Journalism Ethics: The Washington Post Enables Disinformation Regarding Hillary’s Email Machinations

In an article for the Washington Post column “The Plum line,” Paul Waldman wrote, after noting that reports on the FBI investigation into Hillary Clinton’s mishandling of classified materials suggest that the F.B.I. has found no intent on her  part to violate classification rules,

“That point about her intending to break classification rules is important, because in order to have broken the law, it isn’t enough for Clinton to have had classified information in a place where it was possible for it to be hacked. She would have had to intentionally given classified information to someone without authorization to have it, like David Petraeus did when he showed classified documents to his mistress (and then lied to the FBI about it, by the way). Despite the enormous manpower and time the Justice Department has devoted to this case, there has never been even a suggestion, let alone any evidence, that Clinton did any such thing.”

This continued a process, begun and fed by Clinton herself, to mislead the public about the investigation, the law, and Clinton’s conduct. It is the insidious “narrative” tactic again, and it apparently almost impossible to fight. For example, an old friend, a smart and informed former journalist, recently posted on Facebook to the effect that he wondered if the F.B.I. would investigate Colin Powell and Condoleeza Rice, since they also used personal e-mail for official business while Secretary of State. He wrote this in good faith, because this has been a central defense from Clinton for more than a year. It is harder to kill than the Hydra, despite the fact that it is pure deceit, for two reasons.

The first is that what was considered responsible and acceptable use of technology nine years ago is not responsible and acceptable use of technology now. What was considered responsible and acceptable use of technology nine weeks ago is often not responsible and acceptable use of technology now. The acceleration of technology development was well underway when Clinton was appointed, and new security measures and best practices at all the major agencies reflected that. If she intentionally ignored this, she was irresponsible and reckless; if she negligently failed to follow them, she was incompetent. No matter how Rice and Powell handled their e-mail, it was a different time, and the comparison is invalid and misleading. No one who understands technology and the speed with which it evolves, with accepted practices becoming dangerous and incompetent virtually over-nigh, could hear Clinton’s “They did it too!” excuse without rolling their eyes. But of course, this spin isn’t intended for those who understand the issues involved. They are designed for people like my friend, who are relatively uninformed regarding technology, and can be converted into an effective disinformation agent without his consent or knowledge. From today’s Washington Post:

“One of President Obama’s top national security advisers led journalists to believe a misleading timeline of U.S. negotiations with Iran over a nuclear-disarmament agreement and relied on inexperienced reporters to create an “echo chamber” that helped sway public opinion to seal the deal, according to a lengthy magazine profile.

Ben Rhodes, the deputy national security adviser for strategic communications, told the New York Times magazine that he helped promote a “narrative” that the administration started negotiations with Iran after the supposedly moderate Hassan Rouhani was elected president in 2013. In fact, the administration’s negotiations actually began earlier, with the country’s powerful Islamic faction, and the framework for an agreement was hammered out before Rouhani’s election.

The distinction is important because of the perception that Rouhani was more favorably disposed toward American interests and more trustworthy than the hard-line faction that holds ultimate power in Iran.”

In other words, the Obama Administration manipulated the news media to deceive the American public. The objective was to make the public less concerned about the trustworthiness of the Iranian government and the motives of the Obama administration regarding an agreement that resulted in Iran receiving billions  of dollars in exchange for a promise to do what it has never done before, adhere to an international nuclear treaty.

Since this information arrived in the form of a boast from Obama’s chief foreign policy advisor, in a tone reminiscent of the revelations of Obamacare architect Jonathan Gruber, it qualifies as a smoking gun indictment of the President’s integrity, honesty, competence and transparency.

Let me correct that: another smoking gun.

Yet the Post published this in its Style section, with the movie reviews, gossip columns and crossword puzzle. The Rhodes profile itself was published by the New York Times Magazine, not the newspaper itself. In other words, the two major U.S. dailies that were among the news sources duped by Rhodes and Obama, think this is interesting, entertaining even. The Donald Trump Presidential Candidacy Ethics Train Wreck is so deadly that the nation will be forced to board the Hillary Clinton Presidential Candidacy Ethics Train Wreck to survive it, as a broken back, a smashed face and need for multiple organ transplants are still more survivable than a damaged brain and a crushed heart.

Like all political Ethics Train Wrecks, however, it does allow us to learn a great deal about various pundits, politicians and public figures. Here are some early results from the wreckage once known as the Republican Party:

Ethics Heroes: The Bushes (Jeb, George H.W. and George W.) Mitt Romney, House Speaker Paul Ryan, Republican U.S. Senators Lindsay Graham,  Ben Sasse of Nebraska and Jeff Flake of Arizona, Massachusetts Gov. Charlie Baker and Illinois Governor Bruce Rauner;  Conservative columnist Erick Erickson, Republican strategist and operative Mary Mat Weekly Standard founder and editor William Kristol.

There will be more. To reject the apparent nominee of your own party is a nearly unprecedented step for party leaders and ex-Presidents. I can’t find any vaguely similar example since Teddy Roosevelt split the GOP with his Progressive Party in 2012. Sasse has called for a third party alternative. Eventually, we will have a more definitive list, and some of these will fall into perdition. Continue reading

unbalanced-justice-scaleA May 5 NBC News online story reported that the infamous Rumanian hacker called “Guccifer” had revealed “in an exclusive interview” with correspondent Cynthia McFadden that Hillary Clinton’s secret private e-mail server was “like an open orchid on the Internet,” and that he hacked its contents with ease. It has been noticed, however, that NBC interviewed Guccifer during his pre-extradition detention in Rumania, at least a month ago. It was not until yesterday, when Fox News broke the news, also as an “exclusive,” that Guccifer, a.k.a. Marcel Lehel Lazar, asserted from a Virginia jail that he had repeatedly breached the former Secretary of State’s  in early 2013, that NBC let the story out.

A Catastrophic Existential Failure Of Ethics And Institutions

I woke up this morning nauseous, after a restless night. It could have been dinner, but I’m pretty sure that it was Indiana.

Not that seeing Ted Cruz suspend his quest to be President was upsetting in and of itself. He’s a terrible candidate and a dangerous man, and almost certainly unelectable, which in his case is a good thing. As it did with Chris Christie, who was exposed as a character-free fraud; as it did with Jeb Bush, who demonstrated an inability to think; as it did with Ben Carson, who proved why his theory that leaders need no relevant experience at all was nonsense; as it did with Marco Rubio, who provided the definitive definition of “empty suit,” the primary system worked, and eliminated aspiring nominees who were unqualified and unfit in various ways.

It has not worked, however, with Donald Trump. This was not a failure of the primary system or the political system (Hillary Clinton’s impending nomination will be a failure of the political system) but something far more ominous. We are faced with the threat of an unstable, incoherent, ethics-free and irrational man becoming our President because of a catastrophic breakdown in the ethics of our cultural, societal and political institutions, over a long period of time. As a result, our democracy, ideals and way of life are imperiled as never before.

It didn’t have to be this way. It’s just how things broke, that’s all. The United States has sewn the seeds of its own destruction many times before and lucked out, smelling like a rose after mistakes, miscalculations and stupid actions that easily could have ended Mr. Jefferson’s experiment in tragedy and chaos. We might get lucky again, I suppose. Trump might get squished by a falling piece of space junk. Hillary Clinton might get possessed by the spirit of Julia Sand. I wouldn’t bet on it though. KABOOM! ESPN Achieves A New Low In Unethical Journalism: Misinforming The Public Out Of Spite

ESPN has been foundering in a sea of ethical ignorance for some time now, but this was shocking even for them.

In a petty exercise to express its disdain and and anger at dismissed baseball commentator Curt Schilling, the sports network excised an entire section of its documentary on the legendary 2004 American League Championship play-offs when it was shown last night prior to the scheduled Red Sox-Yankee game. I cannot think of a single example of unethical journalism by a major outlet so blatant and so offensive.

Let’s go back a bit. Schilling is an outspoken religious conservative, active on social media. He was suspended from his baseball game broadcasting duties last season after comparing Islamic radicals to Nazis in a Twitter post—not all that unreasonable, actually, but if ESPN has a policy against its employees making controversial political statements on social media, and apparently it does, Schilling was asking for trouble.

Indeed, Curt has nothing if not integrity when it comes to expressing himself, and he could not resist commenting on the transgender bathroom controversy, re-tweeting a particularly ugly meme on the issue:

ESPN fired Curt. He had earlier in the year opined in a radio interview that “If I’m gonna believe, and I don’t have any reason not to believe, that she gave classified information on hundreds if not thousands of emails on a public server after what happened to General Petraeus, she should buried under a jail somewhere.” Allowing for hyperbole, that’s a perfectly legitimate position to take, but again, if ESPN doesn’t want Curt, who it was paying a million bucks or so, to take shots at someone it believed its audience members were fond of,  it can instruct its employees accordingly. It expressed its objections to Schilling, and he tweeted the meme anyway. Continue reading

I’ve called out the Tucker Carlson’s conservative news and commentary website The Daily Caller for this before. Apparently this is Carlson’s sick and unethical obsession: I guess he can’t stop his sophomoric fantasies and pain arising out of being a high school nerd gazing hopelessly at cheerleaders and the occasional attractive teacher from infecting his judgment and ethical values. Thus he—and his “education editor,” Eric Owens—think rape is ethically acceptable if the rapist is hot enough.

Once again, the site reports on an example of high school teachers exploiting their male students for their own sexual satisfaction with a slimy wink-wink-snort coded piece making it clear that the Daily Caller regards the episode is one big joke. This time the tongue in cheek headline, accompanied by the photographs of the two women involved, conveys Tucker’s attitude:

“Ted Cruz’s announcement of his preferred running mate has enhanced the nomination process by giving voters pertinent information. They already know the only important thing about Trump’s choice: His running mate will be unqualified for high office because he or she will think Trump is qualified.”

-Conservative columnist George Will, in a piece nicely consistent with the Ethics Alarms position that the Republican Party’s ethical duty is to refuse to nominate Donald Trump, whatever the cost.

Will’s observation is concise, logical, and absolutely true. Nothing I can add will improve on it.

Indeed He Deserved All Of It, But Denny Hastert’s Sentencing Hearing Was A Legal And Ethical Travesty

“I am deeply ashamed to be standing here,” former Speaker of the House Dennis Hastert  told a judge yesterday at his sentencing hearing.  “I know why I am here … I mistreated some of the athletes that I coached.”

Wait…what? That’s not why Hastert was in court at all. He was before a judge for one reason: he violated banking laws and lied to the F.B.I.. The fact that he was a sexual predator and molested members of the wrestling team he coached many years ago is not the reason he was in court. It couldn’t be. The statute of limitations on all of those crimes, horrible crimes all, had expired. Hastert couldn’t be charged, tried or convicted of any of them.

I don’t understand why this hasn’t been the focus of the coverage of Hastert’s ordeal yesterday. Why did the judge think it was appropriate to “angrily” lecture him about his crimes that in the eyes of the law he must be considered innocent of by the legal system, because he cannot be found guilty of these crimes any more?

“‘If Denny Hastert could do it, anyone could do it,'” U.S. District Judge Thomas M. Durkin said. “Nothing is more stunning than to have the words ‘serial child molester’ and ‘speaker of the House’ in the same sentence.” Well, that’s very interesting, Judge. If  the late Ted Kennedy had been before you to be sentenced for, say, just a wild hypothetical, a drunk driving charge, would you lecture him about letting Mary Jo Kopechne drown in his car?

I may have missed it, but when O.J. Simpson was sentenced for burglary, I don’t recall the judge asking him to confess to murdering Nicole and Ron…did that happen?

Earlier this month, the judge and prosecutors allowed the trial to become a proxy trial for a crime that wasn’t on the docket, with prosecutors hammering at graphic details about the sex-abuse, describing how Hastert would sit in a recliner in the locker room with a direct view of the showers. The victims, prosecutors said, were boys between 14 and 17. Hastert was in his 20s and 30s. This is relevant to the charges against Hastert how, exactly? Answer: They aren’t. Continue reading

The U.S. Court of Appeals for the Second Circuit appeals court reinstated the NFL’s four-game suspension of New England Patriots quarterback Tom Brady yesterday. This overturned last year’s ruling by U.S. District Judge Richard M. Berman, who had nullified the league’s suspension of the superstar quarterback. The three-judge panel of the appeals court wrote…

“We hold that the Commissioner properly exercised his broad discretion under the collective bargaining agreement and that his procedural rulings were properly grounded in that agreement and did not deprive Brady of fundamental fairness.”

It is important to note that the Court only ruled on whether NFL Commissioner Roger Goodell had the power to suspend Brady and did not violate the player’s rights as a players union member by doing so. The NFL’s current deal with the players gives Goodell the kind of power Major League Baseball gave to its first commissioner after the 1919 Black Sox Scandal, when gamblers fixed the World Series. Goodell, like Landis, can use his discretion to punish a player for “conduct detrimental” to the game and the NFL. They did this because a disturbing number of NFL players were getting headlines for doing things that don’t comport with what the public expects of its paid heroes, like sucker-punching women, shooting people, getting in bar fights, and engaging in assorted felonies. The game also has a very successful coach, Brady’s coach, in fact, who has made it very clear that he will cheat whenever he can get away with it..

I’m not going to rehash the “Deflategate” incident: I wrote enough about it when it occurred. Nobody knows for certain if Tom Brady in fact did conspire with Patriots employees to cheat when his team was behind in a crucial play-off game, but we know this: Continue reading
