Ethically And Legally, Yeshiva University Can’t Have It Both Ways

Yeshiva University is in a legal fight with a group of LGBTQ students, the YU Pride Alliance, that demands that the Modern Orthodox Jewish university recognize their campus club. To make the argument that it can refuse to do so, Yeshiva is claiming that it is a religious institution, which would which would exempt it from anti-discrimination laws under the First Amendment.

There’s a problem, though, a rather substantial one. Before the 2021 lawsuit, Yeshiva held itself out as an educational institution, which made it eligible for public funds but also meant that it could not defy city and state non-discrimination laws. The institution has received an estimated $230 million in taxpayer dollars to pay for the construction and renovation of its facilities, among other expenses, when it claimed to be an educational institution before 2021.

Now Yeshiva is stuck. The chairman of the State Senate Judiciary Committee has stated, “Regardless of anyone’s motives, misrepresentation to procure public money is dishonest and could potentially violate state law.” If it acquired those state funds legitimately, then Yeshiva cannot deny the students their organization without breaking the law. The standard issue virtue-signaling woke gibberish above introduces Michigan State University’s “Strategic Plan,” which is more virtue-signaling woke gibberish. You can’t “empower excellence” if you “advance equity,” since equity now means “pay no attention to excellence or actual qualifications and ability, the goal is to make sure everyone gets to the same place.” That requires penalizing excellence, or hobbling it. The strategic plan itself is introduced with this consultant-speak blather: “We envision a Michigan State University that has significantly expanded opportunity and advanced equity, elevated its excellence in ways that attach vital talent and support, and has a vibrant, caring community. Our trajectory is positive, and our will is legendary. We can and will achieve more in the decade ahead.”

Ramalalama-ding-dong! But that’s not what prompts this post.

One of the ways MSU seeks to achieve its goals is by limiting WrongThink through the meticulous constriction of language using the excuse of, you guessed it, “Diversity, Equity and Inclusion.” On the MSU website, this is introduced by this self-contradictory, indeed Orwellian graphic:

Welcome To “Bad Research Theater”!

Yes, it’s Alistair Cookie, here for another episode—two, in fact!—of that long-running exhibition loved by the confirmation bias-infected and the unscrupulous alike, “Bad Research Theater”!

Episode I : “The Steam Engines of Galapagos

The eye-opening scholarly paper “The end of the line: competitive exclusion and the extinction of historical entities” has been published the journal, “Royal Society Open Science.” Bruce Lieberman, professor of ecology & evolutionary biology and senior curator of invertebrate paleontology at the KU Biodiversity Institute & Natural History Museum, uses the history of railroad steam engines history to argue against the merits of “competitive exclusion,” the respected paleontology evolution principle that species can drive other species to extinction through competition.

Working with former KU postdoctoral researcher Luke Strotz, now of Northwest University in Xi’an, China, Lieberman found that the fossil record lacks the detailed data verifying competitive exclusion found in the history of steam engines. Well, I don’t know about you, but I’m convinced!

Many years ago, as a boy trying to bring in distant baseball broadcasts at night on my transister radio, I stumbled across a rural evangelist who was ranting about the godlessness of evolution. “Evolution says that if you put a six cylinder engine in your garage and let it sit there for a million years or so, when you come back and check on it, it will have become an eight cylinder engine!” he said, chuckling heartily. I thought that was the dumbest thing I had heard to that point in my life, and it still is in the top five. Little did I suspect that his idea of comparing mechanical objects with live organisms would be adopted decades later by actual scientists.

Unethical Quote Of The Month: 65 Professors And 558 Other Faculty Members And Students Of Washington & Lee University

“We ask that the University prevent Matt Walsh from speaking on our campus and that the University live out its Statement of Commitment to Diversity by taking action to protect its minority students from future harmful events.”

—623 Washington & Lee signatories, including 65 professors and law professors, of an online petition to block a conservative speaker from appearing on campus

Displaying either ignorance or contempt for the core American ethical principle of freedom of speech, 623 members of the Washington & Lee University community, mostly students and faculty members but with a few others mixed in, maybe cafeteria workers or something, have signed an online petition insisting that conservative political commentator and author Matt Walsh be prevented from speaking at the Virginia campus on March 30, on the currently controversial topic of “What is a woman.” Walsh has been a deliberately inflammatory critic of the current extremist, indeed brain-melting phenomenon of transsexual madness, which has reached such heights (or depths) that the last confirmed Justice on the U.S. Supreme Court professed an inability to define “woman.” Walsh stars in online documentary film “What Is a Woman?” created by the conservative website, The Daily Wire.

What is so disturbing about the petition, which is reproduced in its entirety below, is the anti-democratic logic and ideology it displays, though all of this is now familiar to anyone following the descent of the American Left into aspiring totalitarianism. The position one whole side of the American political spectrum has now almost completely accepted as legitimate is that dissent from its obviously virtuous and correct cant (they are on the “right side of history,” after all) is the equivalent of violence and causes permanent “harm” to member of its constituency or society in general. The petition justifies its existence by providing frightening proof of many horrible truths, among them that the U.S.’s institutions of higher learning now indoctrinate their students into anti-democratic philosophies. Eberstadt, recently the writer of “Primal Screams: How the Sexual Revolution Created Identity Politics “was scheduled to give a speech about her book’s thesis at Furman University today. Prior to her scheduled appearance, the South Carolina campus was festooned with protest fliers. The online student newspaper accused Eberstadt of perpetuating “dangerous myths.” Letters denigrating Ebestadt’s character and demanding that credit for attending her speech be denied were sent to the university’s Cultural Life Program.

So she bailed out, ran away, and capitulated to the mob. In an op-ed in the Wall Street Journal, Eberstadt complained that though the odds of physical violence being inflicted on her if she appeared were low, they were not“not non-existent.” She defended her flight from conflict by writing in part,

Ethics Observations On The House Passage Of H.R.5 (The Parents Bill of Rights)

In a 213 – 208 vote, the House approved the Parents Bill of Rights, which would require school districts to post their curriculum online, allowing parents to review the materials. It has many other provisions, none of which unreasonably burden schools, and all of which are aimed at letting parents know what their children are being taught, what speakers are addressing their classes, what books and publications they will have access to, and what special needs and problems are arising that parents should be aware of.

I have read the entire text of H.R. 5, as should you, as should every parent. If there is anything in the bill that is excessive or that forces schools and teachers to compromise their duties as educators, I would be eternally grateful for someone to point it out to me.

The conventional wisdom is the bill will not pass the Senate to become law (I would dare Joe Biden to veto it). I find that astounding, just as I find it astounding, and damning, and signature significance for a party that obeys the dictates of its powerful constituencies, in this case, the teachers unions, to the detriment of the public at large. It is equally astounding that not one single Democratic House member voted for a bill that as far as I can see only establishes by law an obligation to inform parents of what parents want to know, out to know and have every right to know about the content of their children’s education.

Comment Of The Day: “Stanford’s Disgraceful DEI Dean Throws Down The Guntlet…NOW Will Stanford Fire Her?”

EA has featured a lot of posts about the Stanford Law shout-down of a conservative federal judge and the school’s “DEI” dean’s complicity in making certain that he did not get a fair opportunity to deliver his remarks. It is, I believe, quite possibly a tipping point regarding many important cultural issues, including Leftist censorship, the decline of higher education ethics and academic freedom, the corruption of the legal profession, and most of all, the toxic influence of the “diversity/equity/inclusion” cult to undermine core societal values in the U.S. The mainstream news media is doing its best to keep the story and its implications far from the consciousness of the average member of the public.

Glenn Logan has offered a helpful Comment of the Day which analyzes Stanford Law School Associate Dean for Diversity, Equity, and Inclusion Tirien Steinbach’s defiant and telling op-ed in the Wall Street Journal. Glenn is one of many experienced bloggers in the Ethics Alarms commentariat, and at times like these it shows.

Steinbach wrote: “Regardless of where you stand politically, none of this heated exchange was helpful for civil discourse or productive dialogue.

True, but only because one side decided the right way to deal with debating controversial issues was to make sure that the other side of the debate could not be heard without wading through repeated ad hominem attacks and invective.

At no point does Steinbach recognize that the students were driving the lack of civility. It is also true that the judge’s remarks at certain points crossed the line, but he was under constant attack to the point that he was unable to deliver a coherent presentation. Steinbach either does not recognize these facts, or is okay with them. Based on her prepared remarks, the latter seems to be the betting favorite.

So how can this possibly square with her implied desire for civil discourse? Easy — discourse can only be civil when it’s hers, or she agrees with it, or it is had on her terms.

Ethics Quiz: Michelangelo Porn

Oh, let’s start out this rainy weekend (here in Northern Virginia, at least) with an ethics quiz on a theme that will be recurring on Ethics Alarms today if all goes as planned (which it seldom does).

Tallahassee (Florida) Classical School principal Hope Carrasquilla was given a choice between being fired or resigning following complaints by parents over a recent art lesson in the charter school that included Michelangelo’s famous “David” statue and his Sistine Chapel “Creation of Adam” fresco painting.

After all, pee-pees were involved.

The stated mission of the Tallahassee Classical School is “training the minds and improving the hearts of young people through a content-rich classical education in the liberal arts and sciences, with instruction in the principles of moral character and civic virtue.” The school also maintains that “reform of American public education, to be successful and good, must be built on a foundation of classical liberal arts learning.” Presumably parents who enrolled their children in the school were aware of this orientation.

Moreover, it is fair to say that “David” is just about as iconic a symbol of the classical arts as one could name, with perhaps the Venus de Milo being the only competition. Yet after three parents complained about their 6th graders being exposed to images of “David” (and the naked Adam in the Sistine Chapel painting), the school’s principal was forced out.

Conservative Hillsdale College provides the curriculum, training, and resources for the school as well as for other public schools through Hillsdale’s K-12 support. This was not an example of parents rising up against an extreme left-wing curriculum. Yet one of the parents famously denounced “David” as “pornography.”

Central Connecticut State University May Not Be Stanford, But Its Anti-Speech Mobs Are Exactly The Same

Candace Owens’ documentary exposé on Black Lives Matter was released last Fall. “The Greatest Lie Ever Sold” also challenges the mainstream media narratives surrounding the death of George Floyd, so you will not be shocked–shocked!—to learn that it has received minimal attention from the news media. Discussing, never mind showing, the utter corruption of the cynical, racist movement that corporations, whole industries and major cities bowed down before in abject submission is a perfect excuse in for Woke World—-and that includes most journalists and editors—to metaphorically kill the messenger. I’m abashed to admit that I had never heard of the film before this week.

And so it came to pass that when The Daily Wire-produced documentary was screened at Central Connecticut State University (CCSU) earlier this month, the film was shut down by a Stanford Law-style student mob. Conservative Hollywood blogger Christian Toto quotes the account of a CCSU professor who related what happened when the film began to play on the screen:
