function of sports is to raise racial and gender grievances. Woke sports commentary isn’t just bad sports journalism, it’s also boring. Politics makes sports less fun and less of what it was intended to be, entertainment, not crusading. By “this” I mean columns like his most recent titled “The Olympics Rely On, but Don’t Support, Black Girl Magic.” Never mind that the headline is racially offensive at the outset—nobody should care what color bodies athletic “magic” comes from, and only bigots like Streeter view sports that way.

Streeter’s brief supporting his obnoxious thesis is based on selective facts and personal bias. Here are his examples:

“Simone Biles is one of the most brilliant talents at the Games. But if recent history holds and she tries her most stunning moves in Tokyo, gymnastics officials will place an arbitrary limit on her score. Some say this is meant to discourage other competitors from attempting similarly dangerous aerial maneuvers. I say the sport’s regulators cannot deal with her sheer audacity.”

And what does this have to do with her being black? Nothing, and nobody has alleged that it is otherwise, though if Biles does not win her expected gold, I’m sure Streeter will be among the first to cry “racism.”

Naomi Osaka is …perhaps the most widely known female athlete on the planet…will get tossed under the bus if she is not polite and pleasant in her interviews with the news media, a backlash prompted by her withdrawal from the French Open because she did not want to participate in news conferences there. That pressure exists alongside the dread that she’ll be derided as either too Black or not Japanese enough if she does not win a gold medal.

Whose “dread”? Apparently Streeter’s, the race-baiter. Meanwhile, any athlete who is not polite and pleasant in interviews always gets criticism from the news media, and deserves it. She didn’t withdraw from the French Open because “she did not want to participate in news conferences,” she quit because she wanted special privileges to break the tournament’s rules, and was foiled. None if this has anything to do with race either, except that Osaka may have thought that her appeal to the King’s Pass might be especially hard to turn down since people like Streeter would be quick to call enforcement of the same rules for all “racist.”

“Gwen Berry is one of the most powerful hammer throwers in the world and one of the boldest athletes in protesting racism and injustice. But the Olympic overlords have made clear she’d better behave on the medal stand — or else.”

Those “overlords” have the same rules for everyone. Berry is bold in protesting what she isn’t in the Olympics to protest; she’s a narcissist and a lousy citizen who should have been kicked off the team once she proclaimed that she didn’t regard herself as representing the nation that is honoring her by giving her a chance to compete. Streeter thinks her “Black girl magic” isn’t being supported because she won’t be allowed to embarrass her team and act like an asshole on the world stage.

2. From the “Blind Squirrel Finds Nut” files…Criminal justice reform activists and some lawmakers are upset the the Biden Justice Department is inclined to follow through on a Trump-era memo by the Justice Department’s Office of Legal Counsel requiring inmates who were allowed out of stir to reduce the spread of the pandemic in prisons and whose sentences lasted beyond the “pandemic emergency period” to go back behind bars. Awww! How mean. Criminals will actually have to serve their sentences! Systemic racism, of course. But the Biden legal team concluded that the memo correctly interpreted the law, which applies to about 4,000 nonviolent inmates. There are still plenty of fanatics and anti-incarceration extremists among Joe’s minions, so they might get the policy reversed yet.

Comment Of The Day: “Cowardly, Culture-Betraying Grovel Of The Month: Karen Taylor Of Breakfast Cure”

I’ll answer the first query in Null Pointer’s excellent Comment of the Day on the great congee cultural appropriation brouhaha: “I’m not sure I understand why the woke mobs are throwing fits on Asian people’s behalf.”

There are two reasons. One is part of the Wuhan Virus Ethics Train Wreck. In order to tar President Trump as a racist before the 2020 election, the Axis of Unethical Conduct (the unholy and undemocratic “resistance,” Democrats and the news media alliance), claimed that what we knew pretty much then and now know almost certainly now, that the pandemic originated in China’s Wuhan province, nonetheless was racist to speak out loud because so many idiots were attacking Asian-Americans as a result of telling the truth. This was accompanied by absurd inflations of the actual number of such attacks without any evidence in most cases that the attacks there were had any nexus to calling the Chinese virus a Chinese virus.

Thrilled nonetheless to finally have a platform from which to cry “Victim!” like women, blacks and Hispanics, some Asian-American activist groups gleefully embraced the new discrimination fable, neatly sidestepping the inconvenient fact that a disproportional number of the attacks on Asians were carried out by African Americans.

The second reason the woke mobs are throwing fits on Asian people’s behalf is to avoid dealing honestly with the approaching reckoning for elite colleges and universities that are making Asian-Americans real victims of discrimination as the pursue unconstitutional affirmative action policies.

That’s why.

I work almost exclusively with Asians, mostly from India. I have never, not once, ever heard any of my Indian coworkers say ANYTHING about cultural appropriation or condone any woke causes. On the contrary, they are almost all quite eager to share their cultural traditions and cuisine, and eager to learn about American culture and cuisine.

I’m not sure I understand why the woke mobs are throwing fits on Asian people’s behalf. I work almost exclusively with Asians, mostly from India. I have never, not once, ever heard any of my Indian coworkers say ANYTHING about cultural appropriation or condone any woke causes. On the contrary, they are almost all quite eager to share their cultural traditions and cuisine, and eager to learn about American culture and cuisine.

They put on little performances during the Hindu festivals to show off the dancing and food and fashions. They are always inviting me to go to Indian restaurants and explaining which part of India the different foods come from and how to eat them.

They also love going to the American holiday events and partaking in our traditions. When one company I worked for had a gingerbread house-making contest for Christmas, all my Indian coworkers went and happily made gingerbread houses and proudly showed them off. There were no tantrums about Christian holidays, white oppression, or anything else the Woke like to have fits about. Just fun and little houses made out of cookies.

Observations On The “567 True-False Question Multiphasic Personality Inventory”

The first observation is that I am amazed that I never heard of this thing before very recently. I am pretty certain that I never encountered it in my psychology course in college, nor in my criminal law courses in law school, nor in the ridiculous number of movies and TV shows I have watched that would seem to be natural places for the test to be referenced. The large and seemingly random holes in our knowledge of the world makes each or us less competent to deal with life, and ethics, to a great extent, is a matter of life competence. I should have learned about this a long time ago, and I don’t know why I didn’t.

The 567 True-False Question Minnesota Multiphasic Personality Inventory (MMPI), for those of you who don’t know already, is apparently the most widely used and researched clinical assessment tool used by mental health professionals to help diagnose mental health disorders (above is an excerpt from list of problems it is designed to flag and the number of questions that allegedly identify them). It has been used since the late 1930s, and has been revised and updated several times to improve its validity.

As you review its details here, you will immediately see the relevance to ethics. There are many scales used to evaluate the responses to the test, which takes 30-50 minutes to complete and involves the subject answering “true” or “false” to each of 567 questions. The survey may be used to assess hypochondria, psychosis, depression, obsessive-compulsive disorder, hysteria, sexual identities, paranoia, schizophrenia, introversion, and to identify psychopaths. There are also sub-scales that measure “the test taker’s belief in human goodness, serenity, contentment with life, patience/denial of irritability, and denial of moral flaws.”

I don’t have a lot to say about the test, which more or less speaks for itself. It reminds me of several things, like those trick questions they used to ask you when you checked your luggage at airports before 9/11: “Did anyone pack your suitcase for you? Did you accept anything from a stranger before you came here? Are you carrying any explosives or weapons?” How inept a hijacker did someone have to be to answer “Yes! I mean no! Damn, you caught me!” to that last one? A lot of the questions are like that. They are a bit cleverer, in that the whole reason there are so many questions is that the incriminating ones are randomly hidden among benign and distracting True-False assertions like ” I think I would enjoy the work of a librarian” and “I like poetry.” You’re rolling along for half the test and getting bored and suddenly you get hit with “It does not bother me particularly to see animals suffer.” Dingdingdingdingding!

The MMPI also reminded me of a bad Elvis Presley movie called “Follow the Dream” that has its climax in a courtroom where Elvis and his con artist father are fighting to keep custody of two twin boys the family adopted. In court, a suspicious psychiatrist gives Elvis’s father a “word association test” to prove whether he would be a fit parent, and the doctor interprets everything he says in the worst context imaginable.

And the test reminds me of what failures the fields of psychiatry and psychology have been since Sigmund Freud was going to save the world a century ago with his new science. If this list is a “primary tool” for metal health professionals, then I have a better understanding of how a Yale psychiatrist could go on MSNBC and insist that Donald Trump should be removed from office based on her assessment of his statements. It also explains how Woody Allen could spend decades in analysis and still be, you know, like Woody Allen.

One final observation, before I leave the rest to you, is that the list suggests that the current “antiracism”/Critical Race Theory/ Black Lives Matters assault on U.S. society and culture may be making African-Americans mentally ill. For example,#71 states, “These days I find it hard not to give up hope of amounting to something.” Being angry is also obviously a marker in the test.

Presenting The Complete Fake Voice Ethics Verdicts

In Roadrunner: A Film About Anthony Bourdain, filmaker Morgan Neville,examines the life and death of the famous TV chef Bourdain. In the process of doing so, he introduced a new documentary device: using Artificial Intelligence to simulate Bourdain’s voice.

In a recent interview with the New Yorker, Neville explained that he used AI to synthetically create a voiceover reading of a Bourdain email that sounded like Bourdain was the reader. He engaged a software company and provided about a dozen hours of recordings, allowing them to create a convincing electronic version model of Bourdain’s voice. That voice reads three lines in the film, including an email sent to a friend by Bourdain: “My life is sort of shit now. You are successful, and I am successful, and I’m wondering: Are you happy?” But Bourdain, of course, never read that or any of the other three lines, to which Neville’s message to viewers is “Nyah, nyah, nyah!” “If you watch the film … you probably don’t know what the other lines are that were spoken by the AI, and you’re not going to know,” he said.

Well, critics, including Ottavia Bourdain, the chef’s former wife, objected to the ethics of an unannounced use of a “deepfake” voice to say sentences that Bourdain never spoke.

I was going to make this an Ethics Quiz, and then after thinking about for a few seconds, decided that the issue doesn’t rate a quiz, because I’m not in nay doubt over the answer. Is what Neville did unethical?

Yes, of course it is. It is unethical because it deliberately deceives listeners into believing that they are hearing the man talking when he never said the words they are hearing. It doesn’t mitigate the deception, as Neville and his defenders seem to think, that Fake Bourdain is reading the actual unspoken words in an email. It’s still deception. Is the creation and use of a zombie voice for this purpose also unethical, like the creation of CGO versions of famous actors to manipulate in movies they never made, discussed (and condemned) here?

That’s a tougher call, but I come down on the side of the dead celebrity who is being made into an unwilling ventriloquist’s dummy by emerging technology.

Cowardly, Culture-Betraying Grovel Of The Month: Karen Taylor Of Breakfast Cure

Breakfast Cure, an Oregon company, was attacked on social media by Asian Americans and the Woke Mob of culturally-appropriating congee, a traditional Asian rice porridge. The company sold its version of the dish in pre-packaged meals, and asserted that they were yummy. The problem is that the company was run by…a white woman.

How dare a white woman’s company claim to make a version of congee to fit the ” modern palate” and “improve” a recipe beloved by Asian cultures for centuries? So, as we have come to expect. company exec Karen Taylor begged for forgiveness:

“Recently, we fell short of supporting and honoring the Asian American community and for that, we are deeply sorry. We take full responsibility for any language on our website or in our marketing and have taken immediate steps to remedy that and educate ourselves, revising our mission to not just creating delicious breakfast meals, but becoming a better ally for the AAPI community.“

Saturday Ethics Discouragements, 7/24/2021: NPR, President Biden, Penn State, And The New York Yankees

1. Apparently NPR has a sense of humor. Last week’s NPR article, “Outrage As A Business Model: How Ben Shapiro Is Using Facebook To Build An Empire” actually complained that

“By only covering specific stories that bolster the conservative agenda (such as… polarizing ones about race and sexuality issues)… readers still come away from The Daily Wire’s content with the impression that Republican politicians can do little wrong and cancel culture is among the nation’s greatest threats.”

The fact that NPR only covers stories that bolster its progressive agenda or covers them in such a way that any conservative criticisms are obscured apparently never occurred to the taxpayer-funded operation that panders furiously to it’s upper-middle class majority Democrat audience. I speak as a former contributor who was banned from NPR for correctly explaining an aspect of sexual harassment that the host felt could be too easily used to defend President Trump…and told me exactly that.

Yet NPR tells its listeners that “experts worry” conservative websites may be “furthering polarization” in America.

These people are hilarious!

2. Now who can argue with that? Daily Caller reporter Shelby Talcott asked President Biden, “Are there people in the Democratic Party who want to defund the police?”

“Are there people in the Republican Party who think we’re sucking the blood out of kids?” Biden responded.

Good answer! For the record, police budgets have been slashed in more than 20 major cities with Democratic Party-run governments, including Minneapolis, Seattle, Los Angeles, New York, Chicago, Milwaukee, Philadelphia, Baltimore, and Austin, Texas. Evidence of Democrats displaying vampire conduct toward children is, in contrast, sparse.

3. Nah, there’s no indoctrination in colleges and universities! Campus Reform reports that Penn State professor Sam Richards orders white students in front of the 700-student “SOC119: Race and Ethnic Relations” lecture so he can intimidate them into validating his anti-white theories. One exchange:

Prof.: “I just take the average white guy in class, whoever it is, it doesn’t really matter. Dude, this guy here. Stand up, bro. What’s your name, bro?”

Student: Russell.

Prof.: “Look at Russell, right here, it doesn’t matter what he does. If I match him up with a black guy in class, or a brown guy… who’s just like him, has the same GPA, looks like him, walks like him, talks like him, acts in a similar way…and we send them into the same jobs…Russell has a benefit of having white skin.”

With another student similarly called out in front of the class, James, Richard asked, pointing to a slide from Coca-Cola’s infamous woke training that read, “To be less white is to be less oppressive, be less arrogant, be less certain, be less defensive, be less ignorant, be more humble, listen, believe, break with party, break with white solidarity,” what the intent of the screed was.

“I think, you know, it’s more or less just recognizing the advantages you have in life,” James responded. “Whatever that may be, and not thinking yourself superior because of that.”

Prof.: “Awesome answer man.” [Unspoken but clear: “And best of all, now you won’t be harassed, shunned and attacked for expressing a non-conforming opinion!”]

The Eastman Kodak Affair’s Lesson: Corporations Only Signal Their Imaginary Virtue When It Doesn’t Cost Anything

Eastman Kodak issued an Instagram post featuring images of Xinjiang, a western Chinese region where the government of China has committed horrific human rights violations

The post promoted the work of French photographer Patrick Wack, who made several trips to Xinjiang in recent years and has collected his damning images—all shot on Kodak film— into a book. Kodak shared 10 of his images with its 839,000 Instagram followers. In the Kodak post and on his own Instagram account, Wack described his images as a visual narrative of Xinjiang’s “abrupt descent into an Orwellian dystopia” over the past five years.

Oh-oh! As the disgraceful U.S. complicity in China’s Wuhan virus cover-up (also Orwellian) has shown, you don’t dare call China’s brutal regime what it is or demand accountability. Chinese social media users attacked Kodak, but Kodak, staying true to American principles of freedom of expression and refusing to bend a knee to tyranny, held its ground as it continued to support Wack and his work.

KIDDING!

I was just messing with you…of course Kodak deleted the post and grovelled an apology for “any misunderstanding or offense” that it might have caused. China, you see, is a big market.

So while our corporate giants have no hesitation in bombarding the gullible with nostrums during “these difficult times,” and announce their fealty to #MeToo, “antiracism,” and Black Lives Matter to pander to various consumers, never think that they really care about anything but their global profits.

Capitalism confers many benefits on society, but courage, integrity, and ethical values are not among them, and never have been.

Ethics Verdict On The Public Marriage Proposal Disaster…

Good. Perfect. I love it. Condign justice exemplified!

And cheers are due for the young woman for having the courage to say no. Maybe now this selfish and unfair grandstanding stunt, yet another disgusting outgrowth of the cell phone revolution ,will start to die out. Nobody should feel sorry for the jerk who was rejected, but we should all sympathize with the woman whom he embarrassed. She ducked a metaphorical bullet, though.

The so far unnamed creep popped the question in front of a crowd of fans at a Worcester (Mass.) Red Sox home game on Thursday. The scene was also broadcast to the entire park on a giant screen. The allegedly romantic gesture prompted cheers until the stunned object of the proposal put her hands over her mouth and shook her head “no.” “I have to go,” she said, and left the scene with him still on one knee. For the second time this week, “The Simpsons'” Nelson Muntz’s trademark response is called for:

Naturally, since nothing can be trusted these days, there are theories that the whole thing was staged. Family members of the couple were in the crowd, however. It appears to have been a genuine fiasco, not a fake one.

Let the episode be a lesson to any other abusive suitors who think it’s acceptable to make a private moment public to force a desired outcome.

Another IIPTDXTTNMIAFB Classic: Biden On Vaccinations!

IIPTDXTTNMIAFB is Ethics Alarmseese for “Imagine if President Trump did X that the news media is accepting from Biden.” I could probably feature such stories every day, but that would be as boring as these episodes are infuriating. They all come under the sub-heading of “Nah, there’s no mainstream media bias,” which I could justifiably update to “Nah, the mainstream news media didn’t steal the Presidency for Joe Biden.”

This one was so egregious that the AP even did a “factcheck”, but muted its description so absurdly that it is a perfect IIPTDXTTNMIAFB.

You see, President Biden said, in a CNN town meeting during which he periodically babbled incoherently, “If you’re vaccinated, you’re not going to be hospitalized, you’re not going to be in the IC unit, and you’re not going to die…You’re not going to get COVID if you have these vaccinations.”

That is a lie. It’s a lie because it is demonstrably false, and like so much else involving the pandemic, it is deliberate misinformation to manipulate the public. The Democrats, after all, fervently believe that the ends justify the means in all things. Apparently the truth, which the Biden Administration knows and thus its head is responsible for knowing, just isn’t good enough to move the herd along as its masters desire, so the strategy is to lie.
