Comment of the Day: “Ethics Hero: Mother Jones Pundit Kevin Drum”

There are, I think, three regular commenters on Ethics Alarms who extend all the way back to Ethics Scoreboard days, or pre-2012. One of them is Tim Levier, who unlike the other two, I have actually met while I was in his state of Colorado. Tim posted the following on my Facebook page, and I invited him to cross-post here. In his post, he addresses the “do something!” lament that appears to be thoroughly rotting the brains of our leaders in both parties as they hustle to pander to the emotional responses to the Orlando tragedy. Tim wrote a younger friend about what somethings he would do, and not all of them are relevant to guns. They all, however, are relevant to building a society in which fewer people might choose to start shooting strangers.

I’m 35 and was recently talking with someone slightly younger. He had the standard call for ideas to check the “do something” box. After I did some jumping jacks to show that I did something, I buckled down and wrote some ideas.

Now, I’m usually accustomed to reading some constitutional murky stuff, so I veered a different direction. Below is my list as I wrote it to him, perhaps there’s something in it that speaks to people. My 4 ideas for improvement (not solutions, because solutions don’t exist.):

I’ll tell you that the #1 thing I would like to see in this country (give me some slack here, I believe everything is connected), given the state of health care…

I’d like to see a 3 tier system of medical insurance & payments. (Tier 3 will be the part that relates back.)

Ethics Dunce: ESPN

ESPN has announced it will give the University of Missouri (MU), a.k.a Mizzou, football team a special humanitarian award in July to honor the team for its strike  in 2015. You know the one, right?  If you did, then you are probably retching.

This was the Black Lives Matter-esque fuse that caused over a hundred universities to explode in racial unrest and cave in to pressure from black student groups to yield to demands supposedly addressing various imagined, concocted or politically exploited race-related problems on campuses, ranging from microagressions, to inadequate race-consciousness, to unidentified people saying mean things.

That last, in fact, was what caused the Mizzou foolishness. There, three unrelated episodes caused the “crisis”:

  • Payton Head, MU senior and president of MSA,  published a Facebook saying that he was walking around campus when the passenger of a pickup repeatedly shouted the “nigger at him.

No one confirmed his claim.

  • The Legion of Black Collegians posted on social media that the group was rehearsing for a performance at the University’s Traditions Plaza when a “young man” talking on his cellphone walked up to the group, was politely asked to leave, and hurled “racial slurs” at LBC members.

Was he a student? Nobody knows.

  • Someone draw a swastika using human feces inside Mizzou’s Gateway Hall.

Funny, I think of the swastika as an anti-Semitic symbol, not anti-black one, but hey, whatever it takes, right?

None of these involved perpetrators who were identified, or who were shown to be students. None of them  were remotely within the control of the University; nor were they coordinated in any way.  Black groups on campus, however, harassed the school’s president, Tim Wolfe,  and demanded that he resign. A black graduate student began a hunger strike, promising to forgo all food and nutrition until Wolfe was ousted. Finally, black University of Missouri football players announced that they would not participate in team activities or games until the university yielded to various demands, including Wolfe’s dismissal. The coach and the rest of the team backed the black players, and the university caved.

In addition to sparking many other conflicts on other campuses, disrupting students’ education, making U.S. ccolleges look like the inmates were running the asylums (because they were) and increasing racial tensions, the episode had the effect of  causing a huge drop in enrollment that has cost Mizzou about $32 million.

Isn’t that great?

Good job, everybody!

From The Ethics Alarms Double Standard Files: A Brock Turner Sentence For A Predator Teacher, And Everyone Shrugs

The lenient sentence Judge Aaron Persky handed to Stanford student Brock Turner for raping a drunken co-ed  enraged the social media and the public conscience, resulting in thousands of op-eds, protests from feminists and rape-culture activists, petitions, a recall effort, and most devastating of all, an Ethics Alarms post.

Last week, a 33-year old high school teacher named Lindsay Himmelspach pleaded guilty to repeatedly having sex with two minor students at the high school, and received the almost the identical sentence, from another California judge, as Turner. Himmelspach recieved three years probation and four months in jail.

I’m listening, but I hear no screams of outrage.

Huh.

The judge, Butte County Superior Court Judge James Reilley, administered the equivalent rap on the wrist that her Santa Clara colleague did on Turner because Himmelspach had no prior criminal record, she expressed remorse, and somehow he concluded that she’d never do such a thing again. (I’m sure it had nothing to do with the fact the she is hot, and the judge was thinking, “Those lucky bastards!”) Indeed, the judge didn’t even require the predator teacher to register as a sex offender, at least not yet. He’s keeping an open mind, and will decide after a separate hearing.

Fairness To Incompetent Lawyers?

Why this story didn’t make my head explode, thus rating the KABOOM! label, is a mystery. My theory is that the truly idiotic and ignorant exclamations on Facebook by my usually rational friends about guns in the wake of the Orlando terrorist attack have gradually strengthened my skull’s tolerance to internal pressure.

Once again, I have encountered a news story that required me to check and see if it was a hoax.

Tamara Wyche is a 2013 Harvard Law School graduate who is suing the New York State Board of Law Examiners. She claims she twice failed the bar exam because it refused to provide the same kind of testing accommodations that the law school did for her in her exams there, in recognition of her various cognitive problems. The fact that she flunked while being forced to take the exam under the same rules as everyone else resulted in the large Boston law firm Ropes & Gray terminating her employment. You can read her complaint here.

I confess that I didn’t read all of it: I didn’t want to press my luck with the old cranium.

The 29-year-old Wyche says she was diagnosed with depression and anxiety as a first-year law student at Harvard, and also  suffered several head injuries (?) that resulted in permanent memory problems and cognitive issues, requiring her to take several leaves of absence from her studies. She finally earned her law degree in 2013 thanks to Harvard granting her several doctor-recommended accommodations, including 50% extra time on tests, a separate testing room, and extra break time. She also was exempt from being called on in class, because of a propensity for anxiety and panic attacks.

Ethics Quiz (Extra Credit!): The Sexist, Satirical, Stupid Sign

Ryan Sullivan, a Salinas High School math teacher, picketed Hillary Clinton’s campaign visit to Hartnell College in Salinas May 25 while holding a sign that said: “Hillary Clinton not fit to be President. President equals a man’s job.”

The sign, naturally, was photographed and quickly went viral on social media, where I encountered it. All of the respondents to the sign’s posting on social media pronounced Sullivan a vile, sexist fool who was unqualified to teach. There is a “fire Sullivan” hashtag on Twitter. I immediately guessed that the sign was probably intended as satire: it was just too stupid. Sure enough, satire is what Sullivan, with the social media screaming for his metaphorical head and to end his teaching career, claims the sign was. It was a joke! Don’t you get it?

He wrote,

“Disgusted by the statement on my sign? Good! I’m happy to hear you disagree with such outlandish statements.Unfortunately, I have several family and friends who express the point made on my sign (mostly behind closed doors), I wanted to bring their message into the public forum to show how ridiculously outdated it sounds in 2016. Glad to hear it bothered so many—opinions like that should.”

Of course, if Sullivan meant every word of the sign, he could still say the same thing, and if his job was on the line, he probably would. Sullivan reportedly wrote his thesis on the gender gap in high school mathematics classrooms to help teachers create a more equitable environment for students. Does that prove his sign was a joke?

Asian-American Students Take Aim At What’s Unethical About Affirmative Action

Good.

The ethics problem with affirmative action is that its utilitarian trade-off is undeniably unfair and hypocritical. In order to admit African-American students whose test scores and grades would not normally allow them to be admitted to elite institutions, racial preference is used to justify not admitting white students whose credentials would otherwise qualify them for entry. Diversity justifies racial discrimination.

Asian-Americans have long been an embarrassment to this theory. Even though it is another minority group that was the target of institutional and social prejudice in this country, and despite added disadvantages of language and culture, Asian Americans as a group have better test scores and grades than the supposedly privileged whites. Not only does this fact call into question some assumed explanations for the consistently lagging performance of African-Americans, it also threatens diversity policies by raising the possibility of a student body disproportionately Asian American, with whites students being squeezed out at one end by  superior Asian-Americans  and on the other by Affirmative Action-assisted blacks.

How have universities avoided this problem thus far? They have avoided it by applying quotas to both Asian-Americans and African-Americans. The problem is that the quotas on Asian Americans limit their numbers, regardless of their qualifications. Continue reading

Tales Of The Self-Righteous And Incompetent: Lawyer/Teacher Malik Leigh And His Donald Trump Exam Question

Malik Leigh is an attorney who teaches in Palm Beach Lakes High School’s pre-law academy. He submitted an exam for review, as the school requires of all tests, that included this question:

“If Donald Trump becomes president of the United states, we are:

A.) Screwed

B.) Screwed

C.) Screwed

D.) Screwed behind a really YUGE wall that Mexico pays for.”

In another question on the same test, this lawyer—and I’m still trying to get my mind around that embarrassing fact— asked

“When performing an opening statement, it is best to:

A. Wink at the Judge

B. find the hottest person on the Jury and focus your words on them

C. Speak to them as if they are cordial friends.

D. Treat them like the MORONS they are.”

Leigh was suspended.  The letter he received from Principal Cheryl McKeever announcing the suspension stated that the questions contained “inaccurate content, irrelevant material, unprofessional use of language, inappropriate use of language.” Continue reading

Here is the short version:

Yale’s Thomas Pogge is a world famous Yale professor of philosophy and ethics who is especially renowned for condemning the terrible human rights effects caused by disparity of resources between rich countries and poor ones. His books, lectures and a well-recieved TED talk argue that the power imbalance between rich countries and poor countries is so great that poor countries cannot reasonably be said to “consent” to agreements between them. Pogge has also accumulated many credible accusations of exploiting, harassing, and taking sexual liberties with his female students in multiple institutions. In the case that has led to this contrast becoming public, Yale offered a female accuser, a Yale graduate named Fernanda Lopez Aguilar, $2000 in exchange for ending the matter and keeping the story out of the news media.

The long version is here. Because the publisher is BuzzFeed, which is not widely regarded as a sterling source of trustworthy journalism (to say the least), the detailed and apparently well-researched report will be easy for Pogge and Yale to ignore and shrug off. However, other publications, including the Yale Daily News, have investigated the work of author Kaitie J.M. Baker, and so far it has held up to scrutiny.

Pogge has responded, less than convincingly, I would say, to the Lopez Aguilar allegations here. I say unconvincingly because he does not address the previous accusations made against him at Columbia University, and if there is one common characteristic of sexual harassers and abusers that stands out above all others, it is that they are habitual and repeat offenders. Anyone who has spent any time in academia (like me) is well aware that the culture permitting professors, especially male professors, to use the student body and bodies as a sexual perk of the job is widespread and only weakly restrained, if at all. Does that prove that Pogge is one of the professors who partakes in the lusty opportunities presented to him as an object of trust and admiration? No. There is, however a lot of smoke surrounding him, and the smoke has been issuing for a long time.

Yale’s institutional conduct is more than smoke. Yale appears to be another example of a trusted institution deciding that it is preferable to cover up the possible, likely or proven misconduct of a valuable employee than to risk damaging the reputation of that institution, or alienating the loyalties of other employees, by addressing it openly and decisively. I’m sure you can name other infamous examples of this phenomenon, broadly covered by the rationalizations “The King’s Pass” and “The Saint’s Excuse” on the Rationalizations List. Among the most infamous of these are the Catholic Church’s decades, perhaps centuries-long enabling of child sexual predators in the priesthood, the Watergate cover-up by the White House, and Penn State’s failure to stop a known child predator from using the school’s football program and its campus as a base of operations. Yale’s particular variety of this unethical choice is an especially unsavory one, closer to the Joe Paterno/ Sandusky and “Spotlight”scandals, because it intentionally  places future innocent victims at risk of harm.

I accept that there is a possibility that Pogee is an impeccable  professional and as pure as the driven snow, and thus himself a victim of a smear, though this seems unlikely. What I am more interested in now is to address the questions asked in the BuzzFeed piece, which relate to how we should regard unethical ethicists as well as other prominent figures who defy, in their actions, the wisdom they are celebrated for dispensing to others—the Bill Cosbys of the world.

Talk about a lack of transparency.

Students in a class  at the Georgia Institute of Technology were recently stunned to discover that the teaching assistant they knew as “Jill Watson” all semesterwas actually a an on-line artificial intelligence program..

A creation of IBM’s Watson analytics system, “Jill” helped graduate students by answering their questions for  an online artificial intelligence course. Professor Ashok Goel, who led the online course, told The Wall Street Journal that Jill was designed to help burdened TAs field an onslaught of questions from the 300-person class. He did not tell the publication why the school chose to let students think Jill was “a real, live, girl,” as the song goes. This is, and I realize that since the Professor in in the field of computer science and not philosophy, political science  or management, so he may be unfamiliar with the concept, something that is known as perpetrating ” big lie.”

Another story about the incident in Geek Wire notes that “some say it sets a bad precedent.”

Ya think?

I supposed now is as good a time as any to tell you that “Jack Marshall” is really just a private AI program set up in Hillary Clinton’s bathroom.

Not a comment on the post so much as on the underlying conditions that spawned it, Ethics Alarms reader Chris Bentley weighed in on the lack of ideological diversity on campus and the fact that many leaders both educational and political think that’s just fine. The key  question: do you listen to an argument against what you may believe with an open mind, or a closed one? The ethical answer is “Open,” but the predominant mindset on college campuses believes there isn’t any question to that effect.. Wrong is wrong, and the Left is Right, so the the only question is, “Do you allow those with wrong ideas speak at all?”

It is terrifying that universities, of all places, would ever consider that issue unsettled in the United States of America.

Here is Chris Bentley’s Comment of the Day inspired by the post, Dear Harvard: Fire President Drew Faust And Dean Rakesh Khurana:

“They know best, after all.”

Only a tertiary connection to the topic, I know, but I just got done listening to Obama’s Howard Univ. speech. While there is no doubt that he is a captivating orator, one thing kept striking me. The repeated refrain to the students, that they needed to “listen” to those that they disagree with, and not try to have speakers who think differently from you banned from campus, b/c, as his grandmother used to say “Don’t do that…Every time fool speaks they are just advertising their own ignorance. Let them talk.”
