Comment Of The Day (1): “Observations On Britain’s Charlie Gard Ethics Fiasco”

I thought that the Charlie Gard story would stimulate some excellent thoughts on ethics and public policy from readers, and for once I was right. This is the first of two superb Comments of the Day it generated, and there were several others as well.

Here is Ryan Harkins’ Comment Of The Day on the post,  “Observations On Britain’s Charlie Gard Ethics Fiasco.”

The idea of the state telling me I could not seek medical aid for my child when I had both the money to pay for it and a provider willing to give me the services is terrifying. My sixteen-month-old daughter has been receiving the majority of her sustenance through a feeding tube for the past six months. Prior to that, we had been struggling to get her to eat enough calories so that she would gain just an ounce or two, only to find that weight gain vanish when she caught a cold or a stomach bug. Granted, the gastroparesis she suffers is not a severe condition, but without the feeding tube she would risk starving. The thought that the state might step in, tell me that they not only would not pay for my daughter’s tube and care any more, but also expressly forbid me from feeding my daughter through the tube, makes me shake uncontrollably. If I have to fight for my daughter without the state’s help, fine by me. But for the state to forbid me from fighting for my daughter? That is unconscionable.

However, at this time, I don’t have to face that issue. I live in a place and a time when I don’t have to contend with general threat, and my daughter’s condition is not terminal and readily treatable. I hope that my child-rearing and my fear for my daughter helps me to have empathy for the parents of Charlie Gard. I also hope that I can step back away from the emotional turmoil this issue raises and try to understand what is happening here.

The principle dilemma in the case of this poor baby boy lies in the fundamental tension between the fact that human dignity demands we do fight for life, while at the same time we know that we will all ultimately die. Because human life bears an intrinsic dignity, its wrong to deprive a human being of what it needs to survive. Because all humans ultimately die, it can become, through the use of extreme or unethical means, against human dignity to fight against death when death is inevitable.

Why would it be wrong, in some circumstances, to keep fighting against death? The most clear-cut examples are when the means of preserving life are unethical. Bathing in the blood of virgins, selling one’s soul to the devil, killing an innocent to harvest his organs, transferring one’s consciousness into the unwilling body of another — all these (fantastical as some of them are) represent tactics to extend life that obviously violate ethical principles.

What about less obvious examples? Let’s consider a man in a coma. His state is persistent, perhaps even vegetative, but his body is capable of processing food and drink, although he is incapable of eating and drinking orally. A feeding tube could provide him with all the nourishment he needs, and he could be kept alive for years in such a fashion. To stop feeding him through the tube would be to deliberately deprive him of sustenance he needs to survive, and thus would be unethical. Death is not inevitable in this case, except in the most sweeping sense.

In times past, a feeding tube would not have been possible, or if possible, not recommended because of infection, and thus this would not have been a serious alternative. Absent any means of delivering food to the man in the coma, no one could be faulted for not providing food. And if trying to use a feeding tube would actually kill him quicker, or have negligible effect, then the extreme measure of using a feeding tube would not be ethical. However, since we are at time with the technology that makes the use of a feeding tube fairly easy and safe, we no longer have that excuse to deprive a person of nutrients.

What about a slightly different case, when the man in the coma can no longer process foods even through a feeding tube? Then providing food actually causes harm without any gain. Perhaps nutrients could be provided through an IV, but one would be justified, and perhaps is even obligated, to stop providing food through the feeding tube.

Now, the most challenging cases are when a person is terminally ill, but there are procedures that exist that can extend life. To what extent are we obligated to provide care? It depends on the nature of the treatment, the cost of the treatment, and the effects of the treatment. A person is fully justified in accepting that death cannot be stopped and let the terminal illness run its course. A person is not justified in taking steps to deliberately end that life, but is justified in procuring palliative care that eases the pain of the dying, even if it hastens death. But one is not obliged to pay for or undergo an extensive, dangerous, expensive procedure that will not provide a cure, but only a short extension of life.

It should be clear, though, that just because one is not obliged to pay for or undergo extreme care, it does not follow that one is obliged to never pay for or undergo such procedures. If a person has the money and desire to attempt such care, and that care is available, that person should not be denied.

Is there any instance, then, when that person could be denied that extraordinary care? Again, we are assuming that the person can pay for it and the care is available, so we aren’t discussing an instance in which the terminally ill patient is displacing someone else’s care.

I personally cannot think of an instance in which we could rightly deny that care. What I do know is that, in Catholic theology, death does not mark the end of the existence of a person. The soul survives death, and the soul will be reunited with the body at the Resurrection. There is danger in pursuing treatments at any cost, and that danger lies in the denial of the afterlife. The New Rationalization #23: The Dealer’s Excuse, or “I’m just giving them what they want!”

The new Rationalization #23, The Dealer’s Excuse. or “I’m just giving them what they want!” now bumps Woody’s Excuse: “The heart wants what the heart wants” to sub-rationalization status as 23A.

Good. Woody Allen doesn’t deserve a free-standing rationalization.

While narcissist Woody’s contribution to the Ethics Alarms Rationalizations list states that something is ethical if you want it badly enough, as in, “I really, really want to have sex with my adopted daughter,” its recently revealed parent hold that conduct becomes justifiable and benign if there is a market for it. Woody’s excuse is bad, but this is worse. For one thing, it’s usually disingenuous. Those who employ the Dealer’s Excuse aren’t providing a service out of altruistic motives, but out of the profit motive. They want the money they can make by doing unethical things that make society uglier, dysfunctional and dangerous, and they really don’t care if their customers come to a bad end or bring miseries to others.

The most famous exposition of The Dealer’s Excuse is in “The Godfather,” as Don Corleone and the other mafia heads discuss their “business.” The Godfather is balking at adding drugs to the mob’s businesses, and says:

When — when did I ever refuse an accommodation? All of you know me here — when did I ever refuse? — except one time. And why? Because — I believe this drug business — is gonna destroy us in the years to come. I mean, it’s not like gambling or liquor — even women –which is something that most people want nowadays, and is forbidden to them by the pezzonovante of the Church. Even the police departments that’ve helped us in the past with gambling and other things are gonna refuse to help us when in comes to narcotics. And I believed that — then — and I believe that now.

Morning Ethics Warm-Up: 6/30/17

1. Traffic here is cratering in the run-up to the 4th, guaranteeing that for one of the few months in Ethics Alarms history, June 2017 will have seen significantly less traffic than its previous year’s equivalent. 2017 and 2016 are now in a dead heat.

I have some theories: by this point last year the campaign was heating up, and I was being sufficiently critical of both parties and candidates to make everyone happy. Ethics Alarms also started getting a lot of those paid Hillary shills commenting; I banned more commenters in 2016 by far than any other year. Also because of the campaign, there were an unusual number of posts shared by hundreds and even thousands of readers, as well as a record number of the anomalous posts that double or even triple the daily average. Those, I have found, are completely unpredictable. What I consider important or especially astute essays almost never attract readership; the runaway posts are usually about something relatively trivial.

On the other hand, the blog has many more followers in 2017, more consistently high-quality comments, and, as my life partner continues to remind me with dagger glances, revenue is holding steady…

2. There was another Ethics Hero tale to tell yesterday, though the only one I had time for was the group in Texas that bought a car for a young fast-food worker.

Major League Baseball umpire John Tumpane, assigned to a Pittsburgh Pirate home series, was walking from his hotel to the ball park across the Roberto Clemente Bridge when he saw woman climb over the railing to the outside of the bridge. He decided to approach her, and in response to his queries, she told Tumpane she just wanted to get a better view of the Allegheny River below.

The look on her face and the tone of her voice told Tumpane otherwise, so he grabbed her and refused to obey her demands that she let her go…and jump. Another  bystander saw what was going on and joined him, grabbing the woman’s free arm. A third grabbed her legs through the railing as Tumpane implored the gathering crowd to call 911. The three men held on  until emergency responders arrived. Continue reading

Ethics Heroes: Andy Mitchell, Samee Dowlatshahi, And Friends

 

Rockwall, Texas resident Andy Mitchell posted a photo on Facebook of himself and Justin Korva, a young stranger whom Mitchell had picked up and driven to his job after seeing him walking to work in his work uniform  in 90 degree weather. He was stunned and impressed to learn that Korva walks three miles each way to his low-paying job at Taco Casa, a fast food restaurant,

“To all the people that say they want to work but can’t find a job or don’t have a vehicle all I can say is you don’t want it bad enough!” Mitchell wrote on the Facebook post. Mitchell then used his post as a springboard to raise money to buy a car for Korva, who is 20.  It took less than 30 hours to raise $5,500. 

Samee Dowlatshahi, the owner of a pizza restaurant who had set up a donation box for Korva’s transportation inside his establishment,  contacted a friend at a local Toyota dealership. The friend told his boss about Korva, and persuaded the dealership to drop the price of a white 2004 Toyota Camry. This allowed Mitchell’s group to buy the car, pay Korva’s insurance for a year, and finance two years’ worth of oil changes along with a $500 gas card.

“Are you serious?” Korva said as Mitchell handed him the keys.

Dowlatshahi said,, “We just want you to know, seriously, this community, nothing we love better than to have someone who works hard. We take a lot of pride in that. It’s so hot out here, I can’t believe you walk even one mile in this heat.”

There is hope.

Morning Ethics Warm-Up: 6/26/17

1. I am puzzled that no respected journalism source—assuming arguendo that there is one—hasn’t taken on the New York Times’ alleged list of President Trump’s “lies,” which was in my Sunday Times and released on-line earlier. I will do it today, but it shouldn’t fall to me, or other similarly obscure analysts. Why, for example, hasn’t the Washington Post taken this golden opportunity to prove how biased, dishonest and incompetent its rival is? Because, you see, the list is disgraceful, and smoking gun evidence of the Times’ abdication of its duty to its readers, except its own perceived duty to give them around the clock Trump-bashing.

The other thing I’m puzzled about is why I continue to subscribe to the New York Times.

2. One possible reason: The Sunday Times is now a weekly collage of the various derangements, false narratives and  obsessions of the Left, and worth reading just to witness how 1) bias makes you stupid and 2) how unmoored to reality one can be and still be judged worthy of op-ed space. Here, for example, is “Black Deaths, American Lies” (the print title), a screed by Ibram X. Kendi, a professor of history at American University in Washington, D.C. (Disclosure: I was also a professor at American University. But I was an honest and apolitical one.)

The first line is, “Why are police officers rarely charged for taking black lives, and when they are, why do juries rarely convict?” This is deceit: an honest scholar wouldn’t have written it, and an ethical editor wouldn’t have allowed it to get into print. The sentence implies that officers are less rarely charged and convicted when they take white lives, and this is not true. In the print version, the article is headed by a touching photo of a street memorial to Mike Brown, whom we now know got himself shot. The Black Lives Matter narrative that Brown was murdered is still carried on by racist activists, ignorant members of the public, cynical politicians  and unethical figures like Kendi, who lend their authority to divisive falsehoods.  Kendi then focuses on the Philandro Castile shooting, as if its facts support his thesis. They don’t. First, the officer was charged, though he shouldn’t have been. Second, we have now seen the video, which clearly shows that after telling the officer that he had a gun, Castile reached into his pocket and began pulling out his wallet as the obviously panicked officer shouted at him not to pull out his gun. Just as the video proves that the officer was unfit to be a cop, it shows that he was in fear of his life and why. He could not be convicted of murder on that evidence. Ethical Quote Of The Month: Harvard Law Professor Jeannie Suk Gersen

“We chose to set up our system to be stacked in favor of the defendant in all cases.So, in areas where most of the defendants are male, and most of the accusers are female, it’s a structural bias in favor of males. Even if we were to get rid of sexism, it would still be very hard to win these cases. I think this is what we have to live with on the criminal side, because we’ve made the calculation that this is the right balance of values.”

—-Jeannie Suk Gersen, Harvard Law School professor, explaining why the failure of a jury to convict Bill Cosby has little to do with sexism and everything to do with our standard of guilt in criminal cases.

The Professor could also have said, just as accurately,

It’s the exact same problem. The confusion comes when the public or a portion of it is  certain that particular defendant is guilty, and thus regards the failure of the system to find him so as proof of a malfunctioning justice system. It isn’t. It is proof that the system functions as it is supposed to, was designed to do and must do.  We do not take citizens’ freedom away unless guilt can be proven beyond a reasonable doubt under the evidence rules of the law. This is what Colin Kaepernick doesn’t understand. This is what Black Lives Matters refuses to understand. This is what feminists and the Obama Education Department, which commanded that universities give the benefit of the doubt to accusers in allegations of sexual assault rather than the accused, either refuse to understand or do understand but argue against anyway to pander to the ignorant.

Americans, however, must understand this principle, and not just understand but fight for it, because it is the foundation of the Rule of Law as well as our individual rights.

Before I am done I will probably have posted this scene from “A Man For All Seasons” more than a hundred times. Maybe I should post it every day. Those who casually advocate forging short-cuts and detours through our laws and rights as the remedy for what they perceive as intolerable wrongs need to see it, read the words, memorize them, and maybe be quizzed on the scene’s lesson as a condition predicate to being respected in any policy debate:

 

What Is The White House’s Obligation To Journalism And Journalists When They Are No Longer Behaving As Journalists Nor Abiding by Journalism Ethics?

I know: I’m full of questions lately, and short on answers. I certainly don’t have an answer to this one, and the urgency of finding an answer, and a solution to the underlying crisis, is critical.

Here was Camille Paglia last week describing the state of American journalism:

“It’s obscene. It’s outrageous, OK? It shows that the Democrats are nothing now but words and fantasy and hallucination and Hollywood. There’s no journalism left. What’s happened to The New York Times? What’s happened to the major networks? It’s an outrage. I’m a professor of media studies, in addition to a professor of humanities, OK? And I think it’s absolutely grotesque the way my party has destroyed journalism. Right now, it is going to take decades to recover from this atrocity that’s going on where the news media have turned themselves over to the most childish fraternity, kind of buffoonish behavior.”

(I would link to a non-right wing source, but for some reason the mainstream media didn’t feel Paglia’s assessment was worth reporting. I wonder why?)

Now here was Peggy Noonan, in a Wall Street Journal op-ed:

“Dislike of Mr. Trump within the mainstream media is unalterable,” she wrote. “It permeates every network, from intern to executive producer and CEO. Here is a theory on what they’re thinking: They’re thinking attempts at fairness and balance in this charged atmosphere get them nowhere. They’re attacked by both sides. And anyway they think Mr. Trump is insane. They live on ratings, which determine advertising rates. Hillary Clinton got 2.9 million more votes than Mr. Trump, so the anti-Trump audience is larger.

Hillary Clinton got 2.9 million more votes than Mr. Trump, so the anti-Trump audience is larger. Moreover, people who oppose Mr. Trump tend to be more affluent, more educated, more urban. They’re more liberal, of course, and they’re younger. They’re a desirable demographic. The pro-Trump audience is more rural, more working- and middle-class, older. A particularly heartless media professional might sum them up this way: “Their next big lifestyle choice will be death.”

So, if you are a person who programs or sets the tone of network fare and you want to take a side—you shouldn’t, but you want to!—you throw your lot with the anti-Trump demo, serving them the kind of journalistic approaches and showbiz attitudes they’re likely to enjoy.

Mr. Trump, you are certain, won’t last: He’ll bring himself down or be brought down. You want to be with the winning side. So play to those who hate him, exclude others, call it integrity and reap the profits.”

Both women are substantially right at worst, despite the furious head-shaking you get from journalists, who are either in denial or corrupt, and most progressives and Democrats, who have every reason to deny the phenomenon because 1) they are the beneficiaries of it and 2) they have been leached of all integrity by emotion, arrogance, and bias.

Currently the mainstream news media is having a collective conniption because the White House is increasingly limiting reporter access. The journalists regard this as an ominous effort to constrain the free press, which it would be, except that the “free press” is not conducting itself as honest and trustworthy journalists are obligated to do.

If a lawyer practices law in blatant violation of the ethics rules, he or she doesn’t get to practice law any more. If a doctor breaches the ethical tenets of the medical profession, he or she is barred from treating patients. Journalism styles itself as a profession, meaning that it exists for the public good. Its ethical principles demand fairness, competence, responsible reporting, independence and objectivity. For a long, long time, what we still call “journalism’ for lack of a better name has not met any of these ethical ideals with sufficient consistency, and since the 2016 election, it has openly, shamelessly allied itself with the partisan effort to undermine and destroy the legally elected Presidency of Donald Trump. To do this, the mainstream news media has jettisoned its ethical values, and its right to be trusted by the public. As polls show, the public doesn’t trust them. The public still gives them more trust, out of habit, that they deserve.

Morning Ethics Warm-Up: 6/24/17

This morning, my mind is occupied by one long-standing ethics issue, and the rest seem trivial in comparison. Let’s warm up by trying to find some way out of this mess.

The ethical problem seems increasingly beyond our ability to solve. Yesterday there was second mistrial in the retrial of Raymond M. Tensing, the former University of Cincinnati police officer who has been charged with the 2015 murder and voluntary manslaughter for fatally shooting Samuel DuBose, an unarmed motorist.  This is the third example of a police officer shooting a black man under questionable circumstances being found short of being criminally responsible in a week:

In St. Paul, police dashboard video showed Officer Jeronimo Yanez shoot into the car where Philando Castile was sitting with his fiancée and her daughter, and acquitted the officer. In that case, the officer appeared to have panicked after Castile reached into his pocket for his wallet after telling the officer, unasked, that he was carrying a firearm. In Milwaukee, jurors acquitted Officer Dominique Heaggan-Brown after watching frame by frame as he shot once at fleeing armed suspect, Sylville K. Smith, then fired a second time after Smith tossed the gun he was holding and lay on the ground. Now, in Cincinnati, jurors couldn’t agree on the proper culpability of Officer Tensing. He stopped  DuBose for a missing license plate, then asked him for his driver’s license. Instead of producing it, DuBose pulled the door closed with his left hand and restarted the car with his right hand. The officer reached into the car with his left arm, yelled “Stop!” twice, and used his right hand to fire his gun directly, into Mr. DuBose’s head, killing him.

Ethics Quiz: The Ferguson Settlement

News Item:

The parents of black teenager Michael Brown and the city of Ferguson, Missouri, have settled a lawsuit over his fatal shooting by a white city police officer in 2014, according to a court document filed on Monday. …Terms of the wrongful death settlement between Ferguson and Brown’s parents, Michael Brown Sr. and Lesley McSpadden, were not disclosed. U.S. District Judge E. Richard Webber approved the settlement and ordered it sealed.

“The gross settlement amount is fair and reasonable compensation for this wrongful death claim and is in the best interests of each plaintiff,” Webber wrote. Both James Knowles, the mayor of the blue-collar, largely black St. Louis suburb, and Anthony Gray, the lead attorney for Brown’s parents, declined to comment.

Wait, what?

A thorough investigation found Officer Wilson guilty of no crime, nor did the shooting appear to be the result of officer malfeasance or negligence. Brown’s parents, Michael Brown Sr. and Lesley McSpadden, meanwhile, took extraordinary measures to stir up racial hatred and anti-police sentiment, not just locally but nationally, sparking deadly riots in Ferguson and elsewhere, and leading to attacks on police. They even made a human rights complaint to the United Nations, based substantially on a lie (“Hands up! Don’t shoot!”) concocted by their son’s friend and credulously reported as fact by the news media. By what theory are Brown’s parents deserving of damages from Ferguson? By agreeing to this settlement, is not Ferguson setting the precedent that any time a black suspect is shot by a white police officer, it is a wrongful death mandating damages?

Was this settlement, whatever the amount, ethical?

I’ll launch the debate by saying that the city probably had no choice but to settle, as the sooner this whole catastrophe can get in the rear view mirror the better off the city will be. In the narrow sense, then, the settlement was in the city’s best interest and the responsible course.

Long term, however, I see nothing but bad results flowing from this result. If Wilson was not wrong, then Brown was at fault. If Brown was at fault, his family should not benefit. If Ferguson paid out a significant amount when its police officer behaved reasonably, then Ferguson just set a precedent that Black Lives Matter could have authored in its dreams.

If a black victim is shot by the police, it is  racism and a wrongful death per se, whatever the facts are.

Unethical Quote Of The Week: Gateway Pundit’s Lucian Wintrich

“On Friday, June 16, 2017, Laura Loomer, a patriot activist and journalist, took the stage at Shakespeare in the Park’s performance of “Julius Caesar”, a performance where liberals applaud as President Trump’s assassination is shown in full bloody detail. Laura was arrested for speaking out against this performance.”

What makes a blog post especially unethical? Oh, many things: misstatement of facts, ignorant analysis, sensationalism, incompetence, not being able to distinguish right from wrong and good from bad, appeal to bias and stupidity. Wintrich’s post, absurdly called “Proud Conservative Woman Was Arrested Friday at Trump Assassination Play – Help Pay Her Legal Fees *HERE*!” has all of this and more.

The conservative woman, along with her conservative male partner in attempted censorship, has nothing to be proud of. She’s proud of emulating the leftist crypto-fascist students who have been using intimidation and riots to prevent conservatives from speaking? She’s not a patriot, since patriots don’t intentionally ignore core American principles like freedom of expression and speech whenever they feel like it. The word Wintrich is looking for in his limited vocabulary is “hypocrite.”

She was also not arrested for “speaking out” against this performance. This can only be a lie, or Wintrich is too stupid to be allowed to put his shoes on by himself. You cannot be arrested in the U.S. for “speaking out,” and nobody ever is. He is trying to inflame the stupid and ignorant, or he is stupid and ignorant. Laura, the jerk, was arrested for interrupting a theatrical performance that she had absolutely no right or justification to disrupt. Just so there is no mistaking his dishonest, inflammatory and ignorant description as entirely deliberate, Wintrich, the hack, repeats it, writing,

“The left keeps calling President Trump a fascist dictator, but speaking out against assassinating a Democratically elected President apparently gets you arrested in New York City.”
