Morning Ethics Warm-Up, 2018 President’s Day Edition:
Good Morning, George, Tom, Teddy, Abe!
I’m in a bad mood. Maybe it will pass.
1 No Presidents Day post this year. I usually do a special Presidents Day post. I never thought I would ever feel this way, but I’m thoroughly sick of writing about the Presidents after the last year. I blame “the resistance” for this along with the news media, both of whom have created a related but separate ethics issue by relentlessly attacking, disrespecting, mocking and undermining President Trump. [Of course, for those who are interested, this epic post, from 2015, was about four years’ worth of Presidents Day material, and this one, also from that year, is my personal favorite of all the entries here about my favorite 45 Americans. Does President Trump have a Julia Sand out there somewhere? We can only hope…]
Yesterday Ann Althouse, strafing the news media’s obsession with the ridiculous publicity-mad porn star whom Trump either did or did not have an affair with and to whom his to slimy lawyer Michael Cohen paid hush money, was attacked on her own blog by commenters who accused her of defending the indefensible—you know, the President of the United States, who was never allowed a single second when the entire country unified behind the winner of a hard-fought election, and as one wished him good fortune and success. Not a second.
Ann usually doesn’t get involved in her blog’s comment threads., but she responded this time:
You Trump haters made it so boring to hate Trump. I don’t even like Trump, but you people annoy me.
Above all, I believe Trump won the election, and he deserves support as he attempts to carry out the responsibilities America entrusted to him. We need to help him, not try to screw him up at every turn. I think it’s outrageous what has been done to him, and I regard it as an attack on democracy.
I have always found that once the President is elected, we should accept the result and support him when we can and look to the next election if we can’t. I think the “resistance” is a rejection of democracy…
That is about as perfect an expression of my feelings as anyone could compose, including me. It has been this blog’s position from November 9, 2017 on, and I have never wavered from it. I knew this was basically Althouse’s stance as well, since so many of her posts reflect it, but it is gratifying to have another serious blogger I respect express it so clearly. Continue reading

Michael Ejercito registered as concise, witty, sharp and unmerciful a rebuttal of the knee-jerk anti-gun position’s multiple dishonesties, deceits and distortions as I have ever seen. I am debating whether to post the whole thing on Facebook. It may be unethical to make one’s friend’s heads explode, even heads that deserve it.

– These people claim that we “do nothing” regarding murder. How then, are murderers in prison? Is it just sheer coincidence that they are serving life sentences or on death row? If not, why is punishing murderers not considered “doing something”?
– “This happens nowhere else”. Does “nowhere else” include Brazil, Jamaica, Mexico, and South Africa?
– These people claim that no one is talking about banning guns. How then, did guns get banned in Chicago, Illinois, and Washington, D.C.? How did guns get banned in South Carolina in 1902 if no one ever talked about banning guns? Continue reading
Comment Of The Day: “Morning Ethics Warm-Up, 2/8/2018: Tolstoy And The News,” (Item #4)
Frequent commenter Otto vanished from the wars for many weeks, and then nailed a Comment of the Day on his first day back. Boy I hate that: it’s as if he can register a sharp, thought-provoking analysis at will, like he’s toying with us. This time, his topic was illegal immigration, as he responded to the item about Nancy Pelosi thanking the parents of “Dreamers” for breaking our immigration laws.
Here is Otto’s Comment of the Day on the illegal immigration item in the post, Morning Ethics Warm-Up, 2/8/2018: Tolstoy And The News :
…The only reason persons would immigrate to the U.S., legally or illegally, is hope for a higher quality of life than they could have in their home countries. Any positive differential between what they would achieve in their home country and what they would achieve in the U.S. with the same output of effort can only be attributed to living off the fat (wealth, capital, productiveness) of the American people (past, present, and possibly future). If their effort would achieve the same results (or better) in their home country, they would not immigrate. It is that simple.
While this is true, I don’t believe we should even consider the economic benefit to the U.S. when determining who should and should not enter the U.S. or become citizens – it sounds too much like using a person as means to our own ends. However, if we do consider economic benefit, Humble Talent is correct that we must include opportunity cost in our calculation. If admitting a farmer from Guatemala as a citizen precludes us from admitting a physician from Germany as a citizen, we must include any differential in productivity (economic benefit) between the two persons as a cost (or benefit) of admitting the farmer.
Of course, the myriad avenues of opportunity cost are not the only costs of illegal immigration. Assuming illegal immigrants purchase food, clothing, housing, and other commodities, their demand for these commodities puts upward pressure on prices that must be paid by all U.S. citizens. Assuming illegal immigrants seek employment, their supply of labor puts downward pressure on wages, a cost suffered by all U.S. citizens. If illegal immigrants seek an education, they contribute to classroom crowding and greater expense of education, which is a cost to all U.S. citizens. If illegal immigrants drive vehicles anywhere, they contribute to wear and tear on infrastructure, a cost to all U.S. citizens. If illegal immigrants receive any type of governmental benefit, it is a cost to U.S. citizens. If illegal immigrants receive any type of pseudo-private benefit (such as reduced rates on utilities), it is a cost to U.S. citizens. Continue reading

I am backed up on Comments of the Day again, especially embarrassing after I announced that I would be posting one a day if possible. Getting one of the comments in the queue last night required trying to use my netbook while watching the Westminster Dog Show with my old Jack Russell feeling insecure and cuddling in my lap. The Update will be late today.
The post about the Oregon hospital being bullied by the local ACLU into placing an illegal immigrant on its transplant list simultaneously raised medical ethics issues and illegal immigration ethics issues, so I am grateful that Zoltar Speaks! resuscitates the topic with his comment. I am particularly greateful for his raising the question, “Is the perception of an action what makes the action ethical, or is it the motives behind the action that makes the action ethical, or does it take both?”
My answer, which I think I have made clear over 80,000 posts, is that it is what an action does or can reasonably be expected to do, within the intention and goal of the actor, that makes conduct ethical or not. Unanticipated and unanticipatable results don’t count, and neither does pollution by non-ethical and unethical motives mixed in with the ethical motives, unless they warp the conduct and the decision to engage in it.
There are exceptions, of course.

On one hand there is the Hippocratic Oath that directly implies that medical need trumps things like legal status, so in that regard the policy change is a direct reflection of the core of the Hippocratic Oath and it can be said that they changed their policy to reflect the ethical core of the Hippocratic Oath and present that argument to the public and their actions on the surface can be regarded as ethical. (Yes it’s a run-on sentence)
On the other hand there is the fact that illegal immigrants are literally taking advantage of a near “border-less” country and existing systems in place across the United States that ignore their legal status will allow them to do whatever they want regardless of the fact that they are in the United States illegally and some existing systems in place that actually help them do anything they want because they’re illegal immigrants. The United States has been, and still is, enabling illegal immigrants and this policy change is another system changed that enables illegal immigration.
This leads me directly to a topic that we’ve talked about on Ethics Alarms in the past: is the perception of an action what makes the action ethical, or is it the motives behind the action that makes the action ethical, or does it take both? If I remember correctly, I think the general consensus was that it’s the perception of the action that makes it ethical.
The perception of this action is two fold; first ethically complying with the intent of the Hippocratic Oath and second it’s another policy change enabling illegal immigration. Continue reading
Comment Of The Day: “KABOOM! So It Has Come To This: The Book-Of-The-Month TV Commercial”
The recent post about Madison Avenue continuing its effort to coarsen the popular culture and society with gratuitously vulgar commercials, in this case Book-Of-The-Month Club believing that it is hilarious to fake out viewers into thinking they are watching a tampon commercial, was not one that I felt would ignite much controversy or varied comment. As is often the case, I was wrong. The essay generated several surprising threads, including a comment by prolix, controversial blog warrior Alizia, whose commentary here ranges all the way into another post, the article about a high school musical casting controversy and the school’s unethical response to it.
She also raises the question of whether Ethics Alarms should engage more frequently in meta-ethics and philosophy. One reason I selected her comment as a Comment of the Day is that I’m interested in other readers’ views on that topic, not that I’m interested in turning in that direction. My focus as an ethicist has always been practical ethics, and the posts here about grand ethics issues of the sort that have been debated to no productive end for centuries have been incidental and few. Frankly, those topics don’t interest me very much; certainly not enough to devote the blog to it. About a year ago an erudite young woman briefly submitted some provocative comments here but want to argue about competing philosophical theories. She was shocked, indignant and angered when I refused to engage, and after yelling at me for a while, left the forum. For those seeking what she sought, I recommend going here.
Abstract and scholarly ethics have undermined the subject of ethics to the degree that it is not one most people can tolerate or understand, effectively removing ethics from public education and general discourse, and thus undermined the goal of an ethical society as well. They are still relevant to the discussion; I just know from hard experience how philosophy tends to send normal people fleeing like the Tokyo crowds in a Godzilla movie.

One things I noticed and have mentioned a few times in respect to the Ethics Alarms blog and, naturally, the people who participate in it, is that it often clearly distinguishes a situation or event in which an ethical issue is brought out and then it successfully and interestingly provokes an examination of the problem or issue. Yet what I notice as well is that the issue is not brought out in a larger context. Or, the larger context is rarely explored. The reason why it is not explored is more interesting and it seems to me more important than what is allowed to be explored or what is acceptable. I can think of two instances and I will mention them.
In this present instance it is noticed that advertising is incorporating vulgarity. But it is really far more than that, at least as I see things. What is the real issue? The real issue is the pornographication of culture. It is, I think this is true, coming about because this is the sort of things you-plural have allowed to go on. It is certainly true (as I have scoldingly said) that ‘it is your generation that has allowed these levels of moral and ethical corruption to creep in’ and I think that this is a necessary stance to take. In my view, though it is not appreciated much here, ‘the pornographication of culture’ connects to sexual expression of many sorts and also extends to ‘the homosexualization of culture’.
There is an active agent, either in the business culture itself, or perhaps in academic culture, that has set in motion these pornographic processes. And just as media culture and Hollywood has gotten continuingly infected with this material (which I assume *you* find titillating and exciting and do not oppose), similarly one can now notice the insinuation of homosexuality into the culture-productions. It becomes visible, included, and influential thereby. Normalized. But behind these appearances, behind this increasing in-flux, stands something far more raw, far more brutal, far more elemental, far more powerful and influential, and that is ‘the pornographic’, a truly ugly and vile *world*. Comment Of The Day: “Proposition: An Illegal Immigrant Is Entitled To Receive A Life-Saving Organ Transplant That Otherwise Would Go To A U.S. Citizen In Similar Need”

“Hello, is this the Oregon hospital? Yes, I live in Mexico, and I need a liver right away. When can I schedule a time to come to the US and get a transplant? That sounds perfect! See you soon!”
The post about an Oregon hospital being publicly shamed into accepting an illegal immigrant for a potential liver transplant attracted the varies and thoughtful response here I hoped for. I have an unusual gut reaction to it, for me at least: I am sure that my position that the hospital is wrong (and that the ACLU is very wrong to bully the hospital into changing its policy) is ethically correct, but I feel badly about it anyway.
Here is what I told myself to make me feel better: Would anyone argue that the same woman would have any right or claim to an organ transplant from an Oregon clinic if she lived in Mexico? Would the ACLU dare argue that she had a right to be placed on a waiting list? Would even an Oregon hospital think twice before rejecting such a request? Would the ACLU be able to create a public outcry against her rejection? Let’s see: No, no, no, and “you’ve got to be kidding.”
Yet logically and ethically, I see that alternate universe version of Silvia Lesama-Santos being more deserving of a transplant, and receiving a lifesaving organ that a citizen in similar need would receive otherwise, than the actual Silvia. The actual Silvia, unlike my theoretical one, broke our laws. The actual Silvia has already benefited unjustly from doing so. My compassion for the theoretical Silvia is not reduced by my objection to her conduct and disrespect for our immigration laws; given the choice between whether to give a liver to her or the real Silvia, I would choose her, and it wouldn’t be a hard choice. She is more deserving than the real Silvia, unless one reasons that breaking out laws and continuing to avoid accountability for doing so over 30 years is a positive accomplishment. And yet the alternate Silvia has no right to a liver at all.
There. I feel better now.

Curmie is one of my favorite bloggers, and also a fellow stage director, a teacher, and a learned man with a keen understanding of ethics. As soon as I encountered the jaw-dropping story about the high school that cancelled its scheduled musical after a protest was mounted because a white student was cast in the role of the show’s Romani heroine, I knew it was in Curmie’s wheelhouse.

Re #3: I’d seen this story a few days ago, but luckily for my sanity I had too many other things on my mind to contemplate too deeply what was going on in my old stomping grounds (I went to high school a little over a half hour from Ithaca, and spent four years in grad school at Cornell).
I’m not sure I agree with you that the school is supporting “per se racism,” but I do think the decision was equal parts stupid, repressive, and cowardly. Even if we discount your entire argument, Jack (and I don’t), we still left with this: the character is Romani. The fact that a POC actor played the role in the biggest production of this particular iteration of the story doesn’t change the fact that many Romani are indeed white. What they definitely aren’t is black, although one suspects that casting such as actor in the role would have been at least condoned if not applauded. And if I’m identifying the complaining student correctly, she is far from the body type one would associate with the role. Continue reading
Comment of the Day: “Ethics Quiz: The Tip-Sharing Plan”
We have a rare Ethics Alarms Quote of the Day hand-off. Responding to the ethics quiz about the ethics of tip-sharing, veteran commenter JutGory wrote,
“My understanding is that, in some places, servers collect the tips and “tip-out” to the others (kitchen staff, etc.) at certain rates. If that is the culture (I have never been a server; not my skill set), why is a server trusted more than the employer to be fairer than the employer in tipping out?”
I have written about tipping ethics issues for years, and never encountered the concept of “tipping out,” perhaps because the minimum wage jobs I had in my youth never involved tips of any kind. Still Spartan picked up JutGory’s baton and dashed for the finish line. Here is her Comment of the Day on the post, Ethics Quiz: The Tip-Sharing Plan:
I used to work at a fancy restaurant and that was the system. The percentage of tip out was based on total food sales, so you couldn’t cheat. And, if I received really generous tips, I was incentivized to tip more because I wanted the hostess to seat good customers at my table, my drinks up first, my tables bussed quickly, etc. I would never work at a place that pooled tips because I was quite frankly better than most servers. I was quick, friendly, and rarely made a mistake. I could up-sell my customers on liquor and food which meant more money for me at the end of the night. And you people think I am anti-capitalist! Chefs aren’t tipped and they make a lot more than $3/hr., and although it is a hard job, at least their revenue is consistent. Many managers are well-paid too and often double as hosts or bartenders. I would be pissed if they had the ability to collect my tips.
The real solution to this problem is to pay servers a living wage and just have it incorporated into the price of food.

John Billingsley elaborates on the import and implications of the troubling research results regarding the brain disease CTE and participants in contact sports, especially football.

I agree that with 99% of NFL players and 91% of college players showing CTE on autopsy there is no ethical justification for American football and we don’t need it. Do we actually need any contact sports? CTE has been demonstrated in participants in multiple other contact sports including basketball, boxing, ice hockey, rugby, soccer, wrestling, and baseball. Unfortunately, there is not as much information available about the rates of CTE in those sports. There was an autopsy study demonstrating CTE in the brains of 21 of 66 individuals who participated in different contact sports at various levels, but no CTE in the brains of 198 controls who had no history of participating in contact sports. A study looking at high school athletes who participated in various contact sports from 2005 to 2014 found that there were about 300,000 concussions annually. That study found that the sport with the highest rate of concussions adjusted for the rate of participation was girl’s soccer. A concussion does not mean CTE will develop but repeated head injury is the etiology of CTE. Continue reading
