“With all due respect, what the hell are you talking about?”

—Actor and Wounded Warrior ally Gary Senise, in an open letter responding to Howard Dean’s statement that the audience for “American Sniper” consisted of “angry people.”

Good question. What are the vicious and anti-military critics of Clint Eastwood’s box-office busting bio-pic about Navy Seal Chris Kyle talking about?

I saw the film yesterday. It’s not pro-war, pro-Iraq invasion, or political in any way. The various critics of the film out themselves as hateful and so biased against combat, the military and, I don’t know—life? Reality?—that they can’t even keep their minds open a crack for a thought-provoking piece of popular art. Dean had said, turning his review (I’ll bet anything that he hasn’t seen the film) into a gratuitous attack on tea party supporters:

“There’s a lot of anger in this country, and the people who go see this movie are people who are very angry. And this guy basically says ‘I’m going to fight on your side.’ … I bet you if you looked at a cross-section of the Tea Party and the people who go to see this movie, there’s a lot of intersection.”

In the same forum–his weekly HBO conservative-bashing fest–Bill Maher called Kyle a “psychopath patriot” (there is nothing whatsoever in the film that supports that diagnosis). Seth Rogen compared “American Sniper” to a Nazi propaganda film. Michael Moore used the film–which he couldn’t possibly have seen–to make the ridiculous observation that snipers were “cowards.” Kyle, the most effective sniper in U.S. military history, was wounded repeatedly and awarded two Silver Stars and five Bronze stars. For him to be smeared as a coward by the likes of Michael Moore is grotesque.

The film, among other things, shows just what kind of horror our service men and women endured in Iraq, how they suffered (and suffer still), what it did to them and their families, and accords them well-deserved compassion and respect. How sad, bitter and rotten inside someone must be to resent that. As I watched the film, it occurred to me that this was probably exactly what John Wayne wanted “The Green Berets” to be during Vietnam, but had neither the discipline to avoid agitprop and sentimentality, nor Clint’s directing skills to pull it off.

After expressing his disgust at Dean’s outburst in a tweet, the stage and screen star, whose foundation works to help and recognize the soldiers and veterans he calls our “defenders,” wrote,

To Howard Dean,

I saw American Sniper and would not consider myself to be an angry person. You certainly have a right to make stupid blanket statements, suggesting that all people who see this film are angry, but how is that helpful sir? Do you also suggest that everyone at Warner Brothers is angry because they released the film? That Clint Eastwood, Jason Hall, Bradley Cooper, Sienna Miller and the rest of the cast and crew are angry because they made the film? Chris Kyle’s story deserved to be told. It tells a story of the stress that multiple deployments have on one military family, a family representative of thousands of military families. It helps to communicate the toll that the war on terror has taken on our defenders. Defenders and families who need our support. I will admit that perhaps somewhere among the masses of people who are going to see the film there may be a few that might have some anger or have been angry at some point in their lives, but, with all due respect, what the hell are you talking about?

My guess is that Dean is talking about his own estrangement from basic American values, its history, and its essential role in the world, including all the sacrifices, risks and difficult choices that role demands. He’s the angry one.

 

Facebook’s Unconstitutional News Hoax Policy

Boy, there’s a lot of pro-censorship sentiment going around these days. I wonder why?

The latest comes from Facebook, which now is going to attempt to shield us from “hoaxes.” I don’t trust the government to decide what I should read and I don’t trust Facebook to do it either. Nobody should.

Back in the sixties, Economist John Kenneth Galbraith wrote papers and books asserting that large corporations were becoming the new nations and states, and that it was their power, not elected governments, that would decide how we lived. Galbraith wasn’t the best professor I aver had (he was the tallest), and his assertions in this realm were certainly exaggerated, but a lot of what he foresaw has come to pass. It is true that the First Amendment prohibition against government censorship of expressive speech doesn’t apply to private entities, but it is also true that huge corporations like Facebook weren’t even a twinkle in the eye of the Founders when that core American value was articulated. Any corporate entity that has the power to decide what millions of Americans get to post on the web is ethically obligated to embrace the same balance of rights over expediency that the Constitution demands of the state, specifically free speech over expediency, period, exclamation point, no exceptions. Embodying Clarence Darrow’s statement that in order for us to have enough freedom, it is necessary to have too much, the Supreme Court has even pronounced outright lies to be protected speech.

For this reason, Facebook’s well-intentioned anti-hoax policies—boy, there’s also a lot of well-intentioned lousy policies going around these days, being applauded for their goals whether they work or not. I wonder why?—add one more offense to core American ideals.

The Destructive, Useful, Unethical Presumption of Bigotry, Part 2: The Oscar “Snub”

For the second time in nearly two decades, and for the first time since 1998, the Oscars will be awarded to only white acting nominees. This, then, if you listen to the caterwauling race-baiters, is because Hollywood is racist. The Academy’s voters just hid it well since 1998, that’s all. Does that make any sense to you?

There are few more infuriating and transparently illogical examples of an unfair slapping down of the race card than looking for bigotry in the notoriously arbitrary, bias-soaked, essentially meaningless choices for “best” in the various Academy Award movie-making categories. Yet the race card sharks were up to the task.  Naturally, the authority on the subject was Al Sharpton, he whose own performance quality on his MSNBC TV show is so amateurish that it would be shut out in any community theater awards.

“In the time of Staten Island and Ferguson, to have one of the most shutout Oscar nights in recent memory is something that is incongruous,” Sharpton told The Daily News. Wait, what??? Incongruous is the assertion that the nominations for film-making excellence should be influenced in any way by how many blacks are killed resisting arrest. Anyone who finds that to be a logical argument for why more black actors should have been nominated for Oscars is useless to any rational discussion of the issue. I want a show of hands. Ethics Alarms Mail Call: Mt. Holyoke Ditches “The Vagina Monologues” As “Non-Inclusive,” and the Misuse of Kindness

VaginaI’m an ethicist who often writes on college controversies, and I make no secret about my double life in professional theater, so it figures that my inbox would include more than one query about Mt. Holyoke College’s decision to end its annual student performance of Eve Enlser’s “The Vagina Monologues” on the grounds that it is now admitting women without vaginas—I know, it’s confusing–who would feel excluded from what was supposed to be an inclusive experience and statement for the all-women’s school.

The annual production of the play is part of a country-wide tradition to perform Eve Ensler’s Vagina Monologues on Valentine’s Day to raise awareness about gender-based violence and usually coincides with the V-Day campaign. The proceeds are donated to sexual assault prevention organizations or women’s rights organizations. This year, however, Mount Holyoke’s Project Theatre Board is defying tradition by permanently retiring the play. In a school-wide email from the Theatre Board, a representative from the group, Erin Murphy, explained the problems with the play and the reasoning behind its discontinuation.

“At its core, the show offers an extremely narrow perspective on what it means to be a woman…Gender is a wide and varied experience, one that cannot simply be reduced to biological or anatomical distinctions, and many of us who have participated in the show have grown increasingly uncomfortable presenting material that is inherently reductionist and exclusive,” the email, obtained by Campus Reform, said.

Replacing the play will be Mount Holyoke’s own version that will be trans-inclusive and fix the “problems” supposedly perpetuated by Ensler. Murphy also claims that there are problems with race, class, and “other identities” within the play. The new production, comprised of students’ monologues, will be performed in a fashion reminiscent of the feminist classic. The program will be performed alongside the College’s Peer Health Educators, an on-campus student-led group that provides education and workshops for students, including a workshop on how to use sex toys properly.

Now THIS Is Hypocrisy: Steven Soderbergh’s Copyright Exemption

Few ethical concepts are as misidentified as hypocrisy, which is the opposite of integrity. The judge who secretly engages in crimes by night that he harshly sentences poor defendants for committing when he wears his black robe by day is a hypocrite; the parent who punishes his child for conduct she defiantly engaged in when she was the same age is not. The anti-hate speech zealot who uses what she would call hate speech in attacking others is a hypocrite; the closeted gay Baptist who opposes same-sex marriage is not. There is no danger of confusion where director Stephen Soderbergh’s copyright militancy is concerned, however. He’s a perfect hypocrite, one who distinguishes  right and wrong this way: if anyone other than  Soderbergh does it, it’s wrong.

Soderbergh is an outspoken copyright infringement hun who has testified  before Congress on behalf of the Director’s Guild of America, calling for tough legal penalties against online copyright infringers. He was also the lead plaintiff in the 2006 case of Soderbergh et al v. Clean Flicks of Colorado et al., seeking to shut down a company called Clean Flicks  that distributed versions of previously-released films edited by them to be more “family friendly.”

Soderbergh suit was successful, with the court ruling that the edited versions prepared by Clean Flicks violated his rights under sec 106(2) of the Copyright Act  by creating derivative versions of the films – defined as “works based upon one or more preexisting works, such as a translation, musical arrangement, dramatization, fictionalization, motion picture version, sound recording, art reproduction, abridgment, condensation, or any other form in which a work may be recast, transformed, or adapted”—and held that that Clean Flicks was responsible for “irreparable injury to the creative artistic expression in the copyrighted movies.”

But what’s this? Now Soderbergh is posting his own specially-edited versions of the classics “Psycho,” “Raiders of the Lost Ark,” and “2001: A Space Odyssey” on his own website. Want to see how good Raiders looks as a black-and-white film for example? Soderbergh’s color-free edit will show you. And how is editing the color out of the Lucas-Spielberg film ethically and legally distinct from editing out the naughty words and images from Soderbergh’s “Sex, Lies, and Videotape?”

I have no idea. Ask Soderbergh, whose answer, I suspect, will be “because I did it, not someone else.”

Unethical Artist Of The Year

Performance artist Maximo Caminero, who  walked into the Pérez Art Museum in Miami, entered a special exhibit of sixteen ancient Chinese vases painted over in bright colors by celebrated Chinese dissident artist Ai Weiwei, picked up one of them, and immediately after a security guard instructed him not to touch the exhibit, allowed the vase to fall from his hands, shattering into bits. Caminero admitted that smashing the pottery, which was valued at a million dollars,  was intentional, and was his protest against in support of local artists like himself whose work is not exhibited at the museum while the art of international artists like Weiwei is.

Unethical Veterinarian Of The Year

Fort Worth, Texas veterinarian Lou Tierce lost his license for five years as a result of, among other transgressions, his telling the owners of a Leonburger (it’s a very big dog) that their pet was terminally ill and had to be euthanized, then secretly keeping the dog alive in a small cage so he could use Sid’s blood for transfusions to Dr. Tierce’s other canine patients. Eventually an assistant at the clinic blew the whistle and alerted Sid’s owners, who rescued their dog and sicced the law on the worst veterinarian since Dean Jones menaced Beethoven.

No, There’s No Comparison Between Bill Cosby And Woody Allen And No “Double Standard”

One of these things is not like the other….

Newspapers should make us more informed and smarter, not less informed and dumber. Thus a Washington Post feature this morning qualifies as journalism malpractice, incompetence exemplified. Its theme: “Gee, why is Woody Allen signing a new deal to do a streaming comedy series for Amazon, while Bill Cosby lost his deal with NBC?” The print edition sub-heads: “Crisis responses may explain…”

No, they don’t. This is a false comparison based on superficial similarities: two comics who initially peaked in the same era, both in their seventies, shadowed now by sex scandals. The effort to use one to question the treatment of the other is either intellectually dishonest or so analytically unsound that it should forfeit the authors’ privileges of being assigned to write anything for mass consumption (the Post piece is by Stephanie Merry and Amy Argetsinger, and shame on them). The question of why Allen and Cosby are being treated differently in the court of public opinion isn’t worth asking, but since they asked, here are the obvious answers:

1. Woody Allen’s art, comedy, and persona have never had anything to do with virtue, stable families or being any kind of a role model. As a performer, he has presented himself as perpetually horny, neurotic, obsessed with sex and masturbation, prone to lying, and open to adultery, betrayal, stealing friends’ lovers; in “Manhattan,” he happily romanced a virtual child. In real life, he says things like “The heart wants what the heart wants,” which is a  rationalization for any act unethical or illegal, involving sexual or romantic desire. If you were ever a fan of Woody Allen after the age of 13, you were so because he was funny, accepting the fact that he is at best a sexually obsessed, maladjusted creep.

None of this is true of Cosby, who has always aimed his comedy at innocence, functional families and traditional virtues, and represented his own values as consistent with these when speaking for himself. Sex was not any part of Cosby’s art or image. He was an iconic good guy. Continue reading

Professional Chauvinism At “Above The Law”

Lawyers really need to get over themselves. This post, by Staci Zaretski at the legal gossip site “Above the Law,” was introduced in my e-mail inbox with this line:

“Amal Clooney’s lifetime achievements are far greater than those of her husband, George Clooney. Where’s her award?”

The flip answer would be: “George Clooney.” But to the point: one has to have an enhanced regard for the profession of the law and a dismissive and culturally ignorant attitude towards the arts to state that “Amal Clooney’s lifetime achievements are far greater” than those of George Clooney.” Zaretski is welcome to her biases, but by any fair measure, the lifetime achievements of an actor of Clooney’s popularity, daring and prominence far outstrips those of a lawyer like Amal Alamuddin Clooney.  “Above the Law” makes its case thusly:

“Amal is a human rights lawyer who worked on the Enron case, was an adviser to Kofi Annan regarding Syria, and was selected to a three-person U.N. commission investigating rules of war violations in the Gaza Strip.”

Hundreds of lawyers worked on the Enron case(s): you will have to prove to me that she had some special impact that another lawyer with similar skills, and there are thousands, would not have. So she was an adviser to Kofi Annan regarding Syria: is Zaretsky aware that Annan’s misguided and naive efforts to broker a Syrian peace saved not a single life, and may well have blocked more substantive and effective initiatives? Then she served on a commission “investigating rules of war violations in the Gaza Strip.” Translation: she is a willing participant in the U.N. effort to demonize Israel for defending itself from Hamas shelling.  She also is defending Julian Assange. I don’t hold that against her: he’s a criminal, but he deserves a defense. Would he have not gotten one without Amal Clooney? Of course he would have. Continue reading

2014 Conflicts of Interest of the Year

  • Conflicted Elected Official: Philadelphia State Senator LeAnna Washington. This is always an entertaining category. Washington was convicted of using her tax-payer financed staff to organize a yearly campaign fundraiser around her birthday party. When one staffer complained that this was illegal, she reportedly replied, according to his grand jury testimony:

“I am the fucking senator, I do what the fuck I want, and ain’t nobody going to change me. I have been doing it like this for 17 years. So stop trying to change me.”

  • Conflicted Journalist: CNN sent Jay Carney, fresh off his assignment as President Obama’s official spokesman, defender and spinmeister, to cover his ex-boss’s speech.
  • Conflicted  “Non-partisan” Watchdog: CREW. The Center For Responsibility and Ethics in Washington and its chief, Melanie Sloan, finally came clean (after falsely claiming non-profit status as a non-partisan organization for years) by making David Brock, head of the openly partisan, foaming-at-the-mouth anti-Republican media watchdog Media Matters its Chairman of the Board, essentially merging the two groups.
  • Appearance of Impropriety Award: Rep. Steve Scalise (R-La), Republican Whip. It is not certain yet whether Scalise knowingly spoke to a group of white supremacists in 20o2, inadvertently spoke to the group, or just spoke to another group meeting in the same venue before the David Duke-affiliated group of racists started comparing sheets. It isn’t even clear that Scalise knows, but everyone should agree that it looks awful no matter how you categorize it, making the fiasco a classic appearance of impropriety situation. If the Republicans were smart, they would dump him.

Wisconsin Democratic gubernatorial candidate Mary Burke, whose campaign materials were largely plagiarized from the materials other candidates.

Ethically Clueless Voters of the Year

New York’s 11th Congressional District, which contains Staten Island and parts of Brooklyn. These alert and ethical citizens sent back to Washington thuggish and crooked Rep. Michael Grimm (R), then facing a 20-count indictment by federal authorities for fraud, federal tax evasion, and perjury, having earlier distinguished himself by threatening to kill a reporter and being recorded doing so.

Wendy Davis, Democratic candidate for Texas Governor, offered an ad attacking her wheelchair- bound opponent that 1) appealed to bias against the disabled 2) misrepresented the duties of a state attorney general 3) misrepresented the facts of the cases the ad referred to and  4)  deceived the public regarding the ethical duties of lawyers, which Davis, a lawyer, presumably understands.
